Councilmen present at the meeting Mayor . Bert Broad, Wray Brown, Betty L. Edmondson, Don Schussler and Bill Whitaker. Councilman absent and excused.. ' A presentation was given by Matt Young, Fire Chief, regarding the supression of the Chieftain Hotel fire. It was noted.that the overtime'cost.of- fighting the fire was. $6,151=.' . There, was discussion by the Council regarding the Southeast Community Center Fund and the City's financial share in•the clinic.' The questions remaining before the Council' concern the reasons for the financial difficulty and the effect of the City's contribution. Councilman Schussler recommended that City Staff obtain more information on this matter. • There was a request from County Commissioner Lenore Lambert to appoint Mayor Broad to the District Health Board. It was MOVED by Whitaker, seconded by Edmondson that Mayor Broad be appointed'to the District Health Board; carried, Brown, Edmondson, Schussler and Whitaker voting aye by voice vote. Cole absent. • Director of Public Services, Jack Daniel,,gave'a presenation.on the "Flavorland" proposal for hanger space for two planes. It was the consensus of the Council to negotiate'further with Flavorland on this proposal. . At 3:00 P.M., the Council - members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Edmondson, Schussler and Whitaker, • City Manager McMicken and City Attorney Andrews present on roll call. Councilman Cole absent and excused on'roll call. The Invocation was given by City Attorney Andrews. The minutes of the previous regular meeting of December l7, 1973, having been duly certifie.� accurate by two Councilmen, and no one present wishing'to have said minutes read publicly, Mayor Broad declared said minutes approved'as'recorded.' This being the time set for the Hearing on L.I.D. No. 990, Rock Avenue and Others Domestic Water District, and there being no one present to against this matter, it was MOVED by..Schussler, by Whitaker that Ordinance No. 1604, confirming the assessment roll on L.I.D. No. 990, be passed: carried, Broad, Brown, Edmondson, Schussler and Whitaker voting aye on roll call. Cole absent. ORDINANCE NO. 1604, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 990 as created and established by Ordinance No. 1487 of the Ordinances of the City of Yakima. This being the time set- Hearing on the Rezone Application filed by Lawrance Blan. et al, for property located at 206 -216 North Naches Avenue and 406 and 408 East :Lincoln Avenue, Director of Community Development, Jay Otto, reviewed the Planning Staff Report and Planning Commission Minutes on this subject dated November 15, and December 4,, 1973, respectively. 'Mr. • Otto indicated that'this proposed rezone from R- 3 Multiple Family Zone to B -2 Local Business Zone conforms to'the General and Central Business District Plans. He indicated that the Planning Staff recommends approval of this request based upon the following reasons: 1. It conforms with the General Plan and the CBD Plan. 2. It conforms to land development trends'in the area. 3. It would be consistent with recent rezoning considerations for this area by both the Yakima City Council and Planning Commission. 4. It would be a logical.extension of the adjacent B -2 Zoning in relation to the circulation and land use patterns for this portion of the downtown area. It was MOVED by Whitaker, seconded by Brown, that Ordinance 1605, accepting the recommendat'on of the Planning Commission and.zoning'said property, be passed: carried Broad, Brown, Edmondson, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1605, AN ORDINANCE accepting the recommendation of the'Planning Commission and rezoning certain property situated at 206 -216 North Naches Avenue and 406 -408 East Lincoln Avenue in the City of Yakima, Washington; from R -3, Multiple Family Zone, to B -.2, Local Business Zone. • This being the time set for the Hearing on the Rezone Application filed by William James Smith for property located at 902 -506 West Logan Avenue, Pincipal Planner, Dick Hill, reviewed the Planning Staff Report and Planning Commission Minutes on this request dated November 28, and December 4, 1973, respectively. He indicated that a revised plot plan has been submitted in compliance with the following conditions: 1. All driveways and parking areas be surfaced'by asphalt or similar type material. 2. Wheel stops be provided in parking areas. 3. Driveway be redesigned to intersect Logan'Avenue at 90 °. 4. Prior to issuance of any building permits, final landscaping and irriga- tion plans be submitted for approval. 5. This being the time set for the Hearing'on the Appeal from the Planning Commission''s . action on the Rezone Appi- ication filed by Mr. and Mrs,....Ea•rl C. .Grissom, for' property. located at 1101 Landon Avenue,.Director of'.Community Development, Jay Otto, reviewed the Planning "Staff 'Report and Planning Commission Minutes this subject dated November II 23, and December 4, 1973, respectively. He indicated that the request is for a rezone from R -2, Two - Family Zone;'to B -2; -Local Business•Zone-, for :purposes of constructing a restaurant. Mr.'Otto indicated surrounding land uses and noted the nearby zoning to be primarily residential. .He.further stated the recommendation from the Planning Commission to deny'this request, noting that this rezone would encourage more commercial development along Nob Hill Boulevard. Mr. Jack King, attorney representing the Grissoms, being present, passed to copies of a petition signed' by neighbors in the vicinity of the proposed rezone'who in the request. Mr. King indicated that there are several other located not far from the. proposed area along Nob Hill Boulevard ' and -- showed slides of'these'businesses. He further indicated that v the neighbors hae•not. the noting that there does not seem to be interest in residential development along this street. There was discussion by the Council regarding the possibility of submitting a Planned Development request instead of the straight rezone for this property. It was MOVED by Whitaker, seconded by Edmondson that the Motion requesting a rehearing by the Planning Commission, be passed: ' Edmondson and Whitaker voting aye on roll call; Broad, Brown, and Schussler voting nay ' on roll call. ' Referring to the proposed letter of agreement with the Washington, State Department, of Highways for services in connection with the Rehabilitation of Runway 4 - 22 at'the'Yakima Air Terminal, City Manager McMicken explained that this authorizes certain. testing services . at an estimated cost of $2,500. D -3050, A authorizing the Mayor and City Clerk :of'the City . of•Yakima - to execute.a'letter of agreement with the'Washington State Department of Highways for' services' in connection with th'e Rehabilitation of ,4 -22 at'Yakima Air Terminal -- A':D.A.P. No 8 -53- 0089 -02. City Manager McMicken requested authorization for the execution of automobile rental agreements and'licenses, with Ranier'Rent =A -Car, Inc'.', and Wickstrom Motors, Inc.' He indicated that'a third agreement from' Avis Rent -A -Car System, Inc. will be arriving . within the week. Referring••to the-report on • the decision the' Interagency Committee on Outdoor Recreation to not fund Freeway.Athletic Park, City - Manager'McMicken - explained -that the .Committee is not funding this project due to lack of' sufficient funds'and a low rating. Mr. McMicken indicated that the City will not - be resubmitting ` this• - project to the state at this time for funding. City Manager McMicken referred the matter of approval for the preliminary design and cost estimate for the City Shop Complex to' Director of Public Works, Dave Vargas,' who commented on meetings held with the City Shop Review Team, indicating their agreement with the plans for the shop complex. Mr. Bob Dawley, Architect, being present, reported on the - detailed studies made of the various shop areas and reviewed the plans for the preliminary design for the four main buildings and related areas. He' indicated that the prelim -inary design is complete except for the wall systems and gave a report on' the various- types of wall's which could be utilized, noting a recommendation for the use.of precast concrete. Mr. Dawley reviewed the preliminary construction cost estimate dated January 7 that the total building cost is '$34,000 higher than the August estimate. There was discussion by the Council regarding possible future expansion of the facilities in the event that more buses are' added and Mr. Dawley indicated, that there is rroO for additional building and expansion in the plan. - After due discussion, it was MOVED by Schussler, seconded Whitaker' that the preliminary design and cost estimate presented for the proposed City Shop Complex be approved: carried, Broad, Brown, Edmondson Schussler and Whitaker voting aye by voice vote. Cole absent. City Manager McMicken reviewed his Report No. 202 concerning Police Vehicle Purchases - 1974. There was discussion by the Council concerning the differences noted for the Dodge Coronet by st'ate'contract and the proposed Plymouth Satellite. After due discussion, it wasp4MOVED by Schussler, seconded Edmondson that the City Manager:and staff be authorize.' to proceed on the basis outlined in City Manager Report No. 202 for the purchase of 1974 Police vehicles: carried, Broad, Brown, Edmondson, Schussler and Whitaker voting aye by voice vote. Cole'absent. • City Manager McMicken referred to the Memo on the financing of six SHU -PAK refuse trucks dated January 7, 1974. Referring to the ordinance drafts and reports on the 1973' Edition of the Uniform Building, Plumbing,•and Mechanical'Code, City Manager McMicken explained that there needs to be a preliminary public meeting with interested parties within the next three weeks to go over the technical changes in the Code. In accordance with a request received, from Mr. Rex Sweitz, Brokers Trust Real Estate, for a. two hour parking limit on the south''side of Yakima-Avenue from 10th Avenue to llth Avenue in order to eliminate all day employee parking, it was MOVED by Schussler, seconded by Brown that Ordinance No. 1607, providing for a limited parking time in this area, be passed: carried, Broad, Brown', Edmondson; Schussler and Whitaker voting aye on roll • call. -'Cole absent.
