The City Council met in session at 6:30 P.M. on this date in the Conference Room at
Yakima City Hall.
•
' Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Howard C.-Cole, Betty
L. Edmondson, Ralph Holbrook, Don Schussler and Bill Whitaker. Also present were City
Manager Craig McMicken, City Attorney Fr Finance Officer Leonard Crose,
Administrative Assistant Dick Zais, City Clerk Iris Litzenberger, Parks Director - Bill
Hutsinpiller, Transit Manager Bob Knight, Stan Darling representing the press, Chuck Rich,
Mary Hersey, Marilyn Hudson and Russell Miller.
The balance of the Police Department and Fire Department sections of the 1974 Pre- 1"iminary
Budget were reviewed.
There was discussion on the transfer of Cahalan Park to Union Gap and whether to ask
Union Gap for $15,000 for the new restrooms.:.. Parks Director Bill Hutsinpiller reviewed
his report on this matter and the. minutes of the Park Commission. Councilmen Brown and
Edmondson indicated'that they feel the City should get some money for the $15,000 the City
spent .for the new restrooms, along with guaranteed permission to schedule use of the
Park
spent_ City needs it. Other Councilmen indicated that they feel that they would, be
willing to forego the money, with the guaranteed permission. After'due discussion, it
was MOVED by Holbrook, seconded by Whitaker that the transfer of Cahalan Park to Union -
Gap be made without asking for any money, but to obtain an agreement to give ten years
permission to schedule use of the park as the City needs it: carried, Broad, Cole,
Holbrook, Schussler and Whitaker voting aye by voice vote. Brown and Edmondson voting nay.
There was discussion on the City- County regionalization study;the possibility of changing
the City's outside utility policy in exchange for something from the County. *
At 8:00 P.M., the Council members moved into the,Council Chambers for the balance
of meeting, Mayor. Broad presiding, Councilmen Brown, ; Cole, Edmondson, Holbrook,
Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present
on. roll:. call.
The Invocation.was given by Councilman Cole.

The minutes of the previous regular meeting of November 12, 1973, and the adjourned
regular meeting of November 16, 1973, having been duly certified accurate by two
Councilmen, and no'one.present wishing to have said.minutes read publicly,. Mayor
Broad declared said minutes approved as recorded.

Petition,No. 799, having been 'filed with the-City Clerk on November_15, 1973,
by employees from business establishments in the area proposed for the .
Pierce Avenue - "B" Street - Lincoln Avenue project, it was. MOVED by Whitaker,
*seconded by Holbrook that Petition No. 799 be referred to the City Manager and
staff for study and recommendation:. carried, Broad, Brown, Cole, Edmondson, Holbrook,
Schussler and Whitaker voting aye -by voice vote.
Damage having been filed the City'Clerk on:
a. November 13, 1973, by Jack'W..Bledsoe., 1326 Fair Avenue:, in -the amount
of "$81.33, for damages to..his-automobile by a city truck,
b. November 13, 1973, by Ernest Falk, 4209 Scenic Drive, in the
amount of $10 for overcharges on yard service;
c. November 14, 1971, -by Ronald W.' ,Graham, .609 North 7.th..Street, 'in ..the
amount of $100,000 for personal injuries during a police incident;

It was MOVED by Holbrook, seconded by Cole that -said Damage Claims be,referred
to the Manager. for study and recommendation: carried,•Broad Brown, Cole,
Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.

An Ordinance appropriating $11- ,616.00-for the Firemen's and Policemen's-Relief
and Pension Funds, having been read by title only at this meeting, was laid on
the table for one week, or until November 26, 1973. City Manager explained
that this Ordinance covers an increase in Pension benefits to those Policemen
and Firemen not the • present LEFF System, -and which raise is- required by
- an amendment to•State law.' • 0
• City Manager McMicken referred to the Ordinance creating a Trolley Fund .as a depository
for funds.to for acquisition, delivery, and refurbishing of trolley cars for
use by. the City on Yakima Valley Transportation Company lines,,. stating that this
Ordinance is in accordance with the letter of request from Mr. Lust read at the
previous meeting. It was MOVED by Brown, seconded by Edmondson,-- that Ordinance
No. 1586, creating said Trolley. Fund be passed: carried, Broad, Brown, Cole,
Edmondson, Holbrook, Schussler and Whitaker voting aye.on roll call. 0

mi"ssion. Councilman Brown reported that the County Commissioners would like the:City
'•Council'to m'ake'a formal proposal to them with these ideas. There was further discussion
on the= fact` that the 'City Council wants the same type of zoning and building - codes on the
outskirts as:within the City. After discussion, It was-MOVED by Holbrook, 'seconded by
Whitaker that the following ideas be presented to the County Commissioners: that the
County Commissioners agree to the same zoning and building codes on the outskirts as with-
in the City, that when that agreement is made, the City Council will change the outside
utility policy, and that the Regional Planning Commission be revamped: carried, Broad,
Brown, Cole, Edmondson, Holbrook and Whitaker voting aye by voice vote. Schussler voting
nay.

NOVEMBER 19, 1973
ORDINANCE NO. 1586, AN ORDINANCE relating to Funds and Accounts; creating a Trolley Fund
as a special fund and designating its purpose, sources of funding and means of expenditure
therefrom; enacting Chapter 3.95, ."Trolley Fund ", and its various sections as a new chapte
and sections of the City of Yakima Municipal Code; and declaring an emergency.
An Ordinance transferring $7,500 to'the Trolley Fund and'appropriating that amount •
for acquiring, shipping,•and refurbishing railroad cars, having been read by title
only at this meeting, was laid on the.table for'one week, or until.November 26, 1973.
City Manager McMicken referred to'the proposed Citizens Trolley Advisory Committee,
explaining that this committee will advise the :City on expenditures of funds from the
Trolley-Fund. Mayor Broad read the following list of names of those,.to be,on the committe :
Wray Brown, James Lust, Ray Pittman, Robert Wilson, Elwood Miller,.John Schactler,
Don Williams, Mike Mercy, and Lenore Lambert. It was MOVED by Holbrook, seconded by
Cole, that Resolution No- 'D-3034, establishing said Citizen Trolley Advisory Committee,
be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker
voting aye by voice vote.

RESOLUTION NO. D -3034, A RESOLUTION establishing 'a Citizen Trolley Advisory Committee.
•
Mr.'Ray Munson, Chairman of the Yakima County Commission on Alcohol.Abuse and Alcoholism,
being present, reviewed his letter and attached report to the Council, dated November
12, 1973, regarding,funds requested for a'detoxification demonstration project. He
explained that this program.is, being setup to establish adequate detoxification.services
before enforcement of the Uniform Alcoholism Intoxication Treatment Act to be effective
January,_ 1975. He•further'reported.on present 'negotiations for appropriate space in
which to conduct'the program. Mr. Munson requested a total of $30,000 from FRS Funds
to help cover operating and capital expenses. City Manager McMicken indicated that
this request would be taken up along with the 1974 Budget considerations.
Mr. Anthony DiTommaso, DiTommaso Brothers Garbage Service, being present, reviewed
the offer by firm for handling City refuse collection as contained in a letter
dated November 13, 1973. He reported on the proposed rates, equipment, and crews to
be used in this service.. Mayor Broad indicated to Mr. DiTommaso that this offer is
being taken into consideration along with that from the City staff also -on the agenda
for this meeting.: •
A report havng'been' from. the Planning Commi on the amendment to the
Planned Development filed by Glascam Builders, Inc., for property located at the northeast
corner of 40th•Avenue and Nob Hill Boulevard, it was MOVED by Schussler, seconded by
Whitaker that Dec 3,.1973, be the time set for Hearing on this matter:. carried,
Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice
vote.
Referring to the request by t he Yakima Mall to erect a parking directional sign in •
the Naches Parkway; City Manager McMicken reviewed the recommendation'foiund ' in•the
Planning Commission Minutes and Park and Recreation.. Commission minutes dated. November
13,'1973, and November 19, - 1 . 973, respectively. He indicated the recommendation from
both commissions for denial' request to place a sign in the Naches Parkway,. but
rather their recommendation f:orthe•ins,tallation,o"f mid -block standard signs directing
traffic to the Mall Garage'Parking. Mr.,,.McMicken read a portion from the Uniform Traffic
Control Manual regarding preferred sig:n City Attorney Andrews outlined the
legal principles to be followed. Mr., Dick Tweeten, Yakima Mall Inc., being present,
reported on the locations preferred - and.the type of signs proposed to correspond with
the Naches Parkway. He indicated that along with a smaller sign for the Parkway, larger
mid -block signs are also requested.. Traffic engineer, Hal Kensler, indicated that
by 1975 the City will have to conform signing to. the Uniform Code that has been adopted.
He suggested that any signs put up now should be in conformance with this code. After
due discussion, it was MOVED by, Whitaker, seconded by Brown, that the request by the
Yakima Mall to place a parking direction sign in the Naches Parkway, be denied: carried,
Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote;
Mayor Broad voting nay, by voice vote. City Manager McMicken indicated that City Staff
will work with the Yakima Mall regarding conforming signs to be put up at other locations.
Present and speaking to this matter was Althea Hayden.
City Manager McMicken, briefly explained the request by the Yakima Health Department
for $14,306.25 .as an additional grant for 1974 to fund P.E.P. employees. Councilman
Cole and Edmondson spoke in favor of this request, noting that insufficient_ funding
will mean cutting. back on employees. It was MOVED by Schussler, seconded by Whitaker
that this matter be set over one week: carried, Broad, Brown, Cole, Edmondson, Holbrook,
Schussler and Whitaker voting aye by voice vote.
In accordance with discussion and presentation made by City Staff at the previous Council
meeting of November 12,.1973, City Manager McMicken reviewed City Manager Report No.
196 entitled Refuse Collection - SHU -PAK System. :He indicated that this report and the

attached'Memo from Public Services Director,•Jack Daniel, is a follow -up to - the oral
presentation given at the previous. Council meeting and recommended the purchase of
six SHU -PAK trucks. .After due discussion, it was" MOVED by Whitaker, seconded Brown
that the Citybe authorized to purchase six SHU -PAK loaders as specified in the report
from Jack Daniel: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and
Whitaker voting aye by voice vote. Present and speaking to this matter were Chuck
Rich, Pete Moore., Mary Lamb,'and'Tony D. DiTommaso.
City Manager. McMicken referred the status,:report on ambulance regulations to City Attorney
Andrews,'who reviewed the earlier request.. by Yakima Ambulance for restriction of ambulance
services in Yakima or a limitation on the number of ambulance vehicles. He•reported
that State Hearings will be held at which,the City should make its appearance before

any action is taken on this matter. Mr. Andrews stated: that the situation that : ••
existed at that time is no longer a problem. as Yakima Ambulance'is.now the only ,
one licensed.
In,accordance with a complaint.re the previous meeting from Mrs. Gerald
Gaudette regarding' vicious'dogs running - loose in .the vicinity of North Sixth Street, .
II City Manager McMicken reported on contacts made re this matter. 'Police Chief, •
Jack LaRue, gave .a report on the number of notices given to the parties involved
and reviewed action taken on October 18 -23, 1973. He reported that last week a
warrant was issued by the Police Department to one of the parties involved. Mrs.
Hayden,..being present, also spoke to this matter and explained •action taken in
reference to her dog running loose. Mrs. Gaudette, being:present,.indicated that
the. dogs still continue to run loose. Mayor Broad reported that the situation
is now going to be,handled by the court. Also present and speaking to this subject .
was Mr. Robert Lounsbury.
City Attorney Andrews referred to.the prbposed Resolution vacating utility easements
on property located in the High View..Courts Addition. He indicated'that the.petitioners
desired to acquire room for construction purposes. It was, MOVED by Schussler, .
seconded by Edmondson.that Resolution No. -D- 303.5, vacating said .easements, be passed: •
carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting
aye on roll call. .. .

RESOLUTION NO.,D -3035, A RESOLUTION'.vacating _ public,utility easements held by the
City of Yakima over and across parcels of real property situated in High View Courts
Addition to`the,City of- Yakima.
City Manager McMicken referred to a recommendation from architect Ron Cameron for
extension of time.on.the completion of the new fire stations due to unfavorable
weather conditions last winter. He indicated that the recommended date for- extension
II is November 10, 1973. .It. was, MOVEDby- Whitaker,,seconded•by Schussler that the -
extension date of November'10th be approved: .carried, Broad, Brown, Cole, Edmondson,'
Holbrook, Schussler and Whitaker voting aye by.voice vote.
City Manager McMicken requesting authorization. for out -of- state - travel for. Hal
Kensler and Glen Pleasant, Traffic' Department, to travel to Eugene, Oregon to attend
the fall meeting -of the'-Signal Association, November 29 - December 1, 1973, it
was MOVED by Brown, seconded by Schussler.that said travel'be - approved: carried,
Broad, Brown, Cole, Edmondson, Holbrook, Schussler` acid Whitaker- voting; aye by voice
vote. . .
Mayor Broad referred to a request from Phil Pleasant and Tailor to speak to .
the Council regarding needs in the Southeast Community of Yakima. Councilmen decided
on the Study Seasion meeting of December 10, 1973 as the time to hear their presentation
on this matter. .
