STUDY SESSION
1. ROLL CALL
The City Council met in session on this date at 2:00 .p.m. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Clarence
Barnett presiding, Council members Henry Beauchamp, Pat Berndt, Lynn
Buchanan, and Jack Sparling present on roll call. Council members
Lynn Carmichael and Jerry Foy absent and excused. City Manager Zais,
City Attorney'Andrews and Deputy City Clerk Toney also present.

3. REPORT FROM CITY MANAGEMENT REGARDING PROPOSED FINANCING OPTIONS FOR
NOB HILL BOULEVARD STREET IMPROVEMENT PROJECT' */
City Manager Zais gave a historical synopsis of the Nob Hill Boulevard
Project and then'requested Dennis Covell, Director of Engineering.and
Utilities, to review the staff report and recommendations. Following
discussion of'the information contained in'the report to Council, Mr. •
Covell stated staff is recoiiuuending approval of Alternative #3. This
alternative provides for funding of the Nob Hill Boulevard project,
together with several projects from the Transportation Improvement
Program to be funded with $900,000 of Urban Arterial Board funds,
$500,000 2¢ gas tax and all other State and Federal funds, plus a
"$500,000 bond issue. Discussion ensued regarding which'of the alterna-
tives would be niost advantageous for the City.' It was MOVED by
Buchanan; seconded by Berndt, that this item be brought before
Council "during next week's Business Meeting for'Council action to be
taken. Unanimously carried by voice vote. Carmichael and Foy absent.
4. REPORT FROM PERSONNEL DIVISION REGARDING THE FAIR LABOR' STANDARDS ACT
Personnel Officer Weaver reviewed the information contained in the
Council packet regarding the U.S. Supreme Court's decision made in
connection with the Garcia case. He elaborated on possible ramifica-
tions stemming from that decision. Mr. Weaver explained that in the
past when an employee has worked in excess of a 40 hour work week,
he /she has been given the option of receiving overtime pay at
time - and -a -half (1.5) or earning. compensatory time at time- and -a -half.
He stated overtime pay has always been computed at 1.5 times the
hourly rate of pay. The Garcia Decision includes "fringe benefits" as
part of the employees regular rate of pay upon which overtime pay is
based. Therefore, any hours worked beyond the regular 40 hour work
• week is _computed at 1.5 based on the "regular rate of pay ", which
includes fringe benefits. He stated the National Institute of Munici-
pal Law Officers (NIMLO) is preparing to challenge the decision on
the basis of constitutionality and is soliciting donations for this
purpose. He indicated the contribution for a city the size of Yakima
would be $1,000 and Council may wish to consider making such a
contribution to this effort. It was the general consensus of the
Council that the $1,000 donation be discussed at a future Council
meeting.
5. REPORT FROM LEGAL DEPARTMENT REGARDING CODE ENFORCEMENT AT 311 SOUTH
8TH STREET
City Attorney Andrews g ave an oral report regarding this particular
situation. Mr. Andrews indicated that on August 5th he met with Maud
Scott and her husband, Chief Pleas Green, Officer Don Loveland, and
Prosecuting Attorney Bob Bounds for the purpose of launching a
cooperative effort to resolve the complaint made by Ms. Scott concern-
ing the storing of vehicle hulks and the type of fence which has been
erected at 311 South 8th Street. He explained the direction given to
Ms. Scott in the gathering of evidence to present to the court system
in an attempt to file a citizen's complaint. City Attorney Andrews
reported on the followup action by the Police Department and the Code
Administration Division concerning the fence and vehicle hulks being
kept at 311 South 8th Street. He stated he has been informed by Ms.
Scott that the fence structure has changed and the vehicle hulks have
been covered over again with canvass, however, they are still visible
from her property and the property of her neighbors. After the

information is gathered by Ms. Scott, the .Police Department and the
Legal Department will then be presented to the court for action and
possible resolution. He stated he would report back to Council after
the attempt to take the 'case before the court system. City Attorney
Andrews also informed Council that it is now possible under the state
law to amend the city ordinance to require that vehicle hulks be
contained in a building, and delete the provision which states sight
screening is adequate. He indicated this information is presented for
Council's consideration and possible future direction to staff to
bring'back the appropriate legislation amending the city 'ordinance.
Discussion'ensued regarding the definition and composition of fencing.
It was the general consensus of the Council to direct staff to bring
back the proper legislation to amend the city ordinance which would
require vehicle hulks to be contained in a building rather than by
sight screening measures.
6. OTHER BUSINESS
Deputy City- Clerk Toney indicated due an oversight in publishing the
date of hearing for the Transit Division's Public Hearing regarding
proposed reductions in services for the Dial -A -Ride program, it will
be necessary to reset the date of the public hearing for September
10, 1985 in order to comply with federal_ regulations. It was MOVED by
Beauchamp, seconded by Berndt, to reset the date of the public
hearing concerning the Dial -A -Ride program for September 10, 1985.
Unanimously carried by voice vote. Carmichael and Foy absent.
A. EXECUTIVE SESSION
There being no further business to come before the Council, it was
MOVED by Buchanan, seconded by' Beauchamp:,` to move into Executive
Session for the purpose of discussing collective bargaining. Unanimous-
ly carried by voice vote. Carmichael and Foy absent.
