HomeMy WebLinkAbout12/03/1973 Business Meeting • - c o • DECEMBER 3,.::1973 The City Council met in session at 1:30 P.M. on this date in the Conference Room at Yakima City Hall. • , Councilmen present at the meeting. were •Mayor Bert,Broad, Wray Brown, Howard C. Cole, Betty L. Edmondson, Ralph Holbrook, Don Schussler and Bill Whitaker. Director of Public Services, Jack Daniel, and architect Bob Dawley reported on the.Airport Parking Lot Project and proposed Walkway Cover. Councilman - Don Schussler asked that no /further consideration be given to a covered walkway. It was the consensus of the Council that the staff develop alternative for consideration. ; There was discussion by the Council regarding the•Affirmative Action Program. It was MOVED by Schussler, seconded•by Holbrook that an advisory committee be formed named by the City Manager with the,Cbuncil designating its own - member and that, the elements of the Affirmative Action Program be approved carried, Broad,. Brown, Cole,, Edmondson, . Holbrook, Schussler and Whitaker voting aye by voice vote. It was MOVED by Schussler, seconded by Whitaker that the Council go into Executive Session to consider a report..on union negotiations: carried, Broad, Brown, .Cole, Holbrook, Schussler and Whitaker voting aye by voice vote; Edmondson voting nay by voice vote. At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown,Cole, Edmondson, Holbrook, Schussler and Whitaker, City Manager McMicken City - Attorney Andrews present on roll.call. The Invocation was given by City Manager McMicken. The minutes of the previous regular meeting of November 26,1973, and the adjourned regular meetings of November 26, November 28 and November 30, 1973, having been duly certified accurate;by two Councilmen, and no one present wishing to' 'have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. This being the time set for the Hearing on the 1974 Budget, Mayor.Broad,indicated that questions would be considered from those present at this time, but that no decisions will be made at this meeting.. Mr. Russell Miller, 1020 South 34th Avenue, questioned the cost of a traffic signal replacement located.at Nob Hill and First Street. Traffic Engineer,..Bill Stark,. explained that the present type is outdated requiring a high degree of maintenance and the controller - was.damaged . in an auto accident. He reported on the need for a new controller and indicated that TOPICS funding is not available to complete work on this intersection. Mrs. Coffin, President.of the League of Women <yVoters, being present, requested that the Council give the same financial consideration to the Library as was given'last year. This being the time set for the Hearing. on the Amendment to the Planned Development filed by Glascam Builders, Inc., for property located at the northeast corner of. 40th Avenue and Nob Hill Boulevard, Director of Community Development, Jay Otto, reviewed the.Planning Staff and Commission Minutes on this subject dated'November 2, 1973, and November 13, 1973,-respectively. He.indicated the.location.for the present Planned Development, explaining the proposal for substituting a 7 -11 Market for the previously approved service station. Mr. Otto indicated that this amendment would not change the concept of the Planned Development but that,there'would'be a reduction in the number of parking spaces. He recommended approval of the :proposed amendment,. subject to the following conditions: 1. Submission to and approval by the Office of Environmental Planning of a landscaping and irrigation plan of the entire site indicating the. type, size, location,: and. quantity of'landscaping materials. 2. The submission to and approval by the Office Environmental Planning of proposed signs indicating size, height, and location. . 3. Inclusion of a completely screened refuse collection area. Mr. Otto indicated that these conditions are necessary for the building permit. Councilman Schussler expressed a desire to see B -1 zoning for this area. After due discussion, it was moved by Holbrook, seconded by Cole that Ordinance No. a590, 'amending the original Planned Development, be passed: carried, Broad,.Brown, Cole, Edmondson, Holbrook and Whitaker voting aye on roll call; Schussler.voting nay on roll call. ORDINANCE NO. 1590, AN ORDINANCE accepting the recommendation of the Planning Commission and amending the Planned Development Zone .for certain property situated north of Nob Hill'Boulevard between 38th and 40th Avenues within the City of Yakima. A Damage Claim having been filed with the City Clerk on November 27, 1973, by Yakima Hardware Company, 226 South 1st Street, in the amount of $443.92, for costs incurred in the removal of a transmission'power by Yakima Hardware, it was MOVED by Schussler, seconded by Holbrook that said Damage Claim be referred to the City Manager. for study and recommendation: - carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice-vote. An Ordinance appropriating money from the Contingency Fund for repayment to the State Office of Community Development, for overpayments of a State Grant on.the Communications network, having been read by title, only at the previous meeting, and being again read by title at this meeting, it was MOVED by Brown, seconded by Schussler that Ordinance No. 1591, providing for said appropriation, be passed:. carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1591, AN ORDINANCE transferring th'e amount of $1,657.17 from 695 - Contingency Fund to 000 - General Fund, and appropriating that :amount as a 1973 appropriation for 031- Police Department. • '• DECEMBERt3, 1973 An Ordinance appropriating money in various .funds :to = -salaries; wages, and personnel benefits for:the balance of the - current year, having been.read'by = title only at this meeting, was laid` on :the table for one week or until December 10, 1913. . City Manager McMicken reviewed the costs for each department listed in the ,proposed Ordinance. City Manager McMicken referred - to the proposed "Ordinance fixi•ng'and'imp.osing utility taxes and surcharges for 1974 explaining that there has•been no change in the 'charges. It was MOVED by Whitaker; Brown'that OrdinanceNo 15921,, imposing said• taxes, be passed: carried, Broad, Brown•, Cole:, Edmondson, Holbrook', Schussler and Whitaker voting aye on roll call. Finance Officer LeonardCrose spoke to the matter of revenue received from 'annual taxes. ORDINANCE 10. 1592, 'AN..ORDINANCE r,elating'.to licenses and business regulations; fixing and imposing annual fees or taxes on certain utilities and providing for a surcharge; saving taxes; °amending Subsection 5.50.050 (A) of. the City of Yakima Municipal Code and declaring an emergency. . • City Manager McMicken referred the appeal by Mitchell, Lewis' &'Staver.:and Packaging Systems Inc of_anadministrative denial'for outside utility'sewer service to Mr. Don Bond, Attorney Packaging Systems; Inc. Mr. Bond'referred to the question as to whether the outside utility agreement for sewer service 'should be approved when • submitted under protest. He referred to the easement,running through this property previously granted to the City for the right to hook up to aCity sewer in the future. There was discussion by the Council regarding the requirements existing at that .time .. and the current annexation policy. City Attorney Andrews_stated that he concurred that the City should grant the :hookup, but that the 'City.•.di&=not waive its present • requirements. Mr. Bond. indicated these firms wsh`i.'to retain.the option for future annexation. After due discussion, it was MOVED by Schussler,. seconded by Cole.that the agreement as amended be denied'and'that involved be instructed to sign II an agreement in standard form:- carried'; Broad, Brown, Cole', Edmondson, Holbrook, Schussler. and Whitaker voting aye'by voice vote. City Manager- McMicken:referred,to the :Statement of Impasse.with..the Fire Fighters Local 469, recommending that•a hearing' date be set: onthis'matter.: It was MOVED by Schussler, seconded 'by' Holbrook that December 10, 1973, be the date set for hearing on this- matter: -. carried, Broad, Brown;, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. City Manager McMicken reviewed City'Manager,.Report No. 198', regarding Medical�Insurance for L.E.F :.F. Personnel. He indicated that this report, is for information at this time- and that it will be brought back foraction after receiving'input•from the parties involved. 4. . ... .. - . . City Manager McMicken briefly reviewed'City Manager Report No. 199 regarding the_Tahoma . Cemetery' Irrigation System. .He reported on the total amount required for the replacement of!the present main with an automatic system..' Mr. McMicken indicated. that this request will be taken up in 1974 Budget Sessions ,regarding FRS Funding. A report having been received from the City the completion. of L.I.D. No. 990, Rock Avenue and'Others Domest'ic District, it was MOVED by Schussler, seconded by Brown that Monday, January 7, 1974, be the date 'set for Hearing on . tI e Assessment Roll: carried, Broad', Brown, Cole,' Edmondson, Holbrook', Schussler and Whitaker voting aye by voice vote. City Manager McMicken reported that 'bids were received and considered, by the bid board .. on October 23, 1973,'on L.I.D. No, 995, 44th Avenue - and'Others Paving Improvement District, as follows: (to include the deletion of Madera Way.) . - ' Superior Asphalt and.Concrete Company $18,809.50 f . Triangle Sand and Gravel.Company $19,067.00 . Yakim'Asphalt Paving Company $19,915.00 • A The City Engineer recommending that the bid be awarded to Superior Asphalt and Concrete Company,'who submitted the lowest and best. bid in the amount of $18,809.50, it was MOVED by Schussler; :seconded by. Edmondson, that the bid be awarded to Superior Asphalt * and Concrete Company and that the City Manager be authorized to enter into'contract with said contractor upon the •filing'of' the proper bond and insurance:, carried, Broad, Brown, Cole,,• Edmondson;.Holbrook, Schussler and Whitaker voting aye by voice vote,. Mr. Bob Dawley, architect, being present.,. reported on the bids received and opened on • November 28, 1973, for the - Flight Deck Restaurant addition and alterations, as follows: McDonald Construction $52,934.00 R &R Construction $64,.589.00 R.E.W. $58,300.00: V.K. No. 995, subject to deletion of Madera Way. • i32 DECEMBER 3, 1973 The City Engineer recommending that bid be to'Seals Construction, who submitted the lowest and best bid, it was 'MOVED by Schussler, , seconded by ;Whitaker •that the bid be awarded to Seals Construction Company - in'the amount of $52,585.00 and that the.City Manager be authorized to enter into contract with said :contractor - upon:the'filing of the proper bond and insurance: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. City Manager McMicken referred to'the Certification :by the:City Engineer of the completion of work_ and recommendation work accepted and final payment made on L.I.D. No. 994, Englewood Heights West and Others - Schedule III, it was MOVED by Schussler, seconded by Edmondson that the•report the City Engineer dated December 3,, 1973, with respect to the completion of work on Contract L.I.D. No. 994, Englewood Heights West and Others'Sewer Schedule III, be approved, the'work be accepted and payment - - -of the final estimate as therein set forth is hereby authorized: carried, Broad,., Brown, Cole, Edmondson; Holbrook, Schussler and Whitaker voting aye by voice vote. , There was discussion by the Council on the Council Rules pertaining to Order of Business. Several rearrangements of the agenda were proposed in order to bring matters of greater discussion and audience participation near the top of the agenda. .It noted that in order to effect a permanent change, the City*Attorney will need to prepare appropriate legislation. It was the consensus' of the Council that such a change‘be used on a trial basis fora few weeks. There being no further business.to come before the Council, it was MOVED by Holbrook, seconded by Cole that we do now adjourn-at-the 4:30 P.M.: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye voice vote. There was a general discussion by the Council concerning the 1974 Budget. No formal action was taken at this time. There being no further business to come before the Council, it was by Cole, seconded by, Holbrook that this meeting be adjourned at t.he of 1:30 P.M.: carried, Broad, Brown,.
