HomeMy WebLinkAbout08/20/1985 Adjourned Meeting 132 AUGUST 20, 1985 URBAN AREA ZONING ORDINANCE - CONTINUED PUBLIC HEARING The City Council met in session on this date at 11:00 a.m. in the Council Chambers of'City Hall, Yakima, Washington in a joint public hearing with the Yakima County Commissioners to review the proposed joint Yakima Urban Area Zoning Ordinance. County Commissioners present were Chuck Klarich, Graham Tollefson and Jim Whiteside. County staff present were Dick Anderwald, Director of Planning and Mark Hinthorne, Assistant Director of Planning. City Council members present were Mayor Clarence Barnett, Pat Berndt, Lynn Carmichael, Jerry Foy and Jack Sparling. Council member Lynn Buchanan present after 11:15 a.m. Council member Henry Beauchamp absent. City staff members present were Glenn Rice, Director of ._ Community and Economic Development, City 'Attorney Fred_ Andrews, Associate Planner Judd Black and Department Assistant II Marta Leon. City Manager Dick Zais present after 11:40 a.m. The meeting was called to order by Mayor Barnett. Commissioner Tollefson introduced the County Commissioners and County Staff. Mayor Barnett introduced the Council members and City staff members. Mayor Barnett stated the purpose for this hearing is to consider adoption of a common zoning ordinance for the Yakima Urban Area Plan and reviewed the hearing procedure. Mr. Black read the following correspondence into the record: 1) letter to Yakima City Council dated August 6, 1985, from Larry Mathews regarding planned residential development, 2) letter to Glenn Rice date July 31, 1985, from J.S. Applegate of Halverson & Applegate, P.S. regarding home occupation in R -1 Zone at 602 South 32nd'Avenue, (Council member Buchanan present after 11:15 a.m.) 3)letter addressed to Judd Black dated August 14, 1985, from Ron Clarke, Planning Consultant from the Washington Manufactured Housing Association regarding the proposed citing standards for manufactured hones and 4) letter to City Council and County Commissioners from Kurbitz Investments, Inc. dated August 15, 1985, regarding the property at the northeast corner of 40th & Summitview Avenues. It was MOVED by Foy, seconded by Carmichael to correct the CC- 44 request from B-1 back to SCC as the applicant had no' legal right to ask for it.'Unanimously carried by voice vote. Beauchamp absent. Mr. Hinthorne reviewed Report No. 33C regarding the proposed amendments to Chapter 8 - Signs. He stated he contacted a few Washington communities and questioned how they dealt with portable signs, specifically any set time limitations on their use. Council member Sperling 'commented that most sale events occur over a 30 -day period. He would, therefore, like to see the maximum number of days a temporary sign can be displayed changed from 21 to 30 days at any one time and the maximum number of days a temporary sign shall be displayed during the calendar year changed from 84 to 90 days. After a brief discussion regarding permit fees and enforcement, it was MOVED by Foy, seconded by Klarich to amend Report No 33C, namely Chapter 8.110a to read 30 and 90 days, respectively. Unanimously carried by voice vote. Referring to Change No. 5 of the report, Commissioner Klarich questioned what constitutes "attached to the ground" in the first sentence. Mr. Hinthorne explained if it is placed on top of the ground, then it is considered to be a portable sign; if it is placed into the ground so it cannot be moved, then it is considered a free - standing sign. It was MOVED by Foy, seconded by Klarich to concur with the changes in Report No. 33C. Discussion followed with Commissioner Tollefson expressing his concern with the definition and prohibition of portable signs. After discussion, it was MOVED by. Klarich, seconded by'Foy to adopt this report for its inclusion in the Urban Area Zoning Ordinance. Unanimously carried by voice vote. Mayor Barnett questioned if there is any public testimony on this matter. There being none, the meeting continued on to Report No. 35. (City Manager Zais present after 11:40 a.m.) Mayor Barnett questioned if anyone present wished to give testimony on Report No. 35. Bill Hambelton, 615 South 32nd Avenue, referred to Chapter 4.060 - Home Occupations, requesting clarification of the language used in the sentence, "automated or production line equipment ". Mayor Barnett responded that automated refers to a type of machine that AUGUST 20, 1985 133 URBAN AREA ZONING ORDINANCE - CONTINUED PUBLIC HEARING relates to production. Clarifying this further, Mr. Hinthorne stated that currently home occupations do not allow stock and trade on the premise. He noted that new verbage was added under Necessary Conditions to accommodate those home occupations where products are produced for sale by hand, while prohibiting production line types of businesses in the residential districts. After discussion_. of the definition of "automated and production line equipment" and. the, wording in Chapter 3.030.1 - Suburban Residential District, Mayor Barnett questioned if there was any further public testimony. There being none, it was MOVED by Foy, seconded, by Klarich for- tentative adoption of Report No. 35. Mayor Barnett asked staff to modify the sentence which is to be added under Necessary Conditions. Council member Sparling referred to Chapter 19.080 and asked for clarification of the verbage "75% of its adjusted assessed value ". Mr. Hinthorne responded that the County Assessor's Office currently has a book which is used to adjust property taxes according to the inflation rate. Council member Carmichael called for a question on Council member Foy's motion. Unanimously carried by voice vote. Regarding Report No. 36, Council member Sparling questioned why swine is excluded in the definition of domestic farm animal as listed in Chapter 2.020.60. Mr. Hinthorne responded when this issue was first discussed at the Regional Planning Commission, it was the general consensus that most people object to living next door to swine. After a brief discussion, it was MOVED by Sparling, seconded by Klarich to delete the words "but excludes" in the sentence. of 2.020.60. Unanimously carried by voice vote.- Council member Carmichael moved for adoption of Report No. 36. Mayor Barnett interjected, questioning if there, is any public testimony on this report. Blaine Fielding, Assistant Pastor of Yakima Foursquare Church, presented written testimony dated August 20, 1985, which was read by Mr. Black, regarding the definition of church in Chapter 2.020.31 of the report..It was MOVED by Tollefson, seconded by Klarich to re- insert the word "primarily" in the definition of church. Mayor Barnett called for a consensus on the motion. After a short discussion, it was MOVED by Foy, seconded by Berndt to adopt Report No. 36 with the amendment of the re- insertion of the word primarily. Unanimously carried by voice vote. Mayor Barnett then opened the hearing for general testimony. There being none, it was MOVED by Whiteside, seconded by Klarich to adjourn the meeting at 12:10 p.m. to then meet on September 19th at 2:00 p.m. Tollefson concurred and the Motion carried. It was MOVED by Carmichael, seconded by Berndt .to adjourn the meeting at 12:10 p.m. to then meet on September,19th -at 2:00 -p.m.. Unanimously carried by voice vote.
