DECEMBER 1973 '
•
The City Council met in session at 6:30 P.M. on this date in the Conference Room, at
Yakima City Hall.
Councilmen present were Mayor Bert Broad, Wray Brown, Howard C. Cole,
Betty L. Edmondson„ -Ralph Holbrook, Don Schussler and Bill Whitaker.
There was general discussion regarding the proposed County Gambling Ordinance. No action
was taken.
City Manager McMicken :referred to the request by Walt Siler of the West Valley Schools
for.support from the City in:creating a committee to review goals and programs for the.
West Valley Schools: Mayor Broad and Councilman Brown will assist in the matter of
this request.
Councilman Edmondson discussed the Health Board Meeting and Health Fee Schedules. No
action was taken.
City Attorney Andrews discussed the Financial'Disclosure Form with Council members.
City Attorney Andrews briefly on.his•finding regarding the.body.painting shop
and indicated that his, investigations are'in progress.
At 8:00 P.M. the Council members moved into the Council - Chambers for the balance of
the meeting, Mayor Broad presiding, Councilmen 'Brown, Cole, Edmondson, Holbrook, Schussler
and Whitaker , City Manager McMicken and City Attorney- Andrews present on roll call.
The Invocation was given by Councilman Brown.
The minutes of the previous regular meeting of December 10, 1973, and the adjourned
regular meeting of Tuesday, December 11, and Friday, December 14, 1973, having been
duly certified accurate •two Councilmen, and no one, present wishing to have said minutes
read publicly, Mayor Broad declared said minutes approved as recorded.
Mr. Mike Jessup,•213 South 35th Avenue, representing students from Wilson Junior High
School, spoke in opposition to the opening of the body painting shop at 2 East Yakima
Avenue and submitted a petition of approximately 235 names signed by students from Wilson
Junior High. Mr. DanSnyder,'215 South 24th•Avenue, submitted a.petition of approximately
370 names in opposition to this business, requesting'legislation restricting this type
of business in Yakima. Mr. Ron Turner, 912 South 18th Avenue, submitted a petition
signed by persons in opposition also. Reverend Dennis Sunderland, Bethel Assembly of
God, submitted a petition signed approximately 2,395 persons in opposition to the.
body painting shop and asked that the City pass a prohibiting this type of business.
Warren Rheaume, 1314 South 10th representing the Carroll High School Student
Body, stated that this school would like to goon record as opposing this type of business
in Yakima. City Attorney Andrews .explained the two types of,licenses'which are issued
to businesses, and noted that the regulatory license has not.been issued in connection
with this business, but only the revenue raising general business license. He further
stated that a building permit has been issued to allow alterations to.the building.
Others present and speaking in opposition to this business were' Mr. Garson, Mrs. -Arthur
Johnson, Mrs. Charles Rich, Ray Patnode, Ray - Allen, George Guinn, Dan Arellano, Larry
Robinson, Russell Sutton, Pastor Jay Spivey, Leon Leadon, Pam. Kloster and O. F. Gilbert.
Those present and speaking in favor.of the business were Margaret Lloydd, Russell Taylor,
Dwayne Woodard, and .Jim Kurbitz, Mayor Broad indicated that the - Council has asked City
Staff to look into'steps taken.by other cities in 'reference- -to this type of business
and that the staff will bring back a report.
Referring' to report • G.•Jacobson' and Associates regarding the Pierce•,Avenue
proposed.parking improvement project; City Manager McMicken explained that the street •
improvement project was presented last summerand'the.request made fora delay for purposes
of' an analysis associated - with"th - is'improvement. He reported
that N. G. Jacobson and Associates had been to study this matter. He noted.
that-copies of the report'had been sent to interested persons and property owners'and
• indicated that there will be a meeting of property owners before a parking district
is set up. Mr.`Phillip Keightley, Consulting Engineer, being present, reviewed;vari•ous
sections of ..the report 'submitted .on ,this'''project dated 'December 11, 1973. With the
use of a map, he •indicated' the areas'studied,'areas where parking stalls would be removed,
areas of deficiendand surplus, and areas of major parking problems at this
time. -He indicated problems associated with parking for the. Westside Post, Office and
reviewed the three proposals as found in the report, and as they would be used after
the post office has moved, possibly in five years. - He - ,recoinmended the adoption of proposal
"C" to include a parking lot and park in the improvement area, noting that the distribution
of parking is better in proposal. "C ". Mr. Keightley reviewed the cost estimate associated
with this proposal as found in the report; to include operation, maintenance and estimated.
revenues. There was discussion by the Council'regarding the method of financing the-

proposal.and the benefits associated with it. Councilman Schussler spoke in opposition
,to proposal, "C ". After due discussion, it was MOVED by Edmondson, seconded by Whitaker
that this matter be set for hearing the third Monday in February with the understanding
that there will be held with professional staff for discussing portions
of the plan and program: carried, Broad, Brown, Cole, Edmondson, Holbrook and Whitaker •

referred: to •the Planning Commission and - Parks Commission for_. report and recommendations:

With the use of a design drawing; City Manager McMicken ..reviewed the - landscape plans for
Fire Stations No. 1 and No, 5: He referred to the Fire Bond Issue Financial Statement
dated December 14, 1973, recommending adoption of the plans the amount of $14,000,
to include sprinkler systems. I.t was. MOVED by Whitaker, seconded by Edmondson that
the landscape plans presented-for Fire Stations. No. 1 and No. 51be approved.: carried,
Broad, Brown, Cole,..Edmonds.on, Holbrook, Schussler and voting aye by voice
vote. Present and speaking to matter was"Fire Chief Matt Young. •
City Manager McMicken referred to - the proposed temporary loan' in"the amount of $60,000
from the Water - Sewer. Fund: the•Urban Arterial StreetFund, explaining this to be in
connection with. the. Walnut Undercrossing Project. It was MOVED by Schussler, seconded
by Holbrook -,that Resolution No. D -3042, providing for said temporary loan, be passed:
carried, Broad, Brown, Cole,'Edmondson, Holbrook, Schussler Whitaker voting aye
on roll call.
RESOLUTION NO. D -3042, A RESOLUTION authorizing a temporary loan of $60,000 from 473 -
Water -Sewer Fund to 143 -Urban Arterial Street Fund and providing for repayment; and
extending_the repayment date for a loan previously made from 142- Arterial Street Fund
to 143 -Urban Arterial Street Fund.

In accordance with the request for legislation previously it was MOVED by Schussler,
seconded by Edmondson that Resolution No. D -3043, establishing a policy to urge conservatio
of electrical energy, be passed: carried, Broad, Brown, Cole, Edmondson, Schussler
and Whitaker voting aye on roll Holbrook voting nay on roll call:
RESOLUTION NO. D -3043, A RESOLUTION urging cooperation by citizens of the City of Yakima
to conserve electrical energy.
City Manager McMicken referred - to the request for 'an agreement.with'the National Bank •
of Commerce of Seattle for recording and disposing of redeemed bonds and, interest coupons.
It was'MOVED by Cole, seconded by Schussler that Resolution No. D -3044, providing for
said "agreement, be passed: carried, 'Broad, Brown, Cole, Edmondson, Holbrook, Schussler
and Whitaker voting aye on roll call..

RESOLUTION NO. D- 3044, "A RESOLUTION authorizing the City Manager, City Clerk, and City
Treasurer -of the City of Yakima.to. execute a cremation agreement with -the National Bank
of- Commerce of Seattle, as the agency of the State of'Washington for recording
and disposing of redeemed bonds and interest coupons. •
City Manager McMicken referring to the certification by the City Engineer of the completion
of work and recommendation that said work be accepted and final payment made on L.I.D.
No. 994, Heights West and Others Sewer - Schedule I, it was MOVED by Schussler,
seconded by Holbrook that the report of the City Engineer dated December 12, 1973, with
respect. to the , completion - of the work on Public Works L.I.D. No. 994-, Englewood
Heights. West. and Others Sewer- Schedule I, be approved, "the work be accepted and payment
of the - finial estimate as therein set forth is hereby authorized: carried, Broad, Brown,
Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.
City,Manager McMicken reported that bids were received and considered by the Bid Board
on December 11, 1973, for the.Airport Fire and Rescue Truck, subject to FAA approval
as follows: .
Fire Control Northwest,• Inc. • $23,550.37
Western States Fire Apparatus, Inc. • $28,588.35
The City Engineer recommending the bid be awarded to•Fire Control Northwest, Inc.
who submitted the lowest and best bid, it was MOVED by Schussler, seconded by Whitaker
that the bid be awarded to Fire Control Northwest, Inc., in the amount of:$23,550.37,
subject to FAA approval: .carried,. Broad, Brown, Cole, Edmondson, Schussler and Whitaker
voting aye by voice vote; Holbrook voting nay by voice vote.
City Manager McMicken..reported that bids were received and considered by the Bid Board
on December 14, 1973, for the Randall Park Pump Installation, as follows:
Fosseen:'s Pump and Irrigation. Company •$11,479.65
_.Morton's Supply Incorporated $ 5,739.30

The City Engineer recommending that the bid be awarded to Fos:s.een ' s Pump and Irrigation
Company who submitted the best bid, it.was MOVED by'Schussler, seconded by Edmondson
that the'bid be awarded to F:os:se_en "s;Pump and Irrigation Company, in the amount•of $11,479.6
and that the City Manager be authorized to enter into contract with said contractor
upon.the filing of the proper bond and insurance: carried, Broad, Brown, Cole, Edmondson,
Holbrook, Schussler and"Whitaker• voting aye by voice vote.
It was MOVED•by Cole,.seconded by Edmondson,that Ordinance No. 1595, relating to rates
for the rental of equipment through the Garage Fund and revising current rates, be passed:
carried, Broad, Brown,, Cole= ,.Edmondson, Holbrook; Schussler and Whitaker voting aye
on roll call. •
ORDINANCE NO. 1595, AN ORDINANCE relating - to the City Garage Fund; establishing rates
for the rental of equipment through such fund.; and amending Sections 3.15.030 of the
City_ Yakima Municipal Code.; and declaring an emergency.• • •
It was MOVED by Holbrook, 'seconded by Brown that Ordinance No. 1596, adopting a compensation
plan for City employees for 1974, be passed: carried, Broad, Brown, Cole, Edmondson,
Holbrook, Schussler and Whitaker voting aye on roll call.
ORDINANCE NO. 1596, AN ORDINANCE relating to City personnel; adopting a classification
and compensation plan for.City employees; amending Section 2.20.100 of the City of Yakima
Municipal Code; and declaring an emergency.

accordance with passed to Councilmen dated December 14, 1973. It was MOVED
by Whitaker, seconded•by Cole'that Ordinance No.'1597, adopting the 1974 budget, be
passed,: carried; Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker-voting
aye on roll call.
ORDINANCE No..1597: AN ORDINANCE adopting a Budget for the City of Yakima, Washington,
for.the year 1974; and funds for estimated expenditures.
It was MOVED by Brown; seconded Schussler that Ordinance No. 1598, redefining the
boundaries of certain voting precincts and' creating two new precincts within the City,
be passed: carried, Broad, Brown, Cole; Edmondson, Holbrook, Schussler-and Whitaker
voting aye on roll call. •
ORDINANCE NO. 1598, AN ORDINANCE redefining boundaries of certain existing City voting
precincts; creating and boundaries of 'certain new City voting precincts;
and declaring an emergency. 0
Referring to the proposed Ordinance creating a Central Business District Capital Improve-
ment Fund, City Manager McMicken explained' that this is necessary for costs incurred
in connection with the Pierce Improvement Project. 'It was. MOVED by Cole, seconded ,
• by Schussler that Ordinance No. 1599, creating said fund, be passed: carried, Broad,

Brown, Cole, Edmondson, Holbrook, Schussler and•Whitaker voting aye on roll call. -
ORDINANCE NO. 1599, AN ORDINANCE relating to City funds and accounts; creating a Central
Business District Capital, Improvement Fund, specifying the purpose of such fund, designatinc
sources of money for deposit therein 'and providing for expenditures therefrom; enacting
Chapter 3.17, "Central Business District Capital Improvement.Fund ", and its various
sections as a new chapter. and section of the City of Yakima Municipal Code; and declaring
an emergency. .
An Ordinance transferring the amount of $12,000 from the Cumulative Reserve for Capital..
Improvement Fund to the'Central Business District Capital Improvement Fund having been .
read by title only'at•this.meeting, was laid on the table until the next scheduled
Council Meeting or until December 21, 1973. City Manager McMicken explained that this
appropriation is in connection with expenses of the Second-Street Pedestrian Mall•and.
Pierce Avenue Improvement Project. .

An Ordinance appropriating $24,651 to the Police Department for a Communications Console,
having been read by title only .at this meeting, - was laid onrthe.table until the next
scheduled Council Meeting, or until December :21; 1973. City Manager- McMick'en explained
that bids.have been awarded on some of the equipment in this amount.
An Ordinance appropriating $50 within the Mausoleum Fund to pay current obligations •
and close out the fund in 1973, having been read by title only at this meeting, was
laid on the table until the next scheduled Council Meeting or until December 21, 1973.

An Ordinance appropriating $16,000 from for the Police.Department,
having been read by title only at this meeting, was on the table until the next
scheduled Council Meeting or until December 21,.1973. City Manager. McMicken explained..
this appropriation is necessary for•rising costs of fuel, repair and maintenance of •.
• vehicles.

• Petition No. 800, having been filed with the City Clerk on-December-11, 1973, by Orman -
E. Arnold and others,' requesting the vacation of King Street between Rock Avenue and
Ledwich Avenue, it was MOVED by Schussler, seconded by Holbrook that said petition
be referred to the Planning Commission and that Resolution No.. D- 3045, fixing the date -.
of hearing on said for January 14, 1974, , be passed: carried, Broad, Brown,
Cole, Edmondson, Holbrook, Schussler, and Whitaker voting aye on:roll call..
RESOLUTION NO. D -3045, A RESOLUTION fixing time and place for hea -ring on a petition
for vacation of a portion of King Street in the City of Yakima. .
