HomeMy WebLinkAbout01/26/1970 Business Meeting • • JANUARY 26, 1970 ' The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, • Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by Councilman Lust. The minutes of the regular meeting of January 19, 1970, having been duly certified accu- rate by two Councilmen,.and no one present wishing to have said minutes read publicly, • Mayor Larson declared said minutes approved as recorded. Public acknowledgement of the dedicated. service, of A.E. "Bert" Everist as Yakima Civil Defense Director, for many, years, was made by Police Chief Madden, members of the Police Department and Auxiliary Policemen, who were present. Mayor Larson presented him with a plaque honoring him for this service. A Certificate of Recognition by the State Board of Certification was presented to Perry D. Casey, Water Pollution Control Plant Operator, for special study completed. It was MOVED by Brown, seconded by Lambert that Ordinance.No. 1202. fixing the time of delinquency'and providing'for the issuance of bonds for the - payment of the unpaid portion of L.I.D. No..975, St. Johns Street and Decoto_property Water District, be passed as ° read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. . ORDINANCE NO. 1202, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 975, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. • • City Manager McMicken referred to an Ordinance relating_to working hours, leaves of absence.and overtime compensation for City employees which is listed on the Agenda and explained that there have been meetings with employee groups and the-preparation of said Ordinance has not been completed. He stated that this matter will be brought on for action next week, but that employees should be paid overtime based upon what was•the intention of. the City Council at the time of the adopting of the 1970 Budget, and that it was his understanding that the Council intended that the new overtime procedure would pay • time and a half for over -time for all City Departments and there would have to be some specifications and.new rules written up by the Staff which will be effective from the beginning -of the year. After due discussion, it was MOVED by Robinson, seconded by McNeice that the City Council's intention and policy be reaffirmed that the provisions which were indicated before the .end of the year, . be. changed and that those changes will become effective as of January 1, of this year, 1970 and that the Ordinance will'be brought on fo discussion and vote at the next regular meeting of the Councilmon February 2, 1970: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye • • by voice vote. . • Mr. Gary Jackson, with the.Yakima Valley Sun, was present and spoke regarding legal pub - lications of City notices. He stated that in researching this matter, 'it was found that the Yakima. Valley Sun could have run 14 of the 16 types of legal notices generally placed by the City of Yakima and he is asking that City ordinances be changed to allow the other , legal notices to be run in .a weekly paper, so'that they•will'be able to bid for the City's • legal publications business when the matter again comes up for bids.. Council members asked questions about the procedures of calling for bids on the legal advertising and what State laws and City Ordinances must be followed. City .Attorney.Andrews.expla.ined that a City Ordinance provides that the official newspaper be designated annually in .February of each year by the City. Council according to certain procedures which he out lined. He stated that the first Monday -in February, the City Council passes a resolution calling for bids for City advertising for the following year and specifies the form of contract which will be used for the purpose of making bids for that.publication for legal notices. He further stated that bids are then called for and on the third week in • February of each year, by- :the awarding of the bid, the official newspaper for the coming year is designated. Mr. Andrews indicated that there might possibly be.other Ordinances in addition to the two discussed that would need to be changed to allow weekly as'well as daily newspapers to bid on this matter. Council members indicating that this matter should be explored further, it was MOVED by Robinson, seconded by McNeice that this matter • be referred to the City Manager.and City Attorney for further.study and that information be brought to the'next meeting, •regarding any changes that might be necessary to be made in Ordinances to allow weekly newspapers to bid: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. . An Appeal from the Planning Commission's decision - in denying the rezone application, filed by Marquis Enterprises, requesting rezone of property situated at 1105 West "A" Street, having been filed with the City Clerk on January 21, 1970, it was MOVED by Robinson, seconded by Brown that February 9, 1970 be set as time for a hearing by the City Council on the matter of the rezone of said property, and that the City Clerk.give notice of such hearing as required bylaw: .carried, Brown, Keith, Lambert, Larson,. Lust, .McNeice and - Robinson voting aye by voice vote. . Reports having been received from the Planning Commission and from the Parks,and Recrea -. tion Commission regarding the parks and recreation_element of the City General.Plan and recommending that the General Plan be amended.:.by._adding.:a supplement entitled Parks & Recreation Plan, it was MOVED by Robinson,, seconded by Lust that February 9, 1970 be set . as the time for a public hearing by the City Council for the purpose of considering amending the General Plan for the City of Yakima by adding as a supplement thereto, a volume entitled Parks & Recreation Plan, Yakima, Washington: carried, Brown, Keith, • .Ai r 0 • JANUARY 26, 1970 Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. 'It was MOVED by McNeice, seconded by Lust that the report of the City Treasurer dated December 31, 1969, regarding the investments of the City-of Yakima, be ,accepted and approved: carried, Brown,. City Manager McMicken explained that custom, printed irrigation. maintenance assessment statement business forms had been ordered which amounted to $493.87, but when they arrived an additional 1,000 had been sent making the price $529.67, He further explained that these forms can be used and that the difference in quantity between that ordered and that delivered falls within the variance customarily allowed in normal business practice for custom printing and recommends authorization to purchase said forms without calling for bids. After due discussion, it was MOVED by Keith, seconded by. Brown that Resolution No. D -1438 authorizing the purchase of said forms without calling for bids, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1438, A RESOLUTION authorizing the purchase of irrigation maintenance assessment statement forms'without calling for bids. • City Manager McMicken announced the resignation of Bruce Finke as Director of Planning and Community Development effective as of February 6 He related that Mr. Finke has served as the first Director of Planning and Community Development for 11/2 years, and that the Planning Commission and City Council have promoted almost all of his suggestions. Mr. McMicken reported that there will be nationwide 'advertising for a new,Planning Direc- tor . City Manager McMicken reported that a check has been received from Air West in the amount of $4,052 for payment owed for the months of July, August and September, 1969. City Manager McMicken requested authorization for Public Utilities Director Frank Stein, City Engineer Francis Jaeger and Irrigation Foreman Phil Camerer to travel to Eugene, Oregon, to observe the relining of sewer mains with a new type of fiber glass. He explained that they will be going in a City car and will be gone one night. After due • discussion, it was MOVED by Lambert, seconded by Brown that said travel be allowed with expenses paid: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye, by voice vote. City Manager McMicken distributed copies of the Preliminary Study of the Yakima Avenue Undercrossings as prepared by ABAM•Engineers to Council Members'for their information and study. .
