ROLL CALL The City Council met in session on this date at 2:00 p.m. in the Council Chambers of City Hall, Yakima, Washington. Mayor Henry Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt, Lynn Buchanan, Lynn Carmichael, Jerry Foy and Jack Sperling present on roll call. City Manager Zais, City Attorney Andrews, City Clerk Roberts and Deputy City Clerk Toney also present. 2. INVOCATION The Pledge of Allegiance was led by Council member Clarence Barnett. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER None 4. CONSIDERATION OF RESOLUTION OF APPRECIATION '10 OLLIE NELSON AND THE NOB HILL NOW COMMITTEE Mayor Beauchamp read the resolution of appreciation and then presented it to Mr. Nelson and two other members of the Nob Hill Now Committee. It was MOVED by Foy, seconded by Berndt, the resolution be adopted. Unanimously carried by roll call vote. RESOLUTION NO. D -5245, A RESOLUTION of appreciation and commendation to 011ie Nelson and the Nob Hill Now Committee for their dedicated and meritorious efforts towards the successful passage of the Nob Hill Bond Issue. Mayor Beauchamp read a proclamation declaring the week of May llth as "Older Americans and Senior Citizens Week ". Mike Kilpatrick, member of the Area Agency on Aging and the Community Development Citizen Advisory Committee, was present to accept the proclamation. Mayor Beauchamp read a proclamation declaring the month of Mayas "Mental Health Week ". The proclamation was accepted by R. Craig Ackerson, Vice Chairman of Central Washington Comprehensive Mental Health. Mayor Beauchamp read a proclamation declaring the month of May as "Better Hearing and Speech Month ". Marsha Sandersen, Executive Director of the Hearing and Speech Center, and Lisa Henley,' month old patient at the Hearing and Speech Center, accepted the proclamation. Mayor Beauchamp read a proclamation declaring the week of May 5th -llth as Folk Life Festival Week. Mayor Beauchamp read a proclamation declaring the week of May 1 -8th as •Community Law Week in Yakima. Dirk Marler, local attorney, accepted the proclamation and invited Council members to a community luncheon on May 7th at 12:00 p.m. at the Holiday Motor Hotel. 5. CONSIDERATION OF AN ORDINANCE INCREASING THE FIREWORKS STAND PERMIT FEES Council member Barnett asked that a correction be noted on Item No. 5 of the Council packet, indicating he voted against the motion to increase the permit fees for fireworks stands, while Council member Foy had voted in favor of it. The ordinance having been read by title, it was MOVED by Carmichael, seconded by Berndt, the MAY 6, 1986 303 • ordinance be adopted. Carried by 4 -3 roll call vote. ORDINANCE 2958, AN ORDINANCE` relating to , - fire,- regulations; regulating the sale of fireworks; increasing permit fees and amending Section 10.15.020 of the City, of Yakima Municipal Code. 6. REPORT FROM PUBLIC WORKS DEPARTMENT , REGARDING STREET REPAIRS /IMPROVEMENT PLANS AND NEEDS FOR 1986 • Jerry Copeland, Director of Public Works, indicated this report is a result of concerns expressed by various Council members earlier in the year regarding street conditions. Mr. Copeland stated • the entire repair and improvement project totals nearly $5,000,000, however, at this time he would like to address immediate needs in the amount of $150,000. Other repairs and improvement plans will be addressed during budget hearings. He suggested the $150,000 be taken from the street fund and contingency reserves. Council •member Berndt questioned why it is going to take so long to repair 40th Avenue. Dennis Covell, Director of Engineering__ &' Utilities, responded 40th Avenue will require complete pavement redesign and soils analysis. He anticipates this project will have to be contracted out. Council member Carmichael questioned the repair work scheduled for 32nd Avenue, stating "the City seems to be patching patches ". She also questioned why there are no curbs, ' gutters or sidewalks on 32nd Avenue. Mr. Copeland responded he does not know the history of the street, therefore, is unable to explain why curbs, gutters and sidewalks do not exist. He stated the scheduled repairs are -intended to make 32nd Avenue more driveable until more extensive repairs can be made. Following further discussion, it was MOVED by Foy, seconded by Carmichael, that Council authorize the expenditure of $150,000 in increments of $75,000 from the .street fund and contingency reserves. Unanimously carried by voice vote. 7. REPORT FROM CH2M -HILL AND STAFF REGARDING RATTLESNAKE CREEK DAM PROJECT AND FERC PERMIT Assistant City Manager Fred Stouder stated John Mayo, and Mark Keller-.of CH2M Hill are present to give a status report on the studies which are underway. Mr. Stouder reminded Council of the issues currently impacting future water for the City: 1) Yakima River Basin Enhancement Project, 2) the State initiated Department of. Ecology Water Rights Adjudication Process, 3) the Domestic-Irrigation Study, 4) the degree other municipalities and users in the urban area may want to purchase or become involved in the City's water opportunities in the future, and 5) the nature of the specific environmental studies yet to be pursued, the stance of the state, federal agencies and the Yakima Indian Nation on the nature of those environmental studies as they relate to the water state are a cost benefit issue that help identify options for future water needs. Prior to making his presentation, Mr. Mayo responded to Council members •Carmichael's question regarding, no sidewalks, curbs and gutters on 32nd Avenue. Mr. Mayo stated in the late.60's the City Council formed an L.I.D. for that area for the purpose of • installing curbs, gutters and sidewalks,• however, it was voted down by the adjacent property owners. • Mr. Mayo referred to the two executive summaries in the documents provided in their packets. He indicated .these reports update material presented to Council in. November of 1985, as, well as providing some new information. Mr. Mayo reviewed information presented on. page 12 and 14 of the Water Comprehensive Plan. He stated the City has a system with tremendous potential.growth and delivery, and tremendous potentials for conservation of water through abandonment of leaky pipes.- He added there is a great potential for conservation of electricity•through use of.a gravity • system. Mr. Mayo referred to the Feasibility Report stating it was part of the information presented to Council in November 1985, which has been updated and is-near completion at this time. He 304 MAY 6, 1986 pointed out to Council the FERC Permit issued to the City of Yakima was for only 24 months, and 18 of those months has elapsed, and encouraged Council to direct staff to submit a request for a one year extension for the FERC Permit. Ines Rice, 4409 W. Arlington, reiterated past concerns surrounding this issue. She indicated early agreements with the water ditch companies prohibit the mingling of the domestic waters with irrigation waters. Betty Gaudette, 701 North 6th Street, indicated Mr. Mayo is correct in his statement that a high percentage of the irrigation water is being lost due to deteriorating wooden pipes. Mrs. Gaudette stated the sewage treatment plant records indicate an increase of several hundred thousand gallons of water per day after the irrigation water is turned on in the spring. She stated if the domestic and irrigation systems are combined many of the residents would not be able to afford to irrigate. She asked what the cost would be to the citizens if the dual system is implemented. It was MOVED by Foy, seconded by Carmichael, to accept the report, and direct staff to'proceed immediately with the request for a 12 month extension of FERC Permit 8117. Following a brief discussion, the question was called for a vote on the motion. Unanimously carried by voice vote. 8. OTHER BUSINESS Council member Carmichael stated the Association of Washington Cities process for resolution consideration will be starting in the next couple of weeks. She stated if Council wishes to submit any resolutions for consideration she will need to have the information within that time frame. Duane Wagner, 613 Voltaire, addressed Council regarding business property owned by him at 1206 Tieton Drive. A map illustrating the property in question was distributed to the Council and City Clerk. Mr. Wagner indicated his property had been overlooked during the review process of the Urban Area Plan and Zoning Map. Prior to the new zoning ordinance taking effect, his property had been zoned B -2. Under the new zoning ordinance and map, his property is zoned R -2. After talking with Planning staff regarding 'the issue, it was determined to be an oversight on the part of staff, therefore, Mr. Wagner asked the zoning be amended to Small Convenience Center (SCC) to allow his business to continue. It was MOVED by Foy, seconded by Berndt, staff be directed to initiate a rezone on Council's behalf for the property owned by of Duane Wagner at 1206 Tieton Drive, rezoning it from R -2 'to SCC. City Manager Zais questioned the necessity for Council to waive the fees involved in this procedure. City Attorney Andrews indicated if the action is initiated by the Council, the fees do not apply. The question was called for a vote on the motion. Unanimously carried by voice vote. 6 Council member Barnett indicated there will be a Department of Energy informational workshop meeting on the disposal of defense waste on May 21st, 1986 at 6:30 or 7:00 p.m. He encouraged Council members and interested citizens to attend and participate in the workshop. Council member Carmichael reminded Council that on June 24th the Association of Washington Cities will be having a Conference in Tacoma. She questioned if the regular Council meeting scheduled for that day would be cancelled. It was MOVED by Foy, seconded by LA Berndt, to cancel the Council meeting scheduled for June 24th. Unanimously carried by voice vote. Council member Sparling questioned the status of the extension of transit service to West Valley. City Manager Zais stated this was discussed at the last Transit Committee Meeting wherein additional information was requested by Council members Buchanan and Carmichael for discussion at a future meeting. Council member Berndt stated a street cut repair at 48th & Chestnut is "totally unsatisfactory if it is permanent." Jerry MAY 6, 1986 305 Copeland, Director of Public Works, stated he would have staff inspect the street cut repair and take appropriate action. Council member Foy indicated he was contacted by local businessman, Ted Semon, who indicated Gardenmasters would like to accept the responsibility of the planters on Yakima Avenue and other City streets. Mr. Semon stated he was informed there was a question of liability involved in this type of situation. Mayor Beauchamp stated he had spoken with this group and informed them he would research the issue and get back to them with an answer on the • liability aspect. Council member Foy asked if the City street crews have completed the spring street sweeping effort. Mr. Copeland indicated the street crews have not finished street sweeping as two of the sweepers have been in the garage for repairs. He stated it will be approximately another two weeks before the project is completed. Mr. Foy stated he has received phone calls from a certain area regarding this matter. Mr. Foy was informed the area in question is scheduled for sweeping tomorrow. • Information Items Items of information supplied to Council -wire: Memorandum from Water /Irrigation Superintendent regarding Irrigation System Complaint. 4/28/86; Newsletter '86, Washington Nuclear Waste Board/Washington Nuclear Waste Advisory Council, Volume 3,-No. 2. EXECUTIVE SESSION REGARDING PROSPECTIVE LITIGATION AND COLLECTIVE BARGAINING It was MOVED by Berndt, seconded by Buchanan, to move into Executive Session for approximately 45 minutes for the purpose of discussing prospective litigation and collective bargaining. 10.
