The City Council met in regular session,.Mayor Larson presiding ,:Counciimen
Lambert,.Lust, McNeice and Robinson, City Manager McMicken,and City Attorney Andrews:
present on roll call. ..
The Invocation was given by Councilman,Lambert.
The minutes of the regular meeting of January 26, 1970, having been duly certified accurate
. by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded.
In accordance with the action taken by the City Council at the last regular meeting of
January 26,.1970, and the matter of an Ordinance relating to working hours, leaves of ab-
sence and overtime compensation for City employees, having been continued to this date to
allow for further study and preparation, it was:MOVED by Brown, seconded by Lambert that.
Ordinance No. 1203 relating to City employees and amending the Yakima Municipal Code, be
passed as read. City Manager McMicken stated that approval of this.Ordinance has been
received from the two Unions and explained briefly the change s ,being. made , in the' Code re-
garding working hours, leaves of absence and overtime-compensation-for City employees.
After due discussion, Mayor Larson called for the roll call vote on the Motion to pass
Ordinance No. 1203 relating .to said matters and it- carried', Keith-, . Lambert, Larson,
Lust, McNeice and Robinson voting aye on roll call.
ORDINANCE NO. 1203,. AN ORDINANCE relating to city employees specifying working' hours,
leaves of absence and overtime compensation; amending Sections 2.22.'030, 2.40.080 E,
2.40.080 H, 2.40.090 A and 2.40.100 of the City of Yakima Municipal Code; and declaring an
emergency.

It was MOVED by Robinson, seconded by Lambert that the report of the City Treasurer dated
January 31, 1970, regarding the investments of the City of Yakima, be accepted and approv-
ed: carried, Brown,.Keith, Lambert,-Larson, Lust, McNeice and Robinson voting aye by voice
vote.
FEBRUARY 2, 1970
In accordance with action taken by the City Council on January 26, 1970, when a request •
was made by Mr. Gary Jackson of the Yakima Valley Sun for certain Ordinances to be changed
so that weekly papers as well as the daily paper can bid on the City's legal advertising,
and the matter having been referred to the City Manager and City Attorney for further
study, City Manager McMicken explained that the wording in the City Clerk's Notice calling
for bids has been changed to allow both weekly and daily newspapers to bid. He further
explained that the City Attorney advises that in the event a weekly paper is awarded the
bid, then there can be brought before the Council the two Ordinance changes that will need
to be made which will allow the weekly paper to print the City's legal advertising. Mr. '
McMicken further explaining that it is necessary for the City Council to pass a resolution
prescribing the form of contract for City advertising for the ensuing year, it was MOVED
by Robinson, seconded by McNeice that Resolution No. D -1439 prescribing a form of contract

RESOLUTION NO. D- 1439, -A RESOLUTION prescribing a form of contract for City advertising
and directing publication of notice for proposals. .
City Manager McMicken reported that in the widening and improving of a portion of South
24th Avenue, the negotiations have been completed with two additional property owners for
the purchase of right-of-way and recommended that the City Council authorize the purchase
of said property. Council members asked questions regarding•the status of the balance of
the parcels of right-of-way that will need to be purchased to complete this project, and
how long it will take. Public Works Director John Mayo reported that there are 22 parcels
involved, of which 8 have been negotiated, 2 are being negotiated on a staff basis, and of
the 12 left, Mr. George'Lemon has 5 on which he is negotiating and on the remaining 7, the
Titles are being obtained; and that it, should take approximately two or three weeks to
complete all negotiations. After due discussion, it was MOVED by Brown, seconded by Mc-
Neice, that Resolution No. -D -1440 authorizing the purchase of said right -of -way, be passed
as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on

City Manager McMicken referred to his ReportA$70, Water System Improvements and the attach-
ed Memo, Water Improvement Fund Expenditure Summary prepared by Director of Public Works
u, John Mayo, which outlines the remaining work to be done and the approximate costs antici-
�4,4 pated on the improvements being made to the domestic water system. He stated that the
next, step to be taken is to purchase the reservoir site at the northeast corner of the
�!� intersection of 40th Avenue and Englewood Avenue for which there are funds available in
the Water Improvement Fund. Mr. McMicken recommended that in line with the advice of the
°• Director of Public Works, that the City Council authorize the purchase of this site. He

WN explained that he would then have an expert appraisal * made of the site and its improve-
ments, negotiate with the owners and bring back to the Council a recommended purchase of
s ?,W< the property. After due discussion, it was MOVED by Robinson, seconded'by Lambert that
; the City Manager and Staff be authorized to proceed with arranging for the purchase
; this property and the appraisal as recommended by the City Manager's Report ##70: carried,
Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.
• City Manager McMicken explained the procedures of putting fire and police candidates on
the Civil Service Registers, and stated that there have been some recent changes which are
intended to make the program more flexible so that an applicant doesn't have to wait so
long, but will have an immediate scheduling for a written test. He reported that the Fire
Department is now at full strength and the Police Department is short one person. There
was some discussion regarding Civil Service procedures and educational requirements for
uniformed personnel.
City Manager McMicken reported on the Status of Local Improvement• Districts, stating that
in 1965 there was activity in 16 Districts; in 1966, in 15 Districts; 1967,. in 11 Dist-
ricts; 1968, in 11 Districts;and.in 1969, there was activity in only two Local Improvement
Districts. He stated that the slow down in home building and annexation activity affected
the L.I.D. picture in 1969.
.City Manager McMicken referred to the Land Use Coding Manual and Preliminary Report on the
East Yakima Housing and Environmental Surveys, copies of which have been presented to City
Council members. Mr. Bruce Finke, Director of Planning and Community Development explained
that the Land Use Coding Manual is a report which indicates the procedures which were used
by the Staff in conducting 'a survey this last summer. He stated that copies of this report
will be filed with the State as part of the documentation of the completion of this phase
of the 701 Project. He reported that the Department of Planning and Community Development
is carrying out a. twelve month study of housing conditions and needs in East Yakima, which
study is being carried out in three parts: (1) a survey of residential structural condi-
tion; (2) a survey of environmental conditions in residential areas; and (3) a question-
naire survey of 10% of household heads in East Yakima, concerning housing and neighborhood
needs, problems and attitudes. Mr. Homer Matson, Associate Planner, referred to two maps
of the East Yakima area and explained how the survey evaluated the structures. After some
discussion, City Manager McMicken stated that the reports and maps have been presented for
the information of the City Council and that there probably will be some publicity about
the program, but that no action by the Council is required at this time.
City Manager McMicken requesting authorization for out -of -State travel for Mr. Emil Kissel,
Assistant Park Director, to attend the Northwest Tree Conference in Vancouver, B.C.,
February 11 - 14, 1970, at an approximate cost of $150.00, it was MOVED by Robinson,
seconded by Lust that said travel be allowed with expenses paid: carried, Brown, Keith,
Lambert, Larson,•Lust, McNeice and Robinson voting aye by voice vote.
City Manager McMicken requesting authorization for ..Fire Chief Shockley to travel to Los
Angeles, California to inspect a Yankee Walter crash truck, at no cost to the City, it
was MOVED by•Keith, seconded by Robinson that said travel for Chief Shockley be allowed:
carried, Brown,- Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice
vote.

City Manager McMicken explaining that by Resolution No. D -1285, as amended by Resolution
No. D -1391, a ,temporary loan was authorized from the Water-Sewer. Fund to the Airport Im-
provement Fund to be repaid with interest on or before December 16, 1969, and that such
repayment was'not made and cannot be made because a federal grant anticipated to be paid
to the Airport Improvement Fund to apply to the repayment of said loan, has not been re-
ceived by the City, and recommending that said repayment be deferred until April 10, 1971,
it was MOVED by Keith, seconded by McNeice that Resolution No. D -1441 postponing the re-
payment of said loan, be passed as read: carried, Brown, Keith,- Lambert, Larson, Lust,
McNeice and Robinson voting aye on roll call.
RESOLUTION NO. D -1441, A RESOLUTION postponing the repayment of a temporary loan from 520 -
Water -Sewer Fund to 912- Airport Improvement Fund, and amending Resolution No. D -1391
adopted September 15, 1969.
Councilmen Robinson and Lambert asking to be excused from the next meeting of February 9,
1970, and Councilman. Keith asking to be excused from the meetings of•February 9 and 16,
1970, it was MOVED by Brown, seconded by Lust that said Councilmen be excused as requested:
carried, Brown, Lust, Larson and McNeice voting aye by voice vote.
There being no further business to come before the Council, it was MOVED by Lust, seconded
by Keith that we do now adjourn at the hour of 5:00 P.M.: carried, Brown,.Keith,.Lambert,
