HomeMy WebLinkAbout01/05/1970 Business Meeting \ 1 JANUARY 5, 1970 • The City Council met in regular session, Mayor Larson presiding, Councilmen Brown,. Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Keith absent on roll call. It was MOVED by Robinson, seconded by Lust that Councilman Keith be excused from this meeting: carried, Brown, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. The Invocation was given by City Manager McMicken. The minutes of the regular meeting of December 29, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. City Attorney Andrews introduced Mr. Benjamin Brunner, new full -time Assistant City Attorney, who started in this position as of January 1, 1970. This being the time fixed for the Hearing on Petition No. 647, filed by Robert B. Alton, requesting vacation of a portion of E. Nob Hill Boulevard, street right -of -way, and City Attorney Andrews explaining that he has been advised by the Attorney representing Mr. Alton, that it has been found that the City does not own the right -of -way that is being requested to be vacated and that he is waiting for a written statement to that effect, and is therefore recommending . that this hearing be continued, it was MOVED•by Brown, seconded by McNeice that this hearing be continued for one week: carried, Brown, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Keith absent. Petition No. 653, having been filed with the City Clerk on December 30, 1969, by Lester O. and Syble M. Beaver, requesting vacation of unimproved street right -of -way, off Glenn Drive, between Summitview and Chestnut, it was MOVED by Robinson, seconded by Lust that said petition for vacation as set forth in Petition No. 653, be referred to the City Manager and the Planning Commission for study and recommendation: carried, ,Brown, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Keith absentp. City Manager McMicken explained that the City of Yakima recently sold to /the State Highway Department, the property on North 16th Avenue near the Naches River on which the Water Division had a well for supplementing the domestic water supply to the ity of Yakima. He stated that the City can no longer utilize the water right that was granted by the State for use at this site and to keep the records at the State Department,of Water Resources up dated, Frank Stein, Director, recommended that authorization be given to relin- quish the City's interest in the water rights. After due discussion, it was MOVED by Brown, seconded by McNeice that Resolution No. D -1427 authorizing the relinquishment of the City's interest in water rights pertinent to North 16th Avenuefwell site, be passed as read: carried, Brown, Lambert, Larson, Lust, McNeice and Robinson /voting aye on roll call. Keith absent. RESOLUTION NO. D -1427, A RESOLUTION authorizing the relinquishment by the City of Yakima . of a.Certificate of Ground Water Rights. City Manager McMicken referred to his Report #68, Painted House Numbers on Curbs, and explained that occasionally a church group or civic club has asked authority to paint house` numbers on the face of curbs in order to seek a donation to their civic or charitable cause and that the purpose of this report is to establish an appropriate policy on such requests. He further stated that the Chief of Police and Public Works Director approve of the idea with the conditions that the public works department would not be responsible for mainten- ance or otherwise be obligated to protect the numbers from wear due to street sweeping or snow plowing, and that' the City Attorney finds no legal objections to such a project. Mr. McMicken recommended that the Council approve the policy of permitting civic or charitable organizations to paint house numbers on the face of curbs. Council members indicated they feel it is a good idea, but would recommend that it be done under the jurisdiction of the Public Works Director. After due discussion, it was MOVED by Robinson, seconded by Lambert that the Council go on record as approving the policy permitting civic or charit- able organizations to paint house numbers on the face of curbs in accordance with City Manager Report #68: carried, Brown, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Keith absent. City Manager McMicken explained that United Builders of Washington, Inc. desires to pur- . chase property at 1119 South 1st Avenue owned by the City which was acquired by virtue of Local Improvement District foreclosure proceedings. He stated that United Builders has agreed to pay $1,600 for this property, and after receiving a report from George Lemon which indicated that this is a reasonable amount, it is recommended that the Council authorize the sale of said property to United Builders of Washington, Inc. After due dis -! cussion, it was MOVED by Lambert, seconded by Lust that Resolution No. D -1428 authorizing the sale of said property at 1119 South 1st Avenue, be passed as read: carried, Brown, Lambert, Larson, Lust,and McNeice voting aye on roll call. Robinson excused from voting because he has represented United Builders at various times in other matters. Keith absent. RESOLUTION NO. D -1428, A RESOLUTION authorizing the . sale of real property to United Builders of Washington, Inc. City Manager McMicken explained that the City of Yakima, through its Department of Parks and Recreation, has undertaken the continuation of the Yakima Senior Citizens program, be- ginning January 1, 1970, and deems it desirable to apply for a continuation of funds previously granted by the State of Washington to partially finance the program. He recom- mended that authorization be given to submit said application for State Funds for the con - tinuation of a project grant with the City of Yakima, Department of Parks and Recreation. After due discussion, it was MOVED by Robinson, seconded by McNeice that Resolution No. D -1429 authorizing the submission of said application for State Funds to assist financing of the Senior Citizen's Center under the Older Americans Act, be passed as read: carried, Brown, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. Keith absent. RESOLUTION NO. D -1429, A RESOLUTION authorizing an application for an Older Americans Act grant. JANUARY 5, 1970 There being no further business to come before the Council, it was MOVED by Lust, seconded by McNeice that we do now adjourn at the hour of 3:30_P.M.: carried, Brown, Lambert, Lar- son, Lust, McNeice and Robinson voting aye by voice vote.
