ROLL CALL The City Council met in session on this date at 2:00 p.m. in the Council Chambers of City Hall, Yakima, Washington. Mayor Clarence Barnett presiding, Council members Lynn Buchanan, 'Lynn Carmichael, Jerry Foy and Jack Sparling present on roll call. Council members Henry Beauchamp and Pat Berndt absent and excused. City Manager Zais, City Attorney Andrews, City Clerk Roberts and Deputy City Clerk Toney also present. ' 2. INVOCATION The Pledge of Allegiance was:led by Mayor Barnett. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER None. • 4. CONSENT AGENDA Mayor Barnett referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus of the Council that the addition of Items Nos. 9 and 10, as requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Carmichael, seconded by Sparling, that the Consent Agenda, as read, be passed. Unanimously carried by roll call vote. Beauchamp and Berndt absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES The Council minutes of July 30, August 5, 13, & 20, 1985 were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION Don Emerick, 4710 Richey Road, representative of Conover Insurance Company, appeared before Council requesting the opportunity to submit insurance coverage proposals for :consideration. He indicated Conover . has provided insurance coverage to the City in the past, and would like the opportunity to do so again. Mr. Emerick\ stated he is aware that Fred S. James (the City's current provider) is submitting optional proposals to Council at this time.' 7. REPORT FROM DEPARTMENT OF COMMUNITY & ECONOMIC DEVELOPMENT REGARDING THE PROPOSED HEARINGS EXAMINER, ORDINANCE AND INTERLOCAL AGREEMENT Associate Planner, Don Skone, reviewed the report containing the recommended text changes by staff. Council member Foy referred to section 2.23.060 and suggested the word "establish" be changed to "implement" to comply with: the R.C.W. Mayor Barnett stated he disagrees with only one extension being allowed per project. He stated there may be sane cases where extenuating circumstances are involved which may necessitate more than one extension. He stated he would like • to see the language changed to allow for more than one extension if the ,administrative official or the hearings examiner determines there are extenuating circumstances which warrant such an extension. Council members Carmichael, Foy and Sparling were in agreement. It was MOVED by Foy, seconded by Carmichael, to forward the Hearings Examiner Ordinance and the Interlocal Agreement, as amended, to the County Commissioners for their review and consideration. Larry Mathews, 805 S. 17th Avenue, referred to Sections 2.23.140, 2.23.080 and 2.23.100 of the ordinance and requested the word "directly" be removed from the fourth line of page 7 of the report. Discussion ensued regarding whether or not this would change the legal meaning of the text. City Attorney Andrews stated he would like the opportunity to study the R.C.W. prior to making a decision on the matter. This was the general � l 146 SEPTEMBER 17, 1985 consensus of the Council. The question was called for a vote on the motion. Unanimously carried by voice vote. Beauchamp and Berndt absent. 8. CONSIDERATION OF RESOLUTIONS REGARDING HAZARDOUS VEGETATION AND DEBRIS ABATEMENT PROGRAM Mayor Barnett asked if there was anyone present wishing to contest the citation issued by the City Code Administration Department. There being none, and Resolution No. D -5164 having been read by title, it was ,MOVED by Carmichael, seconded by Buchanan, that the resolution be adopted. Unanimously carried by roll call vote. Beauchamp and Berndt absent. RESOLUTION NO. D -5164, A RESOLUTION authorizing the Code Administration Manager to clear certain weedy lots. *9. REPORT FROM TRAFFIC ENGINEERING DIVISION REGARDING PROPOSED PARKING PROHIBITION ON FIRST STREET AND 16TH AVENUE The staff report from the Traffic Engineer dated September 17, 1985, and recommendation that the appropriate legislation be prepared regarding proposed parking prohibition on First Street and 16th Avenue, was approved. *10. CONSIDERATION OF A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT FOR PUBLIC DEFENDER SERVICES FOR 1986. RESOLUTION NO. D -5165, A RESOLUTION appointing Glen P.`Warren as City of Yakima public defender for calendar year 1986. *11. CONSIDERATION OF RESOLUTIONS AUTHORIZING THE EXECUTION OF AGREEMENTS FOR ELDERLY AND HANDICAPPED TRANSIT SERVICES RESOLUTION NO. D -5166, A RESOLUTION authorizing the execution of a transportation services agreement with Diamond Transportation Services, Inc. RESOLUTION. NO. D -5167, A RESOLUTION authorizing the execution of a transportation services agreement with for People. *12. CONSIDERATION OF AN ORDINANCE AMENDING THE 1985 BUDGET AND APPROPRIATING FUNDS FOR COMPREHENSIVE SEWER PLAN STUDY (SECOND READING) An ordinance amending the 1985 budget and appropriating funds in the 476 -Sewer Construction Fund having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 2895, AN ORDINANCE amending the 1985 budget for the City of Yakima; and making an appropriation in the 476 -Sewer Construction Fund for expenditure during 1985. *13. CONSIDERATION OF AN ORDINANCE ACCEPTING THE PLANNING COMMISSION'S RECOMMENDATION AND REZONING PROPERTY AT 501 NORTH 2ND STREET, AS REQUESTED BY BILL HUIBREGTSE ORDINANCE NO. 2896, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at 501 North 2nd Street, from R -3, Multiple - Family Zone to B-1 Modified Business Zone. *14. CONSIDERTION OF AN ORDINANCE ACCEPTING THE PLANNING COMMISISON'S RECOMMENDATION AND APPROVING A MAJOR MODIFICATION TO A PLANNED DEVELOPMENT LOCATED AT 1601 SUMMITVIEW, AS REQUESTED BY FIDDLESTICKS ORDINANCE NO. 2897, AN ORDINANCE granting a major modifiction to a Planned Development Zone applicable to property at 208 North 16th Avenue. • SEPTEMBER 17, 1985 147 *15. ' RECONSIDERATION OF ORDINANCE ADOPTING THE 1985 CODES: (FROM 8/28/85 AGENDA) *A.' UNIFORM CODES NOT SUBJECT 10 FEE CHANGE AT THIS TIME: UNIFORM FIRE CODE ORDINANCE NO. 2898, AN ORDINANCE relating to fire codes; adopting by reference the Uniform Fire Code, 1985 Edition, copyright 1985 by the International Conference of Building Officials and the Western Fire Chiefs' Association, and making deletions therefrom and amendments thereto; amending Sections 10.05.010, 10.05.020, and 10.05.025, all of the City 'of Yakima Municipal Code. UNIFORM MECHANICAL CODE ORDINANCE NO. 2899, AN ORDINANCE relating to building regulations; adopting by reference the Uniform Mechanical Code, 1985 Edition, by the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials, together with "Appendix A ", Uniform Mechanical Code Standards, and "Appendix B ", Steam and Hot Water Boilers, Steam and-Hot Water Piping (hydronics), "Appendix C ",'Fixing of Ventilating Systems serving appliances equipped with and appliances listed for use Type B vents; and amending Sections 11.32.010, 11.32.015, 11.32.060, 11.32.070, 11.32.075 and 11.32.100, all of the City of Yakima Muncipal Code. UNIFORM SIGN CODE ORDINANCE' NO. 2901, AN ORDINANCE relating to building regulations; adopting by reference, and amending certain sections of the Uniform Sigii Code, 1985 Edition, copyright 1985 by the International Conference of Building Officials; amending Sections 11.08.010, 11.08.020, 11.08.025, 11.08.027 and 11.08.029, all of the City of Yakima Municipal Code. ' ' UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS' BUILDINGS ORDINANCE NO. 2902, AN ORDINANCE relating to buildings; adopting by reference the Uniform Code for the Abatement of Dangerous' Buildings, 1985 Edition, published by the International Conference of Building Officials, and making amendments thereto; defining terms; providing for the repair or demolition of dangerous buildings; establishing procedures for 'recovering the cost of such repair or demolition; amendengs Sections 11.46.010, 11.46.030, and 11.46.040, all of the City of Yakima Municipal Code. B. UNIFORM BUILDING CODE (INCLUDES FEE CHANGE AS PROPOSED BY COUNCIL) Bob Shampine, Code Administration Manager, reviewed the recommendations contained in the report and stated staff is recommending adoption of Alternative No. 3 (Attachement C). Attachments B and C include different fee schedule options submitted in the staff report. It was Council's decision not to adopt this ordinance (Attachment B). C. UNIFORM BUILDING CODE (INCLUDES OPTIONAL FEE CHANGE AS PROPOSED BY STAFF) Ordinance No. 2903 having been read by title, it was MOVED by Carmichael, seconded by Foy, to accept staff's recommendation and adopt Alternative No. 3 (Attachement C). Unanimously carried by roll call vote. Beauchamp and Berndt absent. ORDINANCE NO. 2903, AN ORDINANCE relating to building regulations; adopting by reference the Uniform Building Code, 1985 Edition, copyright 1985 by the International Conference of Building Officials, regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, 148 SEPTEMBER 17, 1985 height, area and maintenance of buildings or structures in the City of Yakima; and amending Sections 11.04.010, 11.04.015, 11.04.020, 11.04.025, 11.04.027, 11.04.055 and 11.04.070, and enacting Section 11.04.028 as a new sections, all of the City of Yakima Municipal Code. 16. OTHER BUSINESS Glenn Rice, Director of Community & Economic Development, indicated there are two vacancies currently existing on the Citizen's Advisory Committee due to the resignation of Bob Sinclair and Marsha Williams. He stated there is an urgency to fill these positions. Council member Carmichael interjected that Council has not had an opportunity to properly reveiw the applications submitted; however, she did notice that one applicant lives outside the city limits, and that factor disqualifies the applicant from serving on the committee. She stated she is not ready at this time to make any appointments and requested the opportunity to review the applications on file. It was the general consensus of the Council that no appointments be made at this time. City Manager Zais and City Attorney Andrews informed Council members that a new ambulance service has applied for a license to operate within the city limits. The Care Ambulance Service has requested to be placed on a rotating call basis with Yakima. Medic I. Mr. Zais indicated the request has been pending several weeks while a routine background investigation.is being conducted. He stated the canpany has met all state regulations and requirements. He further stated the City of Yakima has no method of controlling or regulating ambulance service within the city limits. Mr. Zais stated he and City Attorney Andrews have been meeting with members of the medical profession regarding this issue, however, the plan at this time is to proceed with Care Ambulance's request to be placed on a rotation call basis. EXECUTIVE SESSION REGARDING PROSPECTIVE LITIGATION It was MOVED by Buchanan, seconded by Carmichael, to move into executive session for the purpose of discussing prospective litigation, and then to adjourn to the meeting on Thursday, September 19th, at 2:00 p.m. for the purpose of a joint public hearing with the Yakima County Commissioners on the Yakima Urban Area Zoning Ordinance. Unanimously carried by voice vote. Beauchamp and Bernt absent. • 18.
