There - ,was, some discussion._ regardi `ng,•the,.planned.usage,of.. portions of the proposed .annexation., Mr. Louis Irwin ':a p'roperty owner•.in "the proposed, annexation, being present, stated that he has some : boat: storage., buildings on his property and is planning to build more and would oppose this.annexa:tion, if•his property is not zoned so he can continue his building plans. It was brought:,.©ut' that. these matters would be considered by the Planning Commission and the Annexation: Review Board'at their' Hearings, after . a Petition has been filed with the .signatures of the property owners o.f'at least 75% of the assessed valuation of the proposed annexation: After due discussion, Mr. . Paulson, Mr. Morgan and Mr. McCargar stating that•they are =willing to accept the City.'s existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by petition no. 670, (Notice of Intention to Commence„Annexation Proceedings) accepted by the City of Yakima and that the area sought to be annexed.be required to assume the City's existing indebtedness. The above Motion was made by Robinson, .. seconded by McNeice • and carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Lust absent, Miss Laura Roderick, representing the Southeast Yakima Community Center re a Street Chalk_ Drawing Contest, being present, City•Manager McMicken suggested , that this agenda' matter be presented. at this time. He reported that in connection :With -the..Allied Arts. Council' s annual Pin -up Show, it has been requested by Miss Roderick and Dennis Prescott, that authorization be given to allow the Southeast Yakima'Community Center to hold this contest. Miss Roderick explained that they wish to a Street Chalk Drawing contest on Friday, August 21, 1970, which will be open to children from seven to eleven years old, and that prizes will be given. After due discussion, it was MOVED by McNeice, seconded by Keith that authorization be given for this Street Chalk Drawing Contest to be held, subj ect.to review with the Police Department regarding the closure of the Street for the Pin -up Show and this contest: carried, Brown, Keith, Lambert, Larson,,McNeic.e•,andRobinson voting aye.. • by voice vote. It was MOVED by Brown, seconded by McNeice that Ordinance No. 1241 amending certain sec- tions of the Uniform Plumbing Code, be passed as read: , car -vied, •Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Lust'absent. City Manager McMicken . referred,. to a Memo from City Attorney Andrews which explained that there had been some errors made in Ordinance No. 1237 adopting the Uniform. Plumbing Code, passed by the City Council.on August 3, 1970, which are being amended by this Ordinance, and briefly reviewed the amendments to be made. • ORDINANCE NO. 1241, AN ORDINANCE relating. to building regulations; amending certain sec - tions of the Uniform Plumbing 'Code of the City of Yakima; and amending, Sections 11.44.040,( 11.44.070 and 11.44.090 of the City of Yakima Municipal Code. . An Ordinance loaning money from the Water -Sewer Fund to the Garbage Fund, extending re- payment dates of current loans and appropriating money,w'ithin the Garbage Fund, having been read in its entirety at this meeting, was laid on the table until August 24, 1970. • City Manager McMicken explained that $46,364 is required in the Garbage Fund to accomodate • • P . 93 AUGUS 17, 19 a change in customer billing procedures 'from billing to billing in arrears as provided by Ordinance No 12 passed, by the City Council on August. 10, 1970,and to'. ' 'finance operations of th'e Municipal Garbage. the Division of th Public Works Department for the balance of the current year; and it'is also necessary to extend the repayment date of . loans previously made from the Water -Sewer Fund to the Garbage Fund.. He further ex- . plained that'it.is also necessary that the amount of $44,471. be.appropriated to various - accounts within the Garbage Fund to-pay salaries for`regular employees, for necessary part -time employees, to fill three vacant positions and to pay. operating costs for the ' balance of the current year, and this proposed ordinance accomplish these necessary operations.. • . . • City Manager McMicken explained that a request has been received for the. City to vacate . an irrigation pipeline easement at the incinerator site at F.air:Avenue and Maple Street, for. it has no foreseeable need, from Nor -West Enterprise, Inc., who wish to con- ' struct'improvements on the property. In accordance with, action taken by the City Council at the previous meeting of- August 10, 1970, and a resolution having.been prepared authorizing the conveyance of property owned by the City to Mrs.'Pearl M. Parker, it was MOVED by Keith, seconded' by McNeioethat Resolution No D -1525 authorizing the conveyance of said property -to Mrs. Pearl M. City Manager McMicken reported that bids were received and considered by a Bid•Board on this date,' on construction of the Lincoln Avenue and "B" Street Couplet, -as follows: • Yakima Cement and Asphalt Paving Co. $34,9070 Superior Asphalt and Concrete Co. 37,604.'00 Public. Works Director John Mayo recommending that the contract be awarded to Yakima Cement and Asphalt.Paving Company, the low bidder, it was MOVED by Robinson, seconded by McNeice that the bid be awarded to Yakima Cement and`Asphalt Company in.the amount of $34,989.00, and that the City Manager be authorized to enter into a contract'with said,. Contractor upon the filing of the proper bond.and insurance: carried, Brown, Keith, Lam - bert,, Larson, McNeice and Robinson votingaye by voice vote._ Lust.absent. . ' In accordance.with action taken by „the'City Council at the previous meeting of August 10, 1970, and the•matter regarding the sale of. some surplus furniture,owned,by the City,, .having been continued for further investigation City Clerk Marie Donelson reported that Mr: Marion Pierce, an auctioneer.had appraised these items at a much higher price. than had been previously offered. It was informally decided that these items shall be dis- pos,ed of at the next Auction to held later this year. Public Works Director gave a brief report on a Meeting and tour Unio Pacific Rail= road` officiais the' matter of repairing the tracks,at•several crossings. He stated they had contacted him as'a result of a le'tter'recdved from City Attorney Andrews regarding this matter. He further stated that as a result of a tour with him of . the crossings in question, they had agreed that something should'.be done and will re- commend the need to the.head office in Omaha, from where they will have to get approval 1- • II to do this repair work. City Manager McMicken reported that request has been received from the Yakima Eagles, who wish to sponsor a tent circus, (Duane Bros. Circus),. to be located on the premises of the Valu Mart Parking Lot, and that the, Yakima Municipal Code states that circuses and carnivals under tents may be authorized by the City Council and a special permit for a conditional use granted. It was explained that this is an inside show with animals and .performances. After:due'discuss.ion, was MOVED by Robinson, seconded by Keith that said tent show be authorized and the'proper permits and licenses be issued: carried • Brown, Keith, Lambert, Larson, McNeice and Robinson Noting by•voice vote.
