The City Cotnlcil met in session on this date at 2:00 P.M. in the Council Chambers of City Hall, Yakima, Washington. Mayor Henry Beauchamp, presiding, Council members Pat Berndt, Lynn Buchanan, and Lynn Carmichael present on roll call. Council members Clarence Barnett., Jerry Foy, and Bernard Sims absent and excused. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy City Clerk Toney also present. 2. INVOCATION The Pledge of Allegiance was led by Council member,Carmichael. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Council member Berndt referred.to the three voluminous contract agreements contained in the Council packet (Item No. 10 and Item No. 11) and asked if there might be a consensus to omit the contract agreements, since there are no major changes, and act on just the .resolution. City Manager Zais responded in the past Council has requested to review all contracts in detail,, however, where: there are renewal's with no substantive changes, staff could communicate this: on the agenda' statement which accompanies the 'resolution. . Council member .Carmichael asked if .Council would be able to act on the Mayer . rezone request today. Mayor - Beauchamp stated. he had checked on the r procedure and was informed that Council may take action on this item today even though three of the Council ,members are not , present, however, Council member Carmichael will have to abstain from voting' on the issue. Director of Engineering and Utilities Dennis Covell presented.City'Council with an award bestowed upon the Engineering Department for the first place quality award for the best paving project in the State of Washington east of the 'Cascades.' for a municipality. He stated the , project, was the 1986 North First 'Street Paving, from Walnut to Tamarack (Project No. 1033). City Engineer. Dennis Whitcher explained the uniqueness of this project, .stating it required .a lot of special effort and, cooperation between the contractor and City staff. He further explained -that, : due the ;number of businesses located along North First street and the high traffic volume, the _decision was made to do a lot of the paving during the night. This required adjusting staff's hours so personnel was available to work evening and early morning 'hours. He introduced staff ,members Mark Anderson, Jerry.Putas, Jim Maine, Larry Johnston, Al Rose, •Dick .Sommer, Bob Desgrosellier, (all of wham were seated in the 'audience) and ;acknowledged their contributions to the , project. .Rita Gerimunson, Sandy Meyers. and Wendy Leinan, also .contributed to the project, however, were unable to attend today's Council meeting. City Manager Zais pointed out this is the fifth major for the City of Yakima has received this year. He stated earlier in the year the City I. was presented with National HUD Certification Award, the State Planning Award for the Urban -Area • Zoning 'Ordinance, the ;two., Finance Awards . from the State Finance Officers Association for the Financial Report and Budget . Report, and a., National .Budget Award. He stated staff is awaiting word on the National Award from the Government Finance Officers Association (GFOA) for Financial Reporting.: Mr. Zais commented it,has been a rather outstanding year for,City and professional work by the various departments of the City as evidenced by the achievement of these awards. 4. CONSENT AGENDA . :. - Mayor Beauchamp referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the consensus of the Council to add Item No. 9 to the Consent - Agenda as .requested by Council member Berndt. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Carmichael, seconded min®niin /# ' 182 NOVEMBER 24,'1987 by Berndt, that the Consent Agenda, as read, be passed. Unanimously carried by roll call vote. Barnett, Foy and Sims absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF THE COUNCIL MEETING OF NOVEMBER 10, 1987 The Council minutes • of November 10, 19871-were been duly certified accurate by Council members. and no one present wishing to have said minutes read publicly. • • 6. AUDIENCE PARTICIPATION • Larry Mathews, 805 South 17th Avenue, stated he has 74 full petitions which • represents the 1,500 signatures needed to request a change in the City Charter. He requested the item be placed on next week's Council agenda so the signatures can be formally presented to the City Council, City Manager Zais reminded Council and Mr. Mathews that next week the agenda will consist of a study session on the Public Works Budget presentation from 9:00 a.m. to 5:00 p.m. Mr. Mathews indicated the signatures will be - '.presented•to the City-. Clerk next week. • 7. PUBLIC MEETING 'ON COUNCIL INITIA1'Ell REZONE 'OF' PROPERTY AT 501 WEST _WASHINGTON- AVENUE, ' : FROM R -2 TO M -1 ; AS REQUESTED BY NEIL 'BUREN ; This the time. set ; -for Y the public meeting on the ' rezone•. - initiated by the City'. Council"for property at 501 'West 'Washington Avenue, Mayor Beauchamp requested staff to make opening statement.: Supervising Associate Planner Don Skone stated this rezone request was initiated by • City Council at• the request•of property owner Neil Buren who is asking than the property be :returned• to the original M -1', Light Industrial zoning, • ratherLthan the current R -2, Two- family _Residential zoning. -He stated •'the'-Hearing- Examiner has recommended approval of-Mt: Buren's request. • Mayor Beauchamp asked Council - members to - declare -if they had been contacted by anyone regarding this rezone issue. Outside of the initial request from , Mr Buren • at a )previous-'' Council meeting; the • Council members each declared there been no contacts from opponents or proponents of- this rezone request: Mayor Beauchamp opened''the public meeting. -There being no one present wishing to speak to•the issue, Mayor Beauchamp closed the public meeting. It was MOVED by Carmichael, seconded by Berndt, that the ' Council concur with the Urban Area ' Hearing Examiner's 'recommendation for approval of this rezone. Unanimously carried by voice voter Barnett, Foy and Sims absent. - -8. PUBLIC HEARING ON 1988 PRELIMINARY BUDGET • This -being the time set- for the hearing on the: 1988 Preliminary • '-Budget ' for , the City, of - Yakima, Mayor -Beauchamp opened the . public hearing for e.c'itizeni comment. =He stated these budget documents. had been made available. for the • public: to review through the City Clerk's .office, There' -being no one present to speak. the issue; the public • hearing was closed. No Council-action was required. *9. CONSIDERATION - OF REQUEST FROM YAKIMA GREENWAY ADDITIONAL PARK SERVICE - The report -from the Public Works Department dated November 24, 1987, `regarding the request -for .additional reimbursable!City services Yakima River Foundation, and staff recommendation directing Hthe Legal -Department to develop a proper agreement, was approved. *10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH YAKIMA ''COUNTY AND PEOPLE'FOR PEOPLE FOR DIAL -A -RIDE SERVICE L RESOLUTION NO. Barbara Harris, 1911 West Yakima Avenue, _questioned•the: reason for having an ordinance which addresses restricted parking if it is not'going - to be enforced. She stated there are signs indicating "no parking anytime" all the, way up Yakima Avenue to 22nd Avenue, however, vehicles park on the street all the time. City Manager Zais responded the Police .:Department does' not have ..the manpower to devote to the enforcement of parking violations. However, when violations are .brought to the attention of ':the Police Department, an officer does does respond to i.the complaint. Police Chief.. Green' stated enforcing-parking restrictions' is not' a high priority on the. list -of calls received_ on , a daily .•basis unless'. there is• a hazardous situation involved, in which case citations are issued. Chief Green'•indiicated the Police Department has found most citizens to be cooperative when asked to min®min /# 184 NOVEMBER 24, 1987 remove vehicles parked from a restricted area. ORDINANCE NO. 3063, AN ORDINANCE relating to traffic control; prohibiting parking on certain streets; and amending Sections 9.50.050 of the City of Yakima Municipal Code. 16. CONSIDERATION OF.AN ORDINANCE REZONING PROPERTY•IN THE 0 -100 AND 100 BLOCKS OF•NORTH NACHES AVENUE,•ON EAST SIDE, AS REQUESTED BY G. P. MAYER Ordinance No. 3064 having been read by title, it was MOVED., by Berndt, seconded by Buchanan, that the ordinance be passed. Unanimously carried by roll call vote. Carmichael abstaining. Barnett, Foy and absent. In connection with the above rezone, Council member Berndt commented she does, :not feel acceptance of a campaign. contribution should prohibit a Council member from_ voting; one such an 'issue. City. Attorney Vanek commented the conflict. of . interest la_w is very specific, however, the , appearance of fairness doctrine is more profound regarding quasi - judicial matters, in that it states, "in addition to being fair, you must appear to be fair." Council member Carmichael stated she understands the two issues and had agreed to excuse herself on the appearance of fairness even though she did not agree with the challenge. She stated she was very disappointed in the . article that appeared in the Yakima Herald Republic regarding this particular situation as it suggested the Council members who left the room had handled themselves in an irresponsible manner. Council member Carmichael stated the article may have created some misunderstanding on the part of the general public, and she regrets the issue was not elaborated upon at•the•time. - c. ORDINANCE NO. 3064, AN ORDINANCE affirming. the Hearing Examiner's recommendation to rezone property at 0 - 100 and 100 blocks of North Naches Avenue, and- amending the zoning map of the City of Yakima. 17. OTHER BUSINESS • Director of Community & Economic Development Glenn Rice distributed a letter from-Yakima Valley Interurban Trolley; Lines requesting the City approve the loan of a 1908 Motor Generator System to the Oregon Historical Group for display and tourist.. promotion purposes. Jerry .Henderson, •President of..Yakima Valley ;Interurban Trolley Lines, briefly reviewed the letter which outlined. , the proposal, stating the , piece of.' .equipment is currently located on Congdon property and must be removed by December 30, 1987, or ownership of the system will revert to Congdon's. The generator will be stored through the winter months and then moved • (in the spring) to Portland at -the expense of the Oregon Historical •Railway,;Association.. Mr. Rice stated, a. contract agreement will be drawn up . defining the terms under • which the equipment will be on loan., Following a . brief._ discussion, the _question was called .for a vote, on the motion.
