BUSINESS MEETING
1. ROLL CALL
The City Council met in session-on this date at, 2:00 p.m. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Henry
Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt,
Lynn Buchanan, Lynn Carmichael, and Jerry Foy present on roll call.
City Manager Zais, City Attorney Andrews, City Clerk Roberts and
Department Assistant II Leon present. Council member Jack Sparling
absent and excused.
2. INVOCATION
The Invocation was given by Don Stuber, Director of Young Life.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Council member Carmichael stated next week she will give a report
on the items of interest which were discussed at the AWC
Legislative Day in Olympia.
Council member Barnett expressed concern with the City's Parks and
Recreation Department sponsoring a beer tasting (or any other
alcoholic) event. He stated it encourages the youth into the
aspect of drinking and requested this issue be looked into further.
Mayor Beauchamp and Council member Berndt concurred with these
statements. *See addition to Item No. 3 in Council minutes of
March 11, 1986.
Mayor Beauchamp read and presented a proclamation declaring
February 22 -March 1 as Yakima Community Concert Week to Chester
„Henderson, who was present on behalf of the Yakima Community
Concert Association. He encouraged the Council to attend an
upcoming event.
_ Mayor Beauchamp' read and presented a proclamation to Bob Gaither
declaring the week of February 17 -23 as National Patriotism Week.
4. CONSENT AGENDA
Mayor Beauchamp referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. It was the general
consensus that Items Nos. 8, 9, and 10 be added, as requested by
Council members Berndt and Carmichael and Item No. 14 be removed,
as requested by Council member Barnett. The City Clerk then read
the Consent Agenda items, including resolutions and ordinances by
title. It was MOVED by Carmichael, seconded by Berndt, that the
Consent Agenda, as read, be passed. Unanimously carried by roll
call vote. Sparling absent. (Subsequent paragraphs preceded by an
asterisk ( *) indicate items on the Consent Agenda handled under
one motion without further discussion.)
• *5. APPROVAL OF MINUTES OF THE COUNCIL MEETINGS OF JANUARY 16, 21, 28
and 30, 1986
The Council minutes of January 16, 21, 28 .and 30, 1986 were
approved, having been duly certified accurate by two Council
members. and .no one present wishing to have said minutes read
publicly.
6. AUDIENCE PARTICIPATION
None .... .
7. PRESENTATION OF 1985 YEAR- END REPORT
Council member Barnett stated his inquiries to this item relate to
Item No. 14 which he requested be taken off the consent agenda.
In reference to Page 5 of the report, he requested clarification on
the year -end balances for the Parks and Recreation Fund and Street
Fund, as they do not reconcile with the. figures listed in the
report in Item No. 14. City Manager Zais explained the estimates
for revenues and expenditures which were adopted in the budget for

1985 and how they correspond with the actual figures provided in
this report. It was MOVED by Barnett, seconded by Buchanan, to
accept the report. Unanimously carried by voice vote. Sparling
absent.
*8. PRESENTATION OF CAPITOL THEATRE YEAR -END REPORT
The report from the Capitol Theatre dated January 30, 1986
concerning the 1985 operations of the Capitol Theatre was accepted
and approved.
*9. PRESENTATION OF YAKIMA CENTER YEAR -END REPORT
The report from the Yakima Center dated February 3, 1986 concerning
the 1985 operations of the Yakima Center was accepted and
approved.
*10. AWARD OF CONTRACT FOR LEGAL ADVERTISING (MATERIAL AVAILABLE
TUESDAY)
The staff recommendation to award the contract for the City legal
advertising for the.period February 19, 1986 through February 18,
1987 to Yakima Herald - Republic, based upon their bid of $2.75 per
column inch, including free publication of City Council Agendas on
a weekly basis, was accepted.
11. CONSIDERATION OF RESOLUTION PROVIDING FOR THE REMOVAL OF CLEARVIEW
AND STREET SECTION OBSTRUCTION AT 225 SOUTH 16TH AVENUE (CONTINUED
FROM 1/21/86)
Jerry Copeland, Director of Public Works, was present to respond to
Council's inquiries. He informed Council this item had been
continued to allow the property owners an opportunity to act on the
matter. Council questioned whether additional contacts had been
made by staff to the property owner or renter. Mr. Copeland
reported staff had contacted the renter who indicated he had not
heard anything about this matter from his landlord. Resolution
No.D -5221 having been read by title, it was MOVED by Foy, seconded
by Buchanan, the Resolution be adopted. Unanimously carried by
roll call vote. Sparling absent.
RESOLUTION NO. D -5221, A RESOLUTION authorizing final notice and
the removal of a maple tree adjacent to property at 225 South 16th
Avenue, Yakima, Washington.
*12. CONSIDERATION OF RESOLUTION OF INTENTION TO CREATE POPLAR VIEW
SEWER LOCAL IMPROVEMENT DISTRICT (SET DATE OF HEARING FOR MARCH 11,
1986)
RESOLUTION NO. D -5222, A RESOLUTION of intention to create a local
improvement district.
*13. APPROVAL OF OUT -OF -STATE TRAVEL FOR TOM FIELDSTEAD, FIRE

DEPARTMENT, TO EMMITSBURG, MARYLAND
The out -of -state travel for Tom Fieldstead, Deputy Fire Chief, to
attend the Executive Fire Officers Program in Emmitsburg,
Maryland, March 16 -28, 1986 at a cost of $132, was approved.
14. CONSIDERATION OF AN ORDINANCE AMENDING THE 1986 BUDGET AND
APPROPRIATING FUNDS FOR 1986 INSURANCE PREMIUMS (FIRST READING)"
Council member Barnett stated his inquiry was previously answered
in the discussion of Item No. 7. He then asked that the ordinance
,W read. An ordinance appropriating funds for 1986 insurance
premiums having been read by title only at this meeting, was laid
on the table for one week or until February 25, 1986.

*15. CONSIDERATION OF AN ORDINANCE AMENDING THE 1986 BUDGET AND
APPROPRIATING FUNDS FOR OUTSTANDING 1985 ENCUMBRANCES (FIRST
READING)
An ordinance appropriating funds for. outstanding 1985 encumbrances
having been read by title only at the previous meeting, was laid on
the table for one week or until February 25, 1986.
16. OTHER BUSINESS
City Manager Zais informed Council that two Council members are
needed to represent the City in reviewing the applications for a
Hearing Examiner. Glenn Rice, Director of Community and Economic
Development, conQUented the earliest the Urban Area Zoning Ordinance
can be adopted is March 4th. Council members Carmichael and Berndt
both expressed a desire to participate on this committee.
Mayor Beauchamp recognized Gracie Robertson Rogers, a new member of
the Selah City Council, who was in the audience today to learn
Council procedures.
Concil member Foy questioned when he would be provided with an
update on the trolleys and on the bid for Nob Hill Boulevard. City
Manager Zais responded that he, City Attorney Andrews and Cuianunity
and Economic Development Director Rice have met with Dr. Bob Atwood
to review the trolley proposal. Mr. Zais proceeded to state the
information contained in the proposal was insufficient and asked
Mr. Atwood to get back to him with additional information, which he
has not done as yet. Council member Foy stated the City has a
great liability here and suggested the City declare the donation
surplus and have it go out for salvage bids. Council member
Buchanan expressed his concern with considering this as a. single
issue and noted the City should look at other alternatives; perhaps
utilize it for street right -of -way or for Parks and Recreation
purposes. It was MOVED by Foy to authorize staff to prepare
legislation to declare the catenary, copper, railroad tracks and
equipment parts surplus. The Motion died for lack of a second.
Council member Barnett stated he feels the City should wait until
the additional information is received from the Trolley Association
before making a decision on the donation. It was MOVED by Berndt,
seconded by Carmichael, that we get back to logistics and have the
association provide us with more information by March 1st.
Unanimously carried by voice vote. Sparling absent.
Council member Berndt expressed concern with the publication of
ordinances in the local newspaper, as the contract for publicaton
has once again been awarded to the Yakima Herald - Republic and their
fees have been raised this year. Brief discussion ensued with City
Attorney Andrews explaining that state statute requires the
ordinances be published in its entirety or in summary form. To
publish in summary would require a summary for each section of the
ordinance.

17. ADJOURNMENT
There being no further business to come before the Council, it was
MOVED by Barnett, seconded - by 'Berndt, that this meeting be
adjourned at the hour of 2:43 P.M. Unanimously carried by voice
vote. Sparling absent.
