1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Henry
Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt,
Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard Sims present
on roll call. City Manager Zais, City Attorney Andrews, City Clerk
Roberts -and ==Deputy- City- Clerk Toney also - present.. - -
2. INVOCATION
The Invocation was given by Council member Foy.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Council member Barnett distributed copies of the report by the
Northwest Citizens Forum on Defense Waste: Public Process and the
draft Environmental Impact Statement (E.I.S.)., and a set of
charts which includes a listing of sane of the issues raised during
the review of the E.I.S. Mr. Barnett reported that at the last
Forum meeting in December, Admiral Foley, USDOE, made a commitment
to begin clean up efforts of forty -three years accumulation of
defense waste at Hanford. He stated the Forum will continue to
receive progress - briefings from the Department of Ecology (DOE)
through the issuance of the final EIS and the Record of Decision.
It is anticipated the final EIS will be issued in November of 1987
and the record of decision will be made in December. Mr. Barnett
stated one point of interest is the fact that DOE has established
an Assistant Secretary for Environmental Safety and Health. He
stated the Forum's request to establish a Trust Fund, or a
surcharge on production to clean up future generated waste on a
pay -as- you -go basis is a major policy issue which may require
congressional support. He further stated the operators of civilian
nuclear reactors are required by law to set aside funds for
permanent disposal of hazardous waste, and the Forum believes this
policy should also apply to defense programs. Mayor Beauchamp
expressed appreciation to Mr. Barnett for the update on this issue.
Council member Foy applauded Mr. Barnett's accomplishments and the
manner in which he has kept Council abreast of the nuclear waste
issue. •
4. SET DATE OF PUBLIC MEETINGS FOR JANUARY 20, 1987
A. MASTER APPLICATION FOR CHESTNUT GROVE, VICINITY OF 50TH AVENUE
AND CHESTNUT AVENUE, AS SUBMITTED BY TIMOTHY MONOHAN
City Manager Zais informed Council this request for master
application for property located in the vicinity of 50th Avenue
& Chestnut Avenue has been withdrawn by the applicant.
B. REZONE REQUEST FOR PROPERTY AT 819 NORTH 20th AVENUE FROM R -3
(MULTI - FAMILY) TO CBDS (CENTRAL BUSINESS DISTRICT SUPPORT), AS
SUBMITTED BY MARIE MITCHELL BOOSE.
January 20, 1987 was set as the date of the public meeting for
the rezone of property located at 819 North 20th Avenue, as
submitted by Marie Mitchell Boose.
At this time Mayor Beauchamp read and presented a resolution of
appreciation and commendation to former Council member Jack
Sparling in recognition of the past seven and one -half years of
service he has given the City of Yakima. It was MOVED by
Carmichael, seconded by Foy, that Resolution No. 5317, as read, be
adopted. Unanimously carried by voice vote.
RESOLUTION NO. D -5317, A RESOLUTION of appreciation and
commendation for the services performed by Jack Sparling during his
tenure as a Yakima City Council Member.

5. COUNCIL REVIEW, OF - APPOINTMENTS- TO BOARDS, COMMITTEES AND
COMMISSIONS . .
.. , Mayor Beauchamp referred_ -T to the Committees ;for Appointments to
Boards and Commissions and asked for volunteers to. fill the
vacancies listed. Council member Sims volunteered to serve on the
City .Employees a Civil- Service,. Commission:. It was the ::consensus of
the Council that each Council member would continue to serve on the
Committees for Appointments to Boards`and' Commissions to which they
are currently assigned. Council member Barnett suggested assigning
the vacancies,to Council member Sims if he is agreeable -to this.
It was MOVED by Foy, seconded by Buchanan, that Council' member Sims
be, ,,.appginted (to the vacancies listed on the Committees for
Appointments to Boards and Commissions,. and that he be appointed as
II Chairman when the vacancy appears at the' top of the list.

assignments on Boards and Commissions, Jerry Foy indicated.he would
- like to as alternate to the Yakima Air Terminal Board.
ra - Council - , -Sims was appointed ,to the YakimaEJoint•,:Basin: Board,
-and was also assigned as Council representative to the Yakima
Valley- Greenway Task Force. Council- member Barnett asked that the
list. of : Council- Assignments , _on Boards;_and , Commissions te-updated to
; indicate Lynn Carmichael is -now President of the Association of
- Washington Cities. Regarding the Police and Fire Relief -Pension
-Boards ; ,,- Council : member Barnett ;noted , he is .serving as _the_ elected
official, designee at. the request of Mayor Beauchamp, and added he
would continue to serve if the Mayor so desires. It was the
request of Mayor - Beauchamp that Mr. Barnett continue-to serve on
these two-Boards. City Manager Zais directed Council's attention
. to the State 'Centennial Celebration Committee, stating Betty
Edmondson- had resigned -from this Committee ,Council. member Foy
suggested recruiting .a new committee member through the. news media.
He stated perhaps some of-the members currently serving on:the City
-- ofiYakima-Bicentennial Constitution; Committee - would, be +-interested
in serving on this committee. Mr. Foy mentioned. an_ appointment
needs.to be made to the Boundary Review Board and: "Council should be
working with the Conference of Governments in .an.attempt to review
applications for this committee, and then 'forward-the applicants
names to the Governor for an appointment to be made. Council
, --, member- Barnett stated - .the :next -COG - - meeting: isr..December- .2.1st and
encouraged other - Council members to attend. 'Council - member
- Carmichael requested City Clerk Roberts purge the old "applications
, - for various Boardsr,_andr.Canunissions, and - thatl ^then, applicants be
. contacted to ascertain if they are stillrinterested_in serving on
- the -- various Boards and :Commissions-for which they • - applied. Mrs.
r. _ Carmichaeh asked about the; status -of rterm --rlimitation :requirements
., 5 ,<for - Boards and , Commi-ssions members. It was the consensus- of the
Council to ask the -City 'Clerk to research this subject and - report
;,,, back r,to,_,_Council. -;- Council member Buchanan the • -term of a
Housing .Authority Board member expires within the month and
-- questioned why a Council Appointment Committee is necessary if the
,position, is - appointed , -by , j the Mayor- . :and, City r,- Manager ,_Council
member Barnett responded it is necessary as there area couple of
contradictions which exist on the Housing Authority Board. City
Manager Zais explained the appointment- committee was -established
because in -the past Council has wanted to see the applications for
those positions. Council member Barnett .asked that the two
- ,following corrections be-._made:. County District Board ; of; Health
meets.on the fourth Wednesday., and- the representative to, the 3rd
- Class City is now Norman Johnson-of Toppenish. Mr; Barnett also
v requested- the,'City of Yakima : Bicentennial :,Constitution; - Committee be
listed, as well as the names of .the. committee members. :Council
member. Buchanan commented the . Yakima - Air Terminal-, Board
occasionally meets _on the fourth Wednesday the- month...and the
rest of the time it meets.at-noon, or at 4:00. p.m. on:whatever day
they can-.' The- appointments - to the various .Council -Committees,
j Boardseand - Commissions_ •having been, completed., Council .proceeded to

RECOMMENDATIONS /WATER SOURCE ALTERNATIVES .

•.- ,has been under, development for an . extended period , of time. Mr.
" Zais" commented that. Assistant City Manager Stouder -. is the ,Chairman

of the City's Capital Improvement Committee, and asked Mr. Stouder
to comment on the document presented for discussion today. Mr.
Stouder reminded Council that the City entered into a contract in
•May of 1985 to prepare a Comprehensive Water Plan as a of the
feasibility studies necessary to the development of the Rattlesnake
Creek Project : - Hec 'this ' Comprehensive" Plan process will
ultimately result in a document outlining - future :water needs for
• - - the City through ':the year 2025. Previous reports have been
•":. presented - to Council ' inrt November of 1985, and May, = September and
. . December of 1986 " on the status of this process. - •The document
' presented today is a compilation of all the reports and research to
- - E• date by:CH2M Hil-i onE:the_ future =water heeds of the City'of Yakima,
and as such will. be distributed to interested groups and
individuals for review and comment. A report will be provided to
• Council at later date "on" the reviewYprocess." •He reviewed •the two
actions being requested of Council today are: (1) Authorize
submission of remaining elements of the Rattlesnake Feasibility
0H Study.._ for :Council approval'; and - (2 )' authorize • formation of a
• citizen—committee to investigate the proposal for irrigation
systems Pilot Transfer Program: Mr. Stouder introduced Russ Stepp
of !: - _Hill who =• gave" - -.a;, formal. slide ~preentation' "of the
. Comprehensive Water Plan and responded to a number of inquiries
• from various Council members. John Mayo was also present to
respond to Council'`s`rinquiries regarding this :proj'ect. Mt. Stepp
directed Council's attention to a map of the Urban Area and
reviewed the study criteria and standards used in this study to
'::L judge udge the` adequacy' of the-'water' based ' 'on' regulations,
requirements,' and city policy for water service. Discussion ensued
regarding the purpose of the`Pilot Program -,'a program designed to
• ?{ study= ~the effects-' of converting ! to " the -' domestic water ''system.
-Council member Berndt expressed concern that the • 5 year Pilot
Program not provide conclusive data. Council member Barnett
orasked iff- , the "Pilot • = ' fails, ' 'and • a 5.7 Million 'dollar
rehabilitation program is called for, what legal ramifications may
arise. Mr: Stepp pointed out that taking no'action will also prove
`•cto' be 'costly to; the• City.: Assistant Ciity , Manager Stouder--- commented
- •that•at some point in "time, the present system - will completely fail
'nand the residents will be faced with rebuilding the entire system
coo or . - transferring ito= damestio service.'—:Council: member. Buchanan
expressed concern in abandoning a section' of line for a period of
five years. He asked if the irrigation' system is abandoned,_ will
the - City' pay. connection - charges - for :'citizens to 'connect to the
City's domestic service. He also commented on the possibility of
domestic water leaking back into the irrigation system if the
domestic - systems should -revert , back to the ' irrigation " systemE in the
future.. Council-member Barnett about the possibility of adding a
homeowners section to this program which would advise citizens of
the possibilities ' they may =face - if this program is! implemented.
Council member Carmichael stated she echos - the concerns expressed
'by other Council members•conmenting "this is almost like taking the
cart before the horse. "• 1 'Mr: r :Stepp' reviewed the ,domestic water
system, stating water usage for the City of Yakima has been
determined for the next 50 years. (Council member Carmichael
..temporarily' absent 'Jifrdm 3:34 '•to :1:37 p:m.) He stated :87% the
water is used inside the City with 51% being used for domestic
• purposes, and approximately 25% is being used for cainercial use.
Discussion of - _.the `report continued with As City - Manager
.Stouder, John Mayo and• Russ • Stepp of CH2M Hill responding to
'further inquiries by various Council members. Following the
:iconclusion of r they discussion, - Assistants iCity - Manager Stouder
expressed. appreciation' to John Mayo and -Russ Stepp for their
expertise in compiling this document. He reminded Council that
this i {s a • ''draf t r document currently" being '"revi by the
Department of Social and Health Services; at some point the City
Council must adopt a Comprehensive Plan that complies with state
• law to' qualify for_•any potentiale'assistance frail therDepartment of
Social & - Health Services. He stated this document will be
distributed to interested parties and jurisdictions' as a part of
the Rattlesnake Feasibility Issue and the Water Plan issue. Staff
will submit a revised document for further review and adoption in
approximately 90 -120 days. Mr. Stouder stated the only action being
requested today is approval of the Rattlesnake Feasibility Study
and direction regarding the Pilot Transfer Program. Larry Mathews,
•805 South 17th Avenue, commented he has followed the progress of
'this "program for the - past 25'years and stated thefissue isgoing to

have to be addressed" at sane time or other. He added he is
pleasedftto = hear`'the( -City• Council "'s comments regarding :-;the- cultural •
problem of traditional irrigation • water. He indicated this is a
sensitive area and will not be easily solved. Mr. Mathews also
complimented the •r`epresentatives ' from CH2N 1 Hill'f for doing a
"beautiful job" on 'the 'report. Raymond Arnold, of 44 and 48 West
Mead, stated he owns Ray's Mobile Home Court which houses eight
°mobile= harie uni't's; and ''he : pumps - f' irrigation :at. ' from the
Broadgauge Ditch Company. He stated he will be faced with a
tremendous expense if he has to pay to connect to the City's
- domestic water system - 5[cd source of irrigation water: =He ''stated
there would be a number of canplaints from homeowners " in, the area
if the City changes the source of irrigation water. Council member
'Barnett indicated'he='hadlspoken with'Mt: Arnold oh the telephone
regarding this particular situation. He stated he is not sure how
this type of situation will be handled, and'feels staff needs to
give' fu`r'ther' consideration=>to this patti'cular" aspect. Mr. Arnold
stated his irrigation line canes from the Division and 3rd Avenue
pump house and he purchases irrigation water from the City. Ty
Wick, Water Superintendent, interjected that Mr. Arnold purchases
his irrigation water" from the Broadgauge Ditch Company, and the
Broadgauge Ditch Company obtains irrigation water from the New
Schanno Ditch Company rather than the City: "'Mr.•"Wick` stated the
only effect would be that the City also purchases water from the
Broadgauge Ditch Company and.the New Schanno Ditch Company. He
= stated if-`the- City' no longer purchasesthe 'irrigation - .water from
them it is questionable if they would still be viable. Council
member Foy pointed out to "Mr. Arnold if the City longer buys
=water-` from' the 'same-' source 'she does', he' could• = possibly' :face - 'a rate
increase.- Mr. Arnold asked if he would be able. to purchase
irrigation water, or would the line be shut down. Mr. Wick stated
there will still be'-'-water available; "but the `cost fis uncertain at
this time. Council member Barnett stated he - has received a number
of telephone" calls of this nature, and he has'been unable to answer
f' .the question`s po`'sed' by? - concerned ' ci=ti^zens r: 'Mr ''"Barnett andi Mayor
Beauchamp requested that Ty Wick" meet with Mr. Arnold and explain
the possible ramifications of changing from irrigation to
"water 'f orL` irrigation, purpose`s. =Council member Barnett'
this subject was the'topic'of discussion on the Ric Webb'.talk show
'b
earlier in the '-'week and he began receiving telephone calls
`immed "iately " afterward. =He = recommended' '. staff :- =develops ' a public
public
relations program to •deal with this issue and the incorrect
information circulating in the community. City Manager Zais
commented on the "fact that CH2M-Hill has' performed 'contractural
services specified by the City and this should be kept in mind when
Council' discusses additional amendments to the document. Council
member Foy 'spoke °of - the+ needto iadd a •haneowner's section , to the
document addressing concerns of , citizens regarding -"this issue.
Assistant City Manager Stouder stated corrections and comments have
already been forwarded to - CH2M Hill 'and are ' iri' "the ' process of being
made. Regarding the haneowner's section, he suggested staff come
back Council with a proposal on how this may -be accommodated.
r '`Couhci - 1 membee ' =Foy stated he , feels 'the question before' r<Council
today is (1) the Rattlesnake Project and (2) - the Task• Committee, he
indicated'he would comment on this at the 'appropriate time,
suggesting' 'that 'possibly` the`-Task Committee be= given'= the - 'challenge
of looking at the homeowner's section as 'it: is hone owners that
will be studying the issue. Mr. Stouder asked that staff be given
the opportunity to rsearchvthis issue •and= bring=ra proposal cback to
Council'in the near future. He commented maybe the issue' should
be put' in-abeyance until further examination. He stated the issue
''`Of the kattlesnake Studies' has ''been," `arnd is 'at this
time; ,separate "from .those other. issues until -the feasibility
'studies are completed. Council 'member Buchanan , commented, at this
point; heL''is -not 'eleae"as t� what` 'staff- i8 asking' - 'Council to
authorize.- Assistant 'City Manager Stouder indicated the next step
is for staff to bring back proposed contract amendments to complete
the feasibility ' studies': However; if'- Council? does not , wish .to
authorize 'the amendments, they should direct staff,otherwise. It
wa's - MOVED' by Barnett; seconded by Berndt, 'that- staff be authorized
to proceed with Part 1 (Authorize subniissi'on of remaining' `elements
of the Rattlesnake Feasibility Study for Council approval.) The
question was called for a vote on the motion. Unanimously carried
by voice vote. Mayor Beauchamp asked if Council desires to take
action on Part 2 of the staff recommendation. It was MOVED by Foy,

seconded by ,Carmichael,- ,to authorize formation of a : .citizens
committee .to investigate,.the,;proposal for ,an-,irrigation systems
Pilot Transfer Program. Council member•Barnett stated he.will vote
for ; the motion, as, •t-his,isda,br-oad motion,, but he, feels, ,there
,needs•,,to be: definition •as to the composition of the committee. Mr.
Stouder commented it was his intent -to have staff .reconsider the
•-,second portion of the - recommendation, prior to Council - approving the
formation of the. committee. •It was MOVED•by Carmichael,- seconded
by Buchanan, to-table authorization of the citizen. committee to
investigate_.- the - proposal for- j the irr-igat ion-, systems Pilot Transfer
Program. Unanimously carried-by voice vote. Council member Foy
commented •further on .the ccmposition • of the proposed committee,
suggesting •a plumber -, and- someone, with a background - in hydraulics
be - selected to serve on the committee. Council member-,Barnett
added he feels an engineer should=.also!be selected to serve -on the
:committee, ; He - further stated . he • ould _ . like • to see .citizens

A. CONSIDERATION OF' DESIGNATION OE COUNCIL ,REPRESENTATIVE TO
NATIONAL- LEAGUE - OF CITIES. CONGRESSIONAL •CONFERENCE IN
. - WASHINGTON D.C.
Mayor:: , Beauchamp An_itiated -discussion , regarding- selection- a
CounciL to attend, the National. League of Cities
Congressional Cities Conference in Washington D.C., February 27-
March - 4,•t.1987. • Council member Buchanan. stated on, December,.. 16th he
requested permission,to attend this conference and believes the
knowledge obtained at-the conference will bean asset to the City
_tin. _the future.. • Mayor, Beauchamp, Council ; ,member Carmichael
will attending, the; Conference as President.of - -AWC, -and as such, •
her expenses will be paid. by AWC. Council•member Sims questioned
if-,a specific,. agenda and mission: and ; a. trip., report, is completed by
the person attending such conferences. Mayor Beauchamp explained
that the. Council member attending such. meetings and conferences
_,brings back, tapes from the conference. ,to share_ with fellow- Council
members and gives an oral presentation to Council as well.
(Council member Berndt absent after 4:29 p.m.. and Mayor Beauchamp
temporarily absent .from 4:33 to 4:.45.) City Manager -. Zais ...stated
Council member Foy suggested a staff_member, or - the• Rattlesnake
Project- Manager, (if . that- position is filled prior -to the
conference)- , : should attend this . ,conference . ; to meet with- FERC
representatives to discuss the Rattlesnake Project. For
clarification, Council,member Barnett -asked if the suggestion is
;being made. -•for ,a staff - person to: attend ,the._,conference as as
Council .members- Carmichael -and Buchanan.—Council member Foy
explained he feels Assistant City Manager Stouder should attend the
conference as he is well versed on- the,Rattlesnake Project. Mr.
Foy stated he envisions in •the:future, both the Rattlesnake, Project
Manager and Assistant .City Manager Stouder will be, attending these
r,:conferences. He stated , this does, not ; necessarily ; mean • two. .to three
Council._ members should. also be attending" the conferences.
Following further comments, it was MOVED by Carmichael, seconded by
Sims,. , to- allow Council-member Buchanan .to , attend ::.the , :National
League of,•Cities Conference. Carried by 4 -2 voice vote. Barnett
and Foy voting nay. Berndt absent.

,Council�: Carmichael called - attention to the ,information
provided to Council in their packets regarding .the.AWC'Legislative
Day, the- •end of February .in Olympia, , and encouraged. Council to do
some lobbying- on ,behalf of the particular needs, of the City of
Yakima. Council member.tFoy suggested when it is known which
Council; members _,will be- attending this, session, . that teams_, of two
Council. - members be assigned to a specific priority on which to
concentrate. • City Manager Zais stated .the past practice of
having brief meetings on a catch -as- catch -can basis and a dinner
meeting have been. successful, and the legislators have responded
favorably'to- this arrangement. Council member Carmichael, requested
copies of; -the computer .printouts:.illustrating -,the appropriation and
distribution of the City's funds. . -
