ROLL CALL The City .Council met in session on this date at' -2:00 P.M. in the Council Chambers of City Hall, Yakima,' Washington. Mayor Henry Beauchamp, • presiding, Council members Clarence Barnett, Pat Berndt, Lynn Buchanan, Lynn 'Carmichael, Jerry Foy and Bernard Sims present on roll -call. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy City Clerk , Toney'also present. 2. INVOCATION , The Pledge of Allegiance was •led by Clarence Barnett. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Council• member Berndt- reminded .fellow. Council : members • of the dinner meeting tomorrow evening ;lat'6:30 P.M. ' with; area legislators at the Towne Plaza.. to discuss legislative priorities.-. She stated. the Sunfair Association is also having an appreciation reception at'the Towne Plaza from 5-7:00 P.M.'• in honor of those. involved. in the construction of the Sunfair float, and .. those who contributed funding toward the - project. She encouraged fellow Council- members to stop ' by: -the' reception .prior to the 6:30 dinner meeting. Council member Foy commented there..wi'll` also be a preview of next year's Sunfair float during the reception. Council member Carmichael reported• the•.Association-of Washington Cities Board of Directors met last Friday and Yakima was awarded the bid for the 1993. Convention. ' Mayor Beauchamp handed the gavel to Assistant Mayor Barnett and temporarily absented himself from the meeting.- - 4. CONSENT AGENDA' t ,. , Mayor:. Beauchamp•4referred to- the items placed on the Consent Agenda, questioning whether there-were any additions or deletions from either Council• members or citizens present. It was the general- consensus that ' Item No. 8 ' be added to . the Consent 'Agenda,. ' as-- requested by' Council member Foy. The City - Clerk , then read. the •Consent Agenda items including resolutions and ordinances by title. It was MOVED by Buchanan, seconded by Carmichael., that- the :Consent Agenda; as read, be passed. APPROVAL OF THE MINUTES OF THE COUNCIL MEETINGS OF NOVEMBER 10, 17, AND 24, 1987 The Council minutes of November 10, 17 & 24, '1.987 were approvedfhaving been duly certified accurate by twb Council : members •and no one; present, wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION 1 , Larry- Mathews, 805+South 17th Avenue submitted additional signatures for the, :-'.petition asking for, a. change in ' the forni •'of City government. He also submitted a resolution relating to this issue to the City Clerk. City Manager Zais 'apologized for any inconvenience 'to :those- citizens present on behalf the east side.' annexation issue. He stated staff had •• - intended to present a status report to Council'today, however, this has been postponed - -- until' next week. - Lloyd Mullanix, 623 North 6th Avenue, asked what progress has been made on the petition he submitted calling for implementation of a property B -4 ' 200 DECEMBER 8, 1987 maintenance ordinance. Mr. Zais responded staff is in the process of reviewing this issue, and will present a report in the near future. Jerry Whitney, 618 Queen Avenue, submitted a copy of a crime property ordinance recently passed by Portland City Council. He stated the ordinance was drafted by Portland's City Attorney and has been very effective in dealing with their drug situation. Mr. Whitney stated he believes this ordinance could be very useful in our community. Council member Barnett spoke about the one party consent: bill which was defeated last year in Washington' State,. but adopted in Oregon. He asked if this type of legislation was possible due to the passage of the one party consent bill. Mr. Whitney stated he was is not familiar with that legislation and pointed out that he is speaking as a private citizen on this issue and not as a representative of the Department of Corrections. 6. CONSIDERATION OF A RESOLUTION.AUTHORIZING EXECUTION OF A LEASE AGREEMENT WITH YAKIMA SCHOOL DISTRICT NO. 7 FOR USE OF THE BLOCK BUILDING AT FIRE STATION NO. 2 Mayor Beauchamp announced staff would like to present an item that is not on the agenda at this time. Council. member Foy stated he would like to make a motion to approve the resolution and agreement and requested the resolution be read. Resolution No. D -5412 having been read by title, it was NDVED by Foy, seconded by Carmichael, to approve the .resolution, as submitted,, for the use , of that portion of Fire Station No. 2, by School District No. 7, as rendered in the report. Unanimously carried by roll call vote. - RESOLUTION NO. D -5412, A RESOLUTION authorizing the lease of certain Fire Department property to Yakima School District No. 7. 7. PUBLIC HEARING ON THE FINAL ASSESSMENT ROLL FOR THE PRIDEVIEW SEWER LOCAL IMPROVEMENT DISTRICT NO. 1042 (SEE ORDINANCE CONFIRMING ASSESSMENT ROLL) This being the time set for the public hearing on the final assessment roll for the Prideview Sewer Local Improvement District No. 1042, Office - Engineer Rita Germunson reviewed the staff report and responded. to Council's inquiries. Council member Barnett asked about the increase in the property owner's assessment. Mrs. Germunson explained that the bids for this L.I.D. were between $29,000 and $58,000 and this accounts for the 11% increase. She stated she had spoken with the individual property owners regarding this increase, and to date, the City Clerk's office has not received any protest letters regarding this L.I.D. Assistant Mayor Barnett opened the public hearing for citizen comment at this time. There being no one present to address the issue, the public hearing was closed. Ordinance No. 3065 having been read by it was -MOVED by Foy, 'seconded by Carmichael, that the ordinance be .passed., Unanimously carried by roll call vote. Beauchamp temporarily absent. ORDINANCE NO. 3065, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 1042 as created and established by Ordinance No. 2973 of the Ordinances of the City of Yakima. *8. REVIEW OF PRELIMINARY 1988 AIRPORT BUDGET The 1988 Yakima Air Terminal Budget was placed on the Consent Agenda and subsequently approved as submitted. 9. CONSIDERATION OF COUNCIL LEGISLATIVE FOR 1988 Council member Barnett noted the list of Legislative Priorities does not include support for a bill similar to ESSB57, (the One. Party Consent Bill) which was defeated last year, however, if. Council is agreeable, he would like this, added to the list of Legislative Priorities. This being the consensus of the Council, it was MOVED by Foy, seconded by Berndt, to accept the report, with the addition of the One Party Consent Bill. City Manager Zais suggested another topic be added to the list of Legislative Priorties for discussion tomorrow night that being the - sharing of state . and federal funds for drug enforcement. The question was called for a vote on the motion. Unanimously carried by voice vote. B -4 DECEMBER 8, ,1987.. • 201. 10, PRESENTATION OF MANAGEMENT COMPENSATION REQUEST .FOR 1988 . • City Manager Zais indicated this is the first increase management has requested since January 1986. He then commented on the justification for the request. He stated the first part of the recoumendation is for General Management to receive a 5% wage increase effective January 1, 1988 and for ,Police Management to receive a 5% increase January 1, 1988; and•then an additiona1.4 % 1, 1988. He stated the last portion of the proposal • contains. the cost.conta-inment measures recommended for sich leave cash -out and medical : benefit. - program.: It was MOVED by. Foy, seconded by Buchanan, to authorize, a salary ,increase of .5%., in all -General ,General City.Management .salaries effective 1 /1, /88;,,and authorize a salary increase.of.6 %- effective 1/1/88 .and,a 3% salary, increase effective 7/1/88. for Police, Management personnel. Also, approve adoption of the Fringe Benefit Cost Containment„ measures for Sick Leave Cash -out and the Medical Program for Management employees and dependents as proposed in the attached memorandum. Council; member Foy stated his reasons are that management has had no increase 1986; and in ,addition to this.,.,.he would. to. see the • police .. personnel rewarded immediately for the risks they take, as well as the day,- to- day.s,tress they encounter while.performing their duties., . Following a ,brief.,discussion on ..,the,sick leave and cash -out benefit,, the quest was calledfor,.a vote on the Motion. .Unanimously carried by, voice vote. Council me mber Foy. asked , if. _,Council wished to set a. date for the City Manager`';s ' annual review.. It , was the consensus .of the Council _, to conduct _ - this .review during , the month, of January. The,, Adininistra . Secretary will coordinate the date and notify the Council'members of the date'and time. *11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT TO THE . CONSIDERATION OF RESOLUTION AUTHORIZING SUBMISSION OF CDBG APPLICATION FOR 1988' RESQLUTION NO. D- 5414,. A_. APPROVAL OF FINAL .CONTRACT PAYMENT FOR THE TIETON DRIVE.. RECONSTRUCTION, 40TH AVENUE TO 65TH; AVENUE "PROJECT (STANDARD. MOTION V -A, ACCEPT PROJECT AND APPROVE FINAL PAYMENT) The report from the City Engineer dated December 2, 1987., with respect to the completion of the work on the Tieton Drive Reconstruction Project, 40th to 65th Avenue, performed by Superior Asphalt, was approved, the work accepted and payment, of the final estimates as therein set forth was authorized. *15. APPROVAL OF OCTOBER 1987 TREASURY REPORT (STANDARD MOTION V -B -- ACCEPT AND APPROVE REPORT) The report from the Director of Finance and Budget dated December 8, 1987 regarding the investments of the City of Yakima, was accepted and approved. *16. SET DATE OF HEARING FOR DECEMBER 15, 1987 ON THE APPEAL OF DENIAL OF ISSUANCE OF TAXI DRIVER'S LICENSE, REQUESTED BY SHIRLEY POWELL B -4 202 DECEMBER 8, 1987 December 15, 1987 was set as the date of hearing on the appeal of the denial of issuance of a taxi driver's license, requested by Shirley Powell. 17. OTHER BUSINESS • Police Chief Green stated during the last session of the legislature a bill was passed which allows law enforcement agencies to donate bicycles, tricycles, toys, to charitable, non- profit organizations to distribute to the underprivileged. Council was asked to authorize this type of activity for the Yakima Police Department. It was MOVED by Foy, seconded by Buchanan, to bring in the proper resolution permitting; the giving under law, the bicycles to charitable organizations. EXECUTIVE SESSION REGARDING PROSPECTIVE LITIGATION It was MOVED by Carmichael, seconded by Sims, to move into Executive Session for approximately 30 minutes for the purpose of discussing prospective litigation, to then adjourn to the Towne Plaza at 6:30 P.M. tomorrow night for the purpose of discussing Legislative Priorities with area representatives. Unanimously carried by voice vote. 19.
