HomeMy WebLinkAbout05/11/1970 Business Meeting 49 • MAY 11,.1970 • The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Lam- bert, Lust and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilmen Keith and McNeice absent on roll call. It was MOVED by Lust, seconded by Robinson that Councilmen Keith and McNeice be excused from this meeting: carried, Brown, Lambert, Larson, .Lust and Robinson voting aye by voice vote. The Invocation was given by Councilman Lust. . The minutes of the regular meeting of May 4, 1970, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . • • This being the time fixed for the Hearing on Resolution of Intention No. D -1473, to make certain improvements adjacent to the Yakima. Mall, it was MOVED by. Brown, seconded by Robinson that Ordinance No. 1220 'creating L.I.D. No. 978, Downtown Mall Utility,Relocat•ion and Street Modification Project,. be passed - as read. Discussion brought out the fact that this L.I.D. will be extended over a period of 20 years rather than the usual ten years. City Attorney Andrews explained that the Yakima Mali L. Shopping Corporation requested by letter, which letter is in the- City Clerk's files, that the L.I.D. assess - ments be payable over a 20 year period, with interest only being paid the'first''YO years, deferring.the principal payments during that.time and that during the second ten•years the principal payments be amortized over the remaining ten years. He stated that the City Council might wish to postpone its. decision regarding the exact mode of payment until after the work is completed on this.L.I,D, and the Hearing held. He further stated'that • at that time the Ordinance confirming district may specify mode of 'payment and amend Ordinance No. 1220. Mr. J.W. McArdle, Attorney, representing the Yakima Mall = Shopping • Center Corp., was present and concurred with the information given by the City Attorney regarding this matter. After due discussion, Mayor Larson called for .the roll call vote on the Motion to pass Ordinance No. 1220 creating.said L.I.D. No. 978, as read and it carried, Brown, Lambert, Larson, Lust and Robinson voting aye on roll call. Keith and McNeice absent. • ORDINANCE NO. 1220, AN ORDINANCE providing for the improvement of certain streets by repaving and installing sidewalks, curbs, gutters and concrete ramps, and by relocating and placing underground certain public utility facilities; establishing.a Local Improve- ment District; providing for the method of payment for such improvements; and creating a special fund. .. It was MOVED by Lust, seconded by' Brown that Ordinance No. 1221 creating the Southeast Yakima Community Center•Fund, be passed as read: carried, Brown, Lambert, Larson, Lust and Robinson voting aye on roll call. Keith and McNeice absent. City Manager McMicken explained that this Fund is being created to take care of the funds -- received and expended , in connection with the construction of the Southeast Yakima Community Center. ORDINANCE NO. 1221, AN ORDINANCE creating and adopting Chapter 3.76, "Southeast Yakima Community Center Fund" as a.new chapter of the City of Yakima Municipal Code; creating, defining the purpose of, specifying the source of and regulating expenditures from such fund; • appropriating $495,826 within - such such fund; and "declaring 'an emergency':' .. • Mr. L.L. Robinson, and Mr. O.F. Gilbert .representing : Property' Owners Protective Associa- tion, were present to discuss their objections to the adoption, of: a. "Workab'le program for Community Improvement" and its relation to Urban Renewal. Mr. Robinson referred to a pamphlet "The Federal Bulldozer, by. Martin Anderson," and.stated that.it.explains the problems of Urban Renewal, and gives in brief the best explanation of the case against Urban Renewal. He presented Mrs. Gladys Edwards of Seattle, who spoke briefly•against Urban Renewal programs of,any kind and her involvement with such programs in Seattle. Mr. O.F. Gilbert filed with the City Council, a document to "register,. formally, this • Association's protest to any Urban Renewal scheme being adopted by the City of Yakima without a vote of the people," and reviewed the. objections listed in this document. There were approximately fifty people present at this meeting and those speaking against Urban Renewal were Mr.' Clark Crothers, Mr. Raymond Spratt, Mrs. Betty'Keltner, Mr. Lorne House, Mrs. Stapleton and Mr. Frank Strange. Mrs. Mary Wakely•who lives in the Southeast area, • spoke in favor of the City Council and City government. City Manager stated that the City is interested in the:viewpoints'of all the citizens. He also stated that it is no secret that this City government desires to renew old neighborhoods, not as an attempt to injure property owners, but to.help them improve- their.proper.ty. He reviewed the programs and surveys that have been carried on by the City. in an effort-to conserve sound dwellings, and to follow a Code enforcement program to make existing buildings maintain housing and health conditions. He further explained that if the City government does certain things to meet Federal standards in trying to maintain thie - older neighbor - hoods, we can become qualified for' Federal funds. Mr. McMicken referred to. the fact that the properties of three :families in the-Southeast Community are being .purchased for the construction of the Southeast Community Center and Park and stated that the owners are being treated fairly and'being paid a fair,ma.rket value for their property plus moving and other expenses. Mr Homer Matson of the Planning and Community Development Department reviewed the Survey that was recently made by this Department and explained the charts regarding the types of housing in, this area. Council members .indicated that there are no plans contemplated for Urban Renewal as. referred to by L.L. Robinson and O.F. Gilbert of the Property Owners Protective Association, and the citizens present.speaking against Urban Renewal. They further indicated that they are in favor of programs to improve and renew older areas of the City and in obtaining funds for this work, but in contemplating any federally assisted programs in the future, decisions would have to be made by various groups and Hearings be held by the Planning Commission and City Council, Council members referred to the letter described as "Eviction Notice" from L.L. Robinson and,O.F. Gilbert, representing Property Owners Protective Association and expressed their - disapproval of the methods of distributing this information, with no covering letter. Mayor Larson • stated that he felt the sending of this letter was an irresponsible thing to do. He • I r 50 MAY 11, 1970 further stated that he had received phone calls from older people who had received this "Eviction Notice" and who were afraid they had to move out of their homes the next day. All persons having been heard both for and against Urban Renewal programs, no formal action was taken or is necessary on this matter•at this time. • City Manager McMicken referred to the Park and Recrul tion Commission's report regarding the appointment of a Park Needs Study Committee to act as a nucleus of a steering commi- ttee, and recommended the."appointment of. the • fifteen people, named on a list submitted to the Council as follows: Joe Wiatrak, Chairman, Jim Nolan., Gene Shields, 'Rolla Goold, Frankie Romney, Bob Lucas, Hugh Davis, Charles Lyon, Walter Lewis, Hap Brahms, John Mul- venon, 011ie Nelson, John Greriier, Greg Brazindine and Paul Sherfey, that all have been contacted and are willing to serve on this committee. After due discussion, it was MOVED by Lambert, seconded by Brown that the Parks Needs Study Committee be appointed as recommended by the Park and Recrea tion.Commission -: carried; Brown, Lambert, Larson, Lust and Robinson voting aye by voice vote. City Manager McMicken referred to Petition No. 659, Notice of Intention to Commence Annexation Proceedings, filed , by Howard Hettinger on.April 27, 1970, which matter had been continued to this meeting. .He stated that theletter from Howard Hettinger dated May 5, 1970, requesting that said petition for annexation be withdrawn, is being brought to the attention the Council as a matter of information and no further Council action is required. .. ; City Manager McMicken referred,to the outside'.City utility request by R.M.R. Company • for Sanitary Sewer and Domestic Water located at South 48th and Nob Hill Boulevard and the Staff Report from the Planning and Community Development Department which recommends denial of this application. Mr.' Ed Loidhamer, Principal Planner explained "that the applicants plan to build an 84 -unit apartment complex, which the Planning Staff contends does not conform with the General Plan. Mr. W.B. McLain filed with the City Clerk at this time, a copy of a Petition which had been filed with the Planning Commission, signed by 66 property owners in this vicinity objecting to this application for outside City ' . Keith and McNeice absent. • City Manager McMicken referred to his Report ##84, Systems Development and Data Pro- cessing which reviews the data processing method now being used primarily for utility billing and indicates that it is time to move from this slower and more mechanical data processing method to the faster, more sophisticated electronic computer method. His report further gives a summary of what is needed and the steps that•should be taken to proceed with our conversion to computer services. McMicken referred to his Report #85, Police Manpower and Equipment, which explains that in accordance with the City Council's policy, statement regarding use of new sales tax revenues, and a report being requested on th,e sufficiency of police Man- power and equipment, the Chief of Police has requested six men and four automobiles to be added to the Department effective July 1, 1970, City Manager recommending that this request be granted, it was MOVED by Lambert, seconded by Robinson that the proper legis- lation be prepared in accordance with the recommendation of the City Manager: carried, Brown, Lambert, Larson, Lust and Robinson voting aye by voice vote. City Manager McMicken explained that it is necessary to repeal Resolution No. D -1457, adopted March 16, 1970, entitled "A Resolution of Intention to create a_Local Improvement District and setting the date for a public hearing ", which district has subsequently been created by Ordinance No. 1220, passed May 11, 1970, pursuant to Resolution No. D -1473, so that no Local Improvement District will. now be created pursuant to,Resolution No. D -1457. City Manager McMicken explained that it is necessary to purchase an electric typewriter for the'Planning Department, which funds have been made available for that purpose by . a transfer of funds effected by Resolution No. D -1458, adopted March 16, 1970. He further explained that this typewriter isavailable from one source only and recommends that it be purchased without calling for bids.
