ROLL CALL The City Council met in session on this date at 2:00 P.M. in the Council Chambers of City Hall, Yakima, Washington. Mayor Henry Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt, Lynn Buchanan, Lynn Carmichael, and Jack Sparling present on roll call. City Manager Zais, Assistant City Attorney Vanek, and Deputy City Clerk Toney also present. Council member Foy absent and excused. 2. INVOCATION The Pledge of Allegiance was led by Council member Barnett. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Council member Barnett referred to the Transit Monthly Report submitted in the Council packet, noting it does not contain revenues received from the Dial -A -Ride program. He requested staff include this information in future reports, and also asked that an audit trail be developed regarding these funds for future auditing purposes. Mayor Beauchamp displayed a collage of the past Presidents of the Association �f Washington Cities (AWC), noting that four former Yakima Mayors have served in this capacity. He added that Council member Lynn Carmichael, who served as Mayor of Yakima during 1982- 1983, is currently serving as President of A. Former City of Yakima Mayors who have served as President of the Association of Washington Cities include: W. W. Stratton, who is noted for the distinction of being the first AWC President, E. B. Riley, G. W. Burns and John Larson. 4. SPECIAL RECOGNITION OF FIREFIGHTER JOSEPH MAY Fire Chief Gerald Beeson reviewed the actions of Firefighter Joseph May on July 28th following the fire and explosion at FMC Corporation, 4 West Washington. He related that Mr. May had been in the general vicinity of FMC when the explosion occurred. He proceeded to FMC where he initiated medical assistance to the injured and then notified the Yakima Fire Department of the situation. Once the Fire Department arrived, Mr. May apprised them of the situation and assisted fire officials in gathering the necessary information for their report. Having gone through a partial decontamination process on the scene, Mr. May was given further decontamination instructions to be followed upon arrival at his residence. Mayor Beauchamp presented Firefighter May with an award for outstanding public service in response to a life - threatening emergency. Mr. May expressed appreciation to Mayor Beauchamp and the City Council, however, he emphasized he was accepting the award on behalf of all of the members of the Fire Department, stating he does not feel his individual actions warrant such recognition. 5. RECONSIDERATION OF TRAFFIC ENGINEERING REPORT REGARDING NORTH FIRST STREET TWO WAY LEFT TURN LANE (CONTINUED FROM 8/26/86) Hank Hein, Supervising Traffic Engineer, was present to respond to Council's inquiries regarding this report. A brief discussion ensued in which Mr. Hein indicated staff has been successful in resolving issues of concern to the City Council and the businesses situated along North First Street regarding this matter. Council member Carmichael stated she is pleased with the additional information submitted by staff and in light of that, it was MOVED by Carmichael, seconded by Berndt, to concur with the staff recommendation. (Staff recommends referring the matter to the 377 SEPTEMBER 2, 1986 Legal Department for preparation and presentation of a revised parking ordinance prohibiting parking on the east side of North First Street from Lincoln to "I ", and direct staff to stripe the new pavement in accordance with this, as soon as possible.) The question was called for the vote on the motion. Unanimously carried by voice vote. Foy absent. Council member Berndt reported she drove by Eisenhower High School early this morning and then again at lunch time and did not observe any vehicles parked along 40th Avenue between Tieton Drive and Arlington. She informed Mr. Hein that, so far, the changes made in the traffic pattern in that vicinity are working. Regarding the intersection at 48th Avenue & Tieton Drive, City Manager Zais stated the long- awaited traffic signal has finally arrived and has been installed by staff. The traffic signal has been operational since Friday afternoon, August 29th. 6. STATUS REPORT ON ADMINISTRATION'OF URBAN AREA ZONING ORDINANCE - Associate Planner In Skone, Supervising Associate Planner John Haddix and Director of Community & Economic Development Glenn Rice, were present to respond to Council's inquiries regarding the proposed changes to the Urban Area Zoning Ordinance. Don Skone stated the Urban Area Zoning Ordinance has been in effect for five months now and staff has developed fifty -nine relatively minor proposed amendments. Once the amendments have been reviewed by Council and the County Commissioners, they will be forwarded to the Regional Planning Commission. (RPC) a public hearing. He stated by mid- December Council may wish to ask the Technical Advisory Commission (TAC) to review the amendments also. Referring to page 2; Council members Berndt and Carmichael requested the section dealing with schools be given further review and consideration by staff. They suggested a more specific definition be given to the "school ". Council members Barnett,•Berndt and Carmichael voiced concerns related to the sitescreening requirements for Class (1) uses, indicating they feel the requirements are excessive. Council member Barnett read from the text of the Urban Area Zoning Ordinance which states, "a six foot high, view obscuring fence, made of wood, masonry block or slatted chain link be installed for Class 1 Use if the adjoining use is not Class 1 ". Council member Barnett stated he does not know of any church in Yakima that has a six. foot fence bordering the property line. Following a brief discussion of this requirement, Council member Berndt suggested staff review this proposed amendment, stating, "it seems'to be a bit of over - kill ". Council member Barnett questioned if the Regional Planning Commission is the proper body to review•the proposed changes, adding he would like to see a couple of the proposed amendments referred to the Technical Advisory Committee. Mr. Barnett referred to RCW 36.70 which indicates the Regional Planning Commission will hold public hearings and make recommendations on all ordinance changes. He stated is of the opinion the Hearing Examiner should be the one to hear the proposed amendments. Don Skone reiterated that the RPC is the proper body to which the proposed changes should be referred, however, if Mr. Barnett is uncomfortable with that, perhaps the matter should be referred to-the legal department for interpretation. Council member Carmichael commented she had hoped staff would address the issue of 'bed & breakfast' establishments, as well as 'rooming' and 'boarding houses'. Council member Berndt was in agreement with this and suggested, "staff come up with a more modern definition for these types of establishments and address this particular issue before it becomes a problem for Council to deal with ". Council member Carmichael stated she would like to see provisions added to the Urban Area Zoning Ordinance which would protect individual residences that are of historical value. It was MOVED by Barnett, seconded by Sperling, the proposed amendments be referred to the TAC for review and comment prior to the time they are submitted to the RPC. Dick Anderwald, Director of County Planning Department, requested the proposed changes be reviewed by the County Commissioners prior to staff referring them to the Technical Advisory and Regional Planning 378 SEPTEMBER 2, 1986 Commission. He stated, "in the future, he would hope that it would be possible for the City Council and County Commissioners to conduct a joint meeting to review any proposed amendments to the Urban Area Zoning Ordinance ". Acknowledging the validity of Mr. Anderwald's request, the motion was withdrawn with the consent of the second. Therefore, it was MOVED by Barnett, seconded by Sparling, that depending on the action taken by the County Commissioners, the proposed amendments be referred to the Technical Advisory Committee for review prior to being referred to the Regional Planning Commission. Unanimously carried by voice vote. Foy absent. 7. OTHER BUSINESS' Council member Buchanan asked about the status of the painting of the new refuse truck. He noted the Council Meeting Schedule indicates a bid opening for purchase of another side loading refuse truck is scheduled for September 5th at 2:00 p.m. He questioned why is staff purchasing another automated side loading refuse truck when a recent memo from the Fleet Manager recommended refusal of the first one due to damage sustained in an accident while in route to Yakima, and poor quality control items which need to be rectified. Following a brief discussion, Jerry Copeland, Director of Public Works, stated he would inquire as to the status of the recently purchased automated side loading refuse truck and report back to Council. Glenn Rice, Director of Community & Economic Development, reported - that he has a meeting scheduled with David Hanson, of the State Historical Office, to discuss the request from Yakima Interurban Lines Association (YILA) to have the Yakima Valley Transit System (YVT) placed on the historic register. He also stated the City's current lease of the Union Pacific car barn, which is used to house the trolleys and associated equipment, will terminate November 18, 1986 and Union Pacific does not intend to renew that lease. Union Pacific has requested the City vacate the car barns by November 18, 1986. Mr. Rice indicated he will investigate the ramifications of both these issues and report back to Council at a later date. City Manager Zais informed Council that the City has initiated litigation against Fred Williams regarding his South 6th Street housing project. Mr. Williams had been given 30 days in which to bring the project into compliance by paving the parking lot and properly landscaping the area. He has failed to comply, thus resulting in the City filing the lawsuit against him. There being no further business to come before the Council, it was MOVED by Buchanan, seconded by Barnett, that the meeting be adjourned at the hour of 3:40 p.m. Unanimously carried by voice vote.
