HomeMy WebLinkAbout01/16/1986 Adjourned Meeting 234 JANUARY 16, 1986 ADJOURNED MEETING - -URBAN AREA PLAN AND ZONING ORDINANCE • The City Council met in session on this date at 2:00 p.m. in the Council Chambers of City Hall, Yakima; Washington, in a joint meeting with the County .Commissioners for the purpose of consideration of adoption of City and County Ordinances establishing an Office of Hearing Examiner and to•consider an Intergovernmental Agreement for Mutual Use of Hearing Examiner Services. County Commissioners present were Chuck Klarich, Graham Tollefson and Jim Whiteside. .Dick Anderwald, Director of Planning, was present of behalf of County staff. Mayor Beauchamp introduced Council members Clarence Barnett, Pat Berndt, Lynn Carmichael, and Jack Sparling. Council members Lynn Buchanan and Jerry Foy were absent and excused. City staff present were City Manager Zais, City Attorney Andrews, Glenn Rice, Director of Community.& Economic Development, Associate Planners Don Skone and Judd Black, City Clerk Roberts and Deputy City Clerk Toney also present. Associate Planner Don Skone reviewed the changes which have been incorporated in the proposed zoning .ordinance. Mr. Skone then reviewed the various sections of the Report on the Proposed Yakima Urban Area Hearings Examiner Ordinance and Interlocal Agreement (Report No. 40) and discussed proposed changes in the text which were•suggested by City Council members and County Commissioners. It was the consensus of the County Commissioners and City Council that the verbage be ,identical in the two ordinances wherever possible, therefore, changes discussed during this meeting will be made and presented in final draft prior to adoption of the ordinance. Under Section 1.43.040 Removal, it was the consensus that the City ordinance be amended to 'include the words "for cause" so the text will be the same as that of the County. Under Section 1.43.090 Application, it was the consensus that the City ordinance be amended to read the same as the County ordinance, to include the words "subject to review ". Under Section 2.23.120 Examiner's Decision, it was the consensus to delete the word "Planning" in the next - to-the -last sentence. Under Section 2.23.140 Appeal From Examiner's Decision, it was the consensus that the County text be changed to read the same as the City's, therefore -the word, "decisions" was inserted in place of the word "applications ". Under Section 2.23.140 Appeal From.Examiner's Decision, Paragraph (e) it was the decision of those present to deal with this specific issue after it has been given further consideration. Staff was given instruction to bring back provisions for extenuating circumstances to be considered by this body at a, later date. Mr. Skone directed attention to pages 11 -13 of the ordinances, stating these pages address the transition from our existing City and County Planning Commissions to the Hearing Examiner and the Regional Planning Commission. This section dissolves the City of Yakima - Planning Commission, divests the existing Yakima County Planning Commission of authority within the urban area, establishes the Yakima Area Regional Planning Commission as the City's Planning Ccumission and as the Planning Commission for Yakima County within the unincorporated portion of the urban area. It also establishes the organization procedures and duties of the Regional Planning Commission and provides for the continuing function of the City and County Planning Commissions within urban area for the purpose of completing the processing of any applications for planned developments, subdivisions and City special permits pending on the effective date of the Yakima Urban Area Zoning Ordinance. It was requested that the various commissions be named by full title whenever mentioned in the ordinance to eliminate confusion. It was the consensus of the City Council and County Commissioners that paragraph. (6) under Section 2.22.040 Duties, the City's ordinance be amended to read the same as the County ordinance. It was also agreed that the effective date of the ordinance be the same for each entity. Dick Anderwald, Director of County Planning Department, referred to the Interlocal Agreement stating that Section VIII does not satisfactorily address the arbitration issue. He recommended Section 9 (Arbitration) of the Wastewater Treatment Agreement be incorporated into this section. This was the consensus of those present. 235 JANUARY 16, 1986 ADJOURNED MEETING -- URBAN AREA PLAN AND ZONING ORDINANCE Ines Rice, 4409 Arlington, questioned whether the parties entering into these agreements would honor them. She spoke about the current situation with the Lynch Motors and Sunfair Chevrolet annexation. She expressed concern that these agreements would not be honored in future years. Mrs. Rice was assured by County Commissioners and City Council members that the agreements entered into regarding the Urban Area Plan and Zoning Ordinance would be honored by both entities. Keith Daniels, 211 South 37th Avenue, expressed concern with the $75 fee for filing appeals. He was informed this figure had been discussed and agreed upon at a previous meeting. Discussion ensued regarding the possibility of lowering the fee. Mr. Skone stated staff will bring back a fee schedule containing current City & County fees for comparison to fees contained in the Urban Area Zoning Ordinance prior to its adoption. Council member Barnett stated there are only 18 days allotted for the Hearings Examiner. Committee to appoint the Hearing Examiner once the applications have been received. He indicated there are only 26 days allowed for the complete process, and he feels this time frame is too compressed. He further stated the map and Draft 3 of the Zoning Ordinance were scheduled to' be made available on February 10th, and questioned if this would be done. Mr. Skone responded stating the map and ordinance will not be available on the 10th as planned, and that staff is just now providing it to Council. Mr. Barnett stated this will also diminish the amount of time for review of the document by the public. Commissioner Klarich expressed concern regarding adopting the ordinance prior to construction season for the benefit of the builders and developers. He also stated he is concerned the public would not have time to review the document prior to January 30th and provisions should be made to continue the hearing if necessary. Mr. Skone agreed that the time frame is becoming rather compressed and this is the reason staff had decided to send the request for proposals for the hearing examiner on February 3rd, in advance of the adoption of the ordinance. Mr. Anderwald stated it would take approximately five weeks for the entire process of hiring a hearing examiner, and recommended the time frame be expanded. County Commissioner Tollefson stated he did not have a problem with extending that process. It was MOVED by Whiteside, seconded by Klarich, to continue this meeting to January 30th at 2:00 p.m. at the Yakima Convention Center.. Tollefson concurred. It was MOVED, by Barnett, seconded by Carmichael, to continue this hearing to January 30th at 2:00 p.m. in the Yakima Convention Center. Unanimously carried by voice vote. It was MOVED by Barnett, seconded by Berndt, to adjourn this meeting at the hour of 3:34 p.m. and to then meet with Congressman Sid Morrison at 4:00 p.m. Unanimously carried by voice vote.
