HomeMy WebLinkAbout08/24/1970 Business Meeting 95 • AUGUST 24, - 1970 . • • • The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert, Lust, McNeice'and Robinson, City Manager McMicken and City Attorney Andrews presen on roll call. The Invocation was .given by Councilman Lambert. The minutes Of the regular meeting of August 17, 1970, having. been 'duly certified accurate by two Councilmen, and no one present wishing to'have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 664, filed. by. Alfred Stelzer & Others, requesting annexation of property located at 18 West Washington Avenue, having been continued from previous meetings in order for the applicants to prepare the , final develop - ment plan and 'program to be attached to the annexation ordinance, and. these documents having been prepared, it was MOVED by Brown, seconded by Lambert that Ordinance No. 1242. annexing"sa'id property, be passed'as read: 'Director,of Planning'and'Community Development, • Jay .Otto, reviewed this' matter and explained that the program includes 'the.`fifteen condi- tions recommended by the Planning Commission. Council members indicated that they are impressed by the preliminary planning and cooperation with the Planning Department that • has taken place on this matter. After due discussion, Mayor Larson called for the roll • call vote on the Moti.on.,,to pass Ordinance No 1242 annexing this property and it carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye roll call. ORDINANCE NO. -1242, AN ORDINANCE annexing property to the City of Yakima., and:zoning said • property. This being the time fixed for the hearing the Report of -Chief Building Inspector of the demolition.of Dangerous Buildings :at 1004 S. 6th Street, owned by Bethel African Methodist • Episcopal Church, it was MOVED by Robinson, seconded by Keith that • Resolution No.. D -1526 accepting said report and assessing. the. demolition. costs against the property, be passed. as read.. Chief Building Inspector Newell Pock reviewed his.report and showed some slides of the buildings before they removed and the property.since the removal. There being no one presentrepresenting,the property to -to this matter, Mayor Larson called for the roll call vote on the Motion to'pass Resolution No. D -1526 accepting said report ; and assessing- the. demolit-io.n .costs against the property and. it, carried, - Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. Arnold, reques- ting.annexation of property. south of Mead Avenue, between: S. 1st.Avenue. and Ledwich Avenue, and Mr. Thompson and Mr: Orman E. Arnold being .present, it.was MOVED by Robinson,. seconded by, Brown that this date be set as the, time for. a meeting . with the initiating. , . parties who signed the Notice of Intention to Commence Annexation�Proceedings dated August 11, 1970: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Mr. Thompson and. Mr. Arnold stating that they are willing to accept the City's existing indebtedness, it was duly .seconded.and passed that the proposed by petition no. 669, (Notice of Intention to. Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's indebtedness. The above Motion was made _by Robinson, seconded by Lust and carried, Brown, Keith,_ Lambert, Larson, Lust, McNeice and Robinson voting aye by voice • An Ordinance loaning. money from the Water -Sewer Fund.to the Garbage Fund, extending repay- ment - dates of current loans: and appropriating money within the Garbage Fund, having been read - in . its entirety at the previous meeting of August 17,., 1970, and read. by Title only at this meeting, it*was MOVED by Robinson, seconded 'by. Brown that Ordinance No 1243 authorizing'said temporary loan, extending repa of'previousloaiis and provi- ding for; said appropriation be.passed as read: carried,. ORDINANCE NO. .1243; AN ORDINANCE"authorizing a'temporary loan of $46 ;364 from 520 - Water - Sewer Fund to.320 = Garbage Fund,•and providing for repayment; extending repayment dates of lao(s/fil previously made: from. ;520 -Water-- Sewer• Fund , to .320 -Garbage Fund authorized .by Resolutions, Nosy.: D- 1423•,: adopted 'December. 2.2; 1969-and:. D= 1500, adopted June 8, 1970; and appropriating the amount of $44:,471- from= unappropriatedmoney in 32'0 .- Garbage :Fund to - various classifications and accounts within -that Fund. • An Ordinance appropriating $3,250 to the Yakima•Valley Regional Library, having'been- read in its entirety 'at :this - meeting, was ' laid' on 'the' table''for "one week :or until August '31, ._ 1970. City Manager McMicken explained that this- Ordinance' has. been prepared in accordance with . a request from Mrs. June 'Thurston of the Yakima Valley Regional Library on the part of the Library Board who wish to increase certain_ salaries for library personnel, • Mayor Larson reported on a .meeting he attended of the Washington Committee..to Stop Litter and referred to a report from this committee on theirodel Litter Control Law.. He explained that this law sets up enforcement of 'the program' by' the' Department of Ecology. There was some discussion on this program by Council members. No Council action was taken or was necessary at this time City Manager McMicken referring to the Resolution of Intention to .improve property by the construction of curbs:, gutters and the surfacing of streets and an alley, in accordance with Petition Nos. 657, 649, 648 and 656, it was MOVED by Brown, seconded by Robinson that Resolution No..D 7 1527; a Resolution of Intention to 'create a local improvement • setting - September 21t. 1970, as•the time'for a hearing on this , matter;.-be passed as read :• carried,. D -1527; A RESOLUTION of intention to create a local improvement district: • City. Manager McMicken reported that in accordance with action taken by City Council on August 10; 1970, when they authorized that action betaken to,do'as„ much as can be done to acquire property from the First Congregational Church for the Equalizing Reservoir-, an agreement has been. prepared for the consideration of Congregational Church. After due discussion,. it was MOVED ,Robinson, seconded by, Keith that Resolution. No.. D -15 18 authorizing the purchase of said property at 40th Avenue and Englewood, and the execution of said agreement, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. . RESOLUTION NO. D -1528, A RESOLUTION authorizing the purchaserby the City of real property at 40th Avenue and Englewood, in the-City of Yakima, for water reservoir and park purposes City Manager McMicken referred to the letter from Don Hunt, President of the Yakima Edu -. cation Association,, regarding ways and means of increasing voter registration in the City • of Yakima. In his letter, Mr :'Hunt stated that Association suggests that ,. the secre- tary in each school building be a deputized registrar, that they propose to use a mobile. unit, which can be made available to them,and manned.by trained volunteers, to be moved to various locations, super - markets, parking lots, canneries at shift changes and other places where people congregate, and that they also recommend that the precinct committee - • men of both major parties be deputized registrars and as part of their duties they be • instructed to, make a consistent effort to; .regis,ter all :,new'. residents within. their pre- cincts. City Clerk, Marie Donelson, reported that in consulting with City Attorney Andrew:. regarding the suggestions in this letter, they found that there is nothing in the law that precludes doing what is suggested by the Yakima Education Association. She stated that if the suggestions are followed, there will be :additional expense in her department as extra personnel will be needed to process and check all the registrations taken by • these outside - volunteer registrars. 'She further stated that' since this has never been donebefore, we have nothing. to go on as to what the results will be, so would like to suggest that if the Council endorses this 'suggested program, that this effort be.,made, • during the month of September only and that we evaluate the outcome for the future. Coun- cilman Lust stated that he is in favor:of making available more places to register for the convenience of the public; such as the schools and the mobile unit as suggested. Several Council members concurred with this suggestion, but all agreed that the precinct committee • .men should not be deputized registrars. Mayor Larson stated that he is not in favor of creating additional. places to. as he feels r that_,voting is :a. _p.rivilege and a per- son interested in voting - should make the effort to register at the regular places, and that he does not believe -that it is the City's function to.set up more convenient places to register. After due discussion, it was MOVED by Lust, seconded by Robinson that the • City Clerk.act according to the suggestions in Mr. Hunt's letter, with the exception of the suggestion to deputize committeemen. as registrars, that she work with the school secretaries and volunteers mobile unit• in their training and that this pro- gram be carried on for the month of September only suggested, by the City Clerk: carried, • Brown, Keith, Lambert, Lust, MCNeice and Robinson voting aye by voice vote. Larson voting nay by voice vote. Councilman Robinson stated that although he is voting yes•on the Motion, he still doesn't believe that we should try to drag people to register and hopes that this will not be an undue expense to the taxpayers. • 'City Manager McMicken explained that in connection with rerouting traffic on. Lincoln Avenue and "B".Street, special backplates must be immediately obtained for installation on Econolite brand traffic signals, to be installed as the result of a contract awarded in accordance with a call for bids, and recommending that authorization be given to purchase said backplates without calling for further bids, it was MOVED by Robinson, seconded by Brown that' NO. D -1529, A RESOLUTION authorizing the purchase of Econolite backplates with- out calling for further bids., , , City Manager McMicken explaining that in accordance with Resolution No. D -1517, adopted July 20, 1970, the City purchased a_parcel of tax title property from Yakima _County in contemplation.of the sale. of. that property,to: Eugene Roberts,; and.it.now appears that this property should be sold to two separate parties,. Eugene E. &.Ida Roberts, and Ferman L. and Revilla S. Rousseau, it was MOVED-by Keith, seconded by Lambert' that Resolution NO. D -1530 authorizing: the sale, of, said property -.and, amending Resolution No. D -1517, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION'NO. 1530, A_RESOLUTION_ authorizing the sale of real_ property owned by the City of Yakima; and amending Resolution No. D -1517 adopted July 20, 1970. City Manager McMicken reported that bids were received and, considered by the Bid Board on the 1970 Street Sealing Program on August 17;1970, as follows: • Schedule I - Quick set Slurry Seal Slurry Seal of Southwest Washington $11,625.00 A.V. DeBlasio Construction 11,925.00 Schedule III - Furnish & apply Liquid Asphalt (Gilsabind /equal) Superior Asphalt & Concrete .Co. $ 5,397.00 • The Gilsabind Corp. 5,785.20 Slurry Seal of Southwest Washington 5,892.00 The City Engineer recommending that the contracts be awarded to the low bidders, Slurry Seal of Southwest Washington in.the amount of $11,625.•00 on Schedule : I, and Superior Asphalt &'Concrete Company, in the . amount of $5,397.00 on Schedule III, it was MOVED by • - 97 AUGUST, 24, 1970 • Robinson, seconded by McNeice that the bids be awarded as recommended by the City Engineer and that the City Manager be authorized to enter into a contract with said contractors upon the filing of the proper bond and insurance: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. (Schedule II, was for quick set Slurry, Seal for the Town of Selah, Washington and was awarded to Slurry Seal of Southwest Washington.) City Manager McMicken re uesting approval for out-of-state travel for the : followin q g Chief Building Inspector Newell Pock, to attend the 48th Annual International Conference of Building Officials at Portland, Oregon, September 3 - 10, 1970; Wayne Dean of the Park Department to attend the Northwest Turf Grass, Annual Conference at Glendenon Beach, Oregon, October 7 -0, 1970; and Stan May of the Police Department, to attend the Western States Safe Burg- lary Investigators' Seminar at Phoeniz, Arizona, September. 6 - 13, 1970, it was MOVED by Lust, • seconded by McNeice that said travel be .allowed with expenses paid: carried, Brown, Keith, Lambert, Larson, Lust, McNeice andRobinson voting, aye by voice vote. • Councilman Robinson, Mayor Larson and City Manager McMicken reporting that they will be absent from the next meeting of August 31, 1970, and Mayor Larson having been excused at a previous meeting, it was MOVED by McNeice, seconded by Keith that Councilman Robinson be excused from the Meeting of August 31, 1970: carried, Brown,. Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote.
