A RESOLUTION authorizing the City Manager to execute a Memorandum of Understanding
providing additional terms concerning the Fire Services Agreement with
Union Gap.
WHEREAS, the attached and incorporated Memorandum of Understanding addresses
an issue concerning the City's employment of Union Gap firefighters as part of the Fire Services
Agreement between the City and Union Gap; and
WHEREAS, the underlying Fire Services Agreement did not specifically address the re-
assignment of the Union Gap firefighters from the City back to Union Gap in the event that the
Fire Services Contract was terminated before it reached the end of its contract term, and
WHEREAS, the City and the firefighters wish to have a complete understanding with
regard to re -assignment of the Union Gap firefighters that the City has employed in accordance
with the Fire Services Agreement with Union Gap in the event of early termination of the
Agreement; and
WHEREAS, the City Council has determined it to be in the best interest of the City and
the fire fighters to approve an agreement concerning the City's and the firefighters' expectations
and responsibilities in the event there is an early termination of the Fire Services Agreement as
set forth in the MOU attached hereto and incorporated herein by this reference Now, Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager of the City of Yakima is hereby authorized and directed to execute the
attached and incorporated Memorandum of Understanding between the City of Yakima and the
International Association of Firefighters (IAFF) Locals 469 and 3680 Firefighters
ADOPTED BY THE CITY COUNCIL this 16th day of June, 2015.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF YAKIMA AND
IAFF LOCALS 469 AND 3680
THIS MEMORANDUM OF UNDERSTANDING is entered into by and between the
International Association of Firefighters Locals 469 (City of Yakima) and 3680 (Union Gap) and
the City of Yakima, Washington, a municipal corporation, with the purpose of addressing the
reassignment of Union Gap employees that had been transferred to the City of Yakima under
the Fire Services ILA dated November 18, 2014, back to the City of Union Gap in the event of
termination or expiration of the afore -mentioned 3 -year Fire Services Agreement by and
between the City of Yakima and the City of Union Gap.
WHEREAS, IAFF Locals 469 (Yakima) and 3680 (Union Gap) have entered into a
previous and separate Memorandum of Understanding to address the integration of Union Gap
employees with the City of Yakima as part of the Fire Services Agreement, and to provide
direction in the event a reduction in force among the combined personnel were to become
necessary; and
WHEREAS, neither the previous Memorandum of Understanding between Local 469
and Local 3680 nor the Fire Services Interlocal Agreement provides direction for the
reassignment of employees in the event of the termination or expiration of the Fire Services
Agreement; and
WHEREAS, both Local 469 and Local 3680, together with the City of Yakima, believe it
is in the best interest of all involved that this Memorandum of Understanding provide the agreed
direction for the separation and reassignment of personnel in the event the Fire Services
Interlocal Agreement expires or is terminated;
NOW THEREFORE, In the event the Fire Services Interlocal Agreement between the
City of Yakima and Union Gap expires or is terminated prior to completion of the three (3) year
term thereof, or at the termination of said Agreement following completion of the three year
term, after which it is not renewed, the City of Yakima and IAFF Locals 469 and 3680 mutually
agree that only those employees that were one of the original nine (9) Union Gap employees

Union Gap as Union Gap employees, under the terms of employment agreed upon between
Local 3680 and the City of Union Gap
The City of Yakima and IAFF Locals 469 and 3680 hereby agree to the terms and conditions
set forth in this Memorandum of Understanding.

SUMMARY EXPLANATION:
In the event the Fire Services Interlocal Agreement between the City of Yakima and Union Gap expires or
is terminated prior to completion of the three (3) year term thereof, or at the termination of the said
Agreement following completion of the three year term, after which itis not renewed, all parties mutually
agree that only those employees that were one of the original nine (9) Union Gap employees transferred to
Yakima by the Fire Services Interlocal Agreement shall return to Union Gap as Union Gap employees.
