HomeMy WebLinkAbout08/13/1973 Business Meeting r AUGUST 13, _ 1973 The City Council met in session at 1:30 P.M. on this date in the ConferenceRoom at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Howard C. Cole, Betty L. Edmondson, Ralph Holbrook, Don Schussler and Bill Whitaker. Also present were City Manager, Craig McMicken; Public Services Director, Jack Daniel; personnel from the Airport, Cemetery and Transit Departments; Management and Budget personnel and Dick Zais, Admini- strative Assistant. 1974 Work Programs for the Public Services Group were reviewed as follows: a. Transit -- by Bob Knight, Manager b. Cemetery -- by Bob Laird, Manager c. Airport -- by Jim Eakin,° Manager Management and Budget Group Work Programs for 1974 were reviewed as follows: a. Personnel -- by Ila Cherrington, Acting Personnel Officer b. Training and Safety -- by Ed Davis, Training and Safety Officer c. Records -- by Iris Litzenberger, Acting City Clerk d. Finance --- by Leonard Crose, Finance Director e. Treasurer -- by Walter Chappel, Treasurer At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by Councilman Cole. The minutes of the previous adjourned regular meeting of August 3, 1973 and the regular meeting of August 6, 1973, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly,'Mayor Broad declared said minutes approved as recorded. This being the time set for the Hearing on L.I.D. No. '989, Franklund's Pear Blossom Addi- tion and Others Paving District, City Engineer, Fritz Jaeger, reported that only one letter of protest was received from E. V. and Maud Anderson. He explained that the method of assessment being objected to in their letter is standard procedure on these kinds of improvements. It was the consensus of the Council members that a letter be sent to the Andersons thanking them for their concern and explaining the method used for their assess- ment. There being no further protests in writing or otherwise, it was MOVED by Schussler, seconded by Brown that Ordinance No. 1549, confirming said Assessment Roll, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye op . roll call. ORDINANCE NO. 1549, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 989 as created and established by Ordinance No. 1453 as amended by Ordinance No. 1478 of the Ordinances of the City of Yakima. Damage Claims having been filed with the City Clerk on August 9, 1973, by Robert Lee Baughman, Yakima Police Officer, in the amount of $25 for loss of personal property in the line of duty, and by Robert B. Dyal, 3202 Powerhouse Road, in the amount of $200 for damages to his property by city crews dredging out the canal, it was MOVED by Schussler, seconded by Holbrook that said Damage Claims be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. An Ordinance appropriating $9,864 to pay for services to be performed by the`Yakima Valley Opportunities Industrialization Center under the Minority Employment Training Services Agreement, having been read by title only at the previous meeting of August 6, and being again read by title at this meeting, it was MOVED by Cole, seconded by Whitaker that Ordi- nance No. 1550, providing for said appropriation, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. City Attorney Andrews reviewed the provisions of the agreement authorized at the previous Council meet -. ing of August 6, 1973. ORDINANCE NO. 1550, AN, ORDINANCE appropriating the amount of $9,864 from unappropriated money in 199 - Federal Shared Revenue Fund and transferring that amount to 000 - General Fund; and appropriating the amount of $9,864 within 016- Personnel Department of the 1973nappro- priation for 000 - General Fund. An Ordinance transferring and appropriating $58,300 of Federal Shared Revenue Funds for various park and recreation purposes, having been read by title only at this meeting, was laid on the table for one week, or until August 20, 1973. City Manager McMicken reviewed the separate amounts for each project involved. City Attorney Andrews referred to the Ordinance relating to the size of the patient carry- ing area of mobile intensive care ambulances, stating that this Ordinance provides for a minimum head room area of sixty -one inches. It was MOVED by Holbrook, seconded by Cole that Ordinance No. 1551, providing for said regulation, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. Captain Metzer, being present, reported that Dr. Twiss has no objection to the change. ORDINANCE NO. 1551, AN ORDINANCE relating to licenses and business regulations; specifying rules and regulations for mobile intensive care ambulance service; amending Subsection 5.90A.050 2 of the City of Yakima Municipal Code and declaring an emergency. City Manager McMicken referred to the Ordinance specifying rules and regulations for refuse collection in the residential and business districts, stating that this Ordinance provides for the conversion to commercial containers from the presently used scoop bins. It was MOVED by Brown, seconded by Cole that Ordinance No. 1552, providing for said regulations, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. • 5 • AUGUST 13, 1973 ORDINANCE NO. 1552, AN ORDINANCE relating to health and sanitation; regulating the residen- tial and business classifications of garbage and refuse collection; amending Sections 4. 16.170 and 4.16.180, and repealing Sections 4.04.415, 4.04.481 and 10.05.040, all of the City of Yakima Municipal Code'. Mr. Frank Pierce, 4909 West Lincoln Avenue, being present, filed with the City Clerk a petition requesting electric lighting in Gilbert Park. Mayor Broad indicated that this II matter would be referred to the Staff and a report from them would be brought back at a later date. . Mrs. Grayce Kauzlarich, Secretary - Treasurer of Yellow. Cab Company, being. present, referred to her letter submitted at the Council meeting of June 11, 1973, at . which time this matter was referred to Staff, and asked for a status report on this matter. City Manager McMicken indicated that there had necessarily been a delay in a report from the Staff and stated that such a report would be forthcoming within the next two weeks. Mr. Jim Stout, Administrator for Special Projects for the Handicapped, being present, referred to the letter and additional materials concerning this program dated August 6, 1973, and reviewed the objectives of this non - profit organization in providing education, training and work for developmentally disabled persons. He explained the problems now associated with the present facilities being used and indicated that a land donation of at least three acres is being requested from the City of Yakima. After due discussion, it was MOVED by Cole, seconded by Whitaker that the City Staff be asked to consider the rami- fications of this report,from the Special Projects For the Handicapped and to bring back a report to the Council: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. . Reports having been received from the Planning Commission on rezone applications:filed by Richard L. Hurd and others for property located at 1302 -1312 Fruitvale Boulevard, and by Morco, Inc., for property located at the southwest corner of -7th and "A" Streets,, it was MOVED by- Schussler, seconded by Edmondson that August 27, 1973, be the date set for hearings on these matters:. carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. An appeal having been filed .by Marshall and Douglas Wilson on the Planning Commission action on the request for outside sewer service.to the property located. at the-southwest corner of 48th Avenue and Tieton Drive, it was MOVED by seconded by Holbrook that August 20, 1973, be the date set for Hearing on this matter: carried, Broad, Brown, Cole, Edmondson, Holbrook,. Schussler and Whitaker voting aye by voice vote, City Manager McMicken referred to the report of the 'Traffic Engineer on the Pierce.Avenue Street Improvement Project dated August 10, 1973, _and the report from the -- Planning Depart- ment, including a recommendation for an: =;off- street parking study for the Pierce Avenue Connection to be made by N. G. Jacobson and Assoiciates, Inc., Consulting Engineers. Mr. McMicken further reviewed the One -Half Cent Gas Tax-Recap .dated August-10, 1973. There was.discussion as to which project on this list might be deferred until 1975 and it was the consensus of Councilmen that the Pierce Avenue project be completed. Councilman Brown expressed a desire to see this project deferred. After due discussion, it was MOVED by . Holbrook, seconded Whitaker that N. G. Jacobson & :Assoc-iates, Inc., Consulting Engineers be ,hired to conduct an off- street parking analysis study in connection with -the Pierce Avenue Project, with their report to be completed in sixty to ninety days:. carried,. Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Brown voting nay by voice vote. _ . City Manager McMicken referred the outside utility requests to Assistant Planner; Glen Rice, who reviewed the Planning Staff Report on the request of John Marshall Construction for water and S;ewer.service to a subdivision south of._.Gregory.'Avenue between South 32nd and 34th Avenues, noting the problems to be found in supplying and-sewer service to this area. Mr. Rice indicated that this.area is within the airport noise impact zone and referred to the Composite Noise-Rating referred to in the Yakima Municipal Airport Plan. There was considerable discussion on the adoption of the text:of this Airport Plan. :Mr. Rice stated that the Planning Staff recommends approval of this request for outside utility service for the following reasons: 1. The proposed development conforms with the Yakima General Plan and will • compliment surrounding land uses. 2. The applicant is proceeding with annexation. . • - 3. The granting of,;'this request_ will eliminate the possibility of a••.-fringe - - area subdivision being developed with septic tanks -:and -the possibility. of ; future health and pollution problems. Mr. Rice noted eight additional recommendations in the Staff Report to be included as con - ditions to the granting of.this request. City Attorney Andrews explained that these con- ditions should be part of the Outside Utility Agreement. After due discussion, it was MOVED by Schussler, seconded by Whitaker that the request of John Marshall Construction for outside water and sewer service be granted subject to the conditions attached to. the Planning Staff Report of..July 2.7',: 1973, except for No. 7, dealing with_the•Yakima-Municipal - -- Air,port:No.ise Impact Zone: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Mr. Rice reported on the request of the Madison Fountains Nursing Home for a sewer facili- ties extension,to accomod•ate the proposed 26 -bed addition to the - existing. facilities. and reviewed the Staff Report on-this subject dated August 8, 1973. After due-di it was MOVED by Edmondson, seconded by Whitaker -that the request of the Madison Fountains Nursing Home for additional sewer,facilities,- be granted: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. City Manager McMicken.reported that -bids were received and considered by the bid board on August. 9, 1973, for the Naches - Yakima.Avenue Intersection Improvement, as follows: Jess E. McDonald • $ 9,380.50 Yakima Asphalt.Paving Company 11,058.00 P� AUGUST 13, 1973 The City Engineer recommending that the bid be awarded to Jess E. McDonald who submitted the lowest and best bid, it was MOVED by Schussler, seconded by that the bid be I awarded to Jess E. McDonald in the amount of $9,380.50 and that the City Manager be autho- rized to enter into contract with said contractor upon the filing of the proper bond and insurance: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker votin• aye by voice vote. City Manager McMicken referred the review of irrigation practices to Mr. Juan Arambul, Community Relations Intern, who reported on the results received in canvassing various neighborhoods in Yakima and informing the public of the alternating days method for usage of irrigation water. It was the consensus of the Council that no enforcement action be implemented this late in the irrigation season. MAYOR ADJOURNED REGULAR MEETING - FRIDAY, AUGUST 17,1973 The City Council met in session at 12:00 Noon on this date at the Flight Deck Restaurant in the Yakima:Air Terminal. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Howard C. Cole, Betty L. Edmondson, Ralph Holbrook, Don Schussler and Bill Whitaker. There was discussion of taxes that might be included in the proposed gambling ordinance. It was the consensus of the Councilmen that the tax'on Bingo and other lotteries should be a percentage of the gross business and that the tax on punch boards_and pull tabs be a percentage of the gross business of the license holder, and it being agreed that this might be one - fourth of one percent on up to $10,000 per month. It was agreed that the Mayor should discuss this proposal with the Co Commissioners. A variety of other matters were discussed, but no action was taken. There being no further business to come before the Council, it was MOVED by Brown, seconded by Holbrook that the regular Council meeting of August 20, 1973, be held at the Southeast Community Center: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.
