BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date_ at 2:00 P.M'. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Henry
Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt,
Lynn Buchanan, Lynn Carmichael, and Jerry Foy present on roll call.
City Manager Zais, City Attorney Andrews, City Clerk Roberts and
Deputy City Clerk Toney also present. Council member Jack Sparling
absent and excused.
2. INVOCATION
The Pledge of Allegiance was led by Council member Barnett.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
None
4. CONSENT AGENDA
Mayor Beauchamp referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. It was the consensus
of the Council to add Item No. 8, as requested by Council member
Foy. The City Clerk then read the Consent Agenda items, including
resolutions and ordinances by title. It was MOVED by Carmichael,
seconded by Berndt, that the Consent Agenda, as read, be passed.
Unanimously carried by roll call vote. Sparling absent.

discussion.)
5. AUDIENCE PARTICIPATION
A. SPECIAL' APPEARANCE BY INES RICE REPRESENTING CITIZENS FOR
UNITED STATES CONSTITUTION BICENTENNIAL CELEBRATION
Ines Rice, 4409 West Arlington, appeared before Council regarding
the Bicentennial Celebration of the United States Constitution.
Mrs. Rice indicated she and a group of local citizens have recently
completed an in -depth study on the American Heritage and the
Constitution, and they are continuing further research on the
Constitution. She requested they be appointed to serve on a
Committee to develop programs and activities for the Bicentennial
Celebration : "'Others citizens''present' who 'had taken' -the study
course with Mrs. Rice were Helen Turnell, 7504 Spokane Street, Mel
Adams, 3204 West Viola, Florence Hay, 716 South 18th Avenue,
Reverend Chester Dyer, 4301 Tieton Drive, and Delores Boaz, 102
Gilbert Drive. Each spoke of the enjoyment they received during
the process of studying the Constitution, and encouraged Council
members to participate in one of the local study groups. It was
MOVED by Barnett, seconded by Buchanan, that at the appropriate
time, a proclamation be issued on.behalf of the City proclaiming
September 17, 1987 as "United States Constitution Day ", and
that a broad -base committee be appointed to plan and coordinate
activities .deemed. proper, with representation from Mrs. Rice's
group serving on this committee. Council member Carmichael
suggested this committee be added to the Boards and Commissions
application form.in the Clerk's office. to allow other.citizens an
opportunity to apply for service on this committee, and that a
Council Committee' be formed for the purpose of making a
recommendation for appointment at the appropriate time. The
question was called for a vote on the motion. Unanimously carried
by voice vote. Sparling absent.

6. CONSIDERATION OF APPOINTMENT OF HEARING EXAMINER
Council member Berndt reported she and Council member Carmichael
met with the County Commissioners Graham Tollefson and Jim
Whiteside regarding a recommendation for the position of Hearing
Examiner. It was MOVED by Berndt, seconded by Carmichael, to
appoint Phil 'Lamb to the position of Hearing Examiner, 'and to
appoint Ron Whitaker as Deputy Hearing Examiner. Unanimously
carried by voice vote. Sparling absent. It was MOVED by
Carmichael, seconded by Berndt, that staff be directed to bring
back the appropriate legislation and contractual agreement for
ratification by the City Council. Unanimously carried by voice
vote. Sparling absent.
7. PRESENTATION FROM 'GREENWAY COMMITTEE
Nadine Lee, 1415 South 29th Avenue, gave a synopsis on the creation
and history of the Greenway, and Marc.Smiley, Executive Director of
the' Greenway, gave a slide presentation and update on the status
of this project. Mr. Smiley expressed appreciation for the City's
involvement and participation in the Greenway.
*8. REPORT FROM DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT
REGARDING PROPOSED TROLLEY OPERATIONS PLAN FOR 1986 -1991
The report from the Department of Community & Economic
• - Development dated March 20, 1986, with the -staff 'recommendation
that the City Council 'continue to hold the YVT system in a
caretaker status for the next 30 days and allow negotiations to
proceed.' ., with Yakima .Interurban') Lines: t-- Associations - (YILA)
representatives and their legal counsel to formulate a complete
contract and plan, comprehensive budget and satisfactory insurance
plan to hold 'the City harmless from major' and personal
property damages was accepted.

*9. CONSIDERATION OF RESOLUTION INDEMNIFYING CITY OFFICIALS AND
EMPLOYEES FROM - PERSONAL• LIABILITY
RESOLUTION NO. D -5232, A RESOLUTION providing for indemnification
against personal liability for City personnel.
*10. CONSIDERATION OF "RESOLUTION AUTHORIZING THE HATFIELD RUN
RESOLUTION NO. D -5233, Pi' RESOLUTION authorizing the closure of
certain streets within the City of Yakima to accommodate "The
Hatfield" event.
*11. APPROVAL OF FEBRUARY 1986 TREASURY REPORT
- The report from the Director of Finance & Budget dated March 25,
1986, regarding the investments of the City of Yakima, was accepted
and approved.
*12. APPROVAL OF OUT-OF -STATE TRAVEL-TOR BILL SCHULTZ, TRANSIT MANAGER,
TO SAN 'JOSE, CA
The. out =of -state travel: fort-Bill Schultz, , Transit _ M anager,
to attend the American — Public Transit Association, Western
Education and Training Conference in San Jose, CA, April 12 -17, at
a cost of $1,216 was approved.
*13. CONSIDERATION OF AN ORDINANCE ADOPTING UNIFORM CODE FOR BUILDING
CONSERVATION . ' • •
ORDINANCE NO. 2952, AN ORDINANCE relating to building regulations;
adopting by reference the Uniform Code for Building'Conservation,
copyright 1985 by the International .Conference of Building
Officials," setting minimum standards for change occupancy,
" alteration 'or: repair of existing buildings or structures in the
City of Yakima; and enacting Chapters . 11..07•` 'and sections thereof,
all of the City of Yakima Municipal Code.

*14. CONSIDERATION OF AN AMENDMENT TO THE CITY'S "ENVIRONMENTAL POLICY"
(CHAPTER 6.88 YAKIMA CITY CODE) TO COMPLY WITH YAKIMA URBAN AREA
ZONING ORDINANCE
ORDINANCE NO. 2953, AN ORDINANCE relating to public safety and
morals; pertaining to the City's environmental policy; establishing
exemptions from requirements pertaining to environmental impact;
adopting documents by reference as part of the City's environmental
policy; amending Section 6.88.070 and Subsection 6.88.160 (4) (c)
of the City of Yakima Municipal Code; and declaring an emergency.
*15. CONSIDERATION OF AN ORDINANCE APPROPRIATING FUNDS FOR TOURIST
PROMOTION BROCHURE
An Ordinance appropriating funds for a tourist promotion brochure
having been read by title only at the previous meeting, was brought
before the Council for a second reading.
ORDINANCE NO. 2954, AN ORDINANCE amending the 1986 budget for the
City of Yakima; and making an appropriation in the 170 - Tourist
Promotion fund for expenditure during 1986.
16. OTHER BUSINESS
Council members Carmichael and Buchanan reported on the activities
which occurred during the National League of Cities Conference in
Washington. Council member Carmichael stated she attended
committee meetings relating to Community and Economic Development
matters, while Council member Buchanan attended meetings on
Transportation and Communication. Council member Carmichael stated
emphasis was placed on the loss of revenues and possible ways to
replace these losses. She indicated a major concern was
alternative funding to allow for continuation of low income
housing. Council member Buchanan stated there was discussion
regarding the federal reductions and income tax modification. He
reported one of the topics of discussion was transportation of
nuclear materials and other hazardous materials. He stated he
would like to hear comments on the tapes which were brought back
from the conference.
City Manager Zais asked Code Manager Shampine to report on the
status of the evacuation of the Cascade Apartments. Mr. Shampine
stated a fire which occurred at the Plaza Hotel prompted an
inspection of the Cascade Apartments. He reported 35 code
violations were found, of which 23 warranted immediate action and
resulted in an evacuation attempt. A list of the violations was
distributed to Council for their review, as well as photographs of
the interior of the building. Mr. Shampine reviewed the chain of
events surrounding the thwarted evacuation and the action taken by
City officials. The tenants were allowed to return to the
building following arrangements made by telephone with Mr. Dameyer,
property owner, to pay for a fire /watch, manned by two off -duty
firefighters. Mr Shampine stated he felt this action was necessary
because the fire alarm system was not working properly. A
discussion ensued regarding the financial responsibility of the
property owner (Richard Dameyer of Seattle) in this matter.
Council member Foy suggested a letter be sent to Mr. Dameyer
advising him of his responsibilities, adding that the City needs
something more substantial than a verbal commitment from the
property owner regarding this matter. Council member Carmichael
questioned what action can be taken in the future to see that this
type of situation does not reoccur. Mr. Shampine stated a meeting
has been scheduled with the Red Cross, Department of Emergency
Services, Salvation Army, etc., to develop a housing plan for
in this type of situation. City Manager Zais indicated internal
assistance will be necessary for the fire code inspections to be
carried out on a more routine basis in the future. Council member
Foy again expressed concern regarding the ability to locate
emergency housing, and secondly, the absentee landlord who
reportedly is upset with the inspection. It was the consensus of
the Council that staff address a letter to Mr. Dameyer regarding

financial responsibility as the owner of the property under
discussion.

City Manager and Director of Finance & Budget regarding the Refund
Request on Water & Sewer Excise Tax Returns from the State
Department of Revenue. 3/21/86; Memorandum from Director of
Community & Economic Development regarding the Union Gap /So.
Broadway Interceptor Status Report. 3/21/86; and Minutes of the
February 27, 1986 Yakima Air Terminal Board.
17. EXECUTIVE 'SESSION REGARDING PROSPECTIVE LITIGATION AND PROPOSED
ACQUISITION OF PROPERTY
It was MOVED by Barnett, seconded by,Berndt, to move into
Executive Session for approximately one hour for the purpose of
discussing prospective litigation and acquisition of property.
Unanimously carried by voice vote. Sperling absent.
18. ALGOURNMENT
Following the completion of the Executive Session, the meeting was
adjourned at the hour of 4:50 p.m.
