Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Betty L. Edmondson, Ralph Holbrook, Don Schussler and Bill Whitaker. Councilman Howard C. Cole was present after 1:50 P.M. Also present were City Manager Craig McMicken, Administrative Assistant 'Dick Zais, City Clerk Iris Litzenberger, Management and Budget Director Bob Hilsmann, Finance Officer Leonard Crose, Stan _ Darling representing the press, Chuck Rich, Pete Moore, Marilyn Hudson and Russell Miller. • IlL Mayor Broad referred to the matter of appointments to Boards and Commissions and the fact that there are two vacancies on the Plan Commission, the unexpired term of Charles Fowler and.John Vandiver's term which has expired. He reported that the Planning Commission has recommended the following: 1.Russell Miller, 2. Mrs. Allan (Debbra) Patterson, 3. Mrs. Robert Mather, 4. Pat Nagle, 5. Mrs. Pat Nagle, and '6. David Miller. After discussion, it was MOVED by Schussler, seconded by Whitaker that Russell Miller be appointed to fill the vacancy, created by the expiration of John Vandiver's term and.that Mrs. Debbra Patterson be appointed to fill the unexpired term of Charles Fowler - on . the Planning Commission: carried, 'Broad, Brown, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Cole absent. Mayor Broad also reported that there are two vacancies on the Board of Adjustment, explaining that West Britt's term has expired and Don Conner has resigned. - Discussion brought out that no-names have as yet been recommended and it was the consensus of the Council members that this matter be continued until names are submitted for consider- . ation. City Manager McMicken reported on the status of the lawsuitt in Longview regarding the Business Improvement Area Law. He stated that City Attorney Andrews reported that the case was dismissed, Longview withdrew.the suit, and that the City of Yakima did did put:the $1,000 into the lawsuit., Councilman Cole present after 1:50 P.M. , City Manager McMicken reported that the cost of the installation of Ceramascape on the Englewood Reservoir was $23,702.36, and gave the breakdown of the cost. _ Several more sections of the 1974 Preliminary Budget were reviewed: Traffic,` Traffic Engineering, Health,, Engineering and City Hall. The City Council then went into Executive Session for the purpose of discussing the pending lawsuit of Lee vs. City of Yakima, as a.resultof which discussion the Council.passed a:Motion "authorizing the City Attorney settle that lawsuit. At 3:00 P.M., the Council members moved -into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen.Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker,'City.Manager McMicken and.City.Attorney Andrews present on • roll`ca11. The Invocation was given by Councilman.Holbrook. The minutes of the previous regular meeting of November 19, 1973, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. An Ordinance appropriating $11,616 for the Firemen's and Policemen's - Relief and Pension Funds, having been read by title only at the previous meeting, and being again read by title at this meeting,'it MbVED by Holbrook, seconded by Edmondson that Ordinance No. 1587, providing for said appropriation, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1587, AN ORDINANCE appropriating the amount of $11,616 from unappropriated money in 000 - General. Fund and 632 - Firemen's Relief and - Pension Fund to various accounts within such funds as appropriations for expenditure from such funds during the year 1973. An Ordinance transferring $7,500 to the Trolley Fund and appropriating that amount for acquiring, shipping and refurbishing railroad cars, having been read by title only at the previous meeting, and being again read by title only at this meeting, it was MOVED by Brown, seconded by Cole that Ordinance No. 1588, providing for said appropriation, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1588, AN ORDINANCE transferring the amount of $7,500 from 462-Transit Fund to 362- Trolley Fund, and appropriating that amount as ,a 1973 appropriation for 362- Trolley Fund. City Manager McMicken referred to the proposed Ordinance relating to collection of yard refuse, explaining that this Ordinance would delete the requirement for cancellation of this service in writing, noting that these changes are also made by phone. It was MOVED by Brown, seconded by Cole that Ordinance No. 1589, providing for said , amendment to the existing requirements, be.passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1589, AN ORDINANCE relating to Health and Sanitation; specifing fees and prescribing rules and regulations applicable to refuse collection in the residential classification of the City of Yakima; and amending Subsection 4.16.140 (c) (2) of the City of Yakima Municipal Code. An Ordinance appropriating money from the Contingency. Fund for repayment to. the State Office of Community Development due to overpayment of a State Grant for the Police Department Communication Network, having been read by title only at this meeting, was laid on the table for one week, or until December 3, 1973. 6. . 5'7 NOVEMBER '2 6 , L9 7 3 • Cathy McLachlan; Chairman of Christmas' Festival Week, being present, briefly reviewed the activities listed on the Christmas Festival Week Calendar of Events. which was distributed to Councilmen._ She reported on the number of children involved in decorating the downtown and the activities running through. the present week.. Jeanne Conners, being present, reported. on the $1,500 donated by various businesses and read the list of those businesses contributing. . Mr. Gordon Spencer, being present, reported to the Council on the water and sewer billings for his apartment houses, referring to the comparison in new and'old billings resulting from rates established. by Ordinance No..1556. He stated that he feels the adjustments in rates to be unfair to tenants,,but indicated that he is satisfied that adjusted rates are correct. City Clerk Iris Litzenberger having submitted a letter on the referendum election held on November 20, 1973 for,the .employee- selected member of theCi,vil Service Commission esubmitted the names.of Al Coleman, Marie Donelson, and Harry Pop,'Sr. for the Council's, consideration. It was MOVED by Edmondson, seconded by'Holbrook that Marie Donelson be appointed to the Civil Service Commission to fill the unexpired position vacated by (Bud) Yaken, who recently resigned, which,term expires August 1, 1977: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. •- Mayor Broad referred to the letter from the Board of County Commissioners regarding the hearing to beheld on the pr-oposed.County. Gambling Ordinance December A8, 1973,.arid which letter requested input from the City on this matter. - It was MOVED by Holbrook, seconded by Cole that December 1973 be the date set for a public hearing by the City on -this matter: *carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting.aye.by voice vote - Dr. John. Fouts; Yakima Health District, being present, reported to the Council on -. • the request from the Health District for $14,306.25 as an additional grant for 1974' : . to fund P.E.P. employees. He explained that the EEA Program:will-be- phased out -, and that the County is not continuing the total funding of this portion of the Health District Budget. .He further explained their request for FRS Funds for-a possible five -year period. There was discussion_ by: the Council on the feasibility_ of u.s-ing these funds'for continuing this.program: City Manager McMicken indicated that -this • request will be taken under advisement :along with the 1974 Budget considerations. Also present and speaking to this matter was Mr. Karol.Kreutzman. City Manager McMicken referred.to the amending the Lease Agreement with the FAA,. explaining that it- releases the space leased from FAA by the old control tower. It was MOVED by,Whitaker, seconded.by Schussler that Resolution No. D -3036, providing for said amended lease agreement with FAA, be passed: carried, Broad, Brown,..Cole, Edmondson,..Holbrook, Schussler and.Whitaker voting aye on roll call. RESOLUTION NO. D-3036; .A RESOLUTION authorizing the City Manager and City .Clerk of. the City of .Yakima to execute a supplemental agreement with the Federal Aviation Administration regarding the lease of floor'space in the Yakima Air Terminal Building. Referring to..the proposed lease agreement with Cecil and Sandra Beauchamp, for space in the Yakima Air Terminal Building, City Manager McMicken explained that the office space previously used by the control tower is requested for office space for the Flight 'Deck Restaurant. It was MOVED by Whitaker, seconded by Brown that Resolution No. D- 3037,... authorizing the execution of said lease agreement, be passed: carried, Broad, Brown,. Cole, •Edmondson',;_Holbrook, Schussler and Whitaker voting aye on roll • call. RESOLUTION NO. D- 3037, A RESOLUTION authorizing and directing the City Manager and City Clerk Of the City of Yakima to execute a lease agreement with Cecil A. Beauchamp and Sandra M. Beauchamp, husband and wife, for office space .in the Air Terminal' Building. It was MOVED by Cole, seconded by Holbrook >:that Resolution No. D- 303:8, authorizing. the repair of the. water jet pump for the raw water intake without calling forbids, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. • RESOLUTION NO. D -3038, A RESOLUTION authorizing the repair of a water jet pump owned by the City without calling for bids. . City Manager McMicken briefly reviewed the proposed Resolution authorizing the submittal of pre_application_ forms to the Department of Social and Health Services for grants • for water capital improvements. He.indicated the.need for getting possible high - priority projects on the master list for future funding. It was MOVED by Edmondson, seconded by Holbrook that Resolution No. D -3039, authorizing the submittal of said pre - application form, be.passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll :call. RESOLUTION NO. D -3039, A RESOLUTION authorizing and directing the City Managaer and City Clerk of the City of Yakima to submit pre- application information to�the State of Washington, 'Department of Social and Health Services, concerning City Capital Improvement Projects for which state grants or loans are anticipated. • City Manager McMicken reported on the Kittitas- Yakima Regional Clearing House Board referrals regarding the Union Gap Comprehensive Water Plan and the Union Gap • • NOVEMBER 26, 1973 Municipal Well No. 5. He indicated that the City's. response on the first referral would be that the City is also making such a request, suggesting that it be on a regional basis. He that the City has no comment in regard to the request for Union Gap Municipal. Well No. 5. City Manager McMicken bri.etly reviewedsCity Matager Report No. 197 regarding Bicycle . Racks. He referred to several places listed in the report as locations for placement of the proposed racks. After due dicussion, it was MOVED by Edmondson, seconded by Whitaker that the City adopt the bike rack policy proposed and budget funds for this in the coming year: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. City Manager McMicken referring to the Certification by the City Engineer of the completion of work and recommendation that said work be accepted. and final payment made on the following: • a. L.I.D. No. 993, Englewood Heights West Addition Water District; b. 1973 Asphalt Concrete Overlay Program; c. Franklin Park Tennis Courts; d. Senior Citizen's Center; it was MOVED by Schussler, seconded by Brown that the report of the City Engineer with respect to the completion of the work on.said public works contracts be approved, the work be accepted and payment of the final estimates as therein set forth is authorized: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. City Manager McMicken referred.the review of transit patronage in light of the gasoline shortage to Transit Manager Bob Knight, who reported a 13.9 percent increase in bus patronage over last month. He indicated that if the present trend keeps up, there will be a need for more buses.
