ROLL CALL The City Council met in session on this date at 2:00 p.m. in the Council Chambers of City Hall, Yakima, Washington. Mayor Henry Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt, Lynn Buchanan, Lynn Carmichael, and Jerry Foy present on roll call. City Manager Zais, City Attorney Andrews, City Clerk Roberts and Deputy City Clerk Toney also present. Council member Jack Sperling absent and excused. 2. INVOCATION The Invocation was given by Reverend James Schoenrock, Senior Pastor of the Central Lutheran Church. Mayor Beauchamp expressed appreciation to the City Employee Centennial Celebration Committee and other city staff responsible for assisting in organizing and orchestrating the City's 100th Birthday Celebration. He also stated the City received letters of congratulations from several elected state officials on behalf of the occasion. Mayor Beauchamp read and presented a proclamation to Sister Rebecca Berghoff, representing. the Catholic School System, proclaiming February 3rd -7th, '1986 as Catholic School Week in Yakima. Sister Berghoff accepted the proclamation and introduced Sister Helen Brennan, Superintendent of Schools, Don Erickson, Principal of St. Paul's School, and John Cruse, Principal of Carroll High School. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER None 4. CONSIDERATION OF RESOLUTION AUTHORIZING THE-CALL-FOR PROPOSALS THE CITY'S LEGAL ADVERTISING FOR 1986 City Manager Zais stated this fulfills the annual requirement of calling for proposals for legal advertising for 1986 and pursuant to City Code, must be addressed during the first meeting in February. The resolution having been read by title, it was MOVED by Buchanan, seconded by Carmichael, that the resolution be adopted. Unanimously carried by roll call vote. RESOLUTION NO. D -5217, A RESOLUTION prescribing a form of contract for printing and publishing city legal advertising; and directing publication of a call for proposals therefor. 5. MEETING WITH COMMUNITY PROGRAMMING ADVISORY COMMITTEE REGARDING • REVIEW OF 1985 CABLE TV PLAN AND ACCESS REQUIREMENTS Bruce Crest, Cable TV Coordinator, and members of the Community TV Programming Advisory Committee were present to discuss and review this report. Committee members present were Rachel Fields, Randy Marquis, Allan Taylor, Ken Messer and Teri Norman. Committee members Doyle Hardy, Terry Massoth and Eric Mould were unable to attend the meeting. Several Council members expressed concern that while only city residents are financially supporting Cable TV, County residents are benefitting by utilizing the Cable TV operations. Concern was also expressed about the practice of underwriting certain programs. Committee members assured Council that city residents are given priority over county residents. Discussion ensued regarding the non - profit groups which have been the subject of, produced, or provided programming to YCTV. Council member Foy requested information on what percentage of time is used for equipment and training of municipal employees. Council member Buchanan requested a list of producers, indicating city or county residency. There being no Council action required, the report was accepted and appreciation expressed to the Committee by Council member Carmichael for a job well done. 251' • FEBRUARY 4, 1986° Council recessed briefly before addressing the remaining items on the agenda. 6. REPORT FROM DEPARTMENT OF ENGINEERING AND UTILITIES REGARDING STATUS OF THE WASTEWATER. TREATMENT PLANT SPRAYFIELD /USERS AGREEMENT /CITY PARTICIPATION Dennis Covell, Director. of Engineering & Utilities, was present to respond to Council's questions regarding this item. He stated there are representatives from three of the industrial users present also. Jim Roessler, Washington State Juice, .indicated his firm has been meeting with staff for the past year in an attempt to find a solution for allocation of the costs. He stated Washington State Juice is one of the three current users of the Industrial Sprayfield, and feels strongly, that they want to ,pay only their fair share. Jim Jacobs, representing John Ward of Del Monte, stated his firm shares this concern which is of vital interest to them. Chris Waarvick, Wastewater Superintendent, was present and also responded to Council's questions. Council member Buchanan pointed out that the City of Union Gap has recently requested use of the City's sewer line, and expressed concern that the City keep its cost at a reasonable rate for the industrial sprayfield users. There was no action required by Council other than review of the material presented in the staff report. 7. OTHER BUSINESS Council member Berndt stated the Council committee met regarding appointments to the Traffic Safety Advisory Committee and made recommendations to fill three of the existing vacancies. It was MOVED by Berndt, seconded by `Buchanan, that Cindy Warren be appointed to replace Rich Flathers, Sandy Shaver be appointed to . replace Keith Farnam, Ashley Miller be appointed to replace Tom Gasseling, and Julia Blesio; and Paul Horne. be reappointed to their current positions with *terms expiring . .February;, 2, - 1989. • Unanimously carried by voice vote. Sparling absent. Council members expressed concern regarding the job advertisement for the Employment Training Specialist. Council member Berndt commented staff had been given instructions to re -write the job description so the duties would be more in line with the 17.0 pay range Council approved for the position. City Manager Zais indicated neither he nor staff had interpreted Council's comments as such. Discussion ensued regarding this issue, Council emphasizing they determined the pay range they felt appropriate for the position. Council indicated they did not want this position filled at this salary range, using the same job description, and_have : -that individual go to the Civil Service Commission for more pay. City Manager Zais stated this position would be reviewed. Council member Foy stated the Council committee met and came to a consensus for a recommendation for appointment to the Civil Service Commission. It was MOVED by Foy, seconded by Berndt, that Clayton R. Gertsenberger be appointed to the Civil Service Commission. Unanimously carried by voice vote. Sparling absent. City Manager Zais indicated he would like to schedule a day for a Council workshop at which time Council would meet with department heads for an update on the current status of city goals and priorities, and review of the Capital Improvement Program. He stated City Attorney Andrews would also address Council on the subject of "keeping out of trouble as legislative policy makers ". It was the consensus of the Council to meet on April 29th at 9:00 or 9:30 in the morning, break for lunch, and continue the meeting in the afternoon at a location to be yet determined. 252 • FEBRUARY 4, 1986 Information Items Items of information supplied to Council were: Letter from Chief of Police to Steve Conner in response to Mr. Conner's petition regarding pornographic materials sold in City retail outlets. 1/27/86; Letter from Orin C. Smith, State Office of Financial Management regarding City's request to seek reimbursement of extra costs of publishing ordinances. 1/23/86; Memo from Police Patrol Division, City Engineer and Traffic Engineering Manager regarding 1985 Traffic Collision Statistics - Good News. 1/31/86; and Legislative Bulletin from Association of Washington Cities. January 24, 1986 8. EXECUTIVE SESSION REGARDING COLLECTIVE BARGAINING AND PROSPECTIVE LITIGATION (PLEASE ALLOW 45 MINUTES) It was MOVED by Berndt, seconded by Buchanan, to move into Executive Session for approximately 45 minutes for the purpose of discussing collective bargaining and prospective litigation. Unanimously carried by voice vote. Sparling absent. 9.
