Hall,: Yakima, Washington.. Mayor (Henry Beauchamp, _ presiding Council members Clarence Barnett, Pat Berndt, Lynn Buchanan, Lynn Carmichael, Jerry .Foy and 'Bernard Siins present on roll•call. City Manager Zais, City Attorney Vanek, City Clerk Roberts also present. 2. INVOCATION The Pledge= 'of'Allegiance was led by Council member Barnett: ' 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Police Chief Green .gave an update on the report previously provided to Council on October 20th regarding enforcement 'of narcotics involvement in the Spruce Street area. He stated that out of 61 arrests in October for narcotics involvement,38''arrests were in the Spruce Street area 4. CONSENT AGENDA Mayor Beauchamp referred to • the items placed on the Coriserit:' Agenda, questioning whether there were any additions or deletions from either Council members or citizens present.. It was -the general consen "sus of the Council to remove Item No. 15 from the Consent Agenda, as requested by Council member Sims. The .City Clerk then read the Consent Agenda - items, including resolutions and ordinances by title: It was:MOVED by Carmichael, seconded by,Siins, that the Consent Agenda, as -read, be passed'.' Unanimously carried by roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) . indicate:.items on the Consent. Agenda handled under- one= :motion without further discussion.).. - *5. APPROVAL•OF- MINUTES OF THE COUNCIL MEETING-OF OCTOBER 20; 1987 The_•Council minutes :of October 20, 1987 were approved, having been duly certified :accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION None 7. PUBLIC MEETING ON REZONE OF PROPERTY AT SOUTH' 16TH AVENUE'AND GRANT.STREET, FROM R -2 TO R-3, 'AS REQUESTED BY MANUAL BABAYAN (CONTINUED FROM 10/27/87) This being ,the time set for the public meeting on the rezone of property located at South 116th Avenue and Grant Street, from R -2 to R -3, as • • requested by Manual Babayan, Joan Davenport, Associate Planner, reviewed the staff report. She stated the recommendations from the staff and the Hearing Examiner are to deny the rezone. Referring to a map hanging on the wall, she reviewed the zoning and use of the properties surrounding the property proposed to be rezoned. Mayor' Beauchamp stated he wanted it included in the record that he received a telephone message fran Betty Brooks, indicating she isopposed -to the rezone, and. a letter:from Mrs. Ted Boswell, . expressing her opposition to the rezone. Road,.•Pullthan, applicant, apologized for not •being able to attend the Council ' -meeting' last week, however, • he was not ' notified` about the meeting -in time to appear: He outlined the process of application to •rezone' this property ;'stating initially several = residents on 16th Avenue had. indicated an interest in :joining -him and requesting their property be rezoned at the same time. He stated this did not occur because it looked like it could be construed as spot zoning. He gave some background information on the use of the property, stating the house has remained unoccupied for the last four years. He 'stated it is too large a piece of property for just one or two houses and would' be more - appropriate for multiple ' 'residences. He stated he is trying to get a return on his investment and maximize the number of units he can - have within the Urban Area Plan and suggestions from the Planning Division. He commented that during the Hearing - Examiner'' s public =hearing much of the testimony had to A /AD /1 • 166 NOVEMBER 10, 1987 do with his personal character and that of a landlord and did not pertain to the issue of the rezone. He urged'Council to make a decision based upon the facts. He stated the Hearing Examiner was concerned about the 80% lot coverage allowed in an R -3 zone; however, as an architect and planner he has never planned something to cover more than 50% of the property. He . further stated the question had been asked why he doesn't apply for a Class 3 . review in the R-2, zone. He stated he is trying to maximize the use of his property: Council member. Barnett asked Mr. Babayan about the access to this property.. Mr. Bayayan- stated he thought it,..could be resolved in the planning and design stage of the .development. Mayor Beauchamp questioned if more than 18 units would be constructed on the property. Mr. Babayan replied that he has about three different designs and it would depend on investments and the market on which approach he would use, however, he would have to provide adequate parking. Council member Berndt commented that Council should not be basing its decision on the potential use of the property because it could be sold in the future. Phyllis Marshall, 3402 2nd Street, Union Gap, stated she is a friend representing Mrs,, Olson., residing at 1304 So. 16th Avenue, who is opposed to this rezone. She spoke about some incidents which took place involving Mr. Babayan and questioned how he is going to be able to afford maintain the property after it has been developed. Adelle ,Boswell, representing a community of about 100 people, stated all the people she represents is against this rezone. Clark Enslow, 2609 W. Yakima Avenue.:, owner of the property at 1310 So. 16th Avenue, stated he is opposed to the rezone and commented a lot, of Mr.. Babayan's comments were conflicting. City Attorney Vanek. asked- the Council 'members to disclose whether there .has been any contact by any opponent or proponent regarding.this rezone,: between now and the last public meeting. Council . member Barnett reported he received two telephone calls, :however-he could not recall the :names and declared he had told the callers he could not talk about this matter.•All.other Council members declared - no •contacts had been made by either proponents or .opponents. Mr. Babayan urged Council, to keep personalities, out of the basis for determining the rezone of this property. Reiterating there were a number of residents on 16th Avenue who indicated a desire to rezone their property, he stated he would like to submit copies of the applications for rezone signed by- those residents. City Attorney Vanek stated new evidence that had not been previously submitted to the Hearing Examiner could not be submitted at.this time. He stated,the purpose of.this public meeting is to review the-findings of_the Hearing Examiner and hear. arguments-; pro or con, on what the Hearing Examiner has -recommended•. He- further stated the comments regarding Mr. Babayan's character and management style should not be considered on the value of the rezone. He stated if Council decides.to hold a public hearing and consider additional evidence, Council may do so, but that is done at a separate time. Following discussion, Mayor Beauchamp stated Council does not wish to accept any additional information at this • public meeting, ,which would cause us to call for a public hearing, and will make a decision based upon the information•received. There being no other citizen wishing to speak to this issue, Mayor Beauchamp closed the public meeting. It was MOVED by Carmichael; seconded by Foy, to endorse the Hearing.•.Examiner's recommendation, which was for denial -of --the rezone. , Unanimously carried by voice vote. 8: PUBLIC MEETING ON COMMUNITY DEVELOPMENT. BLOCK GRANT PROGRAM FOR 1988 A. REQUEST FROM CENTER OF THE DEAF This being the time set for the public meeting on the Community Development Block Grant Program for 1988, Kracht, Block Grant stated it does not appear any of the members.of the Community• Development Block Grant . Advisory Committee are present,. however, she is available to respond to any questions. There being no questions at the present time, Mayor Beauchamp . opened the floor for public comments. Nancy Frame, 2707 W. Yakima Avenue, President of the Board of .the .Yakima Valley Center For The Deaf, distributed a fact sheet about the. Center For The Deaf. She stated this is an agency that gives services, but does not charge for that service. She stated the agency receives funding from UGN -and has -in - kind funding from the Speech Center. She spoke about the services the agency provides for the deaf, particularly TTY services enabling the deaf to better communicate with the community. She outlined ,-the. agency's, attempts to obtain grants and funding by lobbying for State legislation to fund this service_ provided to the deaf. Following further discussion regarding • possible sourses of funding:, it was MOVED .by. Foy, seconded by Carmichael, A /AD /2 • 16.7 NOVEMBER 10, 1987 to $7.-,000, as .a block grant request, to. ,the Yakima - Valley Center For _ • The Deaf out: of the 1986 contingency . fund,.in carry forward .funds for handicapped•• program. Council member Carmichael indicated she seconded this motion, with the understanding, this ,would be for one year only. Council member Barnett questioned if Council should specify the source. of the funding. Glenn Rice, Director of Community and Economic Development, • stated , specifying the source of fundings helps staff, particularly since the policy is not to fund social service requests with Block Grant monies. He stated staff's recommendation would be to use 1986 carry _forward>.money in 1,987 from the handicapped accessibility .program, to -avoid_ social service type requests in the future. Following further discussion regarding.. granting .this .social service request,. the question was called for .a.vote on the motion. Unanimously carried by voice vote. State Representative Shirley Doty stated she is pleased .Council _ took this action . .because as :State .• finding is sought, it will be. -a selling point that the local: people were ., of 'this worthy. cause. Council member Carmichael suggested the City should be a partner with the Yakima Valley Center For The Deaf in its attempt to obtain State funding :She asked them to keep Council apprised of their efforts. Floyd Brower, 214 So. 65th Avenue,. . thanked Council . for this . help. , He further commented that .accessibility , for :the deaf: is. an on -going situation. __The,• relay :station (TTY) is an on -going expense, and is not subject to, construction methods that would help physically handicapped people. There being no other citizen present wishing to on this issue, Mayor'Beauchamp closed the public meeting. REPORT FROM VISITOR AND CONVENTION BUREAU REGARDING PROPOSED ADJUSTMENT IN YAKIMA CENTER RENTAL RATES (CONTINUED FROM 10/27/87):. , , The report from the Yakima Center and staff recommendation to postpone consideration of the Yakima Center rental rate increase until it has been further reviewed and re- submitted by the Yakima Center Advisory Commission:, was accepted. , *10.' CALIFORNIA ; , 1 . - - , _ • A /AD /3 168 NOVEMBER 10, 1987 The Out -of- State travel for David Harris, Fire Department, to obtain training on the Computer Aided Dispatch program in the Public Safety System, in Ventura, California, November 14 -19, 1987, at a cost of $350.00, was approved. • 15. CONSIDERATION OF A RESOLUTION AUTHORIZING EXECUTION OF A CONTRACT WITH SCOTT WETZEL SERVICES, INC. TO ADMINISTER THE CITY'S SELF - INSURED WORKERS' COMPENSATION PROGRAM • Council member Sims stated he is familiar with this firm -and reviewing this gave him some. concern that maybe it was not adequately .reviewed. He asked staff to- review this during the remainder of this, and the next quarter, and at the'end of - the third quarter, come back to Council with a review of these types of services, by using this or another provider. He stated this contract can be terminated with days notice prior to the end of the third quarter.- Resolution No. D- 5406•having• been read by title only, it was MOVED by Sins, - seconded by Berndt ,7 that the 'Resolution - be' adopted. Unanimously carried by roll call vote. RESOLUTION NO. D-5406, A RESOLUTION authorizing the execution of an •agreement' with Scott Wetzel Services, Inc. to administer` a self- insured workers' compensation program for the City. *16. CONSIDERATION OF AN ORDINANCE AMENDING THE 1987 BUDGET AND APPROPRIATING FUNDS 'FOR. THE DIAL -A -RIDE PROGRAM (SECOND READING) ' An Ordinance appropriating funds for the Dial -A -Ride Program, having been read by title only at the October 27, 1987 meeting, was brought before the Council for a second reading. ORDINANCE NO. 3061, 'AN- ':ORDINANCE amending the 1987 budget for the City of Yakima; and making an appropriation in the 462 - Transit Fund for expenditure during 1987. ' 17. CONSIDERATION OF ORDINANCES AMENDING THE COMPENSATION AND CLASSIFICATION PLAN FOR CERTAIN CITY FNPLOYEES: A. ORDINANCE AUTHORIZING RECLASSIFICATION OF ACCOUNTANT TD PAY RANGE 17.0 AND BUDGET ANALYST 10 PAY RANGE 17.5; OR . B. ,ORDINANCE AUTHORIZING RECLASSIFICATION OF ACCOUNTANT TO PAY RANGE 19.0 AND BUDGET ANALYST TO PAY RANGE.20.0 , Ordinance - Option B, having been read by title, as requested by Council member Carmichael, it was MOVED by Carmichael, seconded by Sims that Ordinance No. 3063, as read, be passed. Carried by 5 -2 roll call vote. Barnett and Foy voting nay. • ORDINANCE NO. 3062, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective December 13, 1987; amending Subsections 2.20.100 A, 2.20.100 C, 2.20.110 A, and Subsection 2.20.110 F, all of the City Of Yakima Municipal Code. 18. OTHER BUSINESS Council member Carmichael commented she was just informed there will be a Veterans Day parade tomorrow beginning at 11:00 A.M.-at • the YMCA and heading west on Yakima Avenue. • Don Skone, Supervising Associate Planner, stated it was brought to the City's attention there were two residents at 801 So. 57th Avenue who were unable to vote in the City - election. He stated staff checked this with the County voter registration office and it was learned an address error had been made. The voter registration office had the address range from the 800.block showing as outside the City. He stated:this has been corrected. Council member Barnett stated he had been contaced by, a Mr. Homes who expressed a concern about .whether or not the property, had been taxed correctly. Mr. Skone stated the City -been receiving the taxes for that property, however, in staff's investigation, it was discovered there is a piece of property on which taxes have not been appropriately charged, and that property is the Westwood West Golf Course.- Council member Sims asked when was the last time the City checked on the City's boundary to make sure A /AD /4 • 169 NOVEMBER 10, 1987 the taxing is correct. Mr. Skone stated he is not sure that has ever been done, but thought it could be accomplished.
