BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m. in the
• Council Chambers of City Hall, Yakima, Washington. Mayor Henry
Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt,
Lynn Buchanan, Lynn Carmichael, Jerry Foy and Jack Sparling present
on roll call. City Manager Zais, City Attorney Andrews, City Clerk
Roberts and Deputy City Clerk Toney also present.
2. INVOCATION
The Invocation was given by City Attorney Andrews.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Council member Carmichael stated the Association of
Washington Cities Legislative Day will be held in Olympia on
February 13th at the Tyee Motor Inn in Tumwater and encouraged the
other Council members to attend.
4. CONSENT AGENDA
Mayor Beauchamp referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. It was the
censensus of Council that Its Nos. 14 and 19 be removed from the
Consent Agenda, as requested by Council members Barnett and.
Berndt. The City Clerk then read the Consent Agenda items,
including resolutions and ordinances by title. It was MOVED by
Carmichael, seconded by Buchanan, that the Consent Agenda, as read,
be passed. Unanimously carried by roll call vote. '(Subsequent
paragraphs preceded by an asterisk ( *) indicate' items on the
Consent Agenda handled under one motion without further
discussion.)
*5. APPROVAL OF MINUTES OF THE COUNCIL MEETINGS OF NOVEMBER 12, AND
DECEMBER 3, 5, 14, AND 17, 1985
The Council minutes of November 12, 1985 and December 3, 5, 14,
and 17, 1985 were approved, having been duly certified accurate by
two Council members and no one present wishing to have said minutes
read publicly.

7. PROCLAMATION DECLARING CELEBRATION OF MARTIN LUTHER KING, JR.
BIRTHDAY OBSERVANCE ON JANUARY 20, 1986
Mayor Beauchamp read a proclamation declaring January•20th as Dr.
Martin Luther King, Jr. Day. He stated there are numerous events
scheduled throughout the City to highlight this day, and
encouraged everyone to participate in these activities.
8. HEARING ON REZONE OF YAKIMA AIR TERMINAL AS INITIATED BY THE
PLANNING COMMISSION

This being the time set for hearing on a rezone application
requested by the City Planning Commission, for property located at
the Yakima Air Terminal, and the hearing procedure having been
read, the Mayor opened the hearing for testimony. John Haddix,
Supervising Associate Planner, stated the City Planning Commission
initiated this rezone at the request of the Yakima Air Terminal
Board. He stated the rezone is compatible with the Urban Area
Plan, with'' .surrounding zoning and 'existing land uses, and
consistent with the future development plans for the Yakima Air
Terminal. Mr. Haddix stated staff and the City Planning Commission

have recommended approval of the rezone request. It was pointed
out that an emergency declaration will be necessary to avoid an
additional delay regarding this rezone request. The City Clerk
stated a letter supporting the rezone has been received from Smoot
Brothers and marked as Exhibit P -1. Gary Robbins, Airport
Manager, spoke in support of the rezone and urged Council's
approval of the request, and the declaration of an emergency.
There being no other proponents or opponents present to speak in
reference to the rezone request, the hearing was declared
closed. It was MOVED by Foy, seconded by Carmichael,. to approve
the rezone request, and under the declaration of emergency, the
issuance of proper building permits in this rezoning. Unanimously
carried by voice vote.
9. HEARING ON APPEAL OF REVOCATION OF TAXI DRIVER'S LICENSE FILED BY
TOMMY HAYES
At the request of Mr. Hayes, this hearing was held in
closed session for quasi- judicial purposes. (Council recessed for
approximately one hour.)
10. STATUS REPORT ON PLACEMENT OF GENERAL LIABILITY AND PROPERTY
INSURANCE COVERAGE FOR THE CITY
City Manager Zais commented briefly on this item and requested Joel
Pearson of Fred S. James to summarize the report for Council. Mr.
Pearson stated property coverage is in place to the 10 million
dollar limit and earthquake and flood coverage is in place in the
amount of 5 million dollars. There is a $10,000 deductible in the
police liabilities and errors and omissions coverages. He stated,
at this point, the liability coverages are up to 1 million dollars
with the exception of the Transit coverage which is $750,000 short.
He stated several options are being considered for this coverage,
however, no decision has been made at this_ time. Council member
• Carmichael informed, Council the Association of Washington Cities is
attempting to establish (through the National League of Cities) a
state wide insurance pool for municipalities and this may be a
solution to the problem in future years. She stated Council member
Sparling's suggestion of becoming self- insured is another
option Council may wish to consider. It was MOVED by Foy, seconded
by Berndt, to accept the report. Discussion ensued regarding the
source of the funding for this expenditure. Mr. Zais stated staff
will meet with representatives of Fred S. James. to determine
apportionment of the total premium for various city departments,
and bring this information back to.Council at a later date. The
question was called for a vote on the motion. Carried by 6 -1 voice
vote. Sparling voting nay.
11. CONSIDERATION OF RESOLUTION ENGAGING PROFESSIONAL SERVICES FOR
HANDICAPPED ACCESS STUDY

Dennis Covell, Director of Engineering & Utilities, was present to
respond to questions as well as Lois Wardell and Don Hollingbery of
Loofburrow & Hollingbery. Council member Barnett questioned why
this report contains a request for $1,200 to determine if the
Senior'Center is in compliance with handicapped regulations. Mr.
Barnett stated he was informed earlier in the year the Senior
Center already complies with federal regulations. He stated Fisher
Park and the Senior Center were not in the original report .as
having code deficiencies which need to be addressed. He further
questioned the amount of money involved to have a separate contract
for the City Shop Complex. Mr. Covell stated he was not involved
in the initial assessment, and Code Administration had requested
the Senior Center be included in this report. He further stated
Dave- Rhodes, former Director of Public Works, had added a change
order to the Tahoma Cemetery Consultant Contract to develop
contract plans and specifications for the Public Works Complex.
After Mr. Rhodes left employment with the City Of Yakima, the
scope of the project was changed to address handicapped facilities.
Following further discussion, it was MOVED by Foy, seconded by
Berndt, that the report be referred back to the Department of
Engineering and Utilities for closer scrutiny as to what is truly
needed, and cane back to Council with a more detailed report and

recommendation. Prior to voting on the motion, Council member
Barnett requested contact be made with the Code Inspection
Department _ regarding " the funding requested for handicapped
compliance at the Senior Citizen Center. The question was called
for a vote on the motion. Unanimously carried bydvoice vote. -
*12. CONSIDERATION OF LEGISLATION REGARDING URBAN AREA PLANNING AND
WASTEWATER AGREEMENTS:
A. RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT TO THE WASTEWATER
TREATMENT AND DISPOSAL SERVICE AGREEMENT
RESOLUTION NO. D -5204, A RESOLUTION authorizing the execution of an
"Agreement to Amend Agreement For Wastewater Treatment And Disposal
Service ".

YAKIMA AREA REGIONAL PLANNING AGREEMENT
RESOLUTION NO. D -5205, A RESOLUTION authorizing the execution of an
"Amendment To The Urban Yakima Area Regional Planning Agreement ".
*13. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH
EMC ENGINEERS, INC. FOR CITY HALL ENERGY MANAGEMENT SYSTEM
RESOLUTION NO. D -5206, A RESOLUTION authorizing the City Manager
and the City Clerk to enter into a contract with EMC Engineers,
Inc. for renovation of the City Hall heating, cooling, and lighting
systems.
14. CONSIDERATION OF RESOLUTIONS ACCEPTING GRANT AMENDMENTS AND
REIMBURSEMENT FUNDING FROM EPA /DOE FOR THE WASTEWATER CONSTRUCTION
PROGRAM

Council member Barnett stated he interpreted from the report that
the City would be responsible for correcting the aeration problems
with the Wastewater Treatment Plant equipment. Mr. Barnett stated
he believes this is the responsibility of the contractor. City
Manager Zais indicated this is a subject on which staff has been
reporting to Council for almost two years now. He stated staff
will be bringing further information back to Council once it is
received from Philadelphia Gear Company regarding their
responsibility in the matter. Following further discussion, and
the Resolution No. D -5207 having been read by title, it was MOVED
by Buchanan, seconded by Foy, the resolution be adopted.
Unanimously carried by roll call vote.
RESOLUTION NO. D -5207, A RESOLUTION authorizing and directing the
• Ci Manager and City Clerk of the City of Yakima to execute an
agreement accepting an offer from the United States Environmental •
Protection Agency for a grant of funds to aid construction of water
pollution control facilites.
B. GRANT NO. C- 930597 -05 -5
Resolution No. D -5208 having been read by title, it was MOVED by
Sparling, seconded by Carmichael, the resolution be adopted.

RESOLUTION NO. D -5208, A RESOLUTION authorizing and directing the
City Manager and City Clerk of the City of Yakima to execute an
agreement accepting an offer from the United States Environmental
Protection Agency for grant of funds to aid construction of water

agreement with the State of Washington, Planning and Community
Affairs Agency, for fire protection services to State facilities.
*16. RESCHEDULE DATE OF HEARING ON FINAL ASSESSMENT ROLL ON L.I.D. NO.
1038, 81ST•AVENUE SEWER DISTRICT FOR FEBRUARY 11, 1986
The date of hearing on the final assessment roll on L.I.D. No.
1038, 81st Avenue Sewer District was rescheduled from January 28,
1986 to February 11, 1986.
*17. CONSIDERATION OF AN. ORDINANCE MAKING FINAL 1985 BUDGET
APPROPRIATIONS (SECOND READING)
An Ordinance amending the 1985 Budget and appropriating funds for
expenditure during 1985 having been read by title only at the
previous meeting, was brought before the Council for a second
reading.
ORDINANCE NO. 2931, AN ORDINANCE amending the 1985 Budget for the
City of Yakima; making appropriations from unappropriated fund
balances within various funds for expenditure during 1985.
*18. CONSIDERATION OF AN ORDINANCE AMENDING THE TRAFFIC CODE
ORDINANCE NO. 2932, AN ORDINANCE relating to traffic control;
designating speed limits in alleys; deleting sections of the model
traffic ordinance; and amending Section 9.50.370 and Section
•
9.46.020 of City of Yakima Municipal Code.
19. CONSIDERATION OF AN ORDINANCE AMENDING THE CLASSIFICATION AND
COMPENSATION PAY FOR CITY EMPLOYEES
Council members Berndt and Barnett expressed concern with the pay
range established for the position of the Employment and Training
Specialist. Personnel Officer Weaver responded to these concerns
and explained the range is in line with other Washington cities
which have such a position. The ordinance having been read by
title, it was MOVED by Carmichael, seconded by Buchanan, the
ordinance be adopted. It was MOVED by Foy, seconded by Berndt, to
amend the motion setting the pay range at 17.0 for the position of
the Employment and Training Specialist. Mayor Beauchamp commented
in support of the pay range as presented in the staff report.
Council members Barnett, Berndt and Foy expressed concern with the
salary as presented in the staff report. The question was called
for a vote on the amendment. Carried by 6 -1 voice vote. Beauchamp
voting nay. The question was called for a vote on the motion as
amended. Unanimously carried by roll call vote.
ORDINANCE NO. 2933, AN ORDINANCE relating to City personnel
adopting a classification and compensation plan for City employees
to be effective February 17, 1986; amending Sections 2.20.100 A.,
2.20.100 C., 2.20.110 A., and 2.20.110 F., all of the City of
Yakima Municipal Code.
20. OTHER BUSINESS
City Manager Zais informed Council that based on the memorandum
fran Attorney Dan Fessler, there will be no formal action taken
during the Urban Area Zoning Ordinance hearing on January 16th as
the City and County desire the ordinance be adopted by each agency
on the same day.
Council member Sperling initiated discussion proposing the Civil
Service Commission be removed from the City Charter. Council
member Foy suggested this issue be placed on the ballot with the
Nob Hill Boulevard Improvement Project. City Manager Zais pointed
out to Council this subject has been addressed previously by the •
City Attorney. He indicated this action would have to be supported
by the employees, and the employees would have to be supportive of
the alternative proposed to replace the Civil Service. Following a
brief discussion, City Manager Zais suggested the issue be
addressed at one of the upcaning workshops on city goals and

objectives for the future. He stated staff could provide Council
with a list of alternatives for consideration in the interim.
Council member Carmichael stated there is a vacancy on the
Community Programming Adiisory Committee created by Eric Silvers'
resignation, and recommended Alan B. Taylor be appointed. It was
MOVED by Carmichael, seconded by Buchanan, to appoint Alan B.
Taylor to fill this vacancy. Unanimously carried by voice vote.
There was a brief discussion regarding the meeting with
Congressman Sid Morrison at which time City Manager Zais stated an
agenda would be prepared and provided to Council prior to the
meeting.
II Council member Buchanan stated the National League of Cities
Congressional meeting is coming up and indicated he would be
willing to attend. Following discussion, it was MOVED by Sperling,
seconded by Barnett, to send Council member Buchanan to the
National League of Cities Congressional meeting in Washington D.C.
Unanimously carried by voice vote.
City Attorney Andrews reported to Council that all Council members
with exception of the Mayor, will be paid the same amount ($325)
per month according to the schedule in Ordinance No. 2556 adopted
in 1981.
Mayor Beauchamp informed Council he had received a telephone call
from the manager of Wendy's restaurant informing him of the
rededication ceremonies to be held at the North 1st Street
location. The South 1st Street restaurant has been closed. He
extended an invitation to fellow Council members to attend the
rededication ceremonies on Friday evening.

21. ADJOURNMENT
There being no further business to come before the Council, it was
MOVED by Berndt, seconded by Carmichael, that this meeting be
adjourned at the hour of 4:35 p.m. Unanimously carried by voice
vote.
