The Council met in session on this date in.the Conference Room at Yakima City Hall, at the hour of 12:00 Noon. • Councilmen present-at the meeting were Mayor Bert Broad, Wray Brown, Howard C. Cole, Betty L. Edmondson, Ralph Holbrook and'Don Schussler. • It was MOVED by Schussler, seconded by Edmondson that the Council go into. Executive Sessior re the Marshall- Wilson litigation. After discussion of this suit by the City Attorney, it was the consensus of the Council to drop the suit. There was a presentation made to the Council by the Black Coalition re community needs. Mr. Phil Pleasant,•Chairman, requested $300,000 annually for use in housing, jobs, youth work` and affirmative action. The Council met with the. press at 2:30 P.M. for discussion of general subjects. At 3:00 P.M. -, the Council members met_.in.the.Council Chambers for the balance of the meet- ing, Mayor Broad presiding, Councilmen Brown,°Cold, Edmondson, Holbrook, Schussler and Whitaker present on roll call. The Invocation was given by Councilman Edmondson. . • The minutes of the previous regular meeting of December 3, 1973, having been duly certi- fied accurate by two Councilmen; and no one present wishing to have said minutes read publicly Mayor Broad declared said minutes approved as recorded. This being the time set for the Hearing on the proposed County Gambling Ordinance, Mayor Broad explained action resulting from previous Hearings held on this matter and action by the Legislature which changed the former proposal. He referred to the proposed County Ordinance, 6 -1973, indicating that no decision would be made at this meeting. There being no one present wishing to speak to this matter, the Hearing was closed. This being the time set for the Hearing on the appeal by Fire Fighters' Local 469 from the impasse regarding pay of alarm operators and a.clerk typist, Mr. Bill Horst, Chairman • of the Negotiating Committee, referred to the City's offer to pay a 6.1 percent increase or3 "O•and the proposal by the IAFF to pay alarm operators the same as firefighters or $958. Bob Hilsmann, representative for the City, passed to Councilmen information re the wages paid for these two positions, the difference in duties and comparison of pay d with other cities in the state. Mr. Hilsmann recommende a 6.1 percent increase for the position of alarm operator. Captain Ken Groth, Fire Department, briefly reviewed the list of those cities which pay equal to or higher.than the position of fire fighter. He described the duties performed by an alarm operator in various emergency situations and reviewed the information.passed to Councilmen regarding job requirements. He'further reported on the monthly and annual difference as proposed by the City and IAFF. Referring to the impasse re pay for the clerk typist, Mr... Hilsmann explained that_this position is similar to other Clerk - Typist II positions in -the city, noting that the city's position is a 5.5 percent for salary and :.6 percent in fringe benefits compared to the 6.1 percent for salary proposed by IAFF. ;Mayor Broad indicated that this matter would be further discussed by the Council and a decision made this week. Mr. Paul Edmondson, being present, requested the location of a traffic diverter on upper Yakima Avenue in conjunction with -the one proposed for South 24th Avenue It was MOVED by Schussler, seconded by Edmondson that this' request be referred to the Planning.Commission'and further that this matter be heard at the same Hearing as that set for the South 24th and Chestnut diverter on January 21, 1974: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting .aye by voice vote. City Manager McMicken referred the' matter of a settlement with the Yakima Police Patrol- men's Association regarding 1974 negotiable items to. Bob Hilsmann, who passed. to Council- men a summary of the proposed Article changes in the Collective Bargaining Agreement. It was MOVED by Schussler, seconded by Holbrook that the City Manager be authorized to execute the Collective Bargaining Agreement between the City and the Yakima Police Patrol- men's Association: carried, Broad, Brown, Cole; Edmondson, Holbrook,.Schussler and Whitaker voting aye by voice vote. • City Manager McMicken referred to the proposed Resolution accepting a Grant Offer from the Federal Aviation Administration for airport lighting, runway overlay, and acquiring a fire rescue vehicle'at.the Yakima Air Terminal. He explained the breakdown of the Federal and Local share, noting that the Federal Grant Offer is in the amount. of $177,918. It was MOVED by Brown, seconded by Whitaker that Resolution No. D- 3040, accepting said Grant Offer, be.passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. RESOLUTION NO. D -3040, A RESOLUTION accepting a Grant Offer from the United States of. America, Federal Aviation Administration, in the maximum amount'of_.$17:7,918, to be used for Project No. 8053 - 0089 -02 in the development of the Yakima Air Terminal, and authoriz- ing the Mayor and City Clerk of the City of Yakima to sign:the acceptance document :for such grant. Referring to the proposed Resolution authorizing emergency repairs to the sewage treatment plant filter pump without calling for bids, City Manager McMicken explained that more • work was required than anticipated initially. It was•MOVED'by_Cole, seconded by Schussler that Resolution No. D -3041, authorizing said repairs without calling for bids, be passed: ca-.rri Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on - roll call. RESOLUTION NO. D -3041, A RESOLUTION authorizing the hiring of and payment, for emergency repairs to.a sewage treatment plant filter pump without calling for bids. • • DECEMBER 10, 1973 A report having been received from the City Engineer on the completion of L.I.D. No. 991, Haven Way Sanitary Sewer, it was MOVED by Schussler, seconded by Brown that January 14, 1974 be the date set for Hearing on the Assessement Roll: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. City Manager McMicken reported that bids were received and considered by the Bid Board on November 8, 1973, for the Rehabilitation of Runway 4 -22 - Schedule I, as follows: Superior Asphalt & Concrete Company $108,717.00 Yakima Asphalt Paving Company 122,986.50 the City Engineer recommending that the bid for Schedule I be awarded to Superior Aspalt & Concrete Company in the amount of $108,717, who submitted the lowest and best bid, it was MOVED by Schussler, seconded by Holbrook that the bid for Schedule I be awarded to the Superior Asphalt & Concrete Co., in the amount of $108,717, and that the City Manager be authorized to enter into contract with said Contractor upon the filing �f the proper bond and insurance: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Referring to the proposed Ordinance imposing and computing charges for connections to existing water and sewer lines to service property not previously'assessed, City Manager McMicken explained that this Ordinance is in accordance with the recommendation given in City Manager Report #183 dated August 3, 1973, for late comer connection charges in compliance with State law. It was MOVED by Whitaker, seconded by Holbrook that Ordinance No. 1593, providing charges for said connections, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1593, AN ORDINANCE relating to public services and utilities; imposing and specifying the manner of computing charges for connections to existing domestic water and sanitary sewer lines to serve property not previously assessed or otherwise charged for an equitable share of the cost of the utility system; amending Sections 7.56.010, 7.56.020, 7.56.030 and 7.56.060 and repealing Sections 7.56.050 and 7.68.045, all of the City of Yakima Municipal Code. A Damage Claim having been filed with the City Clerk on December 5, 1973, by Mr. Sanford Shapiro, Co- executor for the estate of Ethel Shapiro, Box 655, Yakima, in the amount of $26.25, for costs in connection with a water shut off, it was MOVED by Whitaker, seconded by Cole that said Damage Claim be referred to the City Manager for study and recommenda- tion: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. A revised final estimate having been received from the City Engineer on the completion of work and recommendation that said work bec'accepted and'final payment made on L.I.D. No. 992, 1973 Paving Improvements - Schedule I, it was MOVED by Cole, seconded by Holbrook that the report of the City Engineer dated December 10, 1973, with respect to the comple- tion of work on Public Works contract L.I.D. No. 992, 1973 Paving Improvements - Schedule I, be approved, the work be accepted and payment of the revised final estimate as therein set forth is hereby authorized: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Mr. Dennis Sunderland, being present, reported on sewage problems for six homes located on Rancho Lane, requesting hook -up to a city sewer. City Manager McMicken indicated that a Planning Staff Report will be brought back to the Council on this request. At 4 :15,P.M., the Council moved into the Conference Room for general discussion re the 1974 Budget. There being no further business to come before the Council, it was MOVED by Whitaker, seconded by Edmondson that this meeting be adjourned at 5:07 P.M. to Tuesday, December 11, 1973, at the hour of 7:30 P.M., to then meet in the City Council Chambers at Yakima City Hall: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.
