MARCH 9, 1970

The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith,
. Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney Andrews pre -
sent on roll call.
The Invocation was given by Councilman Lust. •

The minutes of the regular meeting of March 2, 1970, having been duly certified accurate
by two Councilmen, and no one present wishing to have said minutes read pub Mayor
Larson declared said minutes approved as recorded.
This being the time fixed for the Hearing on the Confirmation of the Irrigation Mainten-
ance Assessment Roll for the year 1970, it was MOVED by Brown, seconded by Keith that
• Ordinance No. 1207 confirming said assessment roll be passed as read. Public Utilities
Director Frank Stein reported that there is no increase in rates for 1970. He stated that
they are the same.as last year except that there has been a reduction in four of the
districts'. He referred to his Memo and Tabulation of the 1969 Income and Expenses in the
various Irrigation Districts, copies of were available to those present at this
meeting. ,Those present and asking questions regarding improvements, maintenance and dis-
cussing other problems with Mr. Stein such as .cost and water pressure, reside at the
following addresses: 13 North llth Street', 707 North Naches, 108 South 6th Street,
1501 West Chestnut, 1010 South 24th Avenue, 613 North 6th Street, 1018 South 25th Avenue,
708 South 6th Street, 523 South.Naches, 710 South 7th Street, and 723 South 7th Street,
most of them being in District 308, the General System, which has had to have extensive
repairs to keep this system in operation. After due discussion, Mayor Larson called for
the roll call vote on the Motion to pass Ordinance No. 1207 confirming the Irrigation
Maintenance Assessment Roll for the Calendar year 1970, and it carried, Brown, Keith, Lam= •
bert, Larson, Lust, McNeice and Robinson voting aye on roll call.
ORDINANCE NO. 1207, AN ORDINANCE confirming the irrigation maintenance assessment roll
of the City of Yakima for the year 1970, and levying irrigation maintenance assess-
ments according to such roll and declaring an emergency. .
This being the time fixed for the Hearing on a Resolution of Intention to vacate a portion

of South 6th Street, it was MOVED by Lust, -seconded by Keith that an Ordinance providing
for said vacation,,be passed as read. Principal Planner Ed Loidhamer reviewed this. matter
stating that Hahn Motor Company, would like this vacation so the property could be used in
conjunction with their property. Mr. Loidhamer indicated that it is the intention of the
City of Yakima to trade the property for further right -of -way on Washington Avenue. He
reported that the proposed vacation has been referred to all departments within the City
. of Yakima that would be affected by this vacation, and in addition, the public utility
companies have also been contacted. ,Mr. Loidhamer further reported that based on the
study of the proposed'vacation and its affect on other City departments and public utility
• companies, the Staff recommends that •the' vacation of South 6.th•Street, south of its inter-
section with Washington; Street, be approved, provided: '(1) Right -of -way easements for
existing utilities 'be obtained, and (2) , the existing'wood irrigation pipe located in this
portion of 6th Street be replaced with asbestos cement pipe, and such replacement be at
the expense of the Hahn Motor Company'. Public Works Director'John Mayo referred to a map
of this proposed vacation and pointed out to the Council members; the'proposed vacation
area, the proposed dedication and utility lines., Discussion brought out questions regard- -
ing Hahn Motor Company using this jprbperty• for a used car lot if' tie v is granted,
and Mr. Loidhamer reported that property'is,zoned. for apartments and they would have
to request rezoning to Use it for a used car business. Council members asked if the ease-
ments have been obtained and some sort of commitment made by Hahn Motor Company for re-
placing the existing wood irrigation pipe. City Attorney Andrews stated that the matter
.of the reservation of easements for existing facilities is provided'fbr in the Ordinance
that has 'been read, but the matter of the replacement of the pipe might better be handled,
rather than including it in this Ordinance, by some kind of ancillary agreement and have
it executed prior to the Vacation.', After due :.discussion, -..it was MOVED by Robinson, secon-
ded by Keith that this matter be continued for one week or until March 16, 1970; to inves-
tigate the matter further and have the proper agreements preapred: carried, Brown, Keith,
Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.
Damage Claims having been filed with the City Clerk on March 5, 1970, by John E. Jillson,
204 South 8th Avenue for :_damages to his car by a City vehicle, and Florence L. Barber,
P.O. Box 136, White °Swan, for damages caused by a collision in a Funeral Procession, it
was MOVED by Lambert, seconded by Robinson that said damage claims be referred to the City
.Manager and Staff for study and recommendation: carried,. Brown, Keith, Lambert, Larson,
Lust, McNeice and Robinson voting aye by voice vote.
In. accordance with action taken by the Council at the regular meeting March 2, 1970,
and an Ordinance having been prepared. :relating to..licensing of tain amusement'devices-
on a six -month basis, it was MOVED by Brown, seconded by Robinson that Ordinance No. 1208
relating to the licensing,of said amusement devices and amending the Yakima Municipal Code, '
' be passed as read.: carried,.Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson
voting aye on roll call. • r

5.12.020 of the City of Yakima Municipal Code; and declaring an emergency.

It was MOVED by Robinson, seconded by McNeice that the report of the City Treasurer dated
February 28, 1970 regarding the investments of the City of Yakima, .be accepted and approved:
carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice
vote. •
City Manager McMicken referring to the matter of the authorization to call for bids on "B"
' Street and Lincoln Avenue Overpass Project, stated that since the plans and specifications
were adopted by Council action on December 19, 1969, some revisionshave been made and that
these plans are still with the consulting engineers, but shortly will be in a form ready
for distribution to bidders. He reported that in consulting with the City Clerk and Public •
Works Director, a schedule for calling for bids on this project has been worked out, which
does not normally require Council approval, but since this - is a two million dollar project,
he recommended that the Council authorize the call for bids on this project as revised up
to this date, according to the following schedule: the call for bids will be published
on March 12, 19, and 26, 1970; the plans and specifications will be.available to prospec-
tive bidders no later than March 30, 1970; bids will be opened on April 23, 1970; and the
bid award will be made no later than May 18, 1970. After due discussion, it was MOVED by
Robinson, seconded by Brown that authorization be given to call for bids on the "B" Street
and Avenue Bridge Overcrossings•in accordance with -the recommendation of the City
Manager and Staff: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson
voting aye by voice vote.'

Councilman Robinson excused at -4 :30 P.M. '
City Manager McMicken referred to the matter of limiting the number of taxicab, stands in
a block, stating that a Petition was received on,November 18, 1969, -from Mr. Walt Mabry
at 10 North 1st Street and other owners of most of the businesses in that block - the west
side of North 1st Street between Yakima Avenue and "A" Street, that protested the large
number of taxicab: stands in their area. Mr. McMicken reported that there are 8 to 15 curb
spaces assigned as taxicab zones in this one block. He further reported that the Public
Works Director, Traffic Engineer and other Staff members have been working for some time
on a solution to this problem and they are recommending that the Yakima Municipal Code be
amended to be more specific in its delegation of authority to the Traffic Engineer to
specify taxicab zones, and delete the references of obtaining the consent of the abutting
property owners. In submitting a proposed ordinance to amend the Code regarding this
matter, City Attorney Andrews explained that there is nothing•in the general law which
requires consent of a property owner in order to designate a parking space.as a taxicab
stand. Public Works Director John•Mayo referred to a map of this area, pointing out the
taxicab stands and reviewing the Staff's investigation of this matter.' Mr.Mark Fortier,
Attorney, representing Mrs. Al Kauzlarich, Taxi Company Owner, Mrs. Kauzlarich, and Mr.
Robert Kellett, Taxi Company Owner,, were present to speak in favor ofleaving the taxicab
stands as they are. Mr. Walt Mabry,and Mr. James Chapman, property owners in this area,
being present, indicated that.they feel there are too many taxicabs stands in this area at
the present time and stated that there is no space for them to use as,a loading zone for
their own businesses. After due discussion, it was MOVED by Lambert, seconded by Lust
that this matter be continued for further study and recommendation: carried, Brown, Keith,
Lambert, Larson, Lust and McNeice voting aye by voice vote. Robinsrn absent.
City Manager McMicken referring to Petition No. 653, filed by L.O. Beaver, requesting
Vacation of a portion of street right -of -way located east of Glenn Drive between Summitview
and Chestnut, it was MOVED by Lambert, seconded by Lust:that Resolution No. D -1453 fixing
the time of Hearing on said petition for Vacation for March 30, , 1970, be passed as read:
carried, Brown,. Keith, Lambert, Larson, Lust, and McNeice voting aye on roll call. Robin-
son absent. .

City Manager McMicken reported that in accordance with action taken by the Council on July
22, 1969, when amatter of a drainage problem on 18th Avenue, North of Summitview, had been
brought before the Council by property owners in the area, and the City Manager and Staff
were directed to proceed to do what had to be done to correct this problem, a new drain
has been installed and is working and will be taking the water into the canal this summer.
City Manager McMicken reporting that the Council-needs to appoint a representative to the
Mayor's Committee on Human Rights to fill the vacancy caused by the resignation of Reverend
Jesse Boyd and recommending that Reverend Edward G. Melfort be appointed, it was MOVED by
McNeice, seconded'by Lust that Reverend Edward G. Melfort be appointed to the Mayor's Commi-
ttee on Human Rights: carried, Brown, Lambert, Larson, Lust and McNeice voting aye by voice
vote. Keith and Robinson absent.
City Manager McMicken reporting that a Council representative needs to be appointed to the
• Yakima Planning Commission, to fill the unexpired term of Max Vincent, who resigned re-
. cently, and indicating that Mr. Don Schufl..er, Attorney, is willing to fill this position,
it was MOVED by Lambert, seconded by Brown that Mr. Don W. Schussler'be appointed to fill •
the unexpired term of Max Vincent on the Planning Commission, which term will expire on
August 31, 1972: carried, Brown, Lambert, Larson, Lust and McNeice voting aye by voice
vote. Keith and Robinson absent. • •
There being no further business to come before the Council, it MOVEDby Lust, seconded
by McNeice thatwe do now adjourn at the hour of 5:15 P.M.: carried, Brown, Lambert, Larson,
