The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present .on..roll call. The Invocation was given by Councilman Keith, The minutes of the regular meeting of July 27, 1970, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time for the Hearing on the Adoption of the 1970 Building Codes: A. The Uniform Building Code B. The Uniform Mechanical Code C. The Uniform Plumbing Code Chief Building Inspector Newell Pock explained that three copies of the latest edition of the 1970 Codes have been filed with the City Clerk as required by law. He further ex- plained that they are primarily the same as the previously adopted Ordinances with a few amendments and reviewed these briefly. After due discussion, it was MOVED by Brown, - seconded by McNeice that Ordinance No. 1235 adopting by reference "Volume I" and "Stan- dards" of the Uniform Building Code, 1970 Edition, and amending the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1235, AN ORDINANCE relating to building regulations, adopting by reference "Volume I" and "Standards" of the Uniform Building Code, 1970 Edition, Copyright 1970 by the International Conference of Building Officials, regulating the erection, construction, enlargement, alteration, repair,- moving, removal, conversion,: demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures in the City of Yakima; providing for the issuance of permits and collection of fees therefor; providing penalties for the violation thereof; amending Sections 11.04.010, .030, .040 and .060 , and adding new Sections 11.04.020 and .050, all of the City of Yakima Municipal Code. It was MOVED by Brown, seconded by Lust that Ordinance No.1236 adopting by reference Volume II of the Uniform Building Code, entitled "Uniform Mechanical Code ", 1970 Edition, and amendingg "the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1236, AN ,ORDINANCE relating to building regulations; adopting by reference Volume II of the Uniform Building Code, entitled "Uniform Mechanical Code ", 1970 Edition of the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials, together with "appendix B - Fuel Gas Piping ", and making amendments thereto; amending Sections 11.32.010, 030, .040, .060 and .070, adding Sections 11.32.015 and .050 as new sections, and repealing Section 11.32.020, all of the City of Yakima Municipal Code. It was MOVED by Brown,- seconded by McNeice that Ordinance No. 1237 adopting by reference the Uniform Plumbing Code, 1970 Edition, and amending the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1237, AN ORDINANCE relating to building regulations; adopting by reference the Uniform Building Code, 1970 Edition, by the International association of Plumbing and Mechanical Officials; providing for licensing individuals and firms engaged in-the busi- ness of, or laboring at the trade of, plumbing; providing penalties for the violation of the provisions of this Chapter; amending Sections 11.44.010, .040, .050, .060, .070, .080, .090, .100, .110 and 120, and repealing Section 11.44.030 and adding Section 11.44.105, all of the City of Yakima Municipal Code. - In accordance with action taken by the Council on July 20, 1970, and this being the time fixed for a review of the proposed assessts for L.I.D. No. 980, South First Street & East Washington Avenue Sewer District, Public Works Director John Mayo again reviewed, the matterof the forming of this District and explained how assessments are computedand the manner in which they are paid. Property owners present and speaking to this matter and asking questions about the assessment charges were Mr. Lee Miner, Mr. Albert L. Hughey, Mr. and Mrs. Virgil Keller and Mrs. Mary Pitt. Letters were also received from_two pro- perty owners, Mr. W.J. Beerman and Mr. Albert L. Hughey, requesting information regarding this matter, and these were reviewed by the City Council. Mr. Beerman, in his letter, objected to being assessed for two $200 flat fee charges on two small adjoining parcels. Mr. Beerman, in his letter, and property owners present referred to the difference in the charges per foot on the various, properties and objected to the fact that the Country Store is being charged only 1 per foot, while the other property owners are paying 3. Council members discussed this matter and indicated that they felt that property owners outside the City wishing to be deleted from this district should be allowed additional time in which to do this. City Attorney Andrews explained that the thirty day protest period allowed at the time of the passage of Ordinance No. 1228 creating L.I.D. No. 980, has expired as of this date, and that any further action to be taken on this matter will have to be studied and possibly the Ordinance will have to be amended. He explained that there is a time yet when the assessments can be protested and that is after the contract is awarded, the work finished and a Hearing on the Assessment Roll held. After due dis- cussion, it was MOVED by Robinson, seconded by Lambert that action be taken to allow at least 15 days for the property owners outside the City to file protests if they do not wish to be included in the proposed district: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. It was then MOVED by Robinson, seconded by McNeice that the City Attorney ascertain what is required -to remove one $200 basic fee from Mr. Beerman's assessment charges, and to re- assess the Country Store property to charge 3 per foot for the south 300 feet: carried, Brown, Keith, .. Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Mr. Hans Skov, President of Yakima Cement & Asphalt Paving Company, being present, stated that he is protesting an action taken on this date regarding the opening of tim bids on I • 85 • • • • AUGUST'3 1970 ' the Mead Avenue Arterial Improvement project_ He, further stated.-that he does not believe that the bid of Superior Asphalt Company should be considered a legal bid because at the time this bid was opened the proposal page had hot been signed and. Mr. DeAtley :was allowed to sign it before the bid was read, which bid was the lowest bid pre- sented. Mr. John Mayo, Public Works Director, explained that Bids,had,been- called for on this date on the Mead Avenue Arterial Improvement project, that the bid of Superior Asphalt and Concrete Company was the first one' opened, and that before reading any figures the Bid Board reviewed the documents to see that they were all in order, as is customary, at which time it was discovered that the proposal page had been stamped with the Company name, but had not been signed, and Mr. DeAtley was allowed to sign .this page. Mr. Mayo reported that there were only the - two bids submitted on this project, one being submitted by Superior Asphalt and Paving Company in the amount of approximately $147,000, which is 9% over the Engineer's Estimate of $135,000, and the other by Yakima Cement and Asphalt Paving Company in the amount of approximately $157,000, which is 12% over the Engineer's, Estimate. He explained that it has been the normal practice to accept and award a bid up to 10% over the Engineer's Estimate, but anything over that is usually rejected, so that if the bid of Superior Asphalt and Paving Company were to be declared an illegal bid, that probably the bid of Yakima Cement and Asphalt Paving Company would be declared too high, and that both would then be rejected as not being acceptable and a new call for bids would have to be made.. City Attorney Andrews explained that this matter had been referred to his office on this date by the Bid Board and after consideration, it is his,opinion that the bid submitted by Superior Asphalt and Paving Company is a valid bid. He further explained that all other supporting documents are in order, that the Company stamp had been placed on the proposal page, and that the'signature had been allowed before any figures were read, so that there was no prejudice to-any other party and that the lack of signature would not constitute an invalid bid. After due discussion the City Council, it was - indicated that the matter of awarding the contract will be taken up next week and no formal action was taken. at this time. • • A report having been received from the Chief Building Inspector, Newell Pock, of tha de- molition of dangerous buildings at 1004 S. 6th Street, owned by. Bethel African Methodist Episcopal Church, and listing the expenses incurred by the City in_the demolition of said buildings, it was MOVED by Brown, seconded, by Robinson that August 17, 1970, be fixed as the time of Hearing.on said matter by the City Council: carried,- Brown,•Keith, Lambert, • • Larson, Lust, McNeice and Robinson voting aye by voice vote. • City Manager McMicken referred to his Report # 94, Proposed Changes in Garbage Rates - Supplement, and explained that there had been. some additional changes from his previous Report #93, which had been suggested by City staff members.. He reviewed these suggested changes briefly, referring to the billing procedures where some of the monthly charges: are billed in arrears and some in advance, and suggested that all be billed in arrears, He stated that another suggested change to eliminate the 50" penalty•for-delinquent garbage accounts and the other suggested change is where temporary suspension. of services is requested, that all utilities be suspended -- not just the garbage alone. Mr. McMicken recommended that along with the legislation being prepared for the Hearing to be held on August 10, 1970, on the proposed Changes in Garbage- Rates, that legislation be prepared. to authorize the transit tax and the basic one can garbage collection service be billed. in arrears, rather than in advance, that the 50 penalty payment for delinquent garbage accounts be eliminated; and where temporary suspension of services requested, that all utilities be suspended, not just the garbage alone. After due discussion, it was MOVED by Robinson, seconded by Brown that it is the concensus.of the City Council that the suggestec changes be made as recommended by City Manager McMicken in his Report #94: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported that bids were received and considered by a Bid Board on July 27, 1970, for the construction of L.I.D. No. 979, McCargar's Westside Tracts & Other Sanitary, Sewers as follows: • • Cook Construction $18,215.00 A.V.DeBlasio Construction 20,952.50 • DeBlasio Construction . 22,284.00 a_ r Public Works Director John.Mayo explained that there is one remaining requirement before • the contract can be awarded :and that is the matter of obtaining a franchise from the County to .lay the sewer under the county road. He further explained that there is a fran- chise hearing with the county this week and recommended that the contract. be awarded to the .low bidder depending upon getting this franchise from the county. The City Engineer recommending that Cook Construction Company; :having submitted the low bid, be awarded the contract, it was MOVED by Robinson, seconded by McNeice that the recommendation of the City Engineer be accepted and that the bid be awarded to Cook Construction Company in the amount of $18,215.00, depending upon getting a franchise from the County to use the County road, and that the City Manager be. authorized to enter into a contract with said contrac- upon the filing of the proper bond and insurance: carried, Brown;, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. - • :tor Mayor Larson reported that Robert Schultz has been appointed Chairman and Thomas Bostic, • n Vice Chairman of the Housing and Renewal Committee. Councilman Robinson reporting that he may not be present at the meeting of August 10, 1970 and asking to be excused if he is not there, and Mayor Larson asking to be :excused from the Council meeting of August 31, 1970, it was MOVED by Robinson, seconded by McNeice. that Councilman abinson and Mayor Larson be•excused as requested: carried, Brown, Keith, Lam- bert, Lust, McNeice voting aye by voice vote. • • AA AUGUST 3, 1970 There being no further business to come before the Council, it was MOVED by Lust, seconded by McNeice that we do now adjourn at the hour of. -5:45 P.M.: carried, Brown,.
