The City Council met in regular session, Mayor Larson presiding„ Councilmen Brown, Keith, Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney. Andrews present on roll call. . . The Invocation was given by Councilman Brown. The minutes of the regular meeting of March 23, 1970, having been duly certified accurate • by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the continuation of the Hearing on Resolution of Intention No. D -1457, to make certain improvements adjacent Yakima Mall, and City Attorney Andrews _explaining that the required waivers have not yet been received, it was MOVED by McNeice, seconded by Lust that this matter be further continued for one week: carried, Brown, Keith Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. • This being the time fixed for the Hearing on Petition No. 653, filed by L.O. Beaver, requesting Vacation of a portion of street right -of- way located east of Glenn Drive between Summitview and Chestnut, it was MOVED by Brown, seconded by Keith that an Ordinance pro - viding for saidyacation, be passed as read. Principal Planner Ed Loidhamer reviewed this matter, stating that it was considered at the Planning Commission meeting on February 19, 1970. Be referred to a map showing the proposed vacation area, pointing out that the majority of the area is single family residential. He stated that, the General Plan for the City shows that this street will not be anything other than a general street. He further stated that the matter had been referred to the utility companies and they indi- cated that they have no use for the right-of-way and no objection to the vacation. 'Mr Loidhamer reported that the planning Staff and Planning Commission recommended that this vacation be approved providing the applicant agrees in :writing to assume the costs of • • „ relocation of the existing irrigation line and provide the proper utility easement. Mr. Howard Hettinger, Attorney'representing Mr. Beaver, explained that if this vacation is approved, Mr. Beaver plans ,to_sell these three lots to a Mr. English who will build an apartment building through the center of these lots. He further explained that his client does not object to the conditions to the granting of the vacation, but that the relocating of the irrigation line is causing some problem because of the cost, which has been esti- mated at between $2500'and $3000, and would like this matter continued to see if something less costly can be,arranged After due discussion, it was MOVED by Brown,. seconded by McNeice that this hearing be continued for one week to work -out the irrigation problem: carried, Brown, Keith, Lambert, Larson, Lust,. McNeice and Robinson voting aye.by voice vote. • . • This being the time fixed for the Hearing'on 'the Appeal from the Planning Commission's decision in denying the Rezone Application of James M.'NewBorn & Others, requesting rezone of property.located at 1315 S. 6th Street, and' Mr. Howard Hettinger, Attorney, repre- senting the applicants, requesting that this matter be continued for one week, it was MOVED by Lust, seconded by McNeice that this Hearing be continued for one week: carried, Brown,.Keith Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. • A Damage Claim having been filed with the City Clerk on March 24, 1970, by Leo Schmig, 3404 Lower Ahtanum, Yakima, for damages to his automobile in the amount of $76.70, caused by a City vehicle, it was MOVED by McNeice, seconded by Lust that said Damage claim be referred to the City Manager and staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Petition No. 656, having been filed with the -City Clerk on March 27, 1970, by Robert K. Cain & Others, requesting improvement of property by paving the Alley between 17th and 18th Avehues, Tieton Drive to MacLaren Street,', it was MOVED by Brown, seconded by Lambert that'said Petition be'referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. It was MOVED by Keith, seconded by,McNeice that Ordinance No. 1215 relating to the classi- fication plan and salary ranges and amending the Yakima Municipal Code, be passed as read: . carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll • call. City Manager McMicken explained that this Ordinance_provides for two changes in . the Code in that -it adds the position of Administrative Assistant and increases the salary of the Pro Shop Manager at Fisher Golf Park, to bring her salary in line with other City employees by giving her a 7 increase in salary. . • ORDINANCE NO. 1215, AN ORDINANCE adopting a classification plan and salary ranges for certain City employees; amending Subsection 2.20.100 (a) of the City of Yakima Municipal • Code; and declaring an emergency: Dr. Omar H. Scheidt, President, Yakima Valley „College,•being. present, submitted for,.the • consideration of the Council, Community College proposal for•;joint funding of a pedestrian overpass to :-be located near Nob Hill Boulevard and South 14th Avenue. He explained that their proposal is that the City of Yakima participate in the funding for the. construction of said overpass; that such•participation be on the basis of equal cost sharing, present estimates indicating that'the City's share would be between $45,000 and $60,000. He•referred to a model of the proposed pedestrian overpass and the report giving design development plans and maps prepared by Doudna and Williams, Architects. Mr. Williams, being present reviewed the'proposed plans and explained the substantiating data in the report which indicates the necessity for such an overpass being constructed. Mr. AlexDeccio, Yakima Valley College School Board, explained that some Federal Funds will be available, but additional funds will be needed and are requesting that the City share . in the cost of this overpass.” Council members'indicating that they would like to have some more information regarding similar overpasses in other College, areas and also thlt :F. 1 • AA � / • 34 MARCH 30, 1970 they will need to study the city finances further to see if there will be any funds avail- able to share in the cost of this project, it was MOVED by Keith, seconded by Lambert that this matter be referred to the City Manager and Staff for further study: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Council members indicated that they would like to meet with College personnel regarding this matter. Mr. Garrett Anderson, a former City employee, and interested citizen, to the new 1./2 sales tax that will be in force on April 1, 1970, and stated that he realizes it is necessary to have some of these taxes, but is interested in eliminating what he termed unnecessary taxes, such as the utility taxes. Council members indicated that they will study this matter, but feel that at the present time, the City is not secure enough in future financing to remove any of the present sources of revenue. City Manager McMicken referred to the matter of executing an agreement with Southeast Yakima Community at Work,;,Inc „ to lease premises, and indicated that there are many in- terested parties present at this meeting regarding the proposed Center. He explained that the contemplated community center facility which is to be constructed on property owned by the City, and financed in part by a federal grant, for which grant application is being made by the City, is to be leased to the Southeast Yakima Community at Work in accordance with the provisions of a proposed lease agreement which is a part of the app- lication. He further explained that an executed copy; of the lease agreement must be included as a part of the application. After due discussion, it was MOVED by Keith, seconded by McNeice that Resolution. No. D -1467 authorizing the execution of an agreement leasing community center property and facilities to Southeast Yakima Community at Work, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1467, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an agreement leasing community center property and facilities to Southeast Yakima Community at Work. Homer Matson of the Planning Department referred to the proposed Application (Part II) and reviewed the proper procedures in submitting said Application to the Department of Housing and-Urban Development, He referred to the letter of .endorsement of these plans from the Park and Recreation Commission.' Mr. Hanry Beauchampiresenting the Southeast Community Board, was present to speak in favor of submitting this application. Mr. Williams of Doudna & Williams, Architects on this project, was to answer any questions regarding the Center, stating that since he had presented the preliminaryplan at the previous meeting he would not repeat this presentation but would be glad to answer any questions. After due discussion, it was MOVED by Keith, . seconded by McNeice that authorization be given to submit Application (Part II) to the Department of Housing and Urban Development: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken referred to the letter from the Federal Aviation Administration ' giving notice of final payment for Airport Improvements and disallowing $26,235.59. He indicated that this is being brought to the attention of the Council as a matter of in- formation. Public Works Director John Mayo reviewed this situation and the portions of the claim that were disallowed. He reported that in June of 1967, the City submitted a project application for funds in the amount of $776,397, which was approved by F.A.A. and favorably received. He further reported that at the bid opening of July 18, 1967, the bids were lower than anticipated, which made the requested grant funds lower in the amount of $560,287, and then by doing some of the work with our own forces, the final grant claim was for $481,373. Mr. Mayo stated that it was very disappointing to get this report from the F.A.A. and find that some of the requested funds had been disallowed, when the final grant request had been cut from the original request of $776.397, which had been approved, to $481,373, and feels that some further attempt should be made to obtain the original amount requested. Council members indicated that they feel a further attempt should be made to obtain these funds. No formal action was taken at this meeting. City Manager McMicken reported that bids were received and considered by a bid board on March 23, 1970, on L.I.D. . No. 977, Fruitvale- Franklin Domestic Water District as follows: DeBlasio Construction Co., Inc., Parker $29,937.58 A.V. DeBlasio Construction, Yakima 31,364.21 Bills Septic Service 31,547.51 The City Engineer recommending' that the contract be awarded to DeBlasio Construction Company, Inc., the low bidder on this project, it was MOVED by Keith, seconded by Lust that therecommendation of the City Engineer be accepted and that the bid be awarded to DeBlasio Construction Company, Inc., in the amount of $29,937,58, and that the City Manager be authorized to enter into a contract with said Contractor upon the ,filing of the proper bond and insurance: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken explaining that it is necessary that the City purchase Scotchlite sign facing material and aluminum sign blanks throughout the year, and that the Scotch - lite material can be obtained from one source only and the aluminum sign blanks must be purchased on short notice, authorization is requested to purchase this material without calling for bids. After due discussion, in which Councilman Robinson indicated that he would like to have the matter of the purchase of aluminum sign blanks, analyzed before this matter comes up in another year, it was MOVED by Brown, seconded by Keith that Resolution No. D -1468 authorizing the purchase of said sign materials without calling for 'bids, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robin- son voting'aye on roll call. - r ,.` MARCH 30, 1.970 . City Manager McMicken referred to his report 475 - Department of Planning and Community Development Status Report and stated that this report is a status report of the Depart- ment of Planning and Community Development for the information of the Council and no formal action is needed. - • City Manager McMicken referred to his Report #76 - Holiday Leave for Firemen, which'ex- plained that when the holiday rule was amended to follow State 'Statutes---making Us con - sistent with State and County practice to increase holiday leave from 8 to 11 days per . year, it affected police and general government employees, and firemen working 40 -hour ' week, but did not change the rule.affecting firemen.working 24 -hour shifts. He further explained that the firemen presently receive 3 shifts off per year in lieu of holidays, or 72 hours and the eleven.holidays that other employees get represents 88. hours. He stated that an extra shift off in lieu of holidays, representing 96 hours, would more fairly equate the holiday'rule between, firemen and other City employees and recommends that the Yakima Municipal ,Code be.amended to.provide each firemen working 24 -hour shifts with 4 days off with pay:per year in lieu of holidays. He.further explained that this . rule change has the endorsement of the Yakima Fire Fighters' Association. After due ! discussion, it MOVED by Robinson, seconded by that'an Ordinance be prepared to amend the Yakima Municipal Code to provide. each .fireman working 24 -hour shifts with 4 days off with pay'per year in lieu of holidays, as recommended by the City Manager's Report: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. city . Manager McMicken:requesting that 'be given for the Purchasing Agent to - attend the Northwest . Purchasing Agents' Association•meeting in Victoria, B.C., April 8 to 10, .1970, it was MOVED by Keith, seconded by Lust that said travel be allowed with expen- ses paid: .carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by void vote.. - . Mr. Larry Robinson, being present, asked the Council. if. there is any Urban Renewal and relocating of families being contemplated. He indicated .he had information that such a program is contemplated, and asked assurance of the Council that Yakima is not con - sidering an Urban Renewal program. Council members. indicated that they are not aware of any Urban Renewal program being contemplated, and stated that the only relocation of families that is being done is in connection with the relocation of two families now livinc on 'the siteof the planned Southeast Yakima'Community Center. They further indicated that they encourage. improvement of property wherever it is needed, but do not have anything planned in the. way of an Urban Renewal Program and urged Mr. Robinson to help clear up any confusion regarding this matter when he is talking to others. . • There being no further business to come before the Council,. it was MOVED by Lust, seconded by McNeice that we do now adjourn at the hour of 5:30 P.M.: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. .
