TUESDAY - SEPTEMBER 4, 1973
The City Council met in session at 1:30 P.M. on this date in - the Conference Room at Yakima
City Hall. .
Councilmen present at the meeting were Acting Mayor Wray Brown, Betty L. Edmondson, Ralph
Holbrook, Don Schussler and Bill Whitaker. Also present were City Manager, Craig McMicken;
Public Services Director, Jack Daniel; Refuse Superintendent, Glen Koelling; Dave Hoge,
Kermit Smith and Tom Froula of the Management and Budget Group, City Clerk, Iris
Litzenberger; Administrative Assistant, Dick Zais and Jim Bowers, presenting the press.
The balance of the Management and Budget Group 1974 Work Programs were reviewed as follows:

The proposed Charter amendment re increase in Councilmen's salaries was discussed. It was
noted that Cliff Milier,.President of the Chamber of Commerce is. out of town and the Peti-
tion might not be circulated in time to get enough valid signatures to get it on the ballot
for the November election. Council members concurred that they would vote against putting
the matter on the ballot by Resolution.
There was discussion on the refuse service proposals, plastic bags and fees. Public
Services Director, Jack Daniel, and Refuse Superintendent Glen Koelling presented informa-
tion and answered questions. No decisions were made.
At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the
meeting, Assistant. Mayor Brown presiding, Councilmen Edmondson, Holbrook, Schussler and
Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. Councilmen
Mayor Broad and Cole absent on roll call. Councilman Cole having been excused at a
previous meeting,,it'was MOVED by Schussler, seconded by Holbrook that Mayor Broad be
excused from this meeting: carried,. Brown, Edmondson, Holbrook, Schussler and Whitaker
voting. aye by voice vote.
The Invocation was given by City Manager McMicken.
The minutes of the previous regular meeting of August,27, 19731. and the adjourned regular
meeting of August 31, 1973, having been duly certified accurate by two Councilmen, and no
one.present.wishing to have said minutes read publicly;..Assistant Mayor Brown declared said
minutes approved as recorded.

$60,000, -for alleged loss in connection with,Counc it action in disapproving outside utility
service to the claimants and in reference to an easement previously granted by the city

Ordinance provides the appropriate job classification for staff in the newly established

ORDINANCE NO. 1559,' AN ORDINANCE relating to city personnel; amending the classification
and compensation plan for city employees; amending Subsection 2.20.100 (b) of the City of
Yakima Municipal and declaring an :.emergency. '•.
It was MOVED by . Holbrook,- seconded_by Whitaker that Ordinance No. 1560, limiting the
of taxicab licenses authorized. to be issued and establishing rates for taxicab fares, be
passed: carried, Brown, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll
call. ,Broad. and.Cole absent. City Manager McMicken explained. that. the .provision for one
cab company per $20,000 population had been omitted since the various cabs are all•dis-
patched through one office. There was discussion by the Council on the request by Mrs.
Kauzlarich for an emergency clause in the Ordinance. City Attorney Andrews reviewed the
basis for the standard 30 -day clause;, stating that an emergency,clause would also be permis-
sible. It was the consensus of-the Council that:an emergency clause not be included in
this Ordinance. Present and speaking to this matter was Mrs. Grayce Kauzlarich, represent -
ing the.:local Taxicab Company.

It was MOVED by Holbrook, seconded by Whitaker that Ordinance No. 1561, declaring it to be
unlawful to defraud a taxicab operator, be passed: carried, Brown, Edmondson, Holbrook,
Schussler and Whitaker voting aye on roll call. Broad and Cole absent.
ORDINANCE NO. 1561, AN ORDINANCE relating to public safety and morals; declaring it to be
unlawful to_defraud a taxicab operator and enacting Section 6.04.307 as a new section of
the City of Yakima Municipal Code.
It was MOVED by Holbrook, seconded by Whitaker that Ordinance No. 1562, increasing the
sewer service charges to premises other than those served by city domestic water, be
passed: carried, Brown, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll
call. Broad and Cole absent., City Manager McMicken explained that the Ordinance provides
for an increase from 50 to 75 percent for those not served by City water.
ORDINANCE NO. 1562, AN ORDINANCE relating to public services and facilities; adopting
regulations for water meters, and specifying sewer service charges, for premises served by
other than city domestic water; amending Section 7.60.050 of the City of Yakima Municipal
Code; and declaring an emergency.
It was MOVED by Whitaker, seconded by Holbrook that Ordinance No. 1563, specifying rates
for domestic water ready -to -serve charges and water consumption charges, and amending
Ordinance No. 1556, be passed: carried, Brown, Edmondson, Holbrook, Schussler and Whitaker
voting aye on roll call. Broad and Cole absent. Public Works Director, Dave Vargas,
explained the ommissions from the recently passed utility rate Ordinance.
ORDINANCE NO. 1563, AN ORDINANCE relating to public services and facilities; specifying
water service charges; amending Section 7.68.250 of the City of Yakima Municipal Code; and
declaring an emergency.
It was MOVED by Schussler, seconded by Edmondson that Ordinance No. 1564, .specifying each
premise receiving domestic sewer service to be an individual consumer, be passed: carried,
Brown, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. Broad and
Cole absent. Public Works Director, Dave Vargas, explained that this is also an ommission
from the recently passed utility rate Ordinance.
ORDINANCE NO. 1564, AN ORDINANCE relating to public services and utilities; specifying each
premises receiving 'domestic sewer service to be an individual consumer.; enacting Section
7.60.055 as a new section of the City of Yakima Municipal Code; and declaring an emergency.
City Manager McMicken briefly reviewed the letter to the Yakima Softball. Association dated
March 27, 1973 and subsequent letter from them dated August 27, 1973, along with the memo
from Parks Director, Bill Hutsinpiller, all regarding the lighting project at Larson Park.
He further reviewed the request of the Softball Association for an additional $10,877.48
to cover increased supply costs and sales tax incurred since the original amount of $20,000
to be paid by the city was agreed upon. Mr. Merle Harmon, President of the Yakima Softball
Association, being present, briefly reviewed the various increases in materials incurred
between the time of approval for the project and the purchase of supplies. After due dis-
cussion, it was MOVED by Edmondson that this matter be referred to the Park Commission for
their study and recommendation: carried, Brown, Edmondson, and Whitaker voting aye by
voice vote; Holbrook and Schussler voting nay by voice vote. Broad and Cole absent.
Mr. Leo Seguel of the Yakima Volunteer Bureau, being present, briefly reviewed his letter
to the Council dated August 23, 1973, requesting the use of the main fire station building,
129 South Third Street as a multi- service center for voluntary action when vacated later
this year. He explained the purpose for the central location and gave suggestions of
several organizations which could be located in the building. City Manager McMicken read
two letters received from citizens in favor of this proposal, Mr. Jack Thomas, 3203 W.
Viola Avenue, being present, spoke in opposition to the proposal, inasmuch as the used car
business located in that area would be affected the increased traffic and loss of
customer parking space. Assistant Mayor Brown indicated that the Council would take this
request under consideration with a report to be brought back later.
City Manager McMicken referred to the reports received by Councilmen on the Neighborhood
Conservation Pilot Program, stating these tb be for the Council's information and review.
He referred the matter of the agreement with the Home Environmental and Consumer Counseling
Group to City Attorney, Fred Andrews, who reviewed the terms of the Sub - tenancy Agreement
for the city's use of the demonstration house at 515 East Arlington Street. After due
discussion, it was MOVED by Schussler, seconded by Holbrook that Resolution No. D -3004,
authorizing the execution of said agreement with HECC, be passed: carried, Brown,
Edmondson, Holbrook, and Whitaker voting aye on roll call. Broad and Cole absent
RESOLUTION NO. D -3004, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute a lease agreement with the Home Environmental and
Consumer Counseling Group.
City Manager McMicken referred to the letter received from the State Highway Commission
dated August 27, 1973, giving the proposal from them for providing the city with prelimi-
nary cost estimates for airport land and easement acquisitions. After due discussion, it
was MOVED by Whitaker :, seconded by Holbrook that Resolution No. D -3005, authorizing the
execution of said agreement with the State Department of.Highways for this purpose, be
passed: carried, Brown, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll
call. Broad and Cole absent.
RESOLUTION NO. D -3005, A RESOLUTION authorizing the Mayor and City Clerk of the City of
Yakima to execute a letter of agreement with the Washington State Department of Highways
for services in connection with the porposed expansion of the Yakima Air Terminal.
City Manager McMicken referred the report on the status of availability of irrigation water
for the remainder of the season to Public Works Director, Dave Vargas, who reported that
the Fruitvale District is now out of water since the Bureaut-of Reclamation has cut back on
water release and the Naches River has dropped. He referred to other districts now exper-
iencing low pressure, stating that the entire irrigation system will be shut off approxi-
mately September 20, 1973. Mr. Vargas recommended the city not extend special rates for
persons to use domestic water for irrigation purposes after that date and that the city
encourage conservation with the possible use of the rotation system next year.
TUESDAY SEPTEMBER 4, 1973 - SEPTEMBER 7, 1973
City Manager' McMicken referring to the certification by Cornell, Howland, Hayes & Merry -
field, Consulting Engineers and the City Engineer of the completion of work and recommenda-
tion that said work be accepted and final payment made on the Telemetering Facility for
City-wide Domestic Water System, it was MOVED by Schussler, seconded by Edmondson that the
report of the Consulting Engineers and the City Engineer dated August 29, 1973, with
respect to the completion of the work on•Public Works contract Telemetering Facility for
City-wide Domestic Water System, be approved, the work be accepted and payment of the final
estimate as therein set forth is hereby authorized: carried, Brown, Edmondson, Holbrook,
Schussler and Whitaker voting aye by voice vote. Broad and Cole absent.
City Manager McMicken referred to the present plan for relocating management personnel beinc
implemented in City Hall and requested that the trial period be extended another thirty
'days in order that the report and recommendation for this arrangement to be continued on
a permanent basis may be brought back to the Council for action'by the end of September.
It was.MOVED by Holbrook, seconded by Schussler that the trial arrangement be extended
another thirty days: carried, Brown, Edmondson, Holbrook, Schussler and Whitaker voting
aye by voice vote. Broad and Cole absent.
City Manager McMicken requesting out -of -state travel authorization for Public Works
Director, Dave Vargas, to travel .to Denver, Colorado, to attend the Annual Congress of the
Public Works Association, September 16 -20, 1973, it was MOVED by Schussler, seconded by
Whitaker that said travel be authorized and expenses paid: carried, Brown, Edmondson,
Holbrook, Schussler and Whitaker voting aye by voice vote. Broad and Cole .absent.
City Manager McMicken referred to the request made by the Regional Director of the Washing-
ton Lung.Association at the previous meeting for a traffic -free area in downtown Yakima
during Clean Air Week, October 14- 20, 1973. He referred to the requirement that all
abutting property owners in the affected area would need to give their approval for this
and further reported on a meeting with the Downtown Advisor Redevelopment Commission, who
recommended denial of this request. It was the consensus of the Council that this recom-
mendation be followed and City Manager McMicken indicated that he would inform the Lung
Association of the Council's decision.
Councilman Schussler referred to the matter of a Comprehensive Bicycle Plan for Yakima,
stating that Dr. Jim Dodge has indicated that an organization called "The Peddlers" would
like to make suggestions for improvements of the route in the area of Chestnut and 32nd
Avenue. After due discussion, it was MOVED by seconded by Edmondson that the
Staff be asked to provide information to the Council on specific plans for routing in this
area: carried, Brown, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.

Councilman Holbrook requesting permission to be excused from the regular meeting of
September 10, 1973 and Councilman Schussler requesting permission to be excused from the
adjourned regular meeting of September 7, 1973 and regular meeting of September 10, 1973,
it was MOVED by Edmondson, seconded by Whitaker that Councilmen Holbrook and Schussler be
excused on those dates: carried, Brown, Edmondson, Holbrook., Schussler and-Whitaker voting
aye by-voice vote. Broad and Cole absent.
There being no further business to come before the Council, it was MOVED by .Whitaker,
seconded by Holbrook that this meeting be adjourned at 4 :40 P.M. to Friday, September 7,
1973, at the hour of 12:00 Noon, to then meet in the Flight Deck Restaurant at the Yakima
Air Terminal:. carried, Brown,- Edmondson, Holbrook, Schussler and Whitaker voting aye by

The regular Council meeting of September 4, 1973, having been adjourned to this date,
Councilmen Wray Brown,Betty L. Edmondson and Bill Whitaker met in the Flight Deck Restau-
rant at the Yakima Air Terminal. Also present was Jim Bowers, representing the press.
There being no quorum present, no formal meeting was held and the meeting adjourned at
1:30 P.M.
