ROLL :CALL The City Council met in session on this date at 2:00 P.M. in the -Council Chambers of :City Hall, Yakima, - •Washington. , .Mayor Pat Berndt, presiding,: .Council members - 'Clarence :,-Barnett, Henry Beauchamp, Lynn Buchanan, Lynn Carmichael, and Bernard Sims present on roll call. City Manager Zais, City Attorney Vanek, City Clerk Roberts . and Deputy .City Clerk Toney also .present. Council member Jerry Foy absent and excused. 2. INVOCATION The Invocation * was - given by Council member Beauchamp. ' 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER - Council member Barnett' asked City: Manager :• Zais if - ;the City has a *water plan in anticipation .of - the - water shortage• .this summer. Mr. Zais'responded many years the City -has,. hathcontingency plans which can be brought ,into focus, in the event-the water, shortage occurs. He said the last major water shortage was in 1977 and at that time the City backup wellsupply was activated: He :stated.the City has the capability of 'activating the • backup *well quite readily, however, in addition to that, staff investigates other types of voluntary enforcement, such as alternating watering days - for -irrigation, etc. He said the plan the City has used in the - past=has been updated .and can (be :used. •.again depending- the ,severity of the water- shortage. - Council member Barnett-'-asked if the City has a representative that attends the Bureau of ,':Reclamation meetings , `which are held periodically. Mr•. Zais •responded - - :Water Superintendent - Ty' Wick is - cthe r . primary representative to those:•meetingsi Denny Covell and Fred Stouder, and Council members occasionally attend. , 4. CONSENT AGENDA ?. - Mayor - Berndt referred to the items on the Consent Agenda, • questioning whether there - were 'any - additions or from either: Council - members or_ tcitizens present. It was - the - consensus of.r the - Council . that Item' No: . 8 — be added, and that—Item No. 13 be removed, as requested by-Council Carmichael and . Beauchamp. CONSIDERATION OF AWARD OF CONTRACT FOR LEGAL 'ADVERTISING (MATERIAL AVAILABLE TUESDAY) • The report from the City Clerk dated February 16, 1988, 'recommending the: -award of the contract for legal" :'advertising to • the Yakima. Herald *Republic at the bid •amount of , $5.95 per column AAD /1 246 FEBRUARY 16, 1988 inch for the first publication (98.33% increase) and $5.23 per column inch for subsequent insertions (74.33% increase) was accepted and approved. *9. SET DATE OF PUBLIC HEARING FOR MARCH 8, 1988 ON THE FINAL ASSESSMENT ROLL FOR ENGLEWOOD SCENIC HOMESITES SEWER L.I.D. NO. 1043 March 8, 1988 was: set as the date'of public hearing on the Final Assessment Roll 'for Englewood 'Scenic Homesites Sewer L.I.D. •No. 1043. • *10. APPROVAL OF BUDGET REPORT FOR JANUARY 1988 (ACCEPT FOR FILING) The budget report for January 1988 from the Director of Finance and Budget was accepted for filing purposes. *11. APPROVAL OF OUT -OF -STATE TRAVEL FOR SHERYL.SMITH,.PERSONNEL, TO SAN DIEGO, "CA The out -of -state travel for Sheryl Smith, Personnel Division, to attend' the National Public' Employer Labor Relations Association Annual'Conference, •in' San Diego, California, March 27, 1988 to • April 1, 1988, at a cost of $325.00, was approved (Employee paying own transportation and lodging costs). • *12. CONSIDERATION' OF AN ORDINANCE AMENDING THE '1988 BUDGET AND APPROPRIATING FUNDS FOR 1987 YEAR -END ENCUMBRANCES; (SECOND READING) • An Ordinance appropriating" funds for the 1987 year -end encumbrances,' having been read by title only at the previous 'meeting, was brought'before- the for a second. reading. ..ORDINANCE "NO. 3802, AN ORDINANCE amending the 1988 Budget for the City of Yakima; making appropriations from unappropriated fund balances within various funds for expenditure during 1988. 13. CONSIDERATION OF AN ORDINANCE RELATING TO LICENSES AND BUSINESS, REGULATIONS FOR DANCE HALLS AND CABARETS • Council member Beauchamp referred to page _three of the ordinance ..and. requested clarification under #2 which reads "The changing or dimming of lights during any dancing period is hereby • - prohibited." He asked if this applies only to the entrance of the facility or dance hall or the entire facility. City Attorney Vanek explained this ordinance prohibits the changing. and dimming of the lights below the level of light necessary•.for an individual to see to ingress and egress from the facility. Police Chief Green • ' commented .this, ordinance • was '.outdated. ' and the modifications were made primarily for safety reasons. Council member Sims -asked if the ordinance applies to private or social dance clubs. Mr. Vanek stated it is his understanding that it applies' to cabarets and public dance halls. Ordinance No. 3803 having been read by title, it was MOVED by "Beauchamp, seconded by Buchanan, that the ordinance be passed. Unanimously carried by roll call vote. Foy absent. ORDINANCE NO:'3803, AN ORDINANCE relating licenses and business regulations; providing criminal and civil penalties for violation of licensing regulations; amending regulations of cabarets and dance halls; amending Sections 5.01.010, 5.28.090, 5.28.140, repealing Section 5.28.130 and enacting 5.01.020, 5.01.030, 5.01.040, 5.01.050, all of the City of Yakima Municipal Code. *14. CONSIDERATION OF AN ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION PLAN FOR CERTAIN EMPLOYEES (ELIMINATE PARKS RECREATION SUPERINTENDENT POSITION AND ESTABLISHES PARK ADMINISTRATIVE SPECIALIST POSITION) • '-ORDINANCE' 3804, AN ORDINANCE relating to City .personnel . adopting' a classification and - compensation plan for'City employees AAD /2 FEBRUARY 16, 1988 247 to be effective March 20, 1988; amending Subsections 2.20.100 A, 2.20.100 B, 2.20.100 C, 2.20.110 A, and Subsection 2.20.110 F, all of the City of Yakima Municipal Code. 15. OTHER BUSINESS Council member Barnett asked Police Chief Green if the One Party Consent Bill failed. Chief Green stated House Bill 1352 failed, but it is his understanding from the news media that there may be some amendments to a less desirable One Party Consent Bill still under consideration, however, it is inadequate to meet the needs of law enforcement. He stated once the bill gets on the . floor, there may be some attempts to put some real teeth into the bill.
