APRIL 9, 1985
STUDY SESSION
The City Council met in session on this date at 6:30 p.m. in the Council
Chambers of City Hall, Yakima, Washington. Council members present were Mayor
Clarence Barnett, Pat Berndt, Henry Beauchamp and Lynn Carmichael. Council
members Lynn Buchanan, Jerry Foy and Jack Sparling absent.
1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Council member Carmichael announced that the DARC meeting has been
rescheduled, for Friday, April 19, 1985 at 8:00 p.m., and will be held in
the Council Conference Room. She also stated the Utility Rate Advisory
Board (DRAB) will meet April 22, 1985 at 4:00 p.m. in the Council
_Conference Room.
Mayor Barnett questioned when the gravel used for snow control throughout
the winter months will be removed from the streets. The question was
referred to staff.
2. DISCUSSION REGARDING PROPOSED SPECIAL COUNCIL STUDY
SESSION /WORKSHOP - PRESENTATION BY NANCY MCKAY .
Assistant City Manager Stouder introduced Nancy McKay, Workshop
Consultant, to the Council members, after which Ms. McKay gave a brief
review of her resume and projects she has completed. She.outlined the
method in which she intends to conduct the workshop in order to assist
Council in their decision making process, and establishment of
priorities, and a plan to help achieve .their goals. It was the general
consensus of the Council members to discuss the location in which to
hold the workshop with the absent Council members prior to making that
decision. It was MOVED by Carmichael, seconded by Berndt, to agree to
hold the workshop on May 7th, 1985. Unanimously carried by voice vote.

3._ REPORT FROM FINANCE AND LEGAL DEPARTMENTS .REGARDING UTILITY BILLING
DELINQUENCIES -- ACCOUNTS RECEIVABLE .
John Hanson, Director of Finance & Budget, and City Attorney . Andrews
responed•to Council's questions regarding this report. A review of the
report.and staff recommendations.was given by Mr. Hanson...City Attorney
Andrews indicated staff is requesting direction from Council asoto. which
alternative(s)..to present to the Utility Rate Advisory Board for further
consideration. It. was MOVED by...Carmichael, seconded by Beauchamp, to
move this. item down on'the Agenda to become Item No. 8a. Unanimously

6. CONSENT AGENDA
. Mayor. Barnett, referred to the Items.. placed an the Consent Agenda,

• Council members or citizens present. Council member Carmichael requested
Items _Nos..8a and _11 .be added. to the Consent Agenda. It .was. the general
consensus of the Council that the addition of Items Nos,. 8a and 11, as
requested, ..be..made. The ..City. Clerk then .read the .Consent Agenda-.Items,
including resolutions and ordinances by title. It was MOVED by
Carmichael, seconded by Berndt, that the Consent Agenda, as read, be

*7. APPROVAL OF MINUTES
The Council minutes of March 19 & 26, and April 2, 1985 were approved,
having been duly certified accurate by two Council members and no one
present wishing to have said minutes read publicly.
8. AUDIENCE PARTICIPATION
Albert Snow, 308 North 6th Street, read and presented a petition
opposing the proposed siting of the Federal Hazardous Nuclear Waste Dump
at Hanford. He spoke of the impact it would have upon Yakima and urged
Council to request that the Governor veto the proposed site. Mr. Snow
requested Council place this subject on a future agenda for further
discussion and consideration. David J. Graf, 211 South 36th Avenue,
addressed the geological aspects of the repository and the hazards
involved therein, such as possible mining cave -ins, small explosions and
contamination of the soil and Columbia River. Deborah Beadle, Rt. 2, Box
440B, Yakima, expressed concerns regarding the transportation aspects of
the nuclear waste. Mrs. Beadle indicated 88% of the waste will be
transported from east of the Mississippi River to the Hanford Dump site.
She state Congress and the Department of Transportation have not yet
addressed the problem of funding for communities for accident
preparedness training. Gene Rupel, 2704 Summitview, indicated his concern
and disapproval of the proposed Hanford site. He had numerous articles
and newspaper clippings relating to leakage of nuclear waste. He gave a
brief history of some of these incidents and stated contamination has
been released into the Columbia River from Hanford. Mr. Rupel expressed
concerns for public safety due to past incidents of leakage, and
information on soil and water contamination being kept from the public.
Reverend Howard C. Cole, 1509 South 74th Avenue, Yakima, urged Council
to join with Portland, and other cities in the area opposing the
formation of Hanford as a nuclear waste dump for the nation. He stated
the situation has not been given sufficient study, and feels other means
of disposal should be considered. Robert W. McCall, 1218 South 14th
Avenue, Yakima, addressed the cost effectiveness of nuclear energy,
stating it is a very costly process, most of which is subsidized by the
U.S. Government. Mr. McCall also indicated construction costs of nuclear
plants in the State of Washington have increased 10 to 20 times over the
original estimates, while life expectancy of the plants has decreased
tremendously, with many of the plants being decommissioned within 10
years for failure to maintain quality control standards. Mr. McCall
stated the ceiling placed on nuclear accidents by insurance companies is
140 million dollars, and the government has placed a ceiling of 540
million dollars on such accidents. If a nuclear melt down occurrs,
estimated cleanup efforts would be in the neighborhood of 7 billion
dollars. He further explained the process involved in decommissioning a
nucelar waste plant and the length of time involved in doing so. He
stated the nuclear waste plant is a tremendous cost to the tax payers,
one of which few people are aware. Mari Hoffman, 9172 South 12th Avenue,
Yakima, representing the Yakima Audubon Society, requested to go on '-
record in opposition to the proposed nucelar dump site being located at
Hanford. She stated their organization is concerned with wildlife, as
well as citizens, and contamination of the soil and Columbia River. Ruth
Solowan, 928 Adams View, Yakima, reiterated concerns regarding the issue
which had been previously addressed by other citizens. Nancy Faller,
2207 Barge Street, indicated the Federal Act provides that three of
these depositories will be set up within a certain length of time. She
reviewed the process involved in vetoing the Federal Act if Hanford is
selected as a nuclear waste site, and encouraged Council to act quickly '
in communicating to the Governor that the citizens do' not want the
nuclear dump site located at Hanford. Nancy Hovis, P.O. Box 487,
Attorney representing the Yakima Indian Nation, submitted a document for
Council's further deliberation. She indicated the Yakima Indian Nation
opposes the nuclear waste dump site being located at Hanford. Chris
Bowlds, 216 North 8th Street, Yakima, stated he attended the hearings
held by the Department of Ecology in Richland, and he feels it is
important that citizens make their opposition known to the Governor, and
other elected officials. Bob Schmidt, 1107 Ackerman, stated he had also
attended the Department of Ecology hearings in Richland and feels

strongly about the past spills and coverups. Gwen McCulloch, 6 North 6th
Street, Yakima, and Ellen Skinner, Rt. 4, Box 186D, Yakima Wild Crafter,
stated their main concern is the preservation of water. Council member
Beauchamp stated he is concerned about the possibility. of the nuclear
waste dump site being located at Hanford and urged further consideration
with full Council representation and City Manager present for discussion.
It was MOVED by Beauchamp, seconded by Carmichael, to place the subject
on a future Council agenda and obtain further citizen input. Unanimously
carried by voice vote. Buchanan, Foy and Sparling absent.

The report from the Finance and Legal Departments dated April 4, 1985
regarding the Utility Billings Delinquencies, was accepted.
Mayor Barnett announced Council would have a 10 minute recess and
reconvene at 8:45 p.m.
9. HEARING ON MAJOR MODIFICATION TO AN EXISTING PLANNED DEVELOPMENT AT
SOUTH 40TH AVENUE & NOB HILL BOULEVARD, AS REQUESTED BY INLINE
CONSTRUCTION (Continued from 4/2/85)
Mayor Barnett stated this hearing is continued from last week's meeting
and questioned if staff has been able to determine if the right -of -way
is sufficient for the pending Nob Holt Boulevard project. Dennis Covell,
Director of Engineering and Utilities, indicated the right -of -way is
more than sufficient. Council member Beauchamp expressed concern regard-
ing placement of the sidewalks, indicating school children will be
walking next to the vehicular traffic on Nob Hill Boulevard. Tim Monoha,
Inline Construction, indicated a corrected final plan map showing the
proper right -of -way will be'submitted to the Planning Department prior
to Council adopting the final plan for this major modification. There
being on one present desiring to speak against the project , the hearing
was declared closed. It was MOVED by Berndt, seconded by Carmichael, to
accept the recommendation of the Planning Commission subject to' -the
conditions stated. Unanimously carried by voice vote. Buchanan, Foy and
Sparling absent.
10. HEARING ON THE STATE DEPARTMENT OF COMMUNITY• DEVELOPMENT MULTI- FAMILY
RENTAL REHABILITATION
This being the,time set for the hearing on the State Department of
Community Development Rehabilitation Program, the hearing was opened by
Mayor Barnett. Dixie Kracht, Housing Supervisor, gave a brief explanation
regarding the purpose of the hearing, stating federal regulations
indicate the project must be occupied by 1007 of low income residents.
However, if a public hearing is held, the low income residency may then
be reduced to 707. Bill Burris, Director of Yakima Housing Authority,
spoke in support of the project..There being no one present desiring to
speak in opposition to the project, the hearing was declared closed: The
Resolution having been read by title, it was MOVED by Carmichael,
seconded by Beauchamp, that the Resolution be adopted. Unanimously
carried by roll call vote. Buchanan, Foy and Sparling absent.
RESOLUTION NO. D -5100, A RESOLUTION authorizing and directing the City
Manager of the City of Yakima to file an application with the United
States Department of Housing and Urban Development for federal funding
for a rental rehabilitation demonstration program.
*11. RECONSIDERATION OF PROPOSED MECHANICAL REFUSE COLLECTION SYSTEM
The report from the Director of Public Works dated April 9, 1985
regarding the proposed System Change and Equipment Rental, was accepted.
*12. CONSIDERATION OF RESOLUTIONS AUTHORIZING EXECUTION OF INTERGOVERNMENTAL
COOPERATIVE PURCHASING AGREEMENTS

RESOLUTION NO. D -5101, A RESOLUTION authorizing the execution of inter-
governmental Cooperative Purchasing Agreement with the City of Sunnyside
for purchasing a replacement sewer television outfit.

RESOLUTION NO. D -5103, A RESOLUTION commencing alley vacation proceedings
and fixing the time and place for a hearing on the matter of the
vacation of a portion of the north /south alley. in the 900 block of South
Naches Avenue.
*14. ORDINANCE AMENDING THE TRAFFIC CODE RELATING TO BROWNE AVENUE

ORDINANCE NO. 2862, AN ORDINANCE relating to traffic control; designating
one -way streets and alleys, and amending Section 9.50.290 of the City of
Yakima Municipal Code.
*15. ORDINANCE REVISING AND CONSOLIDATING THE YAKIMA MUNICIPAL CODE RELATING
TO AMUSEMENT DEVICES, AMUSEMENT ARCADES, BILLIARD AND POOL HALLS
ORDINANCE NO. 2863, AN ORDINANCE relating to licenses and business
regulations; specifically relating to licensing and regulations of amuse-
ment devices, billiard and•pool halts; repealing Chapter 5.10 "Amusement
Arcades ", Chapter 5.12 "Amusement Devices" and Chapter 5.18 "Billiard
and Pool Halts" and all sections of each chapter; and enacting Chapter
5.12 "Billiard and Pool 'Halls — Amusement Devices" and sections thereof
as a new chapter and sections of the City of Yakima Municipal Code.

17. EXECUTIVE SESSION
It was MOVED by Carmichael, seconded by Beauchamp, to move into Executive
Session for the purpose of discussing prospecive litigation. Unanimously
carried by voice vote. Buchanan, Foy and Sparling absent.
Note: At the request of Assistant City Manager Stouder,. no Executive
Session Minutes were taken.
18. ADJOURNMENT
Following the. completion of the Executive Session, it was MOVED by
Carmichael, seconded by Beauchamp, that the meeting be adjourned at the
hour of 10:05 p.m. Unanimously carried by voice vote. Buchanan and
Sparling absent.
