The- Invocation was given by. Councilman Keith.. . The minutes of the regular meeting of 'May 18; 1970; having been duly certified accurate by II two. Councilmen, and no one present Wishing .to have said:minutes read-publicly, Mayor Larsondeclared.said minutes.approved as recorded, This being the.time.fixed for the Hearing on recommended changes in the CBD Traffic Circulation Plan; Public Works Director, John Mayo presented charts showing the proposed traffic plans and explained. what is involved in the construction of the one -way couplet on Lincoln Avenue and "B" Street and the reversal of :the flow of on "A" Street and Chestnut, He stated that because of the Mall construction, it'will be necessary to . change the flow'of traffic on 'four streets in the downtown area and explained the work that will be necessary to make'these changes. Traffic Engineer Al Ray more about the traffi.c,patterns and plans and that there will - be considerable changes necessary • in the number of parking stalls on various streets involved. City,Manager McMicken • explained that this Hearing is not a legal requirement bylaw, but that it was felt that all people involved in these changes should have a chance.to be heard and notices of this Hearing were, sent out to some 300 occupants of business houses in this CBD.area, along with City Manager Report #82,.. and .the Traffic Engineer's Report. He further explained that the Planning Commission has indicated approval of.the proposed CBD Traffic Circu- lation Plan, arnd. that street changes will be. made by..Ordinance. Those present and . • speaking to this matter were Mr. Wm, Draper, Mrs. June Thurston, Mr. Fred Fellows, Mr. Miller, Mr: Corbett, Mr." Porter Lombard, Mr. Whitehead, ,Mr. Jack Thomas, Mr. Pete Scully and Mr, Thomas Hargis: Mt.' Draper and others in'this area referred to the. plans regarding the losing.of a number of "parking stalls by changing some: of the angle parking to parallel .parking and'asked that these changes be deferred until the.last, possible minute, : Mr. • Fred,Fellows asked •that the• proposal be considered in the planning of traffic flow, that • in the blocks bordered by Front and First, they be made two -way instead of one -way streets. Mr. Corbett and Mr.Lombard indicated that they :feel diagonal parking is needed on both sides of their particular streets. Mr. Jack Thomas stated that Wagner Chevrolet covers one block and they would like to see some consideration given as to keeping as many- parking spaces-as possible and would like to -keep: the diagonal parking. These : people referred tofthe.14 to 20:ft. sidewalks, - and asked about cutting them back :to smaller sidewalks to be able to keep as -much parking space as possible. Public Works Director suggested that an L.I.D. could be formed with -the property and the City coming. to some kind of .an agreement-on the-cost, but stated that,:it would be; much more expensive to - cut back sidewalks and put in - curbs, than to_buy other areas; for. parking', Council members indicated that they would like to have some cost estimates worked up regarding an L.I.D. as suggested,5 City Manager McMicken 'recommend"ing that the "B ", and Lincoln' Couplet be• ,considered at a later date within the next '60 .days, and that legis- lation be drawn up to take care of the other suggested changes i t'was,MOVED"by Keith, seconded by Robinson, • .that an Ordinance ,be prepared effecting the changes., outlined by . the City- Manager : carried;. II was MOVED by Robinson, seconded by Lambert that :we diviate from the regular order of the Agenda and move to _the Audience 'Participation portion : at 'this time: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye. by voice vote, Mr.. Jim Scott, representing the Home"Builders Association of, Yakima, explained that many of the builders Are present to discuss the use ,of - plastic pipe. He indicated that.at,th,e time the City adopted the Uniform Plumbing .Code that the _Home Builders .Association assumed that this. adoption of .the- Code authorized •the.. use of .plastic,.pipe, • _only to, find that the city,: .. . Plumbing and Building Inspectors, have : 'refused, to allow these of plastic pipe other than • in single family homes. Mr. Scott further stated that the Home Builders Association would like a clarification of the Ordinance adopting the Code, and axes are hopeful of the possibility of an -amendment to this .-Ordinance' which would 'authorize the use of 'plastic pipe in other than single family dwellings. Home Builders Association stated that their.. plastic pipe has been, approved by"the V,A, a'nd the Federal Housing Association. He reported thablast month in Selah, the City Council passed an Ordinance allowing a particular warehouse to use Schedule . 40 P.V.C. plastic p.ipe'or, better. Mr, Ron Whitaker, Attorney for.Lee Campbell,.puilder;. • reported that Glascam Builders have been- using",plastic pipe.outside the „City limits since 1959, and asked that "the present Ordinance be clarified, or that an-amendment to the present Ordinance ,be passed.- allowing; the use of ._plastic ,,pipe, :in other single,,. family . dwellings. „,Mr: _Newell Pock,, Chief BuildingInspector._explained that they. have been . awaiting. the_ 1..970 :Building Code, so that they can •come to the Council with -a new Ordinance which will have all the standards up to date, Fire Chief Jules Shockley stated that he feels that there should be a height limit on the buildings "putting in this pipe and would • also, like ' ke to get_ a: reaction of the various. chemicals on this pipe. In discussion on the use of plastic pipe under ground, it was brought out,that any time plastic pipe.is.used underground in rocky ground it should be embedded in "sand or similar material. .Council members indicated that .they, did' not feel..,we should wait for the 1970 .Building Code to be ` filed, and that an Ordinance" should _be..-preparedf ai.lowing the ,use Schedule 4.0•• P:•V.0 ” or' better; ".plastic; :pipe; . Schedule 40, or better, plastic pipe, with building height limitations of 30 feet, and that when used underground it should be embedded in sand or nonporous soil: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken referred to an item listed later on the Agenda, "recommendation by Park Commission to maintain $1.00 admission fee for Learn to Swim Program ", and asked that it be brought on for discussion at this time. Mr. William Hutsinpiller, Director of the Department of Parks and' Recreation, explained that last year the Metropolitan Park District for the first time charged an admission fee of $1.00 for the Learn,to Swim Pro- gram. He stated that the reason for this fee was to help defray the cost of operating facilities which would not otherwise be available to the public because of the ever -growg deficit. Mr. Hutsinpiller reported that this year the Park Department under City manage- ment is still. faced with an inadequate budget to provide the facilities'and programs needed in Yakima and are recommending that a fee of $2_.00 be- charged: - He stated that this recommendation has been sent to the local_Red Cross Chapter D.irector.asking for the approv- al or disapproval of the Red Cross Board, and their reasons. Mr. Hutsinpiller reported. - that the Park Commission has recommended that the fee remain at.$1.00. Mr. Grey M.. Lusty, local Red Cross Chapter Manager, present, stated that the Red Cross Board voted unanimously to object to any fee being asked for Red Cross swimming lessons because they feel many families will not be able to take advantage of the swim program and even though arrangements can be made for those who cannot pay the fee, they feel that many will not apply. He further stated that up until last year this has been a free program, and they feel it. should continue to be offered in this manner. .Mr._Lusty explained that the Red Cross volunteers who help teach program cannot be expected to donate their time while the Park Department is .profiting by.a charge for the lessons. He further explained that they feel that a charge for this program will reduce the number of participants and is directly contrary to Red Cross policy and practices, which is to give every person a skill and knowledge of hazards of the water. Council members indicated that they. feel that there should be a fee, but that it should not be raised. They further indicated that a better program could be initiated to inform the people who cannot afford the•fee,that.they may still take advantage of the program, and suggested that it could be done by a directive to Welfare case workers. .After due discussion,_it was MOVED by Robinson.,. seconded by Keith. that the for the Learn to Swim Program be left at $1.00, for the season: carried, Brown, Keith, Lambert, Larson, McNeice, Lust and Robinson voting aye by voice vote. It was MOVED by Brown, seconded by McNeice that Ordinance No. 1222 amending,6.04.340 of the City of Yakima Municipal Code, defining and prohibiting cohabitation, be passed as read: carried," Brown, Keith, Lambert, Larson,. Lust, McNeice and Robinson voting aye-on roll call. City Attorney Andrews'explained that in recent Court cases on this subject, the pre - siding dismissed the cases on the ground that the present ordinance is invalid for vagueness and ambiguity, and this amendment contains the language of the State law. ORDINANCE NO. 1222, AN ORDINANCE relating to public safety and morals; defining illegal • cohabitation and declaring it to constitute vagrancy; amending Section 6.04.340 of the City of Yakima Municipal Code; and:declaring an emergency. An Ordinance appropriating $20,200 to the Department of Parks and Recreation for Park.' acquisition and for relocation costs, being.read in, its entirety at this meeting, was laid on the table for one week, or until June 1, 1970,. Mr. William Hutsinpiller, Director of Parks and Recreation, explained that this appropriation is necessary to provide for land acquisition and relocation costs ; the development of the park contiguous to the Southeast Community Center. He reported that the Lions Club has donated funds, and recently, picnic tables and a trash dispenser. Council members indicated that they feel that public recog- nition and acknowledgement should be given to the Lions Club for their.participation in this program. An. Appeal from :.the Planning Commiss ion.';s ;.decision . in denying the Rezone Application, filed by Safeway Stores.; Inc., requesting rezone of property located on the southwest corner of Summitview and 56th.Avenue, having been filed with the City Clerk on. May 18, 1970, and.a Report having been received from the Planning Commission on the Rezone Application, filed by James M. Newborn & Others, requesting rezone of property located at 1315 S. 6th Street, it was MOVED by Brown, seconded by Lambert that June 15, 1970, be fixed as the time for Hearings by the City Council on said Rezone Applications: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. A report having been received from the Fair Housing Review Board recommending. revisions to the Fair Housing Ordinance, City Attorney Andrews referred to his Memo on this matter which explains that the Fair Housing Review - Board has asked for two revision as follows: (1) to Amend Subsection 6.80.050 (b) (6) to allow notice and disclosure to the - Washington State Board Against Discrimination and to the Chief and Public Relations Officer of the Police Department of the filing and contents of unfair housing complaints and of the progress during investigation of such complaints and of their disposition; (2) to Repeal Subsection 6.80.030 (b) (2) of the Code regarding four unit apartment exemption. After due discussion, it was MOVED by Keith, seconded by Lust that an appropriate ordinance be prepared to make said recommended revisions to the Fair Housing Ordinance: carried, Brown, Keith, Lambert, Larson,. Lust, McNeice and Robinson voting aye by voice vote. • City Manager McMicken referring to the matter of the letter received from Cornell, Howland, IlL Hayes and Merryfield, reporting on the completion of the 48" water transmission main, Schedule C., and recommending that the.work be accepted and final payment be made, it-was MOVED by Robinson, seconded by Brown that the report of Cornell, Howland, Hayes and Merry - field dated May 15, 1970, with respect to the completion of the work on the 48" Water Transmission, Main, Schedule C, be approved, the work be accepted and payment of the final estimates as therein set forth is hereby authorized: carried, Brown, .Keith,-Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken explaining that the owns approximately seven acres of property situated near Tahoma Cemetery and Ted Va- n:Keulen desires to lease said property, it was .MOVED by Brown, seconded by Robinson that Resolution No. D -1490 authorizing the execution of a Farm Lease agreement with Ted VanKeulen, be passed as read: carried, Brown, Keith, • Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager McMicken, explaining that from time to time the City accumulates used reclaimed manhole, rings and covers for which. it has no use, which would ordinarily be sold as scrap, iron at periodic City auctions, and that from time to time various counties, school dis tricts and.cities.in the State of Washington- desire to purchase said surplus items, it was MOVED by Keith, seconded by McNeice that Resolution No. D -1491 authorizing,the sale of said surplus manhole rings and covers, be passed as read: carried, Brown,. Keith, Lambert, Lar- son,. Lust, McNeice and Robinson voting aye on roll call. , II RESOLUTION N0. D- 1491, -A RESOLUTION authorizing the sale of surplus manhole rings and covers owned by the City of Yakima. City referred the matter of the hiring,of'prbfessional aerial photography and map making services to'Public Works Director John•Mayo, who explained that in connec- tion with proposed arterial street improvements and other contemplated public improvement projects, it is necessary to hire said services, and Walker and Associates,. Inc., has offered to perform ,and is already performing said services for the City. After due dis- cussion, it was.MOVED by Robinson, seconded by Lambert that Resolution No. D -1492 author- . izing,the hiring of said professional aerial photography and map making services, be passed as read: carried,. D -1492, A RESOLUTION authorizing the hiring of professional aerial photo= graphy and map making services,. . • City Manager McMicken reported that in accordance with a request in January by Councilman Robinson, a review of. truck routes through the City was made with the assistance of the .. • City Traffic.Engineer and the'Fire Marshall. He referred to his Report #86 which outlines the .study that was made. and•.the information received', and reported that a. new route map has been prepared with new signs to be prepared accordingly. .. City Manager McMicken - referred to the Notice of proposed amendment to Rules of Procedure_ of City Council, and explained -that in accordance with Rule 0..- AMENDMENT, in the City Council Rules of Procedure, in order to amend these rules, said Notice of proposed amend ment, must be submitted at least five days before a proposed' amendment is submitted by Resolution. He further explained that the present rule calls for meetings to be held on Wednesday of each week, and that Section 1.06.010 of the City of Yakima Municipal Code,: , as amended in.1962, provides for the Monday meeting day, but the rule has never been changed in City Council's Rules of Procedure. City Manager McMicken reviewed the Yakima County Water and Sewer Study, Part 1, Narrative • Report and Part 2, Comprehensive Water and Sewer Plans as submitted to the Yakima County . Conference of Governments, by Harstad Inc.,• which study provides the compre- hensive plans to guide orderly and efficient.development of future water and sewer 'systems in.Yak•ima County. There was some discussion in which Council members.indicated that they feel that this is a -thorough study on this subject. Councilmen•Lambert and Robinson, • being members of the Yakima County Conference of Governments, indicated that.theymill be glad to have any comments,or suggestions to discuss at these meetings on this matter or • other items. of interest. _ City Manager McMicken read a letter from Air West stating that the schedule will again change as of June 1, 1970, that instead of four DC9 flights, there will be. five. City Manager McMicken requesting out -of -State travel for Matson-Young, Fire Marshall; to attend the Fire and Arson Investigation Seminar, May 25 to May 29!, 1970, at Eugene, Oregon; William Thomas of the Police:Department, to attend the Northwest Check Investigators . II Seminar in Portland, Oregon, May 23• and 24, 1970; and for Public Works Director John Mayo and Public Utilities Director Frank Stein, to go to Portland, Oregon, on May 26, 1970, to meet with officials of Teeples and Thatcher regarding the delay of the completion of the Water Treatment Plant; all with expenses. paid, it' was MOVED by Keith, seconded by Brown that said travel be allowed with expenses.paid: carried,..
