The City Council net in session at 1:30 P.M. on this date in the Conference Room at
_>• Yakima City Hall.
Councilmen present at,the meeting_ were Mayor Bert Broad, Wray Brown, Don Schussler and
Bill Whitaker. Also present were Acting,City'Manager,.City Attorney Public
Services Director, Jack.Daniel; City Engineer, :Fritz Jaeger; Director Parks and Recreaticn,
Bill Hutsinpiller; Director of Community Development, Jay Otto; Administrative Assistant,
Dick Zais; City Clerk, Iris Litzenberger; prospective Council candidates, David Miller
and Russel'Miller, and Stan .,Darling; representing the press.

The. Capital Improvements Program was discussed in detail by Council members and Staff
members. Various projects in the-program-were explained, such as:
Street Improvements -- by :Fritz Jaeger
Planning Projects -- by Jay Otto •
Parks 'Improvements -- by Bill Hutsinpiller
Fire Department items - -.by Jack Daniel
Airport Improvements -- by Jack Daniel
There was discussion on the matter annexation at 48th and Tieton by the.
election method.
The City Clerk was asked to provide - Council•material - packets to the prospective Council
candidates who have been-coming meetings; David Miller and Russell Miller.
At 3:00 P.M., the Council members moved.into the Council.Chambers for the balance of
the meeting, Mayor Broad presiding, Councilmen. Brown,.Schussler and Whitaker, and Acting
City Manager Fred,Andrews present on roll call. Councilmen -Cole, Edmondson and Holbrook
absenton•roll call, having been. excused at previous meetings.
The Invocation was given-by Acting City•Manager::Fred_Andrews.
The minutes of the previous regular meeting - of September 17, 1973, and the.adjourned

regular meeting of September 18, 1973, having been : certified:accurate by two:Councilmen,
and no one present wishing to have said minutes read. publicly, Mayor Broad declared said
minutes approved-as recorded. :-
This being thentime :for the Hearing •onthe'Rezone Application.filed by the•Bank of
Yakima, requesting Planned - Development'Zone for property located at 1624 South 24th
Avenue, Principal,Planner; Dick Hill; the. Planning Staff Report on this subject.
dated July 27, 1973, and August -17; 1973, respectively. He indicated the proposed account-
ing and proof- center would be for bank purposes only. Mr. Hill further stated the recommen', - "_
d°a_tion of the Planning Commission for approval.-Of request subject to the.following
conditions:
1. That landscaping and irrigation plans be submitted to and approved
by•the Department•of-Community Development prior to issuance of any
building permits.
2. That sign size, design, and•location be submitted to and approved
by the Department of,Community Development -prior to issuance of any •
building permits. • _
3. That street trees be provided.
4. That adequate fire protection, including•location and_'installation -
of fire . hydrants be provided in with requirements of..

ORDINANCE NO.: 1568; AN ORDINANCE acceptingthe recommendation of :the:Planning Commission
and rezoning- certain property situated'at 16:24 South Avenue in the. City of Yakima,
Washington, from R -4, Suburban'Residence'Zone to Planned Development Zone.
An Ordinance - appropriating- $2-,6.00 within the: :General .Fund..to:purchase a Mimic Identification
System for the Police Department; having'been° read by title only at- previous meeting,
and being read again by title .at this meeting; it by.Brown,, seconded by
that Ordinance No 1569, providing for said appropriation, be passed: carried, Broad,
Brown, Schussler and`Whitaker voting aye on roll call. Cole, Edmondson and Holbrook
absent. Acting .City Manager, Fred Andrews - ,•indicated that the funding for this machine
has been provided from sources outside the City.

ORDINANCE NO. 1569, AN ORDINANCE appropriating '.the :amount of. $2; 6•.00 :to. Account 031 -521-
20-64 of the ,19.7-3 for 031- Police Department.
An Ordinance transferring $2,686 from the Contingency Fund to the General Fund and appropri-
ating that amount to fund the City's share of the Demonstration House for Consumer Counsel-
ing Components -of the,- Ne ighborhood:Conservation`Pilot Program, having been read by title
only at the previous meeting, and being read again by, at _this. _meeting., it was - MOVED
by Brown, seconded by Whitaker that Ordinance No. 1570, providing for said transfer and
appropriation,- be passed carried, Broad; Brown, Schussler and Whitaker voting, aye on
roll call. Cole, Edmondson- and.Holbrook absent
DRDINANC•E•NO. 1570, AN ORDINANCE transferring .the amount :of - $2,686 - ^from 695- Contingency

ORDINANCE NO. 1571, AN ORDINANCE fixing the. time of delinquency'of installments of assessments
levied for the payment of the'cost'of the improvement in Local Improvement District
No. 989, and providing for the of bonds with attached for the payment
of the unpaid portion thereof.
Mr. Roy Cox, 706 North 24th Avenue, being.present, requested the'removal of the no parking
signs located west of North 1st :Avenue in the area between Pacific Fruit Company and
Foseen's. He stated that employees have been parking this area, but Pacific
Fruit Company wishes to use it for truck parking purposes. He further stated that trucks
parking in this location would not block any access areas-. due discussion, it
was MOVED by Schussler, seconded Whitaker that this matter:be. referred to the City
Manager for a report to the carried,. Broad., Schussler and Whitaker
voting aye by voice Cole, Edmondson and.Holbrook absent.
Mr. Alfred Stelzer, 18 West Washington Avenue, being present, spoke to the Council on
the City's utility policy in connection with - the development.of the Golden Age Mobile
Home Court on Washington He explained to the Council that:an 8" meter had been
installed, which increased his -to -serve charge.to :$190': He further indicated
that if a detector check meter could be installed, i- t :would_serve the. same purpose at
less cost. After due discussion,. it was consensus of the. Council that, this matter be
referred to City Staff with a'report to be brought - back to the Council at a later time.
Acting City,Manager Fred Andrews, reviewed-City Manager Report. #190, concerning the
Model Litter Control Act.' Fire Chief; Matt Young reported to the Council
on the proposed Fire Prevention Week and Anti- litter' Month activities to run through
the month of October, as described in his memo on this subject dated September 24, 1973.
He referred to the recommendation for adoption of local legislation to provide for a
City litter program, similar to the Ordinance suggested:by the Department of Ecology,
which was presented to the Council at the meeting of April 16, 1973. There was discussion
by Council members on the preparation of a local ordinance in support of the State Model
'Litter Control Act. After due discussion, it was the consensus of the Council that
the sample litter control ordinance from the Department of Ecology be again reviewed
by Councilmen before a local ordinance is prepared..
Acting City Manager Andrews reviewed City Manager #191, concerning an Increase in Water.
Main L.I.D. Assessments, stating that in the past the City has been.paying the difference
between the cost of installation for a 6-inch an 8 -inch pipe. In accordance
with Modern Fire Underwriters Standards, it is now recommended.that an ordinance be
prepared to implement the assessment for water lines up to 3,inches in residential districts
and 12 inches in commercial areas. It was MOVED•by Brown, seconded by Schussler that
. appropriate legislation be prepared to implement increase: carried,
Broad, Brown, Schussler and Whitaker voting aye by voice vote. Cole, Edmondson and
Holbrook absent.
Acting City Manager Andrews reviewed City Manager #192, concerning Reorganization
of Top Management, reporting on.the success of the three -month trial period of reorganization.
He stated that there is a recommendation for this arrangement of the departments and
.offices into four service groups tobe made permanent. - In accordance with the attached
report outlining the responsibility Of the'four° groups involved,.it is recommended that
the amendment to the Municipal Code implementing the recommended changes be effective
October 1, 1973. After due discussion, it was MOVED by Brown, seconded by Whitaker
that the appropriate legislation be prepared to implement these changes and amend the
Municipal Code'effective October 1, 1973: carried, Broad, Brown, Schussler and Whitaker
voting aye by voice vote. Cole, Edmondson and Holbrook absent.
Acting City Manager Andrews referred the proposed Alcohol.- Related Felon Rehabil-
itationProject to Police Jack LaRue, who reported on preliminary funding
application received from the County Conference of Governments. He_indicated that this
project would.have little financial impact on City and reviewed the primary purposes
of the project in assisting any felon involved in criminal action. Chief LaRue stated
that some of the services to be carried out - by this project could possibly be handled
through 'social service organizations and the Parole Board. After. due discussion, it
was MOVED by Brown, seconded by Schussler that Chief LaRue be directed to return the
preliminary funding application to the Conference of Governments with his comments on
behalf of the City: carried, Broad, Brown, Schussler and Whitaker voting aye by voice
vote. Cole, Edmondson and Holbrook absent. Chief LaRue indicated that. this matter
will be taken up at the meeting of the Advisory to be held next week and
that he would return the application after attending that meeting.
Acting City Manager Andrews referred to proposed agreement with D. B. Hamilton,
authorizing him to make certain street improvements. He reported that Mr. Hamilton has
met with the Department of Public Works and an agreement has been drawn up which is
satisfactory to both the City and Mr. Hamilton. After due discussion, it was MOVED
by Whitaker, seconded by Schussler that Resolution No. D- 3013, authorizing the execution
of said agreement, be passed: carried, Broad, Brown, Schussler and Whitaker voting
aye on roll call. Cole, Edmondson and Holbrook absent.

RESOLUTION No. D -3013, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute an agreement with D. B. Hamilton.
Acting City Manager Andrews requesting authorization for out -of -state travel for Kermit
Smith, Purchasing Agent, to travel to Victoria, B.C., Canada to attend the Northwest
Public Purchasing Conference, October 11 -12, 1973, it was MOVED by Schussler, seconded
by Whitaker that said travel be authorized and. expenses paid:' carried, Broad, Brown,
Schussler and Whitaker voting aye by voice vote. Cole, Edmondson and Holbrook absent.
There being no further :business to come.before the Council, it was MOVED by Whitaker,
seconded by Schussler that we do now adjourn at the hour 'of 3:55 P.M.: carried, Broad,
Brown, Schussler and Whitaker voting aye by voice vote. Cole, Edmondson and Holbrook
absent.
