JULY 15, 1986
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Henry
Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt,
Lynn Buchanan, Lynn Carmichael, Jerry Foy and Jack Sparling present
on call. City Manager Zais, City Attorney Andrews, and City
Clerk Roberts also present.
2. INVOCATION
The Invocation was given by Reverend Dennis Williams, pastor of
Bethel A.M.E. Church.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER •
Council member Barnett stated Ruth Solowan; 928 Adams View,
Yakima, w 98901, called him and said she appeared before the
Council some time ago requesting information on the amount of money
spent for training. police and fire personnel in handling hazardous
waste emergencies. She had indicated she is still awaiting a
response.
4. CONSENT AGENDA •
Mayor Beauchamp referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. It was the ,general
consensus of the Council that Item No. 8 be added to the Consent
Agenda, as requested by Council member Foy . The City Clerk then
read the Consent Agenda items', including resolutions and ordinances
by title. It was MOVED by Buchanan, seconded by Foy, that the
Consent Agenda, as read, be passed. Unanimousl carried by roll
call vote. (Subsequent paragraphs preceded by an asterisk ( *)
indicate items on the Consent Agenda handled under one motion
without further discussion.)
5. AUDIENCE PARTICIPATION
None.
6. _ CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND
DEBRIS ABATEMENT PROGRAM
Bob Shampine, Code Administration Manager, was present to respond
to any questions. -There being no one in the audience wishing to
speak to this issue, Resolution No. 0-5271 was read by title. It
was MOVED by Carmichael, seconded by Foy, that the resolution, as
reade' , ,b Unanimously carried by roll call vote.
RESOLUTION NO. DH5271, A RESOLUTION ' authorizing the Code
Administration Manager to clear certain weedy lots.
7. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF LEASE
AGREEMENT WITH J.K.T.S. INVESTMENTS FOR RENTAL SPACE FOR CABLE TV
OFFICE
Council member Barnett questioned the difference between the
remodeling costs in the original report submitted and this
report. Bruce Crest, Cable TV Coordinator, explained the original
report was based upon estimates and this time staff obtained
estimates from electricians, carpenters, etc. Council member Foy
asked if staff has considered asking the County for financial
assistance for operating expenses, inasmuch as County residents are
utilizing the Cable TV facility and equipment. Glenn Rice,
Director of Community & Economic Development, stated that is
something staff could discuss with the Community Programming •

Advisory Committee.' (Council member Buchanan temporarily• absent
after 2:21 p.m.) Following a brief discussion, it was MOVED Foy,
seconded by Barnett, to direct staff to seek County participation
in the cable facility rental fees. Unanimously carried by voice
vote.' Buchanan temporarily absent. Resolution NO. , D-5272, having
been read by title, it was MOVED by Berndt, seconded by Carmichael •
that the resolution, as read, be passed. Unanimously carried by
roll call vote. Buchanan temporarily absent.
RESOLUTION NO. D -5272, A RESOLUTION authorizing and directing the
City Manager and City Clerk of the City of. Yakima to execute a
lease agreement with J.K.T.S. Investments.

*8. REPORT FROM COMMUNITY AND ECONOMIC DEVELOPMENT•RE ZONING ORDINANCE
STANDARDS ON DAMAGE TO NONCONFORMING STRUCTURES •
The staff report and - •recommendation from the Department of
Community and Economic Development regarding zoning ordinance
standards on damage to nonconforming structures, was accepted and
approved: The staff recommendation is: 1) The ordinance amended
by striking - all reference to adjusted assessed value and inserting
International Conference of Building Officials (ICBO) construction
value tables; 2) Section 15.19.060 remain unchanged; and 3) The
referenced - percentages contained in Chapter 15:19. - remain
unchanged. •
9. REPORT FROM PUBLIC WORKS RE: UPDATE 1NEL FINANCIAL IMPACT OF
AUTOMATED REFUSE COLLECTION SYSTEM
•
Del Kary, Superintendent of Streets and Refuse, explained the
automated bin system should be implemented by the first of
September. He stated the purpose of this was to advise
Council of that date and give on the back -up for the
bin system. Referring to the automated. residential collection,
staff would like to institute a test residential' program and get
some consumer feedback so Council can make a decision on whether to
continue this program. He commented he thinks we should take a
total-route for the test and in that way, there would be a
multitude services for comparison purposes. He stated the yard
carry -out service would be eliminated. He stated staff is
recommending a 90 gallon container. He further commented that not
all the logistics of the test have -been totally analyzed, however,
staff would come back with additional. information-,. prior to
conducting the test, if it is approved. Council member Barnett
stated he believes the test should run partially in the winter and
non - winter months.' He further' commented he did not believe a 60 -90
day test would be adequate time to make a determination -on the
feasibility of the autanated collection in the'`residential areas.
Council member Foy questioned the accuracy of the'f igures ' in the
report, stating fringe benefits were not increased for the years
1990 - 1996. Referring • to 'the top of page three in the narrative, he
stated it indicates a combined rate with yard service for one can
would be a reduction from $9.25 to $8.40, which would be in effect
for six months and then it will be increased. - Council .member
Barnett stated the lack of accurate information on salary and
fringe benefit increases is one of the factors which help
invalidate this projection. He asked how can,the salaries for the
crew remain•constant for anlextended period of time everything
else go up. From 1988 - 1994, the autanated expenses exceed those
projected for the manual system. He stated he doesn't see any
significant benefits for the consumer until after 1994. Mr. Kary
stated that to pay for the installment'of the system, it is going
to cost the people some money until the amortization of the
equipment. Council member Buchanan commented that other cities
have changed to this system without increased rates. Mr. Copeland
explained the other' - cities have kept their rates low, because
they have paid for the containers. He stated that is an option if
funding is available. Another option is to proceed with the bin

service for a few years, allowing the reserves to build, and then
finance some of ' the costs. Following additional discussion
regarding the figures in the report, it was MOVED by Barnett,
seconded by Foy, to table this report. Unanimously carried by
voice vote. Council member Buchanan commented the report needs to
be redone because there is such a big discrepancy between this one
and the previous report. Council member commented it
would help to know how many one can users are actually setting out
additional refuse and paying for one can service. City Manager
Zais commented if there is an assignment for staff, he wants to be
clear-about it. He stated he has taken a lot of notes on the
questions, but a motion to table is to a specific date or it is
tabled indefinitely. Council member Buchanan stated we have a
breakdown of services and there is nothing in this, report that
talks about boxes, bags and bundles that is set out with the cans. III
If we are not charging for that, then we should be, and if we are,
it should have been included in this report. City Manager Zais
stated there is a system in place that is accomplishing that.
- Council member Berndt expressed concern about tabling this issue
forever: She stated she. would like staff to determine why there
- are -such discrepancies between the two reports. It was MOVED by
Berndt, seconded by Carmichael, to instruct staff to re- evaluate
the figures which have been presented to the Council and bring it
back at a future date. Council member Berndt stated she would like
to see a comparison with Longview, etc. Del ,Kerry stated those
cities who were able' to keep their rates lower, paid for the
containers and did not pass those costs on to the consumer. The
question was called for a vote on the motion. Carried by 4 -3 voice
vote. Barnett, Foy and Sparling voting nay.
*10. CONSIDERATION OF RESOLUTION AUTHORIZING CITY TO INVEST IN STATE
LOCAL GOVERNMENT INVESTMENT POOL
RESOLUTION NO. D -5273, A RESOLUTION authorizing- the investment of
City of Yakima monies in the Local Government Investment Pool.
*11. SET DATE OF HEARING FOR SCENIC VIEW TERRACE, L.I.D. NO.1036, AND
ERICH'S HILL SITE, L.I.D. NO. 1037, FOR AUGUST 12, 1986

August 12, 1986 was set as the date of hearings on the final
assessment .rolls for L.I.D. No. 1036, Scenic View Terrace and
L.I.D. No. 1037, Erich's Hill Sites.
*12. CONSIDERATION OF AN ORDINANCE APPROPRIATING FUNDS FOR ACQUISITION
OF MANHOLE- COVERS AND RINGS FOR UPCOMING STREET IMPROVEMENT
PROJECTS (SECOND-READING) -
An Ordinance appropriating funds for manhole covers and rings
• having been-read by title only at-the previous meeting, was brought
before the Council for a second reading.
ORDINANCE Na. 2971, AN ORDINANCE amending. the 1986 budget for the
City of Yakima; and making an appropriation in the 473 - Wastewater
Treatment Fund for - expenditure during 1986.

*13. CONSIDERATION OF AN ORDINANCE REZONING PROPERTY AT 12TH AVENUE &
TIETON DRIVE
ORDINANCE NO. 2972, AN ORDINANCE affirming the Hearing Examiner's
recommendation to rezone property at 1206 Tieton Drive, and
amending the zoning map of the City of Yakima. -
*14. CONSIDERATION OF'AN ORDINANCE APPROPRIATING FUNDS FOR EXPENDITURE
WITHIN THE SEWER OPERATING BUDGET (FIRST READING)
An' Ordinance appropriating funds for services provided by the
City of Yakima Water Department in 1981 having been read by title
only at this meeting, was laid on the table for one week or until
July 22, 1986.

It was MOVED by. Buchanan, seconded by Sparling, 'to move into
• Executive Session for approximately 20 minutes•for the purpose of
discussing acquisition of property and pending litigation and
immediately adjourn thereafter. Unanimously carried by voice
vote.
17. ADJOURNMENT
