The•Invocation was given by Councilman Lust. .

• 'Larson declared said Minutes. approved as.recorded. .
Petition No. 660, having been filed with the•City Clerk on June.1, 1960, by Ed'Miner &
Others, requesting improvement.of"property by the construction'of - a sewer in .the vicinity .
of S. lst'Street •and'Washington-Avenue, City.Manager McMicken explained that this request
has been 'considered by the ' Engineering Staff 'and =Item •No.. 11 on :the. Resolution of
'Intention.to creat an in with said Petition No. 660. has 'been prepared.
After due 'discussion, .-it was 'MOVED by 'Brown, seconded •by"McNeice that Resolution No. D -1498,
.A Resolution•of intention to'create a local improvement district and fixing the time for a
Hearing by the City for:June 29, 1970, be'passed'as :read: carried,.Brown, Keith,
Lambert, Larson, Lust,'"McNeice"and Robinson.voting aye on roll call.
.RESOLUTION NO. D -1498, A RESOLUTION 'of intention to create 's. local improvement district.
"Petition No. 661,,having been filed with the 'City - Clerk on June 2, 1970,' by Wade
&'Others, requesting improvement of property by' the construction of curbs,'gutters, sur
• facing and sidewalk : for the ' property located on the - southwes t corner . of .:Lincoln and 16th
.Avenues, City:Manager that the property requesting is
that'recently rezoned to.permit's.. Shopping Center to be.built'on this corner.' He referred
to the that said Petition No. 661,'has-been signed with conditions that this-L.I.D.
will be null and void unless the - •planned' Shopping Center is completed. Mr. McMicken read
letters previously written, sregarding.this property and the rezone request; and stated
that a building permit' has been•obtained. After due discussion, it was MOVED by Keith,
seconded by;McNeice. that said'Petition No. 661, be referred to:the City Manager and Staff •
for study and recommendation: carried, 'Brown, Keith, Lambert, Larson, Lust, McNeice and
Robinson voting aye by.voice vote. •
Repoits having been received from the Planning - Commission on a Resolution of Intention to
amend . the 'Zoning 'Ordinance and 'on °the' Six -Year Construction Program, ,it was by
Robinson; seconded by,.Keith that June 22, 1970, be fixed the time of:Hearings by the
City Council on said matters': carried, Brown, Keith,, Larson, Lust,,• McNeice and
Robinson voting aye by voice'vote.

. May 31, 1970, regarding, the investments.of Cityof.Yakima, be accepted and•approved:

City Manager •McMicken exp'laining-that ' in connection with the - contemplated construction of
the B Street' and=- Lincoln Avenue Overpasses,'the Union ,Pacific Railroad Company has agreed
. to participate in-accordance with a. letter of agreement which will confirm the negotiations
between 'the City and the'Union Pacific- -Railroad - Company,, it was MOVED by Keith, seconded by
Browri'that Resolution °No. D -1499 authorizing the execution of - said agreement, be passed as
read: carried, Brown, Keith; Lambert, Larson, Lust, McNeice and Robinson voting -aye on:roll

RESOLUTION. NO. D -1499, •. A'RESOLUTION authorizing -and directing the 'City Manager -of the Cd-ty
of Yakima to execute an • agreement with the Union Pacific Railroad- Company - =relating to the
B Street -and. Lincoln Avenue Overpasses - - -- -
City Manager - McMicken'explained that the Garbage Fund requires additional money to finance
the operations ofthat for the balance of the current year and the Water- Sewer
Fund currently contains uninvested cash which is available for investment. He further ex-
plained that it seems to be in the best interests of the City to make a temporary loan of-
$13,000 from the Water -Sewer Fund to the Garbage Fund to be repaid with interest at the
rate of 6% per annum. After due di- scussion, it was MOVED by Robinson, seconded-by Brown
that Resolution No. D- 1500,•A RESOLUTION authorizing said temporary loan, be passed as
read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on .
roll call.
RESOLUTION NO. D- 1500, A RESOLUTION. authorizing a temporary loan of $13,000 from .520- Water-
Sewer Fund to 320 - Garbage Fund, and providing for repayment. •
City Manager McMicken brought on for action an•off- the - agenda item, stating that bids were
received - and considered by .a bid board on this date, June 8, 1970, on the construction of
L.I.D. No. 978, Downtown Mall Utility Relocation &Street Modification•Project, as follows:
Mountain StatesConstruction•Co.. &Assoc., Sunnyside . • $339,900.00
Superior Asphalt & Concrete Co., Yakima 419,068.00 '
Public Works Director John .Mayo explained that this amount includes the alternate item,
which is• to furnish and install snow mats• and appurtenances - complete. The - City
Engineer recommending that the contract be awarded to Mountain States Company
Associates, Sunnyside, the low bidder, it was MOVED by Robinson, seconded by Keith that

• the recommendation °of the accepted and that the bid be awarded to Mountain
States•Construction Company & Associates, Sunnyside, in the amount•of'$339,900.00, and
that the. City Manager be authorized to enter into a contract :with said contractor upon the
filing of the proper bond and insurance: carried, Brown, Keith, Lambert, Larson, Lust,
McNeice and Robinson voting aye by voice vote. --
City Manager authorization for out -of -State travel for Public Works
Director John Mayo travel to Portland,.Oregon, to meet with Burlington Northern Railroad
personnel, it was MOVED by Robinson, seconded. by McNeice that said out-of-State travel be
allowed with expenses paid: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and
Robinson voting aye by voice vote.
There being no further business to come before the Council, it was MOVED by Lust, seconded
by Keith that we do now adjourn at the hour of 4:05 P.M.:.•.carried, Brown, Keith Lambert,'
