P.M. in the , Council - Chambers of City Hall, Yakima, Washington. Assistant Mayor Lynn Buchanan, presiding, Council members Clarence Barnett, Henry Beauchamp, Lynn Carmichael, Jerry Foy and Bernard Sims present on roll call.. Mayor Pat Berndt absent and excused. City . Manager Zais, City Attorney Vanek, and. City Clerk Roberts also ,present. , 2. INVOCATION , . . .The Pledge of Allegiance,was led by Council member Sims. , 3. OPEN. DISCUSSION FOR THE GOOD OF THE ORDER . None. 4. CONSENT AGENDA . . . Assistant Mayor., Buchanan referred to the items placed on the Consent Agenda, questioning whether there were any additions or . deletions, from • either Council .members or citizens present. David. Hawkins. requested Item No. 13 be removed from the Consent Agenda. 'It was the consensus of the Council that Item No. 13 be removed from the Consent Agenda, as requested. The City Clerk then read the Consent Agenda.items,. as amended, including. resolutions and ordinances by title. •It was MOVED by Carmichael, seconded by Foy,, that the Consent. Agenda, as read,- be passed. Unanimously carried by 'roll. call vote. APPROVAL OF MINUTES OF COUNCIL MEETINGS OF JULY:26 AND AUGUST 9, 1988 - .... The Council minutes : of July 26 and August 9, 1988 were approved, having been duly certified accurate by two Council,members and no ',one present wishing to have said minutes read,.publicly. - 6. PRESENTATION OF CERTIFICATE OF COMMENDATION TO ROCKY S. CLAYTON Assistant Mayor Buchanan read and presented a Certificate of Commendation to Rocky S. Clayton for his action in reporting a burglary in progress at Advanced T.V., resulting in the arrest of two male subjects. , 7. AUDIENCE PARTICIPATION. t- . Ines.Rice,, 4409 Arlington, stated she received some material from the Bicentennial Constitution National Committee she thought the City would be interested in, including a document declaring the proclamation of September 17 -23rd as Constitution Week. She gave some historical dates which should be commemorated due to the events occurring on those-dates' relating to the establishment of the•Constitution. She.presented the City with several copies of a poster announcing Constitution Week. She also stated she took the liberty of inviting County . Auditor Bettie ,,Ingham to this . meeting, and also presented her with copies of the poster. Mrs. Rice commented that in 1989 we will celebrate the establishment of . . • the . presidency, and in 1991, .the Bill •of.:Rights to the • Constitution.. . . - , Charles .Kriz, 5708 Bitterroot Lane, stated he wanted to, comment ' about Tim McGree's presentation of'last week regarding the Yakima County Economic Development Long: -Range Plan. He stated that Mr. McGree'used.four'words that he gave_quite a bit of thought to AAD /1 . 458 SEPTEMBER 13, 1988 this, week; communication, and private enterprise accountability. He stated Mr. McGree did not say with whom he would communicate, nor specify to whom they would be accountable. He stated that many of the senior citizens fought for the rights of today's young dreamers; however, the young do not have the right to exploit senior citizens and their savings. He stated that taxes are [taxes and senior citizens with fixed incomes must pay them. He condluded by commenting that senior citizens are people, they are human beings, and Americans who have paid their dues and have inalienable rights. ' • Rick' Chasteen, - Administrator of Good Samaritan Health Center, stated he- was present.to address the Dial=A -Ride program. He stated he understands the federal regulations under which the City must comply. He presented a petition requesting Council meet the increased demands for Dial -A -Ride services throughout the remainder of this year. He spoke about the impact to the Dial -A-Ride users due to the cut -back of services. Doug Coulter, Central III Convalescent, Maria Bradford, Dial -A-Ride user who submitted written comments, Dolly Staffan, Dial -A -Ride user, Matt Fairbank, Interfaith Volunteer Services, Carrie Seeberger, Central Convalescent, and Pat Scully, Good Samaritan Health Center, spoke about the needs met by the Dial -A-Ride program and urged that additional funding to this program be allocated to meet these needs. Mr. Chasteen indicated a willingness to participate in a meeting with staff to develop a criteria for allocating next year's 'budget, so that drastic cut - backs don't occur in the latter part of the i year. He also indicated he would be willing to talk about contracting certain services with Dial A -Ride. Council member Barnett suggested allocating additional funds of approximately $24;000 to bring 1988 expenditures up to same level as 1987 expenditures. It was the general consensus of the Council to refer this issue to the Transit Committee to schedule a meeting with representatives from the health care facilities, Dial -A -Ride users, and !the Department of Social and.Health'Services (regarding use of medical coupons). Bob I Whitney, - 308 N. 21st Avenue, whose business is located in Larson Building, spoke about the panhandling occurring in the vicinity of the Larson Building being so bad that the street kids have relinquished that territory. He stated the menace to the women working in that area is significant and he would like to see additional police involvement in this area for protection. Mike Russell, manager of the Chinook Tower and the Larson Building, stated this problem has been on -going for several months, at both thei'Larson Building and the Chinook Tower. He commented that'the women at the Chinook Tower have to be escorted to their vehicles to make, sure they get'there safely. He stated the panhandlers hang around the parking lot and can't be thrown out just for walking through. • He further commented that vandalism and theft of vehicle emblems have increased recently. He requested additional police patrol in that area. City Attorney. Vanek questioned Mr. Russell about the pan handling incidents to try to determine if the panhandler was simply requesting money, which under the law he has the right to do., or if the panhandler was threatening' in any manner. Mr. Russell 'said that one lady was threatened by an individual with a knife. Council member Foy inquired if there is any-iway for the- Chinook Tower and the Larson Building businesses and! those businesses located in between to meet and talk about sharing some type .of policing assistance that could assist and augment the Police patrolling that area. Mr. Russell indicated he would participate in that type of discussion. Council member Barnett inquired if Mr. Russell would support a Business and Occupation Tax if the revenue is strictly used for Police. Mr. Whitney said they. understand that protection costs' and the businessmen still want additional' protection and know they will have to participate in the program. Police Chief Green commented about this problem, saying he doesn't have the manpower to have an overt presence of police officers in that area for any length of time. Larry' Marvin, ' Yakima Federal. Savings & Loan, Dick Stelzmiller-, Yakima Federal Savings &'Loan, Janelle Denbeste, Mercy Enterprises, and' Dave Burnett, First Interstate Bank, spoke about AAD /2 li 45.9 SEPTEMBER 13, 1988 . the threats presented by these' panhandlers and, the increased. vandalism. Mr. Stelzmiller said he would be willing to - pay the increased taxes to pay for additional police'patrol of this area. ,Mr. Marvin,stated Yakima Federal has an attendant who does nothing but watch their parking lot. He said in addition 'to employees feeling threatened, the shoppers are saying they - won't come downtown to shop. ,Council member Carmichael reported the City of Tacoma had this same problem and went 'to private security guards, working in conjunction with the Police Department. She stated she would like to obtain information on how that program is working. (Assistant Mayor Buchanan absent after 3:2,5 p.m., having given the gavel to Mayor Pro Tem Beauchamp.) City Attorney Vanek said the City of Seattle has enacted an aggressive panhandling ,ordinance; there now being State statutes' which prohibit harassment. He co��uuented th ordinanc is now in the C ourt of Appeals. It was the general consensus of the Council to obtain information 66 City of Tacoma's program and on Seattle's ordinance. Council .member Carmichael suggested Mr. Russell and Mr. Whitney contact Skip Semon or Rob Talcott, Downtown Business Group'and discuss this problem with them and possible options to solve the problem. 8. REPORT FROM PUBLIC' WORKS DEPARTMENT AND COUNCIL : TRAN COMMITTEE REGARDING 1988 UMTA GRANT APPLICATION (SE RESO E• LUTION) Bill Schultz, Transit Manager, was present to respond to Council's inquiries. Council member Barnett asked how the policy is being changed and can any of this reimbursement be used for Dial - - Ride? • Mr. Schultz explained the present policy is th we do not . authorize UMTA Section 9 :funds for operating. assistance in the Transit ce, except '•for the contract with People, For People for transportation of the elderly and elderly residing outside the City _ He s at the present time, UMTA funds are used ,, for capital expenditures It is proposed to request' reimbursement "from UMTA for expenses the City has already incurred for'operating the transit system. UMTA will reimburse'xa portion: of the previous year's operating expense, which will be'placed in the - operating fund and used to operate the system. He stated these ' funds can be used for Dial -A - Ride or any Transit function. At the end of the operating year, those fu in our operating needs would . go into the capital reserve fund. He reported there are regulations which must be met by the City in order to accept these funds. He stated that while the City is already subject to those regulations, the UMTA'Office will'more strictly monitor the City's .compliance, and in the past the City has been late in preparing its certifications.. Council member Barnett' asked" -if we are going to need another 'person "to make_ those 'reports. "Mr Schultz •stated that would - b e one of his ' proposals, . especially, 'since it .has _already become aproblem. He cautioned Council - that`"if we don't abide by those rules, the City can lose its funding and the City may have already received. REPORT FROM PUBLIC WORKS DEPARTMENT REGARDING COMPLIANCE WITH LABOR AND INDUSTRIES - REGULATION .REGARDING WOMEN'S "RESTROQMS AT CITY SHOPS The report regarding compliance With " Labor &'Industries regulations regarding the, women's restrooms at the City 'Shops and staff - recommendation to utilize Block Grant funds for the women's restroom modifications, as detailed in the staff. report, 'was accepted, and staff was authorized to advertise for bids for such modifications, per plans and specifications dated 8/3/85. CONSIDERATION OF RESOLUTION AUTHORIZING CLOSURE OF STREETS TO CONDUCT 'THE APPLE CLASSIC STREET RUN David Hawkins, 916 So..40th Avenue, distributed brochures on the Apple Classic Street Run. Mr. Hawkins'stated there is a with the timing of the race, and he would like to refer this back to Traffic for route modifications or drop the 10K so the 9:00 a.m. start time for the fun run could - be 'kept: City 'Attorney Vanek suggested that since this is a measured race route, perhaps the Sponsor the race should suggest' the route. He said the Police Department is concerned with traffic safety," as opposed to racing considerations. Council member Carmichael pointed out the ordinance states the race hours to be between 7 :30 to 10 :00 a.in. so the'starting hour is flexible. It was the' consensus of' the Council to refer this back to the Police • Department. *14. REPORT'FROM PUBLIC WORKS REGARDING CHESTERLEY'PARK` - REQUEST FOR ADDITIONAL PROPERTY ACQUISITION The 'report from Public Works regardin ac of 'property for Chesterley Park improvement and' Staff recommendation to request the Yaki County Corr¢nissioners to ' transfer two pieces' of property to the `City of Yakima: to be developed as a part of ' Chesterley Park, was accepted. * 15. APPROVAL OF ` RIGHT -OF =WAY USE PERMIT APPLICATION BY CRESCENT REMODELING, 915 SOUTH FIRST STREET The Right -of -Way Use Permit requested by'Crescent Building'to add a facade to the exterior front portion of the building at 915 South 1st Street, was' approved. * 16. APPROVAL OF OUT -OF -STATE TRAVEL FOR DAVE EYLES, CABLE TV, TO MIAMI BEACH, FLORIDA The Out -of -State travel ' for Dave 'Eyles, 'Communications Coordinator, Cable TV, to attend the Eight Annual Conference of the National Association of Telecommunication Officers and Advisors, in Miami Beach, Florida, September 25, 1988 thru October'2, 1988, at a cost of $823.00,'was - approved: - * 17. ORDINANCE NO. 3123, AN ORDINANCE - "amending the-1988 budget for the City of Yakima; and making an appropriation of $195,000 in the Wastewater Facility Fund for expenditure during 1988 for engineering services relative to Wastewater Treatment Facilities Improvement., B. ORDINANCE APPROPRIATING FUNDS .SEWER . OPERATING FUND FOR ENGINEERING SERVICES An Ordinance appropriating funds from the Sewer Operating Fund, having been read by title only at the August 23, 1988 meeting, was brought before.the Council for a second reading. . ORDINANCE NO. 3124, AN ORDINANCE amending the 1988 budget for the . City of Yakima; and making an appropriation . of $195,000 in the Sewer Operating Fund for expenditure during 1988, for engineering services, relative to Wastewater Treatment Facilities Improvement. 19. OTHER BUSINESS Referring to the notice regarding the adjourned meeting for an annual' luncheon meeting with Community .Programming ,Advisory Committee,., Council member Carmichael commented She doesn't have any objections about meeting with them, however, she expressed :concern that there are other boards with .whom the Council has not yet met. Council member Barnett expressed his displeasure that these luncheon, meetings. are scheduled for noon just.prior to the Council " meetings, stating,this, is his service club meeting time He stated he'doesn't think all of these types of,meetings should be "scheduled for Tuesdays. City Manager Zais offered to reschedule - the "meeting, however, it was the consensus of the_Council to luncheon meeting as it is. LUNCHEON MEETING WITH THE COMMUNITY PROGRAMMING ADVISORY COMMITTEE (CABLE TV). The City Council in session in an adjourned meeting 'on this date' at 11:30 A.M. at the Towne Plaza, Yakima, Washington. Council members present were Clarence Barnett, Henry Beauchamp, Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard Sims. Mayor Pat Berndt absent and excused. Community Programming Advisory Conumiptee members present were Alan Taylor, Chairman, Terri Norman - Epperson, James.Garlington, Doyle Hardy, Chris Park, and Donna) West. City staff members present were Assistant City Manager Fred Stouder, Glenn Rice, Director of Community and Economic Development, Dave ,Eyles, Wendy Warren and Lynn Tobin, Cable Communications. • The members. of the Community Programming',,Advisory .Committee discussed with Council issues of general 'interest and concern to them, including wider utilization of the channel and additional use by - City departments,' dealing with controversial programming, and conducting a viewer survey including the niunber of viewers and what programming the viewer wants to see on YCI'V. 2.
