HomeMy WebLinkAbout10/01/1973 Business Meeting �30 OCTOBER 1, 1973 The City Council met in session at 1:30 P.M. on this date in the Conference Room at. Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, -Wray Brown, Howard C. Cole, Ralph Holbrook and Don Schussler. Also present were Acting City Manager Fred Andrews, Public Service Director, Daniel ;*Administrative"Assistant Dick Zais; City Clerk, Iris Litzenberger; Council candidates, Russell Miller and David Miller, and Stan Darling, representing the press. Councilman Bill •Whitaker requesting by phone to be excused from this meeting, it was MOVED by Schussler, seconded by Holbrook that he be excused: carried, Broad, Brown, Cole, Holbrook and Schussler voting aye by voice vote. Edmondson absent. It was noted that"the matter re •Albert.Stelzer water overcharges;has - been settled administratively. There was detailed discussion of the Model Litter Control Ordinance. It was noted that copies of,the proposed Model Litter Control ordinance were distributed to Council members previously for their study. Dick Zais reported on his review of the legislation, the State Model Litter Control Act and the proposed ordinance, indicating that he had tried to work out a program that would follow the State Model Litter Control Act. .Jack Daniel stated that he had discussed this matter with the.Police, Fire, Refuse and,Parks Departments, and that the Public Service Group expressed a desire that this ordinance be adopted. Councilman Schussler stated that he doesn't think that the City should have to prepare an ordinance, since the State Ordinance has to be followed. Councilman.Holbrook indicated that he also is in favor of the regulations of litter control being enforced in accordance with the,lState Law. Other Council members indicated - that they would like to have an Ordinance passed in the City. After due.discussion, it was MOVED by Cole, seconded by Brown that legislation be prepared re a Model Litter Control ordinance: carried, Broad, Brown and Cole voting aye by voice vote. Holbrook and Schussler voting nay. Edmondson and Whitaker absent. The Council members then went into Executive Session at 2:30 P.M., on the matter of. Collective Bargaining. At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Cole, Holbrook and Schussler, and Acting City Manager Andrews,present on roll call. Councilmen Edmondson.and.Whitaker absent on roll call, having been excused at previous meetings. The Invocation was given by Councilman Cole. The minutes,of the previous regular meeting of September 24, 1973, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. Mayor Broad expressed appreciation on behalf of the City for the years of service given to the Civil Service Commission by Mr. Byron W. Yaden. Mr. Yaden being unable to attend this meeting, the award of appreciation was presented to his son, David Yaden, who accepted the award and expressed appreciation for this presentation on behalf of his father. Petition No. 792, Notice of Intention to Commence Annexation Proceedings, having been filed 'with the City Clerk on September 27, 1973, by Homer B. Hubbard and Others, requestine annexation or property located between Englewood and Lincoln from the City limits • to62nd''Avenue, it was MOVED by Schussier,'seconded by Cole that today be set as the time for a- meeting with the initiating.parties - who signed the:Notice of Intention to Commence'Annekation Proceedings dated September 27, 1973, those initiating parties being Homer B. Hubbard, Cler H. Hubbard, Donna M. Chartier, Vern C. Chartier, Stanley J. May, Donna L. May and Hubbard & Hansen, Inc.: carried, Broad, Brown, Holbrook and Schussler voting aye_ by voice vote. Edmondson and Whitaker absent. The petitioners, being present, and indicating that they are willing to assume their share of the City's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by Petition No. 792 (Notice of Intention to Commence Annexation Proceedings) be accepted by the City.of,Yakima and the area sought to be "annexed be required to assume the City's existing indebtedness, and that a Notice of Intention to Annex be filed with the Yakima County Boundary Review Board. The above MOTION was made by Schussler, seconded by Brown and carried, Broad, Brown, Cole, Holbrook and Schussler voting,aye by voice vote. Edmondson and Whitaker absent. Several persons present indicating that they are not in favor of this area - being annexed, Acting City Manager Andrews briefly explained the procedure followed for annexations, stating that a petition for annexation may now be circulated by the petitioners. Present and speaking to this matter was Assistant. Planner, Glenn Rice. Petition No. 793, Petition for Election, having been filed with the City Clerk on September 27, 1973, by residents of the Glen Manor Addition, located in the vicinity of South 48th,- 50th,and Bristol Way, Director of Community Development, Jay Otto, reviewed the Planning Staff Report on this 'subject dated September 28, 1973. He indicated that these residents are seeking annexation for.purposes of adequate • land use protection. There -was considerable discussion on the elimination of the island area included in the.proposed annexation. After due discussion,'it was MOVED by. Schussler, seconded by Cole that this matter be referred to Staff for the preparation of appropriate legislation necessary to commence annexation proceedings: carried, Broad, Brown, Cole, Holbrook and Schussler voting' aye by voice vote. Edmondson and Whitaker absent. Damage Claims having been filed with the City Clerk on September 27, 1973, by George Aubrey, 503 East Chestnut,:in the amount.of $200,.000 for personal injuries received in connection with an automobile accident, and by Anthony Kutch, 808 North 4th Street, in the amount of $200,000, also for personal injuries received in the'same accident, it was MOVED by Holbrook, seconded by Schussler that said Damage Claims be referred, to the City Manager for study and recommendation: carried, Broad, Brown, Cole, Holbrook and Schussler voting aye by voice vote. Edmondson and Whitaker absent. OCTOBER • 1 ,. 19;7 An Ordinance appropriating $644,135 to within -.the Airport Improvement Fund,' having. been read by title was , laid - on the table for one week, -or until October 9, 1973. Acting City Manager - Andrews explained the Capital Improvements included in this amount. Present.and speaking to the matter of the proposed restaurant expansion Director of Public Services; JackDaniel. . Acting City Manager Andrews referred to the authorization given last week for the.prepar- ation of legislation given Manager Report #192 concerning Reorganization - of Top Management. He:brief:ly reviewed the provisions. and changes the proposed ordinance. After due discussion, it was MOVED by Brown, seconded by Holbrook that.Ordinance No. 1572, reorganizing 'management positions of city government, be passed; carried, Broad,Brown, Cole, Holbrook and Schussler voting aye on roll call. Edmondson and Whitaker absent. - • ORDINANCE NO. 1572, AN ORDINANCE-relating-to local governmentadministration; designating the organization of management groups, departments -and offices.and specifying their responsibilities; amending sections 1.18.020, 1.18.030, 1.18.'040, 1.18.050 and 1.18.060; in.acting sections 1.18.017, 1.18.041 and 1.18.061.as new - sections; and repealing sections 1.18.052, 1.18.053, 1.18.054, 1.18.055, 1.18.056, 1.18.065, 1.18067, 1.1 1.18.072, 1.18.080, 1.18.090, 1..18. 091, 1.18.092, 1.18.100, 1.18.111, 1.18.120, 1.18.130, 1.18.132, 1.18.134, 1.18.135, 1.18.136, 148.140, 1.18.142, 1.18.145, 1.18.150, 1.18.155 and 148.196, all of the'City of Yakima Municipal Code; and declaring an emergency. • • Acting City Manager Andrews referred to the, proposed.- ordinance creating a Park Recreation Commission, stating that this.ordinance retains'the existing provisions,. but adds a new Chapter to the Municipal Code...It was MOVED by'Brown, seconded by Schussler that Ordinance No 1573., creating a Park Commission and adding a new Chapter to the.Yakima 'Municipal Code, be passed: carried, Broad, Brown, Cole, Holbrook and Schussler voting aye on roll call., Edmondson .and'Whitaker absent. ORDINANCE NO. 1573, AN ORDINANCE relating to local government - administration; creating a Park and Recreation Commission, specifying'its members and terms of office; and acting Chapter 1.35., "Park and Recreation Commission ", consisting of Sections 1.35.010'and ' 1.135.,020, as a new chapter and new sections of the City of .Yakima Municipal Code; and declaring an emergency. It MOVED by Holbrook, seconded by Cole that Ordinance No. 1574, specifying salaries of certain City positions, be passed: .carried;.Broad, Brown, Cole,.Holbrook and.Schussler voting aye on roll call. Edmondson and Whitaker absent. - Acting. City Manager Andrews explained that this ordinance reflects the new.positions included:.in the management reorganization. • ORDINANCE NO. 1574, AN ORDINANCE relating to city personnel; amending the class•ifi,cation and compensation plan—for—city employees; amending Subsections 2.20.100 (a), 2.20.100 (b) and 2.20.100 (c), all of the City of'Yakima Municipal Code; and declaring an emergency. Mr. Mike Cadden, .representing the Montgomery Elevator Company, being present, requested that the City go out for sealed bid on its 'elevator service,•stating that his company wishes to do business for the-City. After'due discussion,,.it was MOVED by Schussler, seconded by Brown that this matter be' referred to the City Manager for study and recommendation: carried, Broad, Brown, Cole, Holbrook and Schussler voting aye by voice vote. Edmondson and Whitaker absent. • In „accordance with the recent management reorganization and a new City Clerk being designated,. Acting City Manager Andrews administered the Oath Office to Iris Litzenberger, ° a's. City Clerk. Mr,.Andrews explained that it is necessary to appoint .the City Clerk as Clerk of the Council. It was MOVED. by Cole,-seconded by Brown that Resolution No. D -3014 appointing Iris Litzenberger as Clerk of Council,' be'passed: carried, Broad, Brown-,, Cole, Holbrook - and Schussler voting aye - on roll call.. Edmondson'•and Whitaker absent. . RESOLUTION NO. D- 3014, A' RESOLUTION appointing a Clerk of the Council.. ._ Acting City Manager Andrews reviewed City Manager Report #193, concerning the General Occupation Tax - Financial Institutions. He referred to the State Law which now makes it possible to tax.banks, and other finanacial institutions, noting that the loan companies which, according to new legislation, should7not been axed for the past two years, w will be credited_ :.toward payment of the license fee for the two license years. The city,Manager recommending that a new local ordinance be prepared in accordance with the State Law and taxing banks and other financial. institutions, it was MOVED by Cole, seconded by Brown that this- matter be referred to City Staff'for the preparation for appropriate legislation implementing the new tax to begin July, 1974.: carried, Broad, Brown, Cole, Holbrook and Schussler voting aye by voice, vote. Edmondson and Whitaker absent. c. •J It was MOVED by Schussler, seconded by Holbrook that Resolution.No. D- 3 015 , - : ,authorizing. the purchase of barricades, without for bids, be passed: carried'road, Brown, Cole, Holbrook and Schussler voting aye on roll call. Edmondson and Whitaker absent. Acting City Manager Andrews expained_ these barricades are.being used in a current street resurfacing project. • RESOLUTION NO. D -3015, A RESOLUTION authorizing the purchase of barricades without . calling for..bids. ., • Acting City Manager Andrews referred the matter of the request by Roy Cox for parking on a portion of North 1st Avenue to. Traffic Engineer, Bill Stark, who reviewed his memo 'on -this subject dated 1, 1973, recommending denial of this'request.. He explained that Mr. Cox requests that the- area across :from Pacific Fruit be open for employee parking, but that Pacific Fruit asks that the prohibited parking'remain to provide room for loading trucks. 'There wa considerable discussion by the. Council ' concerning alternatives- to the present parking•situation in this area. Mr. Cox, being present, drew a diagram of the area in question, requesting that employees be allowed • _32 October 1, 1973 to park between the electrical poles and the indicated fence. After due discussion, it was the concensus of the Council that this matter'be referred back to the Traffic • staff for further study with a report back to the Council. Present and speaking to this matter was Mr. Don Rice, Office Manager at Pacific Fruit Company. Acting City Manager Andrews requesting authorization for out -of -state travel for Wayne Dean, Parks and Recreation Department, to to Harrison Hot Springs, Canada, to attend a Board Meeting of.the Northwest Turfgrass Association, October -6, 1973, it was MOVED by Brown, seconded by Cole that said travel be approved and expenses paid: carried Broad, Brown, Cole, Holbrook and Schussler.voting aye by voice vote. Edmondson and Whitaker absent. There being no further business to come'before the Council, it was MOVED by Holbrook, seconded by Cole that this meeting be adjourned at 4:30'P.M. to Friday, October 5, 1973, at the hour of 12 :00 Noon, to then meet at the Flight Deck Restaurant: carried, Broad, Brown,, Cole, Holbrook and Schussler voting aye .by voice vote. There was discussion concerning various subjects, but no formal action was taken by the Council at this time. There being no further business to come before the Council, it was MOVED by Brown, seconded by Whitaker that. we do now adjourn at the.hour.of 1:15 P.M.: carried, Broad, Brown, Schussler and Whitaker`voting aye by voice vote.
