HomeMy WebLinkAbout03/02/1970 Business Meeting MARCH 2, 1970 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert,' Lust, McNeice and Robinson, City Manager McMicken and City, Attorney Andrews presa on roll call. . The Invocation was given by Councilman Keith. The minutes of the .regular meeting of February 24, 1970, having been duly.certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . Petition No. 654, having been filed with the City Clerk. on February 24, 1970, by C. Josephine Hammond and Kenneth R. and Wilma Hull, requesting vacation of a portion of Willow Street, it was Moved. by McNeice,'seconded by Lust that said. Petition be referred to the City Manager and ,Planning Commission for study and recommendation: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. A report having been received from the Planning Commission on the matter of the vacation. of a portion of South 6th Street, it was noted that a public hearing was previously set.. for March 9, 1970, by Resolution No. D -1445, adopted February 16, 1970, and no formal ' action is necessary at this meeting. . A report having been received from the Planning Commission.on Petition No. 653, filed by . L. 0. Beaver, requesting Vacation of a portion of street right -of -way located east of Glenn Drive between Summitview and Chestnut, it was MOVED by Robinson,. seconded by Brown that a resolution be prepared setting March 30, 1970, as the time.for a hearing.by'the City Council on said Petition::carried,'Brown, Keith, Lambert,'Larson, Lust,' McNeice and Robinson voting aye by voice vote. 0 Reports having been received from. the Planning Commission on. Resolution of Intention to rezone property located at 402 -412 S. 12th.Avenue, Resolution of Intention to amend Zoning Ordinance Section 12.28.010 (2) regarding orthopedic uses in a B -1 Zone, and Resolution of Intention to amend Zoning Ordinance,,Section 12.60.230 regarding height of fences, wall or hedges in. residential zone, . it was MOVED by Robinson, seconded by Brown that March 16, 1970, be set as the time for hearings on these matters and that the City Clerk give notice of such hearings as required by law: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported that bids,were received and considered by a Bid Board on February, 26, 1970, for the construction of Irrigation Pipeline, South 24th Avenue Arterial Improvement, as follows: . . . DeBlasio•Const.•Co., Inc. $28,417.50 . Ray C. Pickens, Inc. 35,057.41 Bill's Septic Service . 36, 567.50 . Excavo, Inc., Wn. 42,251.00: . • The City Engineer recommending that the contract be awarded to DeBlasio Construction Company, Inc., the low bidder on this project, subject to the approval of the U.A.B. Board, it was MOVED by Robinson, seconded by.Lambert that the recommendation of the.City Engineer be accepted, subject to approval of the U.A.B. Board, and that the bid be awarded to DeBlasio Construction Co., Inc., in the amount of $28,417.50, and that the City Manager be authorized to enter into a contract with said contractor upon_the filing of the proper bond and insurance: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager_McMicken.reported that in accordance with action taken by the City Council at the meeting of February 24, 1970, the matter of a request for semi - annual licensing of . pinball amusement devices has been studied by the Staff. He circulated a report giving the number of machines licensed by. the .two larger operators in the City during.the.first six months of 1969 and the second six months of 1969. There was some discussion about . amending the Yakima Municipal Code to allow the semi - annual licensing of said machines, charging $100 per machine each six months instead of $200 per machine for the entire year, which is paid annually. Mr. McMicken stated that the Staff recommends that the $200 per machine per year should still be the fee,.but that an amendment to the Yakima Municipal Code be prepared to allow this to be paid semi - annually indicating that this would benefit the person obtaining licenses at the beginning of the licensing period but not the ones licensing in the middle of the licensing period. Council members indicated that they felt that the full yearly fee should not be charged if the machines are.used only six months in a year and recommended that the Yakima Municipal Code be amended to change the fee to $100 per machine per each six -month period. After due discussion, it was MOVED by Robinson, seconded by Lust that an Ordinance be prepared amending the Yakima Municipal Code to make this change to $100 per machine per six -month period: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported that in addition to the Preliminary Land Use Plan for Nob Hill Boulevard that was reviewed at the previous meeting of February 24, 1970, a Pre- liminary Land Use Plan for Vicinity of Yakima Valley College'has been prepared by the De= partment of Planning and Community Development. Mr. Ed Loidhamer of the Planning Depart- ment reported that the purpose of this report is to analyze and give direction to policy concerning the development of multi - family housing in the vicinity of Yakima Valley College. He stated that during the past few years, some interest has been expressed in constructing apartments near the college. Mr. Loidhamer reported that several requests for zone changes to permit multi - family dwellings have been considered by the City Plan- • ning Commission, some of which have been granted by the City and others have been denied. He indicated that it seems reasonably clear that a need for multiple housing exists which presently has not been fulfilled and that the purpose of this study, therefore, is to analyze present conditions and attempt to determine areas most appropriate and feasible for multi - family development. Mr. Loidhamer reported that the area delineated for the purpose of this study is bound on the north by Tieton Drive, on the south by Logan Avenue, and extends east west between South Avenue and South 20th Avenue. He further explained that the Department of Planning and Community Development recommends that the General Plan revisions suggested in this report be adopted after a public hearing by the Yakima City Planning Commission and Yakima City Council as amendments to the General Plan for the City of Yakima. Dr. George Pennell, Administrative Assistant, Yakima Valley 20 MARCH 2, 1970 . College and Alex Deccio, Chairman of the Board of Directors, were present at this meeting. Dr. Pennell indicated that studies have been made regarding adding to the College, but that any plans that the College might make will be submitted to the Planning Commission. After discussion by Council members, City Manager McMicken stated that these two reports have been submitted for the information of the Council and the next action probably. will be a public hearing. City Manager McMicken stated that in accordance with action taken by the Council on Feb- ruary 24, 1970, the matter of a violation of the City's zoning code re Shorty's'Used Car Lot at 702 N. 1st Street, has been investigated. He reported that this business has been issued a Yakima City general business license for a Gas Station, but it was found that it is now also a' Used Car Lot, which is non - conforming, and a sign has been erected contrary to the requirements of the City. Chief Inspector Newell Pock reported that Mr. Kinnard is looking for another site for his business. It was suggested by Council members that the . time be extended from the previously requested 10 days to 30 days for Mr. Kinnard to re- solve this problem. City Manager McMicken reported that because the Metropolitan Park District has been dis- solved and the activities taken over by the City of Yakima, it is necessary to make changes in an application for a grant by the Housing and Home Finance Administration for acquisi- tion of land for the Southeast Community Center Park. In accordance with instructions from the Department of Housing and Urban Development, that the .City execute a resolution author- izing the submission of an application, complete a new Form 6600 and submit an opinion of counsel, it was MOVED by Brown, seconded by Keith that Resolution No. D -1450 directing the filing of said application and following the other requested requirements, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1450, A RESOLUTION directing the City Manager of the City of Yakima to file an application for the City of Yakima with the Housing and Home Finance Agency. City Manager McMicken reported that Petition No. 655, was filed with the City Clerk on February 27, 1970, by Thomas C. Bostic; President, for'the Yakima Mall - Shopping Center Corporation, requesting the formation a Local Improvement District for certain utility and construction work, but was not received in time to put on the Council Agenda. He explained that City Attorney Andrews has found that there is no reason why this cannot be accomplished. After due discussion, it was MOVED by'Lambert, seconded by Robinson that this matter be referred to the City Manager and Staff for study and recommendation: carried, Brown., Keith, Lambert, Larson,•Lust, McNeice and Robinson. voting aye by voice vote. City Manager McMicken explaining that Park Director William Hutsinpiller has received notification of the award of a grant to help finance the Yakima Community Center for Senior Citizens and it is necessary to accept the grant award by executing and filing with the appropriate government agency the grant award document, it was MOVED by Robinson, seconded by Keith that Resolution No. D-1451 authorizing the execution of said documents, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. • • RESOLUTION NO. D -1451, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to.accept a grant award for the Yakima Community for Senior Citizens project. • City Manager McMicken explaining that in accordance with Resolution No. D -949, adopted May 9, 1966, the City executed an Agreement to Furnish Engineering Services to the City of Yakima, Washington, for Water System Improvements with Cornell, Howland, Hayes & Merry- . field, and they now desire to modify that agreement as provided by a letter addressed to , John Mayo, Director of Public Works, it was MOVED by Brown, seconded by Lust that Resolu- tion No. D -1452 authorizing modifications to said Agreement, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. Public Works Director John Mayo explained that these modifications are in connection with the • engineering services for design of the.telemetering system, and are necessary to extend the terms of the contract and to allow for increases in prices and wages.
