ROLL CALL The City Council met in session on this date at 2:00 p.m. in the Council Chambers of City Hall, Yakima, Washington. Mayor Clarence Barnett presiding, Council members Henry Beauchamp, Pat Berndt, Lynn Buchanan, Lynn Carmichael, Jerry Foy, and Jack Sparling present on roll call. City Manager Zais, City Attorney Andrews, City Clerk Roberts and Deputy City Clerk Toney also present. Mayor Barnett announced the meeting of January 7, 1986 will be a business meeting, rather than a study session, for the purpose of administering the oath of office to Council members Beauchamp, Berndt, Foy and Sparling, election of a Mayor, appointments to Boards & Commissions, and Committees of the Council, insurance contract renewal, and an executive session on collective bargaining. Mayor Barnett stated he has received a request from Larr Mathews to address Item #8 on the agenda. 2. The Pledge of Allegiance was led by Mayor Barnett. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Council member Carmichael stated Parks Commission Board member Bob Busse's term is expiring and he has requested to be reappointed to his position. It was MOVED by Carmichael, seconded by Beauchamp, that Bob Busse be reappointed to his current position. Unanimously carried by voice vote. 4. CONSENT AGENDA Mayor Barnett referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus of the Council that Items Nos. 7, 9, 21, and 23, be added to the Consent Agenda, as requested by Council member Foy, and Item No. 29 be removed from the Consent Agenda at the request of Mayor Barnett. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED 'by Carmichael, seconded by Buchanan, that the Consent Agenda, as read, be passed. Unanimously carried by roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF THE COUNCIL MEETINGS OF NOVEMBER 14, 19, 21, AND 26, 1985 The Council minutes of November 14, 19, 21 and 26, 1985 were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION None *7. REPORT FROM DEPARTMENT OF ENGINEERING & UTILITIES REGARDING RESUBMITTAL OF BOND ISSUE FOR IMPROVEMENTS TO NOB HILL BOULEVARD The report from the Director of Engineering & Utilities dated December 13,' 1985, with regard to the Nob Hill Boulevard and other street projects 'bond issue resubmittal, and staff recommendation to call for a Special Election on April 8, 1986, a bond issue proposal of $5,000,000 was accepted and approved. 8. CONSIDERATION OF RESOLUTIONS ACCEPTING ASSIGNMENT OF YAKIMA VALLEY TRANSIT PROPERTY RIGHTS AND EQUIPMENT A. RESOLUTION ACCEPTING THE DONATION Larry Mathews, 805 South 17th Avenue, addressed Council regarding this item. Mr. Mathews read a letter of opposing acceptance of 218 DECEMBER 17, 1985 the donation of property from Yakima Valley Transportation Company, and encouraged Council to reconsider the action to be taken on the matter. The letter was submitted to the City Clerk as Mr. Mathews written testimony. A resolution accepting the donation of property having been read by title, it was MOVED by Carmichael, seconded by Buchanan, that the resolution be adopted. Discussion ensued regarding ramifications of tabling the motion for a 30 day period. City Attorney Andrews pointed out there was nothing to gain by delaying the action for 30 days. The question was called for a vote on the motion. Failed by 4 -3 roll call vote. Barnett, Beauchamp, Foy, and Sparling voting nay. Mayor Barnett stated he had voted against the motion due to concern with possible difficulty in obtaining some of the rights -of -way necessary for successful trolley operations. He stated we do not have an indication whether any organization is willing to undertake and assume the effort and the expense for the contemplated rights -of- way. Mayor_ Barnett stated he is concerned there may be some additional potential liabilities connected with ownership of the li/ system, as well as concern for maintenance and security costs for the building site. He indicated consideration should be given to Mr. Buchanan's statement that part of the consideration in this matter relates to the success and future of the Nob Hill Boulevard Project. The gavel having been relinquished to Assistant Mayor Beauchamp, it was MOVED by Barnett, seconded by Foy, to move for reconsideration of adoption of the resolution. Council member Foy stated he voted no due to concerns with unknown liabilities involved in accepting ownership of the Yakima Valley Transportation Canpany. He stated the Nob Hill Boulevard Project is connected to this transaction, therefore, he will reluctantly vote in favor of accepting the property. The question was called for a vote on the motion for reconsideration. Unanimously carried by voice vote. The resolution having been read by title, it was MOVED by Carmichael, seconded by Berndt, that the resolution be adopted. Carried by 6 -1 roll call vote. Beauchamp voting nay. RESOLUTION NO. D -5192, A RESOLUTION accepting the donation of rights and property from Yakima Valley Transportation Canpany to the City of Yakima. B. RESOLUTION AUTHORIZING EXECUTION OF A LEASE AGREEMENT A resolution authorizing execution of a lease agreement with Yakima Valley Transportation having been read by title, it was MOVED by Berndt, seconded by Carmichael, that the resolution be adopted. Carried by 6 -1 roll call vote. Beauchamp voting nay. RESOLUTION NO. D -5193, A RESOLUTION authorizing the execution of a lease agreement with the Yakima Valley Transportation Canpany. *9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH YAKIMA COUNTY REGARDING DISTRICT COURT SERVICES RESOLUTION NO. D -5194, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an agreement with Yakima County relating to Yakima County District Court costs. *10. CONSIDERATION OF RESOLUTION REGARDING APPLICATION FOR 1986 CITY OF YAKIMA URBAN HOMESTEADING PROGRAM RESOLUTION NO. D -5195, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to file an application with the United States Department of Housing and Urban Development for participation in an Urban Homesteading Program. *11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF YAKIMA- TIETON IRRIGATION DISTRICT EASEMENT AGREEMENT RESOLUTION NO. 5 -5196, A RESOLUTION authorizing the execution of easement deeds and agreements with Yakima - Tieton Irrigation District. *12. CONSIDERATION OF RESOLUTION AUTHORIZING SALE OF SURPLUS CITY PROPERTY DECEMBER 17, 1985 219 RESOLUTION NO. D -5197, A RESOLUTION authorizing the sale of surplus personal property owned by the City. * 13. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF OAK FLATS RESIDENTIAL LEASE AGREEMENT RESOLUTION NO. D -5198, A RESOLUTION authorizing the City Manager to ' execute a lease agreement with Charles Mathew Bagley and Nancy Lynn Frechette - Bagley for the use of certain property at Oak Flats. *14. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF LEASE AGREEMENT WITH YAKIMA SCHOOL DISTRICT NO. 7 FOR CABLE COMMUNICATIONS OFFICE AT THE SKILLS CENTER RESOLUTION NO. D -5199, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a lease agreement with the Yakima School District No. 7. *15. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF A SUPPLEMENTAL AGREEMENT WITH WASHINGTON STATE DEPARTMENT OF TRANSPORTATION FOR CONSTRUCTION FUNDS FOR THE REHABILITATION OF NOB HILL BOULEVARD OVERPASS RESOLUTION NO. D -5200, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute a supplemental agreement with the State of Washington, Department of Transportation, for partial reimbursement of costs for the rehabilitation of Nob Hill Boulevard Overpass. *16. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF SUPPLEMENTAL AGREEMENTS WITH WASHINGTON' STATE DEPARTMENT OF TRANSPORTATION FOR CONSTRUCTION FUNDS FOR THE 48TH AVENUE /TIETON DRIVE INTERSECTION IMPROVEMENTS RESOLUTION NO.-D -5201, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute Supplements No. 1 & 2 with the State of Washington, Department of Transportation, for partial reimbursement of costs for improving the intersection of 48th Avenue and Tieton Drive. *17. APPROVAL OF FINAL CONTRACT PAYMENTS • A. 72ND AVENUE SEWER AND 80TH AVENUE TRUNK SEWER The report from the City Engineer dated December 17, 1985, with respect to the canpletion of the work on 72nd Avenue Sewer and 80th Avenue Trunk Sewer Project, performed by Friend & Rikalo, Inc., was approved, the work accepted and payment of the final estimates as therein set forth was authorized. • B. GENERAL IRRIGATION SYSTEM DIVERSION DAM • • The report from the City Engineer dated ..December 17, 1985, with respect to the canpletion of the work on the General Irrigation System Diversion Dam Project, performed by Ranger Construction Co., was approved, the work accepted and payment of the final estimates as therein set forth was authorized. C. 81ST AVENUE SEWER L.I.D. NO. 1038 • The report from the City Engineer dated December 17, 1985, with respect to the canpletion of the work on 81st Avenue Sewer L.I.D. Project, performed by Central Concrete & Utilities, was approved, the work accepted and payment of the final estimates as therein set forth was authorized. D. FRUITVALE CANAL COVERS The report from the City Engineer dated December 17, 1985, with respect. to the completion of the work on the Fruitvale Canal Covers Project, performed by Western Contstruction, was approved, the work accepted and payment of the final estimates as therein set forth . was authorized. • 220 DECEMBER 17, 1985 E. OFFICE AND SHOP AT TAHOMA CEMETERY The report from the City Engineer dated December 17, 1985, with respect to the completion of the work on the Office and Shop /Tahama Cemetery Project, performed by Kranz - McDonald Construction, was approved, the work accepted and payment of the final estimates as therein set was authorized. *18. APPROVAL OF FINANCE REPORTS: A. NOVEMBER 1985 TREASURY REPORT The report from the Director of Finance and Budget dated December 17, 1985, regarding the investments of the City of Yakima, was accepted and approved. B. NOVEMBER 1985 BUDGET REPORT The report from the Director of Finance and Budget regarding the November, 1985 general government budget status, was accepted for filing. *19. SET DATE OF HEARING FOR JANUARY 14, 1986 FOR REZONE OF YAKIMA AIR TERMINAL AS INITIATED BY THE PLANNING COMMISSION January 14, 1986 was set as the date of hearing on a rezone of the Yakima Air Terminal, as initiated by the Planning Commission. *20. SET DATE OF HEARING FOR JANUARY 28, 1986 ON THE FINAL ASSESSMENT ROLL FOR °L.I.D.' NO. 1038, 81ST AVENUE SEWER DISTRICT January 28, 1986 was set as the date of hearing on the final assessment roll for L.I.D. No. 1038, 81st Avenue Sewer District. * 21. CONSIDERATION OF ORDINANCE ENACTING A LOCAL .25% REAL ESTATE TRANSFER TAX ORDINANCE NO. 2921, AN ORDINANCE relating to funds and accounts; imposing an excise tax on the sale of real estate; providing for the collection and distribution thereof; limiting the use of proceeds therefrom; fixing a penalty for late payment; enacting Chapter 3.79, "Real Estate Excise Tax ", as a new Chapter of the City of Yakima Municipal Code; and declaring an emergency. 22. CONSIDERATION OF AN ORDINANCE AMENDING THE WATER AND REFUSE SERVICE RATES Larry Mathews, 805 South 17th Avenue, asked if he could obtain the true cost of water supplied to the larger users. He questioned if Yakima users are. subsidizing the commercial and industrial users. Mayor Barnett referred him to staff to obtain this information. An ordinance amending the Water and Refuse service rates having been read by - title, it was MOVED by Beauchamp, seconded by Berndt, that the ordinance be adopted. Unanimously carried by roll call vote: ORDINANCE NO. 2922, An Ordinance relating to public services, utilities and garbage collection; establishing rates for service charges; adopting rules and regulations; and amending Sections 7.68.251, 7.68.252 and 7.68.282, and Subsections 7.68.250A, 7.68.255A and 4.16.140C, all of the City of Yakima Municipal Code. * 23. CONSIDERATION OF AN ORDINANCE AMENDING THE COMPENSATION PLAN FOR • AFSCME, POLICE, AND MANAGMENT EMPLOYEES FOR 1986 ORDINANCE NO. 2923, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective January 1, 1986; amending Section 2.20.110 of the City of Yakima Municipal Code, and declaring an emergency: The .salary of the City Manager was set at Step E of the compensation plan pay range. 24. CONSIDERATION OF ORDINANCE ADOPTING THE 1986 BUDGET • The ordinance prepared for adoption of the 1986 Budget was circulated and City Manager Zais made a few brief comments DECEMBER 17, 1985 221 regarding the budget. The ordinance having been read by title, it was MOVED by Buchanan, seconded by Berndt, that the ordinance be adopted. Unanimously carried by roll call vote. ORDINANCE NO. 2924, An Ordinance adopting a budget for the City of Yakima, Washington, for the year 1986; and appropriating funds for estimated expenditures. *25. CONSIDERATION OF ORDINANCE AMENDING THE MOBILE HOME INSTALLATION REGULATIONS REQUIREMENTS ORDINANCE NO. 2925, AN ORDINANCE relating to buildings; regulating . anchoring systems for mobile homes; amending Section 11.06.100 of the Yakima Municipal Code. *26. CONSIDERATION OF AN ORDINANCE INCREASING THE REGULATORY LICENSE FEE ORDINANCE NO. 2926, AN ORDINANCE relating to licenses and business regulations; fixing license fees; amending Sections and Subsections 5.11.030, 5.11.040 (B), 5.11.050(B), 5.12.020, 5.18.020, 5.28.070, . 5.30.020(A), 5.42.020, 5.46.030(A), 5.48.040, 5.48.080. 5.54.020, 5.62.030, 5.64.030, and 11.08.110 of the City of Yakima Municipal Code. *27. CONSIDERATION OF AN ORDINANCE MODIFYING THE FIRE HYDRANT REQUIREMENTS ORDINANCE NO. 2927, AN, ORDINANCE relating to fire and fire hydrants, setting standards for looping of water mains under certain circumstances and amending Section 10.10.080 of the City of Yakima Municipal Code. *28. CONSIDERATION OF AN ORDINANCE PROHIBITING PARKING ON A PORTION OF WALNUT STREET (6TH STREET TO NACRES AVENUE) ORDINANCE NO. 2928, AN ORDINANCE relating to traffic control; prohibiting parking on certain streets; and amending Section 9.50.050 of the City of Yakima Municipal Code. 29. CONSIDERATION OF AN ORDINANCE REZONING PROPERTY AT 17TH AVENUE AND STEWART, AS INITIATED BY THE PLANNING COMMISSION Mayor. Barnett stated this item was.taken off the Consent Agenda so he could abstain from voting on the ordinance because he was not present at the hearing. An ordinance rezoning property at 17th Avenue and Stewart having been read by title, it was MOVED by Beauchamp, seconded by Berndt, that the ordinance be adopted. Unanimously carried by roll call vote. Barnett abstaining. ORDINANCE NO. 2929, AN ORDINANCE accepting the recommendation of . the Planning Commission and rezoning property at South 17th Avenue 'and Street from Planned Development Zone to R -2, No- Family Zone. *30. CONSIDERATION OF AN ORDINANCE AMENDING_ THE 1985 BUDGET AND ••• APPROPRIATING FUNDS FOR TOURIST PROMOTION - An Ordinance appropriating funds for tourist promotion having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 2930, AN ORDINANCE amending the 1985 budget for the City of Yakima; and making an appropriation in the 170 - Tourist Promotion Fund for expenditure during 1985. *31. CONSIDERTION OF AN • ORDINANCE MAKING FINAL 1985 BUDGET APPROPRIATIONS An ordinance amending the 1985 budget and funds to the Unemployment Compensation Reserve Fund and the Employee's Health Benefit Reserve Fund, having been read by title only at this meeting, was laid on the table for four weeks, or until January 14, 1986. 222 DECEMBER 17, 1985 32. OTHER BUSINESS City Manager Zais shared information regarding the City and Federal Budget in the year 1886 versus 1986. The projected expenditures for 1886 was $1474, with projected revenues of $775; a percentage difference of 3,120,400% from the 1886 budget to the 1986 budget. The Federal budget for 1886 was $242,483,000 versus today's budget of $973.7 billion dollars, a percentage change of 401,553,800%.
