HomeMy WebLinkAbout01/12/1970 Business Meeting JANUARY 12, 1970 The City Council met in regular session, Mayor Larson presiding, Councilmen - Brown, Keith, Lambert, McNeice and Robinson, Assistant City Manager Friedline and City Attorney Andrews present on roll call. Councilman Lust and City Manager McMicken absent on roll call. It was MOVED by Robinson, seconded by Keith, that Councilman Lust be excused from this meet- ing: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote The Invocation was given by 'Councilman Keith. The minutes of the regular meeting of January 5, 1970, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for•the continuation of the Hearing on Petition No. 647, filed by Robert B. Alton, requesting vacation of a portion of East Nob Hill Boulevard - street right -of -way, and City Attorney Andrews explaining that he has received a documented title report which indicates that the City does not have the right -of -way for which the vacation was requested, and there being no purpose for holding said Vacation Hearing, it was MOVED by Robinson, seconded by McNeice, that this matter be postponed indefinitely: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Lust absent. A Damage Claim having been filed with the City Clerk on January 8, 1970, by Larry E. Gaines, 315 Park Avenue, for damages in the amount of $26.76, caused by a sewer backup, it was MOVED by Brown, seconded by McNeice, that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Lust absent. An Ordinance rezoning property situated between North 16th and 18th Avenues, on the south side of Lincoln Avenue, as requested by Mr. and Mrs. John Wade and Others, having been prepared as ordered by the City Council on December 29, 1969, it was MOVED by Keith, sec- onded by Lambert, that said Ordinance be passed as read. Council members asked if any commitments have been made by the developer of the proposed shopping center regarding ✓arrangements for obtaining additional property for turn lanes on 16th and Lincoln Avenues, as was discussed at the Hearing on December 29, 196,9., Public Works Director John Mayo and Ed Loidhamer of the'P- lanning Department indicated that their= departments' have no addi- tional information to offer regarding this matter. Representatives of the developer, being present, indicated that they were not aware that immediate follow -up and written commitments were necessary before the passage of this Ordinance, but that they are will- ing to meet with the proper people to discuss these matters and are certain that they can be resolved to everyone's satisfaction. After due discussion, it was MOVED by Lambert, seconded by McNeice, that action on the passage of this Ordinance rezoning said property be delayed for one week to allow time for these matters to be investigated and the neces- sary commitments prepared for Council action: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. It was MOVED by Brown, seconded by Lambert, that Ordinance No. 1198 amending Section 7.56.040 of the Yakima Municipal Code relating to installment payments for sewer and water connection charges be passed as read: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Lust absent. It was explained that the present Code provides for property owners in the City to make such installment payments and this amendment allows property owners outside the City, who sign an "Outside the City Utility Agreement" and hook on to City water and sewer mains, the same privilege. ORDINANCE NO. 1198, AN ORDINANCE relating to public service and utilities; specifying the time of payment of domestic water and domestic sewer connection charges; and amending Section 7.56.040 of the City of Yakima Municipal Code. It was MOVED by Robinson, seconded by Keith, that Resolution No. D -1430 approving a form of contract to provide for installment payments of water or sewer connection charges, be passed as read: carried, Brown, Keith,\Lambert, Larson, McNeice and Robinson voting aye 'on roll call. Lust absent. RESOLUTION NO. D -1430, A RESOLUTION approving a form of contract to provide for install- ment payments of water or sewer connection charges. An Ordinance relating to Business License fees, being listed on the Agenda, Assistant City Manager Friedline asked that this be withdrawn.:because more study needs to be done on this matter. Mr. William Horst, of the Fire Fighters, being present, expressed the appreciation of the Fire Fighters to the City Manager and Staff for allowing them to place containers in var- ious places in City Hall to collect money for the Muscular Distrophy charity fund, which funds are used for medical research and other aspects regarding this disease. He explained that this project is carried on by Fire Departments all over the United States. Mayor Larson referred to the letter previously mailed to Council members from Max Vincent, resigning from the Yakima City Planning Commission, and indicated that a new member will be appointed soon. Assistant City Manager Friedline referring to the report of the City Engineer of the com- pletion of South 24th Avenue - Storm Drainage Project, and recommending that the work be accepted and the final payment made, it was MOVED by Robinson, seconded by Brown, that the report of the City Engineer dated January 8, 1970, with respect to the completion of the work on said project, be approved, the work be accepted and payment of the final estimate as therein set forth is hereby authorized: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by'voice vote. Assistant City Manager Friedline explaining that in September, 1969, the Metropolitan Park District contracted for the purchase of materials for delivery and payment in 1970, which obligation was assumed by the City on the dissolution of the Metropolitan Park District and the creation of the Department of Parks and Recreation as a. City department effective January 1, 1970, and recommending that authorization be given to purchase these materials without calling for bids, it was MOVED by Keith, seconded by McNeice, that Resolution No. D -1431 authorizing the purchase of said materials for the Park and Recrea- tion Department be passed as read: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Assistant City Manager Friedline referring to the matter of authorization to deed to the State of Washington Highway Department, two parcels of land near the Reservoir at Cowiche Creek for Highway 12, it was MOVED by Robinson, seconded by Keith, that Resolution No. D -1432 authorizing the conveyance of real property and the granting of construction permit to the State of Washington, and the filing of a certificate for reimbursement with the State of Washington, be passed as read: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Lust absent. RESOLUTION NO. D -1432, A RESOLUTION authorizing_the conveyance of real property and the granting of construction permits to the State of Washington, and directing the filing of a certificate for reimbursement with the State of Washington, all in connection with the construction by the State of Washington of Primary Sate Highway No. 5 (SR 12), Jacobson to Fruitvale Boulevard. Assistant City Manager Friedline referring to authorization to execute a contract with Doudna & Williams, A.I.A., for architectural services for the Southeast Yakima Community Center, it was MOVED by Brown, seconded by Keith, that a Resolution authorizing the hir- ing of said architectural services be passed as read. Council members expressed concern in the matter of signing this contract and Federal Funds not being available. Since all information is not available at this time on the matter, it was MOVED by Keith, seconded by McNeice, that this matter be continued for one week so that further study and investi- gation can be made: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Assistant City Manager Friedline reported on the Notice of Intention of Air West to make payment on the overdue Airport account, stating that according to a conversation between the City Treasurer Walter Chappel and their treasurer, they plan to pay 10 per cent of what was due as of November 1, 1969, plus interest at approximately 8 per cent; that start- ing with December, will pay one - fourth of each monthly payment and the balance will draw interest at the same rate, and hopefully it will all be paid off sometime after the end of March. .. . Assistant City Manager Friedline reported that an easement has been received from the Pacific Power and Company, giving the City the right to install a drain at the north end of Park Avenue. He stated that this transaction now makes it possible for the City to proceed with the installation of the drain in accordance with action taken by the Council at the meeting on July 22, 1969, at which time property owners in this vicinity were present to discuss a drainage problem andthe Council directed the City_Manager and Staff "to proceed to do what has to be done to take care of this problem ". Assistant City Manager Friedline reported that the Overpass Plans and Specifications have been received from the Consulting Engineers, and that the proper legislation shou23 now be prepared to get this project under way. No formal action on this matter was taken at this time. There being no further business'to come before the Council, it was MOVED by Keith, seconded by McNeice, that we do now adjourn at the hour of 4 :00 P.M.: carried, Brown, Keith, Lam- bert, Larson, McNeice and Robinson voting aye by voice vote.
