HomeMy WebLinkAbout08/05/1985 Adjourned Meeting 1123 AUGUST 5, 1985 URBAN AREA ZONING ORDINANCE - CONTINUED MEETING • The City Council met in session on this date at 2:00 p.m. in the Council Chambers of City Hall, Yakima, Washington in a joint public hearing with the Yakima County Commissioners to review the proposed joint Yakima Urban Area Zoning Ordinance. County Commissioners present were Chuck Klarich, Graham Tollefson, and Jim Whiteside. County staff present was Mark Hinthorne, Assistant Director of Planning. City Council members present were Mayor Clarence Barnett, Pat Berndt, Lynn Carmichael and Jerry Foy. Council member Jack Sparling present after 2:10 p.m., Council member Henry Beauchamp present after 2:20 p.m. and Council member Lynn Buchanan present after 3:05 p.m. City staff members present were City Manager Dick Zais, City Attorney Fred Andrews, Glenn•Rice, Director of Community & Econanic Development, Associate Planners Don Skone and Judd Black and Department Assistant II Marta Leon. • The meeting was called to order by Canmissioner Zbllefson, who then introduced the County Commissioners and County staff. Mayor Barnett introduced the Council members and City staff members. Commissioner Tollefson stated the purpose for this. hearing is to consider adoption of a common zoning ordinance for the Yakima Urban Area and he reviewed the hearing procedure and agenda.. Mr. Skone read - the' following correspondence into the record: 1) letter to -Mark Hinthorne dated July 18, 1985 (Exhibit #99) from Darryl Paulsen, President of ,Business Advertising Council of Washington, regarding the proposed amendments to Chapter 8, 2) memorandum from Roy and Constance Little dated July 18, 1985 regarding the siting of mobile hones within the city limits of Yakima (written testimony), 3) letter from Larry Mathews dated August 5, 1985 and 4) letter dated July 17,, 1985 from Jim Siegel, 1607 W. Lincoln,. regarding Table 4 -1 of the proposed Yakima Urban Area Zoning Ordinance. - .(Council member Sparling present after 2:10 p.m.) Commissioner Tollefson noted for the record, Mr. Larry Mathews will give testimony today relating to his August,5, 1985 letter which was submitted prior to this meeting. Mr. Hinthorne reviewed Report No. .33B regarding. proposed amendments to Chapter 8 - Signs. He noted that -one change was discussed but not made in the draft .report, because of the uncertainty of the consensus of both the Council and Commissioners. That change was whether or not flashing and revolving signs should be listed as prohibited signs. Commissioner Tollefson opened the hearing for public testimony on this report. Darryl Paulsen, employee of Heath Northwest Sign Company, stated the last time he met with the-Planning Division, they identified the obvious problems of portable signs being size, height, placement and their cluttered appearance. He informed the Council and Commissioners- that portable signs are usually not UL approved, the electrical connection is not always done properly, and at times , pose a traffic hazard. (Beauchamp present after 2:20 p.m.) Discussion ensued with Bob Shampine, Code Administration Manager, . stating that controlling the placement of signs would be a difficult task because of staff shortage.. Council member Carmichael .stated that although portable signs are first erected temporarily, they, in fact, became permanent after a length of time. She stated the city cannot regulate these signs.. if there•is no assurance the business industry will .cooperate with the regulations proposed. After differentiating. the. needs for portable and temporary signs and discussion. of whether or not .a permit is required, it was MOVED•by Klarich, .seconded by Whiteside that in Chapter 8.050C the verbage "whose purpose is to . circumvent the code " be added to.. the first sentence..- Tollefson concurred and the motion- carried : -It was MOVED by Beauchamp, seconded by Carmichael that the verbage, "whose purpose is to circumvent the code" be added to the first sentence of Chapter 8.050C. . Unanimously carried -by voice vote. Buchanan absent. Commissioner Klarich questioned if a determination had been made on whether a, sign could be placed on the walls of apartment buildings. AUGUST 5, 1985 124 Mr. Hinthorne responded that Table 8 -1 refers to this matter. It was MOVED by Whiteside to add portable signs under the temporary signs category. Commissioner Tollefson suggested that the word "temporary" proceed portable signs under the heading for Section 8.110. (Buchanan present after 3:05 p.m.) Commissioner Klarich seconded the motion made by Whiteside earlier in the discussion. Tollefson concurred and the Motion carried. It was MOVED by Sparling, seconded by Berndt that portable signs be added under the temporary signs category. Unanimously carried by voice vote. It was MOVED by Klarich, seconded by Whiteside to remove the flashing and moving signs from Chapter 8.050 - Prohibited Signs, provided the signs meet certain' codes. Tollefson concurred and the Motion carried. Mr. Hinthorne reviewed Report No. 23 regarding the proposed text amendment to Table 4 -1; table of permitted land uses. He stated the specific issue to be addressed today with regard to this report is whether or not grocery stores and gas stations that are open from • 10:00 p.m. to 6:00 a.m. should go to a higher level of review for land use as opposed to the businesses that are not open for business during these same hours. Council member Carmichael commented she does not see any conflict with this issue because convenience stores sometimes use an equal amount of lighting due to 24 hour operation and the larger grocery stores having the lights on only inside the store from 10:00 p.m. to 6:00 a.m. Commissioner 7bllefson questioned if there is any public testimony on this matter. Frank Glaspey, 1200 W. Ahtanum, requested clarification on the criteria used for review on convenience stores. In reference to the table on page 9 of the report, Mr. Skone stated that small convenience stores that are open for 24 hours are a Class 1 use in the LCC, CBD; and CBDS districts, a Class 2 use in the SCC district, and a Class 3 use in the B -2 zone. In the B -2 and SCC districts, the arterial businesses tend to be back- to-back with the residential areas, which is `why there is a higher level of review. Mayor Barnett'questioned Change' No. 7, referring to the necessity of Class 3 review, with Mr. Skone responding the change would allow a business to use this as a retail - use in a professional office zone. It was MOVED by Foy, seconded by Carmichael to have a consensus on report No. 23 with the amendment to include gas stations under Class 2, in the Light Industrial Zone. Council member Berndt stated she concurred, however, the motion should be convenience store, not gas stations, as it is already on the list. Unanimously carried by voice vote. It was MOVED by Whiteside, seconded by Tollefson for a consensus on report No. 23 with the amendment to include convenience stores under Class 2, in the Light Industrial Zone. Unanimously carried by voice vote. _' Klarich concurred and the motion carried. Mr. Black reviewed Report No. 24 regarding the placement of manufactured housing and mobile hones stating that staff is recommending Alternative B as the text in the proposed ordinance. Commissioner Tollefson opened up the meeting for public testimony on this matter. Ron Clark, Washington Manufacturing Association, thanked staff, County Commissioners and council for their efforts on addressing this issue over the past few years. He noted that either Alternative A or B was acceptable to him. He commented that the definitions for mobile hones and manufactured hones recognized the needs for affordable housing. He noted that it was a difficult compromise in that the county currently allows these types of hares and the city does not. Commissioner Klarich stated that the deletion of the community designated development area is an improvement because it regulates the land use outside the zoning districts. Commissioner Tollefson noted that federal codes preempt any other code. Discussion ensued with the present policies of the placement of mobile hones and manufactured housing , the criteria used to review them and what significant impact, if any, exists when they are placed in residential districts. In response to Council member Sparling's request for the definitions of modular and mobile hones, Mr. Clark stated that modular homes are built to conform with the Uniform Building Code and mobile hares are built to federal standards. (Commissioner Tollefson relinquished the gavel 1'2 5 AUGUST 5, 1985 temporarily to Mayor Barnett.) It was MOVED by Sparling, seconded by Berndt that there be a consensus to accept the report with the recommendation of Alternative B from staff. Carried by 5 -2 voice vote. Beauchamp and Carmichael voting nay. It was MOVED by Klarich, seconded by Whiteside to accept the report with the.recommendation of Alternative B from staff. Tollefson concurred and the Motion . carried. • Mr. Skone reviewed Report No. 25 regarding R -2 (Two - Family Residential) text amendments and the class 3 review. It was MOVED by Klarich, seconded by Whiteside to accept the report and the text amendments. Tollefson concurred and the Motion carried. It was MOVED by Foy, seconded by Buchanan to accept the report and the text amendments. Unanimously carried by voice vote. Commissioner Tollefson then opened the hearing for general testimony. Larry. Mathews, 805 So. 17th Avenue, reviewed his letter dated August 5, 1985,. to the County Commissioners and City Council regarding the Hearings Examiner Concept, the Environmental .Impact Statement (EIS), Planned Unit Development and Solar Access. Discussion was held briefly regarding residential lots on one parcel of land. Mr. Hinthorne distributed and reviewed the Adoption Schedule of the Urban Area Zoning - Ordinance. It was MOVED by Whiteside, seconded by • Klarich to adopt the time line schedule .as depicted by the joint staff. Tollefson, concurred and the Motion carried. It was the general consensus of the Council to try to adhere to this schedule. Council member Sparling requested staff to return at the next meeting with the cost of. the Hearings Examiners Concept. It was MOVED by Foy, seconded by Sparling to adjourn this meeting at 4:25 p.m. to then meet on August 20th at 11:00 a.m. Carried by 6-1 voice vote.
