Mr. Weaver explained that in the past when an employee has worked in excess of a 40 hour work week, he /she has been given the option of receiving overtime pay at time - and -a -half (1.5) or earning. compensatory time at time- and -a -half. He stated overtime pay has always been computed at 1.5 times the hourly rate of pay. The Garcia Decision includes "fringe benefits" as part of the employees regular rate of pay upon which overtime pay is based. Therefore, any hours worked beyond the regular 40 hour work • week is _computed at 1.5 based on the "regular rate of pay ", which includes fringe benefits. He stated the National Institute of Munici- pal Law Officers (NIMLO) is preparing to challenge the decision on the basis of constitutionality and is soliciting donations for this purpose. He indicated the contribution for a city the size of Yakima would be $1,000 and Council may wish to consider making such a contribution to this effort. It was the general consensus of the Council that the $1,000 donation be discussed at a future Council meeting. 5.
