R-2015-086 A RESOLUTION adopting the Six -Year Transportation Improvement Program for the period of 2016 through 2021 for the construction of streets and arterials streets in the City of Yakima and amending the Metropolitan Transportation Plan. WHEREAS, the City of Yakima annually prepares, reviews and adopts a Six Year Program for the construction of streets and arterial streets in the City of Yakima for the ensuing six year period, all as contemplated and required by State RCW 35.77 010 and applicable Federal law; and WHEREAS, the City of Yakima desires to amend the Metropolitan Transportation Plan to ensure compliance with the Growth Management Act and the regional transportation plan for the construction of streets and arterial streets in the City of Yakima, all as contemplated and required by State and Federal law, and WHEREAS, after public hearings on the matter, held at the regular meeting of the Yakima City Council on June 2, 2015 and June 16, 2015, with proper public notice as required by RCW 35 77.010, the City Council finds that the plan attached hereto should be adopted as the Six -Year Transportation Improvement Program for the period of 2016 through 2021 for the construction of streets and arterial streets in the City of Yakima, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The Six -Year Construction Program for the period of 2016 through 2021, a copy of which is attached hereto and by this reference made a part hereof, is hereby adopted as the official Six -Year Transportation Improvement Program for the City of Yakima, including proposed amendments to the Metropolitan Transportation Plan along with Street Improvements, which are also approved. For Meeting of: June 16, 2015 Public Hearing to consider: A) Resolution adopting the Six-year Transportation Improvement Program for the years 2016 to 2021, and to amend the Metropolitan Transportation Plan; and B) Resolution amending the Yakima Urban Area Comprehensive Plan Capital Facilities Element Debbie Cook, Director of Utilities and Engineering Brett Sheffield, Chief Engineer SUMMARY EXPLANATION: Attached is the 2016 — 2021 Six-year Transportation Improvement Program (TIP), along with an explanation sheet that describes the information contained on the various columns of the Six-year TIP. No new projects have been added. Projects that that have been removed from the 2015 — 2020 TIP as they were completed or the funds were obligated include: • #3 Tieton Drive and 64th Avenue Intersection Improvements • #10 E. Lincoln Avenue and 10th Street Roundabout • #16 West Valley Middle School Safety Improvements Project #33, N. 1st Street and 'I' Street Signal Upgrade, has been removed because this work is being included in the N. 1st Street Revitalization, MLK to `N' Street project, renumbered #3. Council and the public are welcome to add other arterial system projects to the list. The six-year TIP project listing will be finalized at the June 18th hearing and sent to the Yakima Valley Conference of Governments (YVCOG) after approval. A) Each year the City is required by RCW 35.77.010 and RCW 36.81.121 to update its Six-year Transportation Improvement Program (TIP) for submittal to the Washington State Department of Transportation. This plan must include all transportation projects for which state gas tax revenue of federal revenue will be used. The current plan for 2016 — 2021 includes ten projects that are funded. Funding for the remainder of the projects will continue to be sought. The funded projects include: #1 — Yakima Railroad Grade Separations, Phase 4 #2 — North 1st Street Revitalization, `N' Street to SR 12 #3 — North 1st Street Revitalization, MLK to 'N' Street #4 — East Nob Hill Boulevard and Fair Avenue Intersection Improvements #6 — Powerhouse Road Sidewalk #7 — Yakima Valley Transportation Company Preservation #44 — Northside Alley Pavers #45 — S. 80th Avenue Bridge #46 — Wide Hollow Bridge #47 — Lincoln Avenue Corridor Safety Improvements. Six-year Transportation Improvement Program (TIP) Background On August 10, 2005, the President signed into law the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). This act is the next authorization after the prior Transportation Equity Act of 1998 for the 21st Century (TEA -21) and previous Intermodal Surface Transportation Efficiency Act (ISTEA) of 1991. The current act again specifies the systems on which certain funds can be used and activities for which funds can be used and promotes the role of the Metropolitan Planning Organizations (MPO) in the planning and programming of projects. SAFETEA- LU requires each designated MPO to develop a Transportation Improvement Program (TIP), and the state to develop a Statewide Transportation Improvement Program (STIP) as a condition to securing federal funds for the transportation projects. Projects listed in the STIP are the only projects that can be approved by the Federal Highway Administration (FHWA) and the Federal Transit Administration (FTA) to utilize federal fund of by the State of Washington for approved State funding agencies. The STIP is a prioritized program of transportation projects, complied from local and regional plans, along with the Washington Transportation System Plan (WTP), which provides a backbone for developing projects for the intermodal transportation network in the State of Washington. The STIP contains federally funded projects plus state and local projects that are regionally significant. These projects have been identified through the planning process as the highest priority for the available funding to the state's transportation program. Planning activities of state and local governments are essential parts of integrated regional planning processes. Long range transportation planning is a part of the comprehensive land use planning carried out by local governments. Citizen participation is an integral part of the planning process at all levels. Local Agencies are required to develop and adopt a six-year transportation program. All local agencies are required to hold at least one public hearing during the development of the six-year transportation program. Project ranking has been performed utilizing data supplied by the Street and Traffic Division. The ranking will be integrated with other project needs and the total list will be reviewed and adjusted to the particular need of the City of Yakima. B) The City needs to amend the Yakima Urban Area Comprehensive Plan Capital Facilities Element to incorporate the adopted six-year TIP for 2014 to 2019. This will ensure that we are in compliance with the Growth Management Act and that we are consistent with the Comprehensive Plan as required. The amendment is limited to incorporate only those projects that adopted in the STIP and is not subject to the "once a year" change required under the laws of the Growth Management Act. The AGENCY will incorporate the plans and specifications into the AGENCY's project and thereafter advertise the resulting project for bid and, assuming bids are received and a contract is awarded, administer the contract, or if the project is of a size which the AGENCY is authorized to perform with its own forces under the laws of the State of Washington, the AGENCY may proceed with its own forces. All work performed under this AGREEMENT shall comply with the applicable provisions of state law 11 Payment The STATE, in consideration of the faithful performance of the work to be performed by the AGENCY, agrees to reimburse the AGENCY for the percentage of the actual direct and related indirect cost of the work shown above, up to the "MAXIMUM AMOUNT AUTHORIZED" The agency will comply with Governmental Accounting Auditing and Financial Reporting Standards and applicable state law and local regulations, policies and procedures. No payment will be made for work done prior to execution of this AGREEMENT Partial payments shall be made by the STATE, upon request of the AGENCY, to cover costs incurred. These payments are not to be more frequent than one (1) per month. It is agreed that any such partial *lent will not constitute agreement as to the appropriateness of any and that, at the time of the final audit, all required adjustments will be made and reflected in a final payment. The AGENCY agrees to submit a final bill to the STATE within forty-five (45) days after the AGENCY has completed work. The AGENCY agrees that all costs in excess of the amount authorized and the AGENCY's matching funds shall be the responsibility of the AGENCY III Audit The AGENCY agrees that an audit may be conducted by the STATE. During the progress of the work and for a period not less than three (3) years from the date of final payment to the AGENCY, the records and accounts pertaining to the work and accounting thereof are to be kept available for inspection and audit by the STATE and copies of all records, accounts, documents, or other data pertaining to the project will be furnished upon request. If any litigation, claim, or audit is commenced, the records and accounts along with supporting documentation shall be retained until all litigation, claim, or audit finding has been resolved even though such litigation, claim, or audit continues past the three-year retention period. IV Legal Relations No liability shall attach to the AGENCY or the STATE by reason of entering into this AGREEMENT except as expressly provided herein. V Nondiscrimination The AGENCY agrees to comply with all applicable state and federal laws, rules, and regulations pertaining to nondiscrimination and agrees to require the same of all subcontractors providing services or performing any work using funds provided under this AGREEMENT VI Venue For the convenience of the parties to this AGREEMENT, it is agreed that any claims and/or causes of action which the AGENCY has against the STATE, growing out of this AGREEMENT or the project or program with which it is concerned, shall be brought only in the Superior Court for Thurston County VII Termination The Secretary of the Department of Transportation may terminate this AGREEMENT if the funding becomes unavailable or if the Secretary determines that it is in the best interest of the STATE. VIII Final Report and Final Inspection Within ninety (90) days following the completion of the project and submission of the final billing for the project, a final report and/or final inspection shall be submitted to the Director, Highways & Local Programs containing the following information Non -Capital Projects 1 A description of the project or program. 2. A summary of actual costs of the project or program 3 An evaluation of the project or program This should address aspects such as transportation and/or other benefits to the public. Capital Projects 1 A final inspection is required. IX Supplement This agreement may be modified or supplemented only in writing by both parties.
