BETWEEN THE CITY OF YAKIMA AND MEMBERS OF
AFSCME LOCAL 1122
THIS MEMORANDUM OF UNDERSTANDING ( "MOU ") is made and
entered into by and between Council 2, Washington State Council of County and
City Employees (WSCCCE) representing Local 1122, American Federation of
State County and Municipal Employees (AFSCME) representing General City of
Yakima Municipal, and Yakima Air Terminal (YAK) McAllister Field employees
AFL -CIO ( "Union ") and the City of Yakima, a Washington municipal corporation
( "City ").
This MOU memorializes the agreements between the City and the Union
regarding the issues described below, and the parties acknowledge that these
issues have been negotiated in accordance with RCW 41.56.
The City and Union agree that the provisions as set forth in this MOU
supersede any conflicting provisions in the two (2) Collective Bargaining
Agreements (CBA) covering the period January 1, 2012 to December 31, 2014.
WHEREAS, the City is the sole owner of the Yakima Air Terminal effective
March 1, 2013, and shall hire all current Yakima Air Terminal Employees on the
current payroll of the Yakima Air Terminal as of March 1, 2013; and
WHEREAS, the City and Union agree that under Washington State law,
the current CBA remains in effect and the status quo is maintained in such
situations for a smooth transition of these employees; and
WHEREAS, the City and the Union agree that the newly acquired Air
Terminal Employees will be City of Yakima Municipal Employees and shall
transfer into the AFSCME Local 1122 Municipal bargaining unit; and
WHEREAS, the City and the Union agree the Municipal Employees of the
Yakima Air Terminal will be credited with the same balance of sick leave, annual
leave, in -lieu and compensatory time as they had upon termination from Yakima
County Air Terminal; and
WHEREAS, the City and the Union; agree the Municipal Employees of the
YAK will maintain their seniority dates to reflect the amount of time they had been
a continuous employee with the Yakima Air Terminal; and
WHEREAS, the City and the Union; agree the new Municipal Employees
of the Yakima Air Terminal will maintain the "Y" salary schedule that was
implemented at the Air Terminal until the City's pay scale is equivalent, minus
three percent (3 %), to go into the employee's individual 457 deferred plan; and

WHEREAS, the City and the Union agree the new Municipal Employees of
the Yakima Air Terminal will covered under WSCCCE Collective Bargaining
Agreement (CBA) and represented positions will be included in Article I —
Recognition of Union Bargaining Unit; and
WHEREAS, the City and the Union agree the new Municipal Employees of
the Yakima Air Terminal will receive benefits as outlined in Municipal CBA that
were in effect prior to January 1, 2012, excluding the yearly change in the
medical premium due to the bargained formula; and
WHEREAS, the parties have agreed to memorialize their agreement on
this issue in the form of this MOU.
NOW, THEREFORE, it is agreed by and between the City and the Union
as follows:
The employees of the Yakima Air Terminal that were previously covered by a
separate AFSCME CBA will be covered by the CBA between the City of Yakima
and AFSCME effective March 1, 2013 with the provisions stated above.
