Lambert,,and McNeice, Assistant City Manager Friedline'and City Attorney Andrews present o roll call. Councilmen Robinson and Lust present after 3:15,P.M.. . The._ Invocation was given by Councilman. Keith. . The minutes of the regular meeting of August 3, 1970, having been duly certified accurate by, twocounc_ilmen, and no one present wishing.to have, said.. minutes read publicly, Mayor II Larson,declared . said minutes approved as recorded. . . . This.. being, the time fixed for the.. continuation .of the'Hearing on Petition. NO; 664, filed by Alfred Stelzer & Others, requesting 'annexation of propertyat,18 West Washington. Avenue, having been continued from July 27, 19•70, to.allow - the applicants to work with the En- gineering Department to.clear up some problems in their plans, Mr. Jay - Otto , Director of Planning.. and Community Development reviewed this matter,.repor.ting that the"Planning Commission had recommended that this property. be annexed :as. -- a:Planned Development .:Zone for • a Mobile Home Park Planned Development - with certain. :pro Mr. ,Stelzer, . being presen.. at this meeting, indicated that he still wishes to annex, but asked if the City Council is . going to require any additional provisions than those.already listed. Council members discussed the various provisions listed, including right -of -way on Voelker Avenue to be dedicated, and indicated that the provisions listed would be t h e only that the , City Council members•would require Public Works Director John Mayo spoke regarding this proposed. annexation., and others are in progress and reported that there are street . construction - projects in,some of these vicinities that.are being'partially funded with ' • Federal funds:and this would mean that if the street project is'finished before'the: pro - perty is annexed, the County pays a portion of the costs. and. should it be annexed before the street construction project. is finished then , .the City would have .to pay this addi- ' tional cost.. Thompson'was present .at this•meeting, which.accord- ing to City Attorney Andrews, does not meet the requirements of the law. - Mr:•Andrews explained' that all :-persons signing a Notice of Intention to. Association, being present, spoke ..regardingc voter registration. He stated that they, have found that thereiis a high percentage of - . people in this area that are not registering to vote and .they`are requesting that, volunteer deputy registrars be appointed to serve in such places in the City as Southeast Commu- nity Center, the Northeast Community Center,,, grocery stores: and in the .schools. After some discussion on. this matter, it was MOVED ,by,. Lambert,, seconded by : McNeice that this matter be referred to the City Manager for s tudy and recommendation: carried,-Brown, Keith 'Lambert, Larson, Lust, McNeice and Robinson voting aye..by.,voice.vote. . A Report from the Chief Building Inspector: regarding the demolition of dangerous buildings at 1004 S. 6th Street, owned by the Bethel African Methodist Episcopal Church,` having been received at the, previous meeting of August. 3, 1970, and.a Hearing:date on said matter having been filed for August 17, 1970, Assistant City Manager Friedline reported that II through an error on the part of the weekly - legal` newspaper, the notice of hearing was not published as required, thus, making it neces that the legal action on this matter, including the publishing Of a. Notice .of Hearing, the posting'of the property and the ' sending of a certified letter to the property'own must be started again -. City Attorney Andrews referred to the matter of making changes in assessments on certain property_ included in this .L.I.D.,.as had also been requested by the City Council on.August 3 - , 1970, those changes being to delete one basic fee .of $200,from the Beerman property - and to re- assess the Country Store property on 'the same basis per square) foot as the other properties. He stated that the City Council members could by motion declare their intention to these adjustments when they 'sit as 'a Board of Ad -f justment at •the-time of the Hearing on the Assessment R611 .this District. He recommen- ded that since the Country Store is to be re- assessed increasing their charges, that it would be in line to send them a special notice that the assessment will }be - increased which will give them an opportunity to file .a protest. Assistant City Manager Friedline explained that the City owns some miscellaneous surplus furniture'for which' it' has no `foreseeabl•e need•=and that some priv pa:rti'es °fia ndi- cated that they are interested 'in purchasing the following: .2 wooden -•and leather chars 1 l0- drawer wooden file cabinet, and 1 picture frame. He further explained. that a Reso- lution has been prepared authorizing the sale of this miscellaneous surplus fu'rni -tu at a price to be negotiated by the City Manager` and purchase -,I discussion, Council members indicated that they feel this surplus merchandise' shouldbe'disposed of by way of 'an .auction sale as is usually done with other surplus equipment. RESOLUTION NO D -1521, A RESOLUTION authorizing the purchase of,right -of -way for the widening and improving of - a portion of South 24th Avenue. Assistant City Manager Friedline referred the matter of the disposition, of property ac- quired by the City through foreclosure proceedings to City Attorney'Andrews that a request has been made by Mrs. Pearl'M. Parker, owner of propertiat 1706 Garrett Street., for cancellation of foreclosure deed and. extension oft redemption period dated July 25, "1970. He further explained that this matter came to the.attentioi.of the City Trea- surer when Mrs. Parker, who has been working and living out of -town for several - years :and was unaware of the foreclosing action, which. had: ,taken place agains t this: - property for .- delinquent local improvement assessments, until recently, has inquired as to•what action she might take to recover her property. Mr. Andrews stated that the issuance of a quit • • claim deed by the City of Yakima can be made conditioned by the payment 'of'. $379'.2 by Mrs. Pearl M. After due discussion, ,it was MOVED by,j seconded by McNeice that authorization be given to cancel the foreclosure deed and extend the redemptidh.period, and that proper legislation be prepared authorizing the issuance claim.. deed by the City reconveying said property to Mrs. .Parker ,upon., the payment of 079. Assistant C ity Manager- Friedline• repotted that bids were received "and considered• •ori - August 3, 1970 on Mead Avenue Arterial Improvement project as follows: Superior Asphalt -• & Concrete Co. $147,389A0 30 Yakima Cement - Si Asphalt Paving Co. $151,855.50 The City Engineer recommended that the contract be awarded to Superior Asphalt and Con= crete Company of Yakima, being the low bidder. Council members referred to the discussion on this matter at the previous meeting of August 3, 1970, when some question.,had•been raised as to legality of the low bid because the contractor had not, signed the _pr_oposa_1 . page before the bid was opened. City Attorney Andrews again affirmed his.opiTnion that:_the_ bid was a valid bid since all supporting documents- .are.-.in order. Councilman_ Robinson concurred ,with City Attorney Andrews: in, he, believes that this was a valid bid.. Coun- cil members indicating that they feel that. because there. was some question regarding the lowest bid. and the fact that the other bid was too high, being 12/o,over the Engineer's estimate, it was MOVED by McNeice, seconded by Lambert that all'bids be rejected and that . the call for bids be re- submitted: carried, Brown, Keith, Lambet, Larson, Lust, McNeice and Robinson voting aye by voice vote. He reviewed briefly the status •of 'the.'property - being purchased for the construction of the Equalizing Reservoir, indicating that, the purchase .o the- preferred site is depen- dent upon certain conditions as set . by •Mrs :: Plath'. Agreement with CH2M for design and supervision of the equalizing reservoir and connection pipeline, be passed i h■ as read :carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on 91: AUGUST .1O , 1970 • RESOLUTION NO D-1522, A RESOLUTION authorizing modifications to an Agreement to Furnish Engineering Services to the City of Yakima, Washington, for Water •System Improvements between the City of Yakima and Cornell, Howland, Hayes & Merryfield, Assistant City Manager Friedline reported briefly on a meeting'heid with Air West and City and Chamber of Commerce officials, stating that they have nothing new planned regarding the number of flights except that there may be a time change of two flights at the end of daylight savings time. , Assistant City Manager Friedline referring to the agreement with Air West for continued occupancy of space and operation of their airline system at the Yakima Municipal 'Airport, •it was MOVED by Keith, seconded by Lust that ,Resolution No. D-1523 authorizing the execution of said agreement, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on •roll call. • RESOLUTION NO. D-1523, A RESOLUTION 6uthorizing and directing the City Manager and City Clerk of the City of Yakima to execute an Airport Lease Agreement with 'Hughes Air Corpora- tion, d/b/a/ Air West, a corporatidn. Asstant City Manager Friedline referring to a. proposal by Hamilton Bus Company to operate Municipal service on a contractural basis, stated that this matter is stillbeing consi- dered by the Staff and it will probably be about three weeks before any decision is reached.
