MAY 7, 1985
STUDY SESSION
The City Council met in session on this date at 2:00 p.m. in the Council
Chambers of City Hall, Yakima, Washington. Council members present were
Mayor Clarence Barnett, Pat Berndt, Lynn Buchanan, Lynn Carmichael, Jerry
Foy, and Jack Sparling. Council member Henry Beauchamp absent.
1. OPEN DISCUSSION FOR THE GOOD OF.THE ORDER
Mel Wagner, Centennial Committee member, gave a brief status report
on the plans for the Centennial celebration, and presented each
Council member with a copy of the book - "Yakima - A Centennial
Perspective - 1885 - 1985 ".
Mayor Barnett informed Council that an invitation has been received
for the Council members to participate in a "Bucket Brigade" on
Saturday, June 8th, 1985. None of the Council members were available
to participate in this event.
With regard to appointments to Boards and Commissions, it was MOVED
by Buchanan, seconded by Foy, to appoint Terry Norman to fill the
vacancy created by the resignation of Cherie Hanses, and Dan Masters
to fill the vacancy created by the resignation of Bob Plumb; Terry
Norman's term to expire September 29, 1987, and Dan Master's term to
expire September 29, 1988. Unanimously carried by voice vote.
Beauchamp absent.
It was MOVED by Buchanan, seconded by Carmichael, to reappoint
Melinda Pullium to the Airport Advisory Commission. Unanimously
carried by voice vote. Beauchamp absent.
2. REPORT FROM DEPARTMENT OF ENGINEERING & UTILITIES REGARDING PAVEMENT
MANAGEMENT SYSTEM
Dennis Covell, Director of Engineering & Utilities, indicated this is
basically an informational report on pavement management for Council
to review. He stated he has also been working with other cities and .
counties lobbying the Department of Transportation to successfully •
acquire a grant to develop a computer software package for pavement
management systems. He indicated he is hopeful the system will become
available later this summer or early fall. Mr. Covell also informed
Council that he has received confirmation from the Urban Arterial
Board that they will partially fund the Nob Hill Boulevard project in
the amount of $900,000 and also fund improvement of the intersection
at 40th Avenue and Summitview. He stated a final decision has not
been made as to participating with the County in developing the last
segment of Washington Avenue from 3rd Avenue to 16th Avenue. It was
MOVED by Carmichael, seconded by Berndt, to accept the report.
Unanimously carried by voice vote. Beauchamp absent.
3. CONSIDERATION OF REQUEST BY HUMANE SOCIETY FOR ADDITIONAL FUNDING AND
AMENDMENTS TO CONTRACT FOR SERVICES
John Hanson, Director of Finance and Budget, reviewed the current
contract between the City and the Humane Society of Central
Washington /SPCA (Humane Society), and the alternatives presented in
the staff report to Council. Mr. Hanson introduced Cal Clark,
President of the Humane Society Board, Rick Shaw, and Executive
Director of the Humane Society. Bert Tabayoyon, Customer Services
Manager, and Chuck Greenough, Budget Analyst, were also present to
respond to inquiries by Council. Discussion ensued regarding past
bookkeeping and record keeping systems, budget line item expenditures,
etc. It was the general consensus of Council that staff provide a
more detailed report. Therefore, it was MOVED by Foy, seconded by
Buchanan, that City staff work in conjunction with Mr. Clark and his
staff, and bring back a more detailed report regarding the operational
expenses of the Humane Society prior to any Council action being
taken on the issue. Unanimously carried by voice vote. Beauchamp
absent.

It was MOVED by Buchanan, seconded by Carmichael, to move into
executive session for the purpose of discussing pending litigation.

BUSINESS MEETING

4.. ROLL CALL
•
At 3:15 p.m., the Council members commenced the regular meeting,
Mayor Barnett presiding, Council members Berndt, Buchanan, Carmichael,•
Foy and Sparling present on roll call. City Manager Zais, City
Attorney Andrews; City Clerk Roberts and Deputy City Clerk Toney also
present. Council member Beauchamp absent and excused.
5. INVOCATION
The Invocation was given by Council member Foy.
Mayor Barnett presented a proclamation to Mark Farsdahl proclaiming
May 5 -11, 1985 as Small Business Week. A second proclamation was
presented to Emma Marks and Loren Zirkle, Yakima Senior Center,
proclaiming the month of May as "Older American Month in Yakima."
Mayor Barnett presented Terry Fitzgerald, Comprehensive Mental Health,
with a proclamation which proclaimed the week of May 12 -18, 1985 as
"Mental Health Week." Mr. Fitzgerald stated there will be a number of
workshops available during "Mental Health Week" and encouraged Council
members and citizens to participate in these workshops. •
6. CONSENT AGENDA

Mayor Barnett referred to the Items placed on the Consent Agenda, •
questioning whether there were any additions or deletions from either
• Council members or citizens present. Council member Carmichael request-
ed that Items Nos. 10 and 20a be added to the Consent Agenda. It was
the general consensus of the Council that the addition•of Items Nos.
10 and 20a, as requested, be made. The City Clerk then read the
Consent Agenda items, including resolutions and ordinances by title.
It was MOVED by Carmichael, seconded by Buchanan, that the Consent
Agenda, as read, be passed. Unanimously carried by roll call vote.

further discussion.)

*8. APPROVAL OF MINUTES
The Council minutes of April 9, & 16, 1985 were approved, having been
duly certified accurate by two Council members and no one present •
wishing to have said minutes read publicly.

a. Transit Advertising Policy.
• The report from. the Transit Division regarding the Transit Advertising
Policy dated May 7, 1985, was approved.
b. Transit coaches bid specifications
The report from the Director of Public Works dated May 7, 1985,
regarding the transit coach bid specifications, was approved.

*11. FIRST 1985 QUARTER REPORT FROM FRED S. JAMES AND CONOVER INSURANCE
REGARDING INSURANCE CLAIMS HISTORY AND LOSS EXPERIENCE TO DATE
The report from the Director of Finance & Budget dated May 7, 1985,
regarding the First Quarter Insurance Claims Report was accepted.
*12. RECONSIDERATION OF THE PROCUREMENT PROCESS FOR WATER METERS
RESOLUTION NO. D -5111, A RESOLUTION pertaining to the purchase of
water meters and water meter repair parts; and repealing City of
Yakima Resolution No. D -4049, adopted March 5, 1979, and Resolution
No. D -4059, adopted April 2, 1979.
*13. CONSIDERATION OF A RESOLUTION CREATING 81ST AVENUE SEWER LOCAL IMPROVE-
MENT DISTRICT AND SETTING. THE DATE OF HEARING FOR JUNE 4, 1985
RESOLUTION NO. D -5112, A RESOLUTION of intention to create a local
improvement district.
*14. CONSIDERATION OF A RESOLUTION AUTHORIZING THE SALE OF SURPLUS ANIMAL
CAGES TO THE CITY OF ELLENSBURG
RESOLUTION NO. D -5113, A RESOLUTION authorizing the sale of surplus
property owned by the City.
*15. APPROVAL OF FINAL CONTRACT PAYMENT FOR THE 1985 WASTEWATER TREATMENT
PLANT DIKE REPAIR PROJECT
The report from the Director of Engineering and Utilities dated May
1, 1985, with respect to the completion of the work on the Wastewater
Treatment Plant Dike Repair, performed by Harry Jefferson Excavating,
was approved, the work accepted and payment of the final estimates as
therein set forth was authorized.
*16. APPROVAL OF OUT OF STATE TRAVEL FOR LANNY BONSON, FIRE DEPARTMENT'
The out -of -state travel for Lanny Bonson, Fire Department, to attend
Emergency and Disaster Planning Workshops in Boise, Idaho, June 23 -29
and August 4-10, 1985, at no expense to the city, was approved.
17. . CONSIDERATION OF AN ORDINANCE REZONING PROPERTY_ AT 708 NORTH SECOND
STREET, AS REQUESTED BY FOUR SEASONS SQUARE
Council members Carmichael and Sparling not having.been in attendance
at the rezone hearing, requested to be excused from voting on this
item. The Ordinance having been read by title, it was MOVED by
Berndt, seconded by Buchanan, to enact the Ordinance. Unanimously
carried by roll call vote. Carmichael and Sparling abstaining.
Beauchamp absent.
ORDINANCE NO. 2869, AN ORDINANCE accepting the recommendation of the
Planning Commission and rezoning property at 708 North 2nd Street
from R -3, Multiple- Family Zone to Planned Development Zone.
*18. CONSIDERATION OF AN ORDINANCE AMENDING THE 1985 BUDGET AND
APPROPRIATING FUNDS INTO THE EQUIPMENT RENTAL FUND. (Second Reading)
An Ordinance appropriating funds into the 551 - Equipment Rental Fund
for additional staff having been read by title only at the previous
meeting, was brought before the Council for a second reading.
ORDINANCE NO. 2870, AN ORDINANCE amending the 1985 budget for the
City of Yakima; and making an appropriation in the 551 - Equipment
Rental Fund for expenditure during 1985.
*19. CONSIDERATION OF AN ORDINANCE AMENDING THE 1985. BUDGET AND
APPROPRIATING FUNDS FOR ENERGY SAVINGS IMPROVEMENTS AND OTHER CITY
SHOP FACILITY MODIFICATIONS (Second Reading)
An Ordinance appropriating funds into the 560 - Public Works fund
having been read by title only at the previous meeting, was brought
before the Council for a second reading.

ORDINANCE NO. 2871,. AN ORDINANCE amending..the 1985 budget for the
City of Yakima; and making an appropriation in the 560- Public Works
Fund for expenditure during 1985.
20. CONSIDERATION OF LEGISLATION REGARDING MANAGEMENT COMPENSATION
*a. An Ordinance Amending The Classification And' Compensation Plan
For Management Employees
ORDINANCE NO. 2872, AN ORDINANCE relating to City personnel; adopting
a classification and compensation plan for City employees to be
effective July 1, 1985; amending Sections 2.20.100 and 2.20.110 of
the City of Yakima Municipal Code.
b. An Ordinance Amending The Deferred Compensation Program For City
Management
The Ordinance having been read by title, it was MOVED by Carmichael,
seconded by Buchanan, to adopt the Ordinance. City Manager Zais
explained this is the second part of the proposal which was made last
December with regard to management compensation. He stated it is
intended to provide an additional percentage match to the management
deferred compensation plan. Following a brief discussion, the question
was called for a vote on the motion. Carried by 5 -1 voice vote. Foy
voting nay, Beauchamp absent.
ORDINANCE NO. 2873, AN ORDINANCE relating to City personnel; providing
a tax deferred compensation plan for management group personnel; and
amending Section 2.20.130 of the City of Yakima Municipal Code.
21. OTHER BUSINESS
Don Skone, Associate Planner, appeared before Council requesting .�
clarification with regard to the Urban Area Zoning Ordinance and
zoning recouniendations south of Nob Hill Boulevard. After discussing
the issue, it was the general consensus of Council that staff prepare
a text amendment to the Urban Area Zoning Ordinance so that area
particularly south of Nob Hill Boulevard remain the same zoning as
the present City of Yakima Zoning Ordinance for R -2 Zoning.
Council member Buchanan stated he had received a call from a citizen -
who had parked in the lot north of Nordstrom and received a parking
citation. Council member Berndt couu«ented that citizens are still
confused regarding the parking lots, and the necessity to pay in
advance.
Council member Buchanan also stated he had observed in the minutes of
the Board of Adjustment where a two -story development for elderly and
handicapped persons had been approved without the installation of an
elevator. He indicated perhaps some of these proposed projects should
receive a more detailed review prior to a building permit being issued.
Mayor Barnett called Council's attention to the painting by Phil
Kooser on the Centennial Celebration, which had been presented to the
City by the Centennial Committee.
Council member Foy suggested the Mayor draft a letter thanking the
Centennial Committee for presenting each Council member with their
individual copy of the book, "Yakima - A Centennial
Perspective - 1885 - 1985 ". Mayor Barnett indicated he would draft such
a letter to the Committee.

22. ADJOURNMENT
There being no further business to come before the Council, it was
MOVED by Berndt, seconded by Buchanan, to adjourn at the hour of 4:20
p.m., to May 13th at 3:00 in Room 232 of the County Courthouse.
Unanimously carried by voice vote. Beauchamp absent.
