SEPTEMBER 21, 1970
The City Council met in regular session, Mayor Larson presiding, Councilmen Brawn, Keith,
Lambert, Lust, McNeice and Robinson, Assistant City Manager Friedline, and City Attorney
,Andrews present on roll call. City Manager McMicken•absent and excused at the previous
meeting. •
The Invocation was given by Councilman Lambert.
The minutes of the regular meeting of September 14, 1970, having been duly certified
accurate by two Councilmen, and no one present wishing to have said minutes read publicly,
•MayorYLarson declared said minutes approved as recorded.
.This being, the time fixed for the Hearing on amending the General Plan by adding the
College and Vicinity Land Use Plan and the Nob Hill Land Use Plan, - Assistant City Manager
:Friedline explained that no legislation has been prepared for this meeting, but will be .
prepared in accordance with instructions by the City Council after this Hearing. Director
of Planning and Community Development,. Jay Otto, reviewed the Planning Commission Hearings
on this matter and referred to the map of this area showing the proposed amendments as
recommended by the Planning Commission -- 1. re the College Land Use Plan, that it be
amended to show that the area south of Nob Hill Boulevard to Prasch and east to 12th - Avenue
be designated for college expansion purposes, and 2.. re the Nob Hill Land Use Plan, that
it be amended to show Arterial Business Zoning rather than.Multi- Family Zoning in the area
from Cornell Avenue to 9th'Avenue. Mr. Howard Elofson,.Attorney, representing property
owners in connection with the proposed amendment to the Nob Hill Land Use Plan, spoke •
briefly in favor of this proposal. After due discussion, it was MOVED by Robinson, secon-
ded by Brown that the recommendation of the Planning Commission be accepted, that these
two Plans be amended by the Planning Department as recommended, and that legislation be
prepared to amend the General Plan by adding the Land Use Plan for Vicinity of Yakima
Valley College as amended and the Land. Use Plan for Nob Hill Boulevard as amended: carried,
Brown,. Keith,. Lambert,. Larson, . Lust- McNeice and Robinson voting aye by voice vote. •
This being the time fixed for the Hearing on.Resolution of Intention No. D -1527, to improve
property by constructing curbs, gutters and surfacing of streets and alleys, in accordance
with Petition Nos. 648, 649, 656 and 657, and there being no protests in writing or other -
wise,'it was MOVED Brown by'Keith.that Ordinance No. providing for said
improvement creating ;.No. 981i McCargar's• Westside'Tracts.& Others Paving - Dist-
rict, as read. Works - Director. John Mayo; - briefly reviewed the various
• 'Petitions and requests for street improvements which make up this'proposed L.I.D., ex-
plained.how the computations are,figured for the various properties involved and the manner
in which be paid: •Present and speaking to this matter were,
Mr. Pete Stadelman, 5519 Englewood Drive and others in this vicinity who.asked questions
regarding their proposed - L:I :D. ..'regarding the alley - and how it
would be constructed ::.in connection : with a retaining wall - along some of the property:

was Mr. C. W..Gekler,.607 S. 18th Avenue, who asked how the cost was figured on the portion

ORDINANCE NO: 1249, ORDINANCEproviding the improvement of certain streets and
alleys by grading ; . .surfacing - with asphaltic concrete and constructing'
curbs-and gutters,•together-with necessary drainage features; establishing a.Local Improve-
ment District, providing the method of thereof, and creating a
• Damage Claims having been filed - with the by - C leora Chalupa 1706 Prasch Avenue;'
on September 11, 1970, in the amount of $6,203.50, for damages caused when she fell because
' of construction work being done by Superior & Company for the City of Yakima and
Yakima County, which'was not by ,W.'Brackett, 610 N. 58th Avenue, on •
September - in the amount of $266: by 'a water main;
and Weaver; 5006 - Englewood.Avenue, - on:September 14, 1970, in the amount of $6.50,
for damages when his daughter 'cut her - foot - in Franklin Pool swimming; it was

It was MOVED by Brown, seconded by.:Lust that Ordinance No..1250 relating to traffic con -
trol; prohibiting parking 'on ,certain streets and the Yakima Municipal Code; be
passed -as read: carried, Keith; Larson,'-`Lust; McNeice and voting'
aye •on roll call; ... Public Works - Director - John Mayo explained - that - this change is necessary
to remove parking on the north sideof -- Nob -- Hrl - 1 Boulevard - from South - 6th - Steet `to South
10th Street and both sides of Nob Hill Boulevard' - from 7South 6th - Street - to Rock Avenue,. in
conjunction with the on Nob - Hill - on •out to the freeway, and -- from - Fair
Avenue west; - the - City ' has the north side County - the' - south side; and ' t -- i - s ' hoped - '
to - remove this parking before Fair time so that be four - moving - traffic - lanes on •
that street.
ORDINANCE NO:-1250 AN =traffic - control vprohibiting - parking - at - all
times on certain city streets; amending Subsections 9.75.040 (pp) and (qq) of the City of
Yakima Municipal - Code and-declaring an'emergency. -- . - -
Mr..George Corbett,: Shelton Realty, Inc., being present and representing the businesses on
the north -side of. 'A" . Street, •between . - North - First Street . and North Third Street, read a
letter -signed by 1-3 business• operators' on . this . street; - which he 'filed the
at this•meeting,-and- which - requested - "That - diagonal' parking - be retained on the - North - side
of "A" Street and that traffic be . directed from Street to - Fron - t :Street going
West. Parallel parking be installed on the South side of "A" Street." Mr. Corbett further
stated that the reason this is so urgent'is that the work on these streets will be starting
in a few days and they feel that serious consideration should be given by the City Council

to this matter and that a decision should be made as soon as possible before this work
starts.. Other signers of this letter present and speaking in favor of Mr. Corbett's.pro-
posal were Mr. Lester Schwaegler, EsCee Investment Company; Mr. Otto Stadler, Sonotone
Hearing Aids; Mr. Victor Multz, Multz Insurance Company; Mr. Harry Whitehead, Whitehead
Insurance Agency; and Mr. Porter Lombard, Lombard Horsley Company, all businesses on the
North side of "A" Street between North First and North Third Streets. Public Works Direc-
tor John Mayo reviewed the matter of the traffic situation on "A" Street, and referred to
City Manager Report #k82, CBD Traffic Circulation Plan, which had been discussed at the
Hearing held on this matter several weeks•ago. He reported that at that Hearing it had
been the Council's thinking to accept the alternate proposal, which would put diagonal
parking on the south side and parallel parking on the north side of "A" Street between 3rd
Street and 1st Street, and to have two -way traffic between North 1st Street and Front. .Mr.
Mayo referred to two sketches showing the parking suggested by both proposals and explain-
ed the reasons it was felt that the alternate plan would be better. In discussion regard-
ing the matter of two-way traffic on "A" Street from North 1st Street to Front Street, Mr.
Mayo explained that this had been requested by the County Commissioners, to make it easier
to get in and out of their parking lot, by the Railroad,and some other businesses in that
area had also made this request. Councilman Robinson stated that in all fairness, the
Council members . are trying to arrange the parking and traffic flow for the people concern-
ed, even though it may not be the best way traffic wise, and that if it does not work out,
it can be changed, but that he feels it absolutely essential that there be traffic both
ways in the area from North 1st Street to Front Street. After due discussion, it was
MOVED by Keith, seconded by Lambert, that the City Council instruct the. Traffic Engineer
that when the traffic flow direction is changed, that parallel parking be put on the South
side and diagonal parking on the North side of "A" Street between North 1st Street and
North 3rd Street, and that two -way traffic be installed on "A" Street. from North 1st Street
to Front Street: carried, Brown, Keith, Lambert and Robinson /voting aye by voice vote.
Lust and McNeice voting nay by voice vote. Larson not voting.
Mr. Ted Adler, being present, introduced Mr. Wayne Root, Mr. Bob Laird and Mr. Gordon
Eisfeldt, who are representing the Veterans of Foreign Wars Organization regarding a pro-
ject they are undertaking. Mr. Gordon Eisfeldt spoke for the group and explained that
they - .have undertaken the project of erecting a Memorial to the City of Yakima's Unknown
Soldier and that since Tahoma Cemetery is one of the few Municipally owned cemeteries in
this area, that they are requesting permission from the City Council, for a plot of ground
to be set aside for this purpose. He further stated that they would like to dedicate this
on Memorial Day, if possible, and reported that if the plot of ground can be set aside for
this purpose, and permission given to ask for donations toward the erecting of this Memor-
ial, that the Veterans of Foreign Wars have pledged $500 towards this purpose, their
auxiliary has pledged.$100, and some other smaller pledges have been received. Discussion
brought out, and it was verified by Bob Laird,- Cemetery Manager, that for many years there
has been a plot of ground approximately 50'.x 50' set aside in the Veterans' section of
Tahoma Cemetery for such a purpose, although there hasn't been.a specific request for the
use of it before this time, nor has any legal action been taken to specify,how such a
project is to be handled. Council members indicating that they feel that this is a worth-
while project, but before making a specific recommendation, think that the matter should
be studied further, it was MOVED by Keith, seconded by Lust that this matter be referred
to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert,
Larson, Lust, McNeice and Robinson voting aye by•voice vote.
Assistant City Manager Friedline reported that in accordance with action taken by the City
Council on September 14,"1970, and the matter of giving authorization to execute a lease
agreement with Bay Zinc Company., covering premises at the Yakima Municipal Airport, hav-
ing been continued to this date in order to investigate the products to be stored, that
since that time Bay Zinc Co. has rented other quarters and has asked that their request
be withdrawn. In accordance with receiving this information and the request for with-
- drawal of Bay Zinc Company's request to lease space at the Yakima Municipal Airport, it
was MOVED by McNeice, .seconded by Lust that this matter be tabled indefinitely: carried,
Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.
Assistant City Manager Friedline explaining that the City of Yakima has a•Pipe Line .Cross-
ing ,Agreement with Yakima Valley Transportation Company in order to facilitate a sewer
pipe line extension on Nob Hill Boulevard, which agreement has been extended by an. Exten-
sion Rider several times and that agreement, as extended, expires on January 24, 1971, and
it is necessary to renew that agreement by the execution of an Extension Rider renewal
agreement, it was MOVED by Lust, seconded by McNeice that Resolution No. D -1539 authoriz-
ing the execution of said pipe line crossing renewal agreement, be passed as read: carried,
Brown, Keith, Lambert,- Larson, Lust, McNeice - and Robinson voting aye on roll call.
RESOLUTION NO. D -1539, A RESOLUTION authorizing the Mayor and City Clerk to execute a pipe
line crossing renewal agreement with Yakima Valley Transportation Company.
Assistant City Manager Friedline explaining that John Bloxom, Sr., whose term as a member
of the Board of Trustees of the Yakima Regional Library District expires December 31, 1975,
has resigned making it necessary for the City Council to appoint anew member to fill that
unexpired term, and it has been recommended that Charles C. Flower be appointed, it was
MOVED by Brown, seconded by Keith that. Resolution. No. D -1540 appointing Charles C. Flower
to the Board of Trustees of the Yakima Regional Library District, to fill the unexpired
term of John Bloxom, -Sr., be passed as read: carried, Brown,- Keith, Lambert, Larson, Lust,
McNeice and Robinson voting aye on roll call.
RESOLUTION NO. D -1540, A appointing Charles C. Flower to the Board of Trustees
of the Yakima Regional Library District to fill the 'unexpired term of John Bloxom, Sr.
Assistant City Manager Friedline explaining that the term of Mr. S. Wright Hawkes on the
Board of Adjustment expires as of October 1, 1970, that City Manager McMicken has recom-
mended that he be reappointed, and that Mr. Hawkes has indicated that he is willing to
serve another term, it was MOVED by Robinson, seconded by Keith that the recommendation of
the City Manager be approved and that Mr. S. Wright Hawkes be reappointed to the Board of
Adjustment for another term, which term will expire on October 1, 1976: carried, Brown,
Keith, Lambert, Larson,-Lust, McNeice and Robinson voting aye by voice vote.

Assistant City Manager Friedline referred to City Manager Report #95, Transfer of Manage -
ment of City Bus Service, which reviewed the transit system situation, and stated that the
City is .1100W ready to assume full responsibility for management.of the transit system and
to drop the services of National City Management Company effective October 3, 1970, and
explained what the next steps will be in order for the City to operate the transit system.
In his report #95, City. Manager McMicken recommended "that the City assume full management
control of the City bus service by:
a. Not renewing'its agreement with National City Management Company.
b. Purchasing buses and other equipment as listed. .
c. Extending lease agreement with YVT for garage facilities.."

After due discussion, it was. MOVED by McNeice, seconded by Lust that proper legislation be
prepared to transfer the City bus system to the City as recommended by City Manager Report •
#95: carried; Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting.aye by
voice vote.
Assistant CitTManager Friedline referred to City Manager Report #96, Joint Computer Cen-
ter, which outlined the steps that have been taken since the City Council approved the
recommendations contained in City Manager Report #84, Systems.Development and Data Process-
ing, and explained the plans for the next phase of this program. •Mr. Friedline also re-
ported that City Manager Report #96 reviews the progress of Systems Analyst Tom Froula in
developing a joint proposal with Yakima County for leasing computer equipment, and also
that the County Commissioners have invited the-City to form a Joint Computer Center. Mr.
Froula, being present, outlined the proposed program and answered questions asked by City
Council members. City Manager McMicken's Report #96 recommended that "the Council approve
the calling for proposals from data processing vendors for a computer used jointly by the
City and County, and that further, preliminary approval should be given to establish a
Joint Computer Center, the legal details of which will be presented for action at a later
date." After due discussion, it was MOVED by Robinson, seconded by Keith that action be
taken to form a Joint Computer Center with Yakima County, and that approval be given to
call for proposals from data processing vendors for a computer to be used jointly by the
City and County, in accordance with the recommendationsof the City Manager in his Report
#96: carried, Brown, Keith, Lambert,.Larson,.Lust, McNeice and Robinson voting aye by
voice vote. .
