HomeMy WebLinkAbout11/12/1973 Business Meeting r 50 -NOVEMBER 12, 1973 The City Council met in session •at 3:00 P.M. on this date in the Conference Room at Yakima City Hall. • Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Howard C. Cole, Betty L: Edmondson,. Ralph Holbrook, Don Schussler and Bill Whitaker. Also present were City Manager Craig McMicken, Finance Officer Leonard Manaq_ement. <and Budget Director Bob Hilsmann, City Attorney. Fred Andrews, Administrative Assistant Dick Zais City Clerk Iris Litzenberger, Stan Darling representing the press, Marilyn and Chuck Rich.' City Manager McMicken stated that a law suit against the City has been settled in favor of the City and asked. the City Attorney to report on. this matter. Mr. Andrews, reported that the previous week the`law suit which had been brought against the. City by Billington. Builders to prevent the City from "enforcing the ordinance removing parking from in front of Billington:Builders premises•, east of Fifth Avenue on the south side of the ' street was heard in court. He..reviewed the matter of the L.I.D. created approximately two years ago from`Rock • Avenue to 16th Avenue -- Widening and Improving of Street,. the obtaining of 10 feet of property ., for $300 in trade for Billington Builders not having to pay for share of the L.I.D., the 'fact that in 1971 the Traffic Engineer recommended the.removal..of on both sides of the street, that several hearings were held and that action on this matter had been postponed for one year to give the owners =timejto.make provisions for other parking. At the. end of the year, the Council passed an ordinance to remove the parking,at which time Billington Builders filed a lawsuit against',,.the City. Mr Andrews reported that the Court had ruled in favor of the City and "parking can now be. removed in accordance' with the ordinance. Council members and the City Manager complimented City. Attorney Andrews on a job well done. • City Manager McMicken reviewed a portion of the 1974-Preliminary Budget, covering'the following sections: Budget`Message, Expenditures, Number of Personnel, Summary of.Double Budgeting, Revenues,- CityCouncil, City Manager, Group Directors, Records, General • Accounting, Personnel, Treasurer, Purchasing' Planning, Code Administration, Housing, Police Department. • There will'be review and discussion on the balance of the 1974 Preliminary Budget at II next week's meeting. • • At 3:00 P.M., the'Council• members moved into the Council :Chambers for -the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker, City Manager.McMicken and City'Attorney Andrews present_ on• roll call. The Invocation was given by City Attorney Andrews. The minutes of the previousregular adjourned meeting of November 2, 1973, and the - regular .meeting _of :- November .5,. 1.973, : having .• been duly... certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded.. Parks Director; Bill Hutsinpiller,. spoke in recognition and appreciation of John Chesterley as a recipent of the Washington'Recreat.ion and Parks Society Award, stating that he was presented with the. Citation:. Merit. Award at the State Meeting. County Auditor, Chet Hatfield, being present, commented on Mr. Chesterley's contribution to the Lions Club. An Ordinance appropriating $10•,000 within:the General Fund for the,Legal Department, having been read by title only at the previous meeting of November 5, 1973, and being again read by title at• this meeting, ,' it . was: MOVED byF. Schussler, seconded by Holbrook. that Ordinance No 1585, :_ providing' for said':appropriation, be passed: carried Broad, Brown, Cole, Edmondson, Holbrook; Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1585, AN ORDINANCE appropriating the amount of $10,000 from unappropriated money in 000 - General Fund to various accounts in 017 -Legal Department as 1973 appropriations for 017. =Legal Department. Mrs. Gerald Gaudette, 701 North 6th Street, being present, spoke to the Council concerning several vicious dogs which continue to run loose in her neighborhood. She explained that the matter has already been to court; but the owner has paid the fine. There was discussion by the Council co the history of this situation. City Clerk, Litzenberger, explained that the owner each.time; paid the fine, but that when the Animal Control Officer patrolls, the dogs are tied up.. • She. indicated that the Animal Control . Officer reported that the matter will need to go.through court again. There was further ;discussion by the Council regarding:possibl,e reports from the Police Department and the Animal Control Officer. .Mayor Broad indicated that he would work on this matter to resolve it as soon as.possible. Mr. Art Fellows, 704 South 2nd Avenue, being present, questioned Councilman Wray Brown . concerning the City's purchase of street cars. Councilman Brown briefly explained the research that has been done, the plans for the use of bus operators, and the budget presently being set up. Mr. Ray Pittman, Secretary- Manager of the Visitors and Convention Bureau', being present, gave a progress report on the material for convention promotion, to include a slide presentation and convention brochure. He indicated that these items:should be completed by the first of next year. City Attorney Andrews reviewed Ordinance No. 1581, as it pertains to.the Traffic Engineer's responsibilities for center- street parking in the newly established. pedestrian mall on 2nd Street. He explained the section of the Ordinance relating to this matter. { - _51 1\TOVEMBER:12 ' 1973 City Manager McMicken reported on the Energy Conservation .. Progr�am;*referring to the request by the President to operate public vehicles at.speeds not to exceed50 miles per hour and stated that this will be law•as soon as posted Mr. McMicken reviewed the present effort being carried out to. effect a reduction in electrical consumption . by the. City Departments. He indicated a request for curtailment of advertising and. display lighting for•retail outlets and parking lot lighting. It was MOVED by Schussler, seconded by Cole that legislation be prepared requesting that businesses turn out II their display lighting after bus'iness,hours: carried,.Broad, Brown.,. Cole, Edmondson, Holbrook,. Schussler and Whitaker voting aye by voice vote. Director of Public Works, Dave Vargas, reported on the City's policy regarding street lighting, stating that a report received•from Pacific Power & Light Company does- not•recommend any reduction in street lighting.. Mr. Vargas reviewed long -range steps that could be taken effect a savings on Street.lighting. Those' present and speaking to this matter were Mr. Frank Boyle and Mr. Gary Walrack., . . _ City Manager -McMicken referred to the request by the Yakima Mall to erect a mall parking sign at the Naches Parkway island. Director of Community Development, Jay Otto,•reviewed the Planning Staff report on this subject dated- November.8, 1973. • With the use a map, he indicated locations of present parking signs, reporting on . a. recommendation from the ,Staff for denial, since ,.approval might :set a, precedent - for the. use of public land for'private commercial purposes. After' °due discussion,. • it was MOVED by Schussler, seconded by Whitaker that;. this matter be_.referred to the Planning- Commission and Parks Commission for : further study, and recommendation: carried:, Broad, Brown, Cole,.Edmondson, Holbrook'and Whitaker voting aye vote. Collection,' systems ' He indicated that the staff ' is :present•ly looking into the SHU PAK system. He further reported °ontpe proposal for the•use of,six trucks., indicating that this method wouid the use of plastic:: bags. Director of Public Services, II Jack:Daniel, reported on the;type of.equ pment used'in the SHU - PAK system, noting that delivery..ofuipment could be made.in January, 1974. He explained that diesel. units are proposed and that`t1e;Rufuse Department would provide the same services as now with ''no change in 'the charges, Mr•. Daniel indicated that this be a two- man. operation -:` There by the Council on the carry - out service policy. Refuse Super Glen Koeling explained the proposal to divide the s. City into five district° for 'collection,., noting . th'at the' days for refuse pickup would probably - be changed He further reported on the cost- savings expected. from this system.
